[Barbados Underground]  Yes Jeff, Charles Herbert faces a monumental task, not least because he has already been convicted in the court of public opinion. The social meaning of the case has become about the history of race relations in Barbados, so although the court case is supposed to consider the evidence dispassionately, I am not certain that a jury will lack bias

    The ONLY reason I did not go to HC was because I had/have no testicles.

    And it is entirely not my fault that I have no testicles.

    My children have gone to HC, because by the time they entered, posession of testicles was not requirement.

    Are my children “brighter” than me?\

    No.

    Do I feel jealous of, inferior to, nasty or spiteful towards my own children?

    No.

    Make no mistake PLT…that “white privilege” that is undeserved is GIVEN to the minority population by successive black parliaments elected by 2 generations of majority black populations in the last 52 years..so in reality…it’s the black government to remove that privilege which will automatically remove the anger.

    ….the minority population most of whom are descendants of indentured servants like their north american and european counterparts are not entitled to any white privilege. ..

    As long as those racist structures are removed, it won’t matter how the Herbert drug case swings and the onus will remain on the police prosecutors to do their jobs without taking bribes.

    At the end of the day, this is not the accuseds first fall guy for taking a gun or drugs rap because they think they are too good for jail…that is the reality, well known, not a myth and given what is known so far, the Prescod dude will have to be an idiot to take this fall, so either they all go down or they all walk…but make no mistake those two are not being scapegoated…

    …it is good that the drug bust happened to highlight the way forward to remove the disgusting and repulsuve structures the white population has been clinging to post slavery and particularly in the last 60 years to be boldfacedly and shamelessly asserting a white privilege that none of them are even remotely entitled to….

    As soon as the government removes those structures, the 7500 whites on the island will know they have no privilege greater than what the black population has….and will have to adapt to their new status as ordinary people on the same level as the majority population.

    If we add up the number of irrelevancies posted by john on this post,therefore stretching it out – this blog would have been a lot shorter and the comments more to the point.

    I am still uncertain as to whether Prescod has been released on bail.We were told his wife has cancer and all that yet none of the white folks seem to have any sympathy for her and the stress she must be under.

    We must not let concepts such as justice get in the way of Bajan loud mouths. If I were Herbert’s lawyer I would challenge every juror appointed about if they had read on BU anything about the case. If they admitted having done so, then ask for them to be removed. It is building up to be a massive miscarriage of justice in an island where miscarriages are routine.

    I withdraw the word “jealousy” from my earlier post as it seems to have unleashed some violent reactions from you and perhaps others and could have been easily misinterpreted, as it obviously was.

    But read and understand what PLT wrote about his feelings re. HC. Read and understand what TheOGazerts wrote about his feelings about HC. Read and understand what I wrote about HC in my post here and in a number of other early posts when the subject of HC came up. HC was a good school academically but it damaged a number of psyches, including those of some students who did not go there. These vignettes all have the common theme that HC engendered negative feelings for the school in its students who might have come from a disadvantaged background.and in no way tried to seek nor claim any kind of privilege for having been a student there.

    IMHO, PLT used HC, not to claim some privelege or access any special treatment, but as a reference to indicate that he knew Herbert as a schoolboy. I stick to my analysis that mentioning HC in those posts merely served to add support to the unleashing of the vigorous unwonted attacks on him that followed.

    BUW, as you add to your writings on this topic you are exposing the degree to which some of the claims you make of your BU persona seem to lack consistency and might therefore call into question the accuracy of that whole persona.

    SS; Your argument on this matter is not up to its usual very high standard. I have siblings who went to Cawmere, St Michael and QC and other family members who did not go to HC and I don’t think they are in anyway inferior to me or any of the other family members who went to HC. Indeed, they have practically all done better financially and otherwise in the wide multicoloured and textured tapestry of life than I have.

  26. Simple..I don’t know who these think they are fooling, there is living proof of what they do, they can pretend as much as they want but obviously not for as long as they like, many, many people know who they are and what do..

    The foolish black men have to stop taking the drugs and guns fall for white and Indian, Syrian, Jordanian, American and all these criminal men who believe they have some kinda privilege to commit crimes and then some fool black man in Barbados takes the fall and lock up for them ..that is the only reason they keep black men around…the lock up factor…where they don’t plan to get locked up and do prison time themselves..

    If I did not know of this, there is no way anyone could convince me that black men are still so stupid to take a gun charge or drug charge for whites etc…in 2018…..this crap just does not happen anywhere else that I know. it highlights how backward, despite all the education…that these men still are..

    Black men bring that on themselves, they know how they are viewed by these bottom feeding riffraff parasites……yet they jump at the opportunity to become involved, they go looking for their own trouble.

    PLT does not know just how lucky he is to escape some kinda lock up by getting involved sentimentally with that toxic crowd.

    When you were just a little school boy, hiding from the sun under the sandbox tree, I was an adult, working, paying taxes, in order to ensure that you got a good education.

    So what if my parents could not afford the busfare for me to go to town, so what if they sent me to a secondary school within walking distance, so what if they had 7 children in school at the same time.

    None of us have ever been charged with drug trafficking.

    None of us have ever been arrested.

    None of us have ever been charged with stealing a tin of corned beef.

    Unlike some of you here my daddy finished his schooling at 11, and my mummy at 13. They raised nearly a dozen children to adulthood.

    None of us have ever spent a day in jail…not even on remand.

    Now there are a few things that come to mind here about this modus of disclosure but what this is indicating is that Herbert IS GUILTY but the parties directing the disclosure DONT WISH TO BE CONTAMINATED by the disclosure

Piece..I was talking to a man well familiar with these types of situations…black boys have to be educated from in school that they do not exist to go to prison for white, Indian, Syrian or any other criminals…this must be taught in the schools to save black boys who grow up to be men…from themselves…..it is not normal or ok like many are saying, I could not believe my ears when grown black men will tell you that is how it is on the island…something is fundamentally wrong with the psyches of those who see this as normal…it would be frightening if the black politicians and ministers also see this as normal…then we will know why the island is in it’s present decayed state..IT SHOULD NOT BE HAPPENING..not in the days of slavery and more importantly……NOT TODAY.

    Something even worse is wrong with these whites, Indians, Syrians etc who keep black men on their payrolls and on standby to go to prison for them..

    What that empty-headed joke Ha, Ha should be calling for is the AG putting systems in place and amending laws so that these boat owners and boat captains must be held accountable for any drugs and guns found on their boats, no excuses, your boat, you should be aware what’s on it, you are responsible for your boat…and stop this scam where they hire black men and keep them around in case of some drug or gun bust, so the black man can hold the charge and easily thrown away..

    Caswell will be fine..they cannot undo what they have done all these years..none of them..and they themselves did it voluntarily ..too many people know who they are, what they have done and are more than willing to expose them….the senator is the least of their problems and they sure as hell can’t mess with the others who know their business, that would be suicide.


  33. @Hal, MrFireInTheTheatre are you really suggesting that we are a failed country because one of the reasons is an inability to sit jurors who cannot objectively review this case! Really.

    We are small yes, and the case will get wide public ventilation but have we not handled other well publicized cases before at Assizes!

    There have been horrific murders, explosive criminal acts and other very well publicized events that were concluded in our courts so I can only surmise that defense lawyers in the various cases adopted all means necessary to help their clients…

    …so in the case where the vagabond removed his wife’s (or girlfriend, don’t recall) vagina and thus killed the lady and scandalized the entire nation, as I recall he was convicted in a court of law….jurors were found then and I presume the judge admonished them accordingly.

    Add to that the notorious escapades of people like Mark Young, Al Harding and Buddy Brathwaite who captivated Bajans like how Capone or Biggs did in their criminal acts in their countries. We Bajans were comprehensively regaled in media by that Young and Harding kadooment of bullets, death and mayhem in Bush Hall years ago and yet a jury was subsequently seated to ‘objectively’ convict Harding, as I recall.

    What exactly is your point!

    The lawyers will defend their client vigorously no doubt but to suggest that the case must be or would be thrown out due to such severe contamination of the jury pool appears far fetched.

    @AreWe, the joy of high school should be the camaraderie over those six to eight years with other like minded boy or girls as you (we) all develop academically….very unfortunate that Kolig conjured up such a level of distaste even as late as 70s that the camaraderie was not an abiding feature.

    I suspect the folks who shout ‘up and on’ here or those from CP or St. Michaels would not feel as aggrieved about their alma maters as late as after the 70s. And just as clearly Lodge boys of your era and before (as former HBoy Maj.Headley chronicled) would surely share your type displeasure; and a history of Cawmere reflects similiar issues in those early days…..the social structure of the nation was surely the overiding problem…as you suggest.

    I received the photo through a WhatsApp group that deals primarily with entrepreneurship. I do not know who took the photo or who first circulated it on social media but I am guessing that it was taken by law enforcement.

    As a juror, being aware of the differing views of others on a matter is not a cogent ground for challenge. To have already made up one’s mind as to the guilt or innocence of the accused is, however. I do not agree with your assertion that miscarriages of justice are routine here. We both know of another ISLAND where these have occurred far more frequently, don’t we?

    I do not know of any island/liberal democratic jurisdiction where miscarriages of justice are routine, with the possible exception of the US. Having a preconceived idea of the case under trial is a disqualification; jurors should make their decisions based on the evidence presented in court. By the way, it is now contempt of court for a juror to read internet reports on the case during the trial. People in the UK have been jailed for it. It is one of the first things judges tell newly sworn in juries. And, unlike the US, it is a crime for a juror to be interviewed or express publicly his/her views on the case.

    Stefan Kiszko served 16 years in prison after being wrongly convicted of the 1975 murder of the schoolgirl Lesley Molseed in West Yorkshire. He was freed on appeal in 1992. Later, Ronald Castree’s DNA was found to match samples taken from semen on the 11-year-old’s clothes. He was jailed for life for the murder in 2007.

    • Stephen Downing was jailed for 27 years for beating to death the typist Wendy Sewell in Bakewell. His conviction was quashed in 2002 after a campaign by the then editor of the Matlock Mercury, Don Hale, who said Downing had been interviewed without legal representation and his signed confession had been written by a police officer.

    • Barry George endured two trials for the murder of the TV presenter Jill Dando and was eventually acquitted of the charge in August, eight years after he was jailed.

    • Derek Bentley, 19, was hanged for involvement in the murder of the police constable Sidney Miles in 1953. His family campaigned to clear his name, saying he had severe learning difficulties and a mental age of 11. In 1998, his conviction was overturned by the court of appeal because the trial judge had misdirected the jury on points of law.

    • Judith Ward spent 18 years in jail for the IRA killing of 12 people on board an army coach on the M62 in February 1973. Her conviction was quashed in 1992 after her lawyers argued the trial jury should have been told of her history of mental illness. Three appeal court judges concluded Ward’s conviction had been “secured by ambush” and that government forensic scientists withheld vital information.

    • Winston Silcott was cleared of murdering the policeman Keith Blakelock during the Broadwater Farm riots in Tottenham in 1985, after new evidence came to light. He spent six years in prison for Blakelock’s murder before successfully appealing. But he was not released as he was serving a second life sentence for the murder of a boxer in east London in 1984. He left prison after serving 17 years for stabbing 24-year-old Anthony Smith to death. He has always said he acted in self-defence.

    • Babysitter Suzanne Holdsworth spent three years in prison for murdering Kyle Fisher, a neighbour’s two-year-old son, before she was cleared in a retrial last year. She had been jailed for life after being convicted in 2005 of killing the toddler by repeatedly banging his head against a wooden bannister at her Hartlepool home. The appeal court ruled her conviction was unsafe after new medical evidence emerged suggesting Kyle may have died from an epileptic seizure. She was found not guilty at the retrial.

    • Angela Cannings was jailed for life in 2002 for murdering her two baby sons, but freed the following year after her conviction was overturned on appeal. Cannings from Salisbury, Wiltshire, was convicted of murdering seven-week-old Jason in 1991, and 18-week-old Matthew in 1999. She always maintained the two boys died of Sudden Infant Death Syndrome (Sids) or cot death.

    • The solicitor Sally Clark was jailed for murdering her two baby sons, and cleared by the appeal court in 2003. The mother, from Wilmslow, Cheshire, had always protested her innocence since being jailed for life in November 1999. She was convicted of smothering 11-week-old Christopher in December 1996 and shaking eight-week-old Harry to death in January 1998. In 2007, she was found dead at her home. Her family said she had never recovered from the ordeal.

    And if so what purpose is the rehabilitation program in prison supposed to serve?

The connect is quite easy…Moore worked for Herbert and found himself taking a fall for guns…and according to the nation article was nearly nabbed with a shipman of drugs…and according to people who know, was never involved with guns before then, the dude is well known to be no saint, but guns were just not his thing..and according to those who know, was represented by the Mottley law firm…of course Piece will find that out soon enough..lol

    Prescod worked until last week for Goddards/Herbert and is being greased to take the fall for this shipment of drugs…this is no coincidence, accident, anomaly..miracle, nothing so.


  43. Charles missed the part of the Lord’s Prayer that reads “And lead us not into temptation”, rehabilitation is great but wasn’t there another role that he could fill at GEL? It is honourable to give people second chances but it is not wise to put them in the same area that got them into trouble in the first place. This is not a statement on the guilt or innocence of anyone but there will be the inevitable “Once a thief……”

When men or women leave prison, they are entitled to leave with skills that can fast track them to employment..self or otherwise, they having served TIME for mistakes should not hinder them from living a productive life, there are those who leave prison in other jurisdictions with masters and Ph.Ds and when released teach at universities and other lucrative, high paying jobs..

    They should not have to leave prison and seek out untouchable gun runners and drug traffickers for employment to end up in the same boat in the future…

    Routine. They are news in the UK because they are a very small proportion of the daily criminal trials. The cases you list stretch over 65 years – 1953, 1973, 1975, 1985, two in 2002, 2003 and 2005. You could have mentioned the murder of Rachel Nickell in 1992.
    Sally Clark in 2003 was jailed on so-called expert evidence, now discredited; I reported on the Silcott case, he was convicted, then released because the police wanted someone to pay the price for the murder of a colleague, Keith Blakelock, Barry George was a clear miscarriage of justice. I reported on the Broadwater Farm riots and on the Silcott case and covered the court case.
    A far better bet, if you really wanted to make a case, would have been the number of young black men railroaded by the criminal justice system. I remember covering a case of a Bajan guy accused of killing two white girls and he was convicted and jailed for 25 years. I sat throughout that case and I am convinced he was not convicted on the evidence presented in court. Miscarriages are also the other way, people released who should have been convicted.
    Or even look at the current crisis within the system of the prosecution with-holding information from the defence. I suggest you look at the numerous rape cases the DPP has just had to drop. Google Liam Allan, a white lad accused of rape.
    The UK is not perfect, especially when it comes to black people, but at least they have a criminal cases review commission to look at historic miscarriages of justice.

  48. I am sure those who are paying attention will notice that Adrian Moore – Manager at Redlands Plantation which is owned by Charles Herbert has not had his case started.

    He was charges in 2013.This is August 2018.

    We are now here 5 years on and wondering if the same thing will happen to the Moore case as happened to the muslim,indian guy Esuf Adam – son of S.Y.Adam, where the file could not be found.

    Commissioner Tyronne Griffith how you think that looks on you Sir?

    Secondly I am watching to see when the case of the Ispector John Annel – who I think was head of the unit that dealt with ammunition etc – when will that case start.

    Come November Herbert case will be postponed until May or June 2019,and so it will be, until it disappears from the system or the files cannot be found.That is,unless our girl with nuff ‘Balls’ – DPP Donna Babb start from now to protect her information in multiple copies.

    Now if Mia really want something to do she should start by bringing serious reform to the Bar Association (and don’t involve her cousin David simmons in it).This is something that the poor people – who she tells -“Mia Cares” – are really crying out for.She can also start by looking at that matter with George Payne.

    She can start by putting an end to these numerous requests for postponement by lawyers and police prosecutors too.Deal with that like yesterday.

    Get retired judges to come back and sit in special courts to speed up the number of cases.Hiring 3 judges as ‘smiley marshall – A.G. is suggesting will not be enough.

    Give better renumeration to the men and women in the police force and remove them from civilian duties.Make a career in the Police Service to be an attractive option and lengthen the Career ladder.
