The decision by Prime Minister Mia Mottley to reverse the controversial appointment of 18 year old Khaleel Kothdiwala is unfortunate. It was evident from exchanges in the last session of the Upper House the amendment to the Constitution to allow Khaleel’s sitting would not have garnered support from independent senators.

Immediately after the January 19, 2022 general election Prime Minister Mottley announced Kothdiwala’s as a BLP nominee for the Senate with the justification she was fulfilling an election promise to bring the youth into “the centre of governance and national determination…if you are old enough to vote then you must be old enough to serve”. All who have followed politics in Barbados are patently aware Khaleel’s politics is heavily influenced from Roebuck Street – and it is right to practice the politics of his choice.

The prime minister became swell headed by a second 30 to zero victory in the last general election and took for granted Khaleel’s appointment would have been rubber stamped by the Senate. Lest we forget, the Senate is currently involved indirectly in a fight for its legitimacy. Although the constitutional motion brought by former Attorney General Adriel Brathwaite was tossed out by Justice Cicely Chase, legal counsel Garth Patterson signaled appeal documents will be filed this week to challenge the Upper Chamber doing business with 18 appointed Senators instead of 21.

From comments posted to BU and aired in other fora, those opposed to the appointment of Khaleel took umbrage to the lack of national consultation about the unprecedented decision to add an 18 year old BLP supporter to the Senate to represent youth matters. Bear in mind Mottley- also in controversial and contentious circumstances- transitioned Barbados to a Republic in November 2021. The dissenting cry then was – why not complete an exercise of national consensus to determine a new constitution to make the process to a republic comprehensive.

At the root of the uncertainty muddying the governance process is an election result that rejected opposition candidates AND the unwillingness of elected members of parliament to cross the floor to manufacture an opposition. This is interesting against the rumour Mottley called a snap general election to quell a political mutiny.

There is also the contention that President Sandra Mason is partly responsible by her refusal to appoint two apposition Senators given the outcome of the general election. Had she appointed two Opposition Senators and Mottley a standin for Kothdiwala there would possibly have been no legal challenge brought and Mottley would have avoided the political embarrassment of having to withdraw Khaleel’s appointment.

It is what it is as the popular saying goes. We wait to endure the Court Appeal process and possible request for leave to appeal to the CCJ. In the meantime there is the potential lawmaking in parliament will be disrupted if Justice Chase decision is overturned.

At a time the country is battling to manage economic challenges acerbated by the pandemic we have become mired in process because of off flippant decision making. It is ironic the Upper House that is currently under challenge in the Barbados courts is responsible for Mottley’s decision to remove Kothdiwala.

We are living in interesting times.

“In addition to the pushing for the removal of the 21 year bar to enter Parliament, what this young politician also should be pushing for is the fast decriminalization of marijuana, the widespread use of which largely stigmatizes the same young people.”

his influence as we well know is limited to more or less misleading the young into joining the congoline of the mindless and backward….

.still waiting for the disabled to get a few marijuana plants a year, to grow them to alleviate their discomfort, pain and suffering as forward thinking progressive countries even in the Caribbean, and especially further afield, did for their people, instead, in Barbados, they fete them and pay them lip service…..and believe that will end their pain and suffering…

Miller…it’s a whole distasteful pappyshow for only fowls and the weakest links to be impressed by…

  3. Without any doubt, there has been no other institution in the recent history of our island as dishonourable and undemocratic as this Senate.

Time for our Supreme Leader to order the citizens to storm the Senate and free Barbados from the yoke of this despotism!

  4. Can someone tell me what else KK has done besides singing in the choir at a young age?

  5. He has done more than many twice his age.

  6. You are right.

Some thrice his age never sang in the choir.

  7. David
It just shows it wasn’t only about age but competence. Eligibility and suitability aint the same. Don’t get it twisted.

  8. For once, we should state the real reason for the opposition to KK.

The opposition in the ´local Senate reminds me a lot of the Republican opposition in the US Senate to the Honourable Justice Jackson. There, the opposition is also blowing the dog whistle because they do not like the ethnicity of the nominee.

  9. @enuff

For many it is about the ease the Constitution was to be amended without wide discussion. In this case before a national conversation promised this year to address a new constitution to fit the new republic.

Been around Barbados long enough to have seen or heard of him involved with social programs ..but never
However the first mention of his name was his grand appearance on the blp platform
Never heard of the lad before until that grand opening
Now from a blp platform to the Senate
What a huge leap of faith

    What a thing!

Just like how the same blind kid led you, the patented red yard-fowl, down the dead-end in arguing that the appointment of two DCoP’s in ONE established post was totally legal.

If Not for the ‘suitably wise’ intervention of ex-Senator Franklyn even you too could have been eligible to become the CoP No.2.

You should have taken the matter to Court for a ruling before being so adamantly wrong!

  13. LMAO, a party wins all 30 seats in two consecutive general elections comprehensively and it takes rocket science to deduce that they got the hog’s share of the youth vote? Not to mention this has always been a feature of Wickham’s recent data and analyses. The DLP is an old people party did not fall from the sky! The comment about the other 30,000 seems a bit hypocritical and is evidence of one trying hard to oppose for opposing sake. Should there be a representative from each losing party? Not to mention this is the same blog with a cabal opposing the lady’s attempt to get the party with the majority of that 30,000 votes 2 guaranteed seats, whilst supporting Caswell and Grenville who weren’t even on the ballot. Man wunna just can’t mount a cogent argument. Pure comic relief.

Who created it ? How much did this promotion cost ?

  15. “There, the opposition is also blowing the dog whistle because they do not like the ethnicity of the nominee.”

Let’s go down that avenue. On the whole black has been more accepting of mixed race children than other races. We do not wait until they achieve to embrace them.

KK is in the political arena and his politics can be commented on. It will take more than your dog whistle to beat some into silence.

  18. @David March 24, 2022 5:53 PM “He has done more than many twice his age.”

David, so who are these 36 year old Bajans who have done less WORK than an 18 year old?

  19. Enuff March 24, 2022 6:11 PM #: “It just shows it wasn’t only about age but competence. Eligibility and suitability aint the same. Don’t get it twisted.”

    @ Enuff

    Come on, my friend.

You know that’s not entirely true.

Remember, the proposed Constitutional amendment was to facilitate eligible 18 year old individuals to be appointed to the Senate, when, in actuality, it was to pave the way for Khaleel Kothdiwala’s appointment to that Upper Chamber.

Rather than expressing disappointment that 18 year olds would not be given an opportunity to be appointed to the Senate at this time, Mottley seemed a bit more concerned with disappointing Kothdiwala, as being “one of the most difficult acts of (her) tenure to date as Prime Minister of Barbados.”

It is important to note the Bill brought brought before the Senate, was to “also provide for the appointment of two senators nominated by the party securing the second highest number of votes in the preceding election.”

We’re reading comments in which the ‘usual suspects’ are celebrating Kothdiwala ‘dis-appointment.’

However, they have conveniently refused to comment on the fact that, adjournment of the debate on the Bill, PREVENTS the DLP from NOMINATING two candidates to sit in the Senate as well.

  20. @ Enuff March 24, 2022 7:03 PM

Stop shooting yourself in the foot by putting it in your gaping-red mouth.

Since the vast majority of (voting) Bajans show a total disregard for the same old people’s party called the DLP by not giving them a say in the HoA why then this ‘pretend’ show of magnanimity by going against the electoral wishes of the vast majority of the People.

Didn’t your Supreme Leader soundly advise the electorate not to vote for any Opposition?

The Court has ruled that the Senate is ‘properly’ constituted to conduct the people’s business without the presence of two senators normally nominated by the LoO.

If the people’s business can be properly conducted without any elected Opposition in the HoA, why this need to throw a spanner in the works by inviting two blue and yellow flies to be in the ointment.

No elected representation in the Lower House, then No Opposition in the Senate unless coming from Independent senators.

  23. @ David

I know I will be accused of ‘the pot calling the kettle black,’ but, I ‘couldn’t resist this one.’

Do you remember when Donville Inniss was sentenced to two years in a US prison, after being convicted of money laundering and conspiracy to commit money laundering…..

………… Hamilton Lashley urged Barbadians not to be quick to conclude his ‘political future was dead’ because he still had an overwhelming level of support from constituents in St. James South?

Hammie was essentially suggesting Donville could ‘run for that seat’ again.

    Guess WHO ENDORSED those comments?

HINT: the same people who are now opposing Gregory Nicholls’ appointment to the Senate, because, according to them, he was “caught up in a web of dishonesty.”

    Only on BU.

  24. Uh wonder who endorsed them comments mentioned by Artax
    Be that as it may
I still maintain that GN dishonesty having his name brought forward to the law courts for a debt passed two years due should disqualify him as a member of govt appointed by PM to sit in Parliament
All darts being thrown would not encourage or persuade my mind to change
Wrong is wrong if adults expect better from youth then setting good examples is where to start

There is where your hypocrisy shines bright
In that you saw a wrong done by Carrington while asking for his resignation but applauds the appointment of Nicholas a person known to have engaged in dishonest behaviors

  27. After the Carrington scandal the blp foot soldiers should be the last frontiers to be encouraging individuals having illegal baggage to be appointed in the House of Parliament
Memory serves as a reminder of the lambasting of Carrington and the asking for his resignation
Yet with GN another measuring stick of excuses coming from the mouths of certain quarters blp and others gives GN a right of passage
Question to be asked are there different types of measuring sticks when it comes to moral issues if so I nominate Charles Herbert
    Why not

It’s amazing , Mottley not only expressed her difficulty with Mr.. Kothdiwala not being able to enter the senate. She took a swipe at the entire country by saying that supporting his entering the senate was “ beyond the imagination” of Barbadians. It was not beyond our imagination to give her all the seats twice. How old was she when we put her in parliament. Was she old. But our imagination was ok then.
What that means: Bajans can’t think that far. That was insulting but she got away with that.
During the COVID,she said that citizens who could not even pronounce or spell the names of the drugs were engaging themselves in discussions.
Two direct insults but not a word from her cult.
She skillfully made her defeat to get her way about the country refusing to give her political pitbull a chance. The truth is that people like @enuff , will come here with his leader’s bull shit and then we want to prosecute others who do the same thing.
Mr. Kothdiwala who has been declared by some as brilliant , has shamelessly embraced his leaders dishonest political PR. Napoleon’s pup.Animal farm.
That’s why it’s always going to be the pot calling the kettle black. These Dees and Bees from Cahill to the Vaccine scam . Same shit ; different day.

  32. Allow me to return to an earlier discussion.
There is an expression “Guns don’t kill people, people do”.
Let me add the following “The constitution does not recognize parties, people do”. And that is all that matters.

Don’t get caught up with pedantry, obfuscation, sophistry, polemics …..Geez, I need to put away my Thesaurus.

It will be interesting to watch who the GG/President nominates and the response by Barbadian voters and how the nominations will be classified
    2 Virgins (2V -not B or D) – rare
    2 B’s – Lots of discussion
2 D’s – Lots of discussion but there will be a ‘sympathy vote’
    1B, 1D – Lots of discussion
    1B, 1V,
    1D, 1V
CASWELL and some other choice – all hell break loose – applauded and condemned at the same time- some will even point out she is a closeted D.

Don’t let them confuse you with fancy talk. I remember how some were saying the judge will return with the judgment of Solomon but some time need to be taken to deliberate/ponder/consider the intricacies of the matter. After the deliberation, we got a boilerplate answer that was predictable.

The time taken was more to condition you into accepting what was the only solution…. Government must go on.

i am not a thumper, but I have found that the Desiderata is a good guide for life…

GO PLACIDLY amid the noise and the haste, and remember what peace there may be in silence. As far as possible, without surrender, be on good terms with all persons.

Speak your truth quietly and clearly; and listen to others, even to the dull and the ignorant; they too have their story.

Avoid loud and aggressive persons; they are vexatious to the spirit. If you compare yourself with others, you may become vain or bitter, for always there will be greater and lesser persons than yourself.

  33. David
We ought to stop abusing the word consultation. Should we have a “national consultation” to discuss for example whether there should be FOI or IL laws? No, because to do so would be absurd. FYI, the failed IPL bill required constitutional changes and the future IPL bill will also need same. Yet none called for such consultation or raised any concerns about changing the Constitution. If one can marry at 18, be tried as an adult at 18 and vote at 18, any opposition to 18-20yr olds sitting in the lower or upper houses of Parliament (or any call for a national consultation) is the height of intellectual dishonesty.

    Last/Last

No, I’m not “flogging a dead horse.” It’s ignorance I’m highlighting.

    ‘Constitutional disqualification Senate law…..’

    (1) No person shall be qualified to be appointed as Senator who —

    (d) within the period of ten years immediately preceding the proposed date of his appointment as a Senator been CONVICTED
by a court of competent jurisdiction of any CRIMINAL OFFENCE involving dishonesty, and who
(i). has not appealed against that conviction, or
(ii). has appealed against that conviction and whose appeal has not been allowed, and
(iii). has not received a free pardon in respect of the offence.

Was Gregory Nicholls convicted of a criminal offence? NO!!!!

Was Charles Herbert convicted of a criminal offence? NO!!!!

However, the goodly prefers to be DISHONEST, by PURPOSELY IGNORING the words, ‘being convicted of a criminal offence,’ to focus specifically on ‘dishonesty’ instead.

But, remember, lying, cheating on your spouse or companion, stealing, intentionally presenting false or misleading information, hypocrisy, political ‘spin,’ political expediency, etc, ARE ACTS of DISHONESTY.
There isn’t a man or woman alive who, at some point in time during their life, has never committed a dishonest act

Therefore, if we were to ‘follow the lady’s argument to its logical conclusion,’ then, NO ONE would be ELIGIBLE for appointment to the Senate.
And, certainly NOT her, because she is known to have an uncanny penchant for manipulating the truth and intentionally presenting false or misleading information to this forum.

“It does not exist after dissolution so it can’t be occupied or become vacant!!”

So if Ms Caddle informs the President she no longer supports the majority, and is desirous of forming an Opposition, how does the President bring the LoO into ‘existance’.
Is there a formal creation, or does the President determine the Constitution already makes allowance, the office exists, and recognizes Ms Caddle as LoO.

    1. Certain persons supported the change to Republic (punting the Monarchy) without extensive Constitutional consideration, based upon the condition such considerations would be forthcoming. Opponents warned, about ‘piecemeal meddling’. Hence the prior mentioned supporters, must now rely on consultation, as these piecemeal changes become reality.
    2. This Senate distraction, was easily avoided The PM handled Adams/McConney easily? The two President Senate nominees, in lieu of LoO, could have been made withOUT the politicization. They were at the “President’s Discretion”. Period.
If at a later date, constitutional change to this was required, it could have been proposed.
The age alteration would never have been an issue, albeit some oppose or approve everything, depending on who governs.

  42. @enuff

No consultation is required for FOI and IL because the legislation was promised by successive governments. Also why no mention of it on the political platform leading into the last general election?
