The case is Radical Investments Ltd. v. Good Vibrations Entertainment LLC et al., case number 9:21-cv-81761, in the U.S. District Court for the Southern District of Florida

Radical Investments Ltd. is a St Lucia registered company owned by Mark Maloney. 

He appears to have been swindled out of $6.7 millon USD from the governments of St Lucia, the Bahamas and Barbados who contributed money to buy COVID vaccines for their citizens.

It is not clear what due dilligence Mr Maloney did before entering into this commercial arrangement with Good Vibrations Entertainment LLC. If you were looking to purchase pharmaceuticals would you do business with a company whith a name that connotes mechanical sexual services, and with an address at 21218 St Andrews Blvd Suite 318 that is a mailbox in a UPS store where 175 other fly by night companies also have their “headquarters”???

    T”he legal filing claimed the company was “deceptively” lured into an “elaborate” U.S. $10.2 million scam for one million “non-existent” doses of the AstraZeneca vaccine through a Florida-based company.

    “This is a classic and very unfortunate example of the very deleterious environment, which currently exists across the world as small and vulnerable countries try to gain access to life-saving medication,” she said.

    Bradshaw said the deal was struck this past February when vaccines were not readily available, and the government was using any means necessary to secure them for Barbados.

    “We agreed to facilitate one million vaccines because for those who understand the process they would realise it is not something that you can just say, ‘I want 50, I want 100, I want 2 000’,” she said.

    “The way the market is working is that you have to purchase at least a minimum of one million vaccines, and it was our understanding that other countries in the region were also grappling with how they get vaccines as well, so we would have helped to facilitate these other countries as well.”

    Bradshaw said the deal falling through contributed to the delays that Barbadians experienced in getting vaccines a few months earlier.

    “Fortunately, having entered into good faith dealings with an extra-regional supplier to procure the vaccines for Barbados, the regional private sector company, Radical Investments Ltd has been unable to get the supplier to hold up its end of the arrangements and deliver the vaccines as promised,” she said.

    “I think on many occasions you have heard the Prime Minister (Mia Mottley) and Health Minister (Lt Col Jeffrey) Bostic tell the country we are awaiting the arrival of vaccines, and on different occasions, we kept saying we were trying to source those vaccines and they should be arriving shortly. That really was what that was connected to.”

    The report is stating that Mark Maloney is seeking to have 6 million dollars return to his company the question then why would Mark Maloney pay out of pocket money for a product which he personnally couldn’t use
    The answer lies within the role in which he played on behalf of govts as the collecting agent to secure the vaccines

    In international trade, business, banking, finance the acts of any party involved in a transactions are generally deemed to be the acts of all parties.

    Therefore if Maloney introduces a criminal purposed-seller in a transaction in which Caribbean governments are known to be involved all the parties are assumed to have been involved in or connected to the misdeeds of a single party. This is why banks, for example, follow “know your customer” rules. Unlike Barbados no one can plead ignorance to the acts of another.

    OPPOSITION LEADER Joseph Atherley says Government’s explanation into the extent of the dealings with the Mark Maloneyowned Radical Investment Ltd does not offer much comfort to Barbadians.
    The company is alleging it was scammed while attempting to procure AstraZeneca vaccines on behalf of the people of Barbados.
    Yesterday, acting Prime Minister Santia Bradshaw in a press statement to the country, acknowledged the vaccines were indeed procured on Government’s behalf, but made it clear taxpayers’ dollars were not expended in the initiative as the intent was to purchase the vaccines from the company once they arrived in Barbados.
    Bradshaw also took the opportunity to address concerns raised earlier by Atherley, suggesting at one stage that he was commenting on matters which he did not understand, when he questioned Government’s rationale and due diligence in the exercise. She also levied similar criticisms against president of the Democratic Labour Party Verla De Peiza, who also called for clarity on the parameters of the arrangement.
    However, responding immediately after Bradshaw’s address, the Opposition Leader accused the acting Prime Minister of “posturing”, during what he said was a misguided attempt to demonstrate to the critics that she was capable of acting in Prime Minister Mia Mottley’s stead.
    He said a host of questions still remain unanswered, namely information related to the track record of Radical Investment Ltd in procuring pharmaceuticals, logistics which should have been key to Government giving the company their blessing.
    “It is emerging now that Government did know about it and that they gave the private company the go-ahead to acquire the vaccines. My concerns were not allayed at all and the response I heard from the acting Prime Minister could only be described as a ridiculous attempt at posturing to try to prove that she is up to the task of acting as Prime Minister, to impress her Cabinet colleagues and others who may be in doubt as to her capacity with respect to that function,” said Atherley.
    He added: “To try to attack me on the basis of the fact that I am saying that in a world of scams, where a company acting on behalf of Government, could be scammed out of that volume of money, then one would have to be concerned and Government would have to be cautious, that the scam does not occur with the quality of the vaccine provided. Are you telling me that this position is so irrational?”
    Referencing an earlier comment attributed to the Minister of Health and Wellness Lieutenant Colonel Jeffrey Bostic, in which he was reported in another section of the press as saying, “I am afraid I do not know anything about Radical Investments Ltd so I cannot comment on this one”, Atherley contended there appeared to be some contradictions.
    “If Bostic does not know about Radical Investment, then how it is that Government can enter an agreement with reference to the Ministry of Health and Wellness? I am not at all attacking Minister Bostic, but the information coming from the two sources are certainly at odds. The Minister of Health is telling us that he has no knowledge of the company, yet the acting Prime Minister can tell us that with the Government’s leave, the company sought to procure vaccines on behalf of the people of Barbados,” he said.

    During a 30-minute address to the nation, Bradshaw said Maloney’s company Radical Investments Ltd, had become a victim of the “wild wild west” environment which now exists as countries across the globe attempt to procure vaccines from pharmaceutical companies.
    The acting Government leader held the address after most media companies in Barbados yesterday reported that the Maloney-owned Radical Investments Ltd had started legal proceedings against Good Vibrations Entertainment LLC in Florida in the United States to recoup over US$10 million.
    “This was a classic and yet very unfortunate example of the very deleterious environment which exists across the world, as small and vulnerable countries try to gain access to life-saving medication,” she said.
    Bradshaw noted that in February last year, Barbados, like other countries in the Caribbean, was struggling to procure vaccines, and several offers were made by private entities and individuals to assist in any way they could, to source the precious drugs.
    She added that the Government was aggressive in reaching out to not only those entities, but in any way to source vaccines quickly.
    “Middlemen or intervening companies that work on behalf of Government cannot actually purchase vaccines,” she revealed. “There are certain rules governing how vaccines can be procured from the manufacturers, and this can only be done if the recipient government approves of such purchases, and arrangements are put in place for the vaccines to be delivered directly to the relevant authorities in the country, under the auspices of the Ministry of Health,” the minister further explained.
    Bradshaw added that vaccines did not go to any private entities, but come from manufacturers to the Ministry of Health.
    “The Government agreed to and approved of this exclusively private-sector led and funded initiative to source the doses of the vaccines for the citizens of Barbados. It was our understanding that we would have also helped to facilitate other countries to get some of the millions that were being ordered,” the acting Prime Minister said.
    Bradshaw noted that Barbados’ quota was to be 300 000 doses of the vaccine, at a time when there was a worldwide scarcity.
    “Having someone that could source these vaccines in these large quantities, with a view that we could enter into relationships across the region, for us, was an attempt to get vaccines into the arms of as many people as possible,” she stressed.
    She said while it was a private matter, no taxpayer resources were given to Radical Investments Limited. “This is a most unfortunate situation, and one which highlights the wild wild west environment of which the Prime Minister (Mia Mottley) has spoken about on many occasions, that obtains on the COVID-19 vaccine market. Radical Investments did not obtain a cent from us and is therefore not expecting a refund from the Barbados government.”
    According to Bradshaw, the clear understanding was that once the items were sourced and arrived in Barbados, then the appropriate payments would have been made to the company. She also said it was her understanding some of the payments had been refunded to Radical Investments Ltd.
    She added that governments have not used their usual procurement departments to source vaccines since the pandemic started 18 months ago.

    OFAC are intermediaries in Banking System investigating foreign transfers from various targeted sanctioned Governments, businesses, groups individuals etc for purpose of preventing terrorism, money laundering etc.
    They can delay or stop payments reaching recipients with no explanation provided to either party involved.
    Innocent people are often hit without knowing why.
    The question is whether Good Vibrations received the money and did not provide the vaccinations as agreed.

    The real concern should have been, why are they still holding on firmly to their patents and not distributing them free of cost to governments with manufacturing competencies since it was state funding given them to develop these vaccinces in the first place?

    This suggests a wider conspiracy. A real conspiracy against the people no less virulent than the Maloney one.

    Why this exception to capitalism along the distribution system alone? Seems inconsistent with capitalism as practised by monopolists.

    Who are you firing at?

    Barbados population is the size of a small city and needed to club together with other Caribbean countries to order minimal sized batches of vaccines available on the market at going rates.
