Collusion a Crime – Judge in Mueller Case Upholds Legal Theory

Is collusion a crime? Since the beginning of special counsel Robert Mueller’s investigation, allegations of “collusion” have dominated the debate. President Trump regularly claims there was “no collusion” with the Russians seeking to influence the 2016 presidential election. His attorneys and other supporters also have repeatedly argued that even if collusion took place, that would not be criminal. But last week, in a case brought by Mueller, a federal judge upheld the legal theory under which “collusion” may indeed be a crime.

I’m not sure how the term “collusion” became so central to discussions of the Mueller investigation. It really should be banned altogether. (I know, I know — this from the guy who just wrote a blog post with “collusion” in the title, right? But hey, I can’t unilaterally disarm.) All it does is breed confusion and lead to diversionary arguments about whether collusion is criminal.

It’s true there is no criminal statute titled “collusion.” But as I’ve noted in several places (here and here, for example) the relevant crime is conspiracy under 18 U.S.C. 371. Collusion refers to an agreement with others to achieve some improper end. In criminal law, we call that a conspiracy – a partnership in crime. And the breadth of the federal conspiracy statute makes it particularly well-suited for cases like Mueller’s probe of Russian interference with the election.

    It means that, while ostensibly there is a change in the government of the day, both continue to effect the rape of their people.

    Totally deranged Democratic Sen Brian Schatz from Hawaii, has tweeted that President Trump used chemical weapons against the illegal aliens trying to invade the United States.

    Schatz claims that the use of the pepper spray was against international agreements on chemical weapons. After fully embarrassing himself, he deleted his tweet. It’s true there is an international agreement on chemical weapons. But that agreement is on lethal chemical weapons. The pepper spray that the Border patrol used on the invaders is made up of water, pepper and ammonia for evaporation purposes.

    Although it is a deterrant, you could put it on your cereal and eat it with no harmful effects.

    Sen. Brian Schatz, D-Hawaii, tweeted Sunday that the use of tear gas against Central American migrants who attempted to enter the U.S. illegally may have been a violation of international agreements governing the use of chemical weapons — before he backtracked.

    The Associated Press reported that U.S. agents shot several rounds of the gas after migrants tried to penetrate several points along the border at the San Ysidro border crossing between Tijuana, Mexico, and California. Migrants sought to squeeze through gaps in wire, climb over fences and peel back metal sheeting to enter.

    In response to the reports, Schatz initially tweeted: “Tear gas across the border against unarmed families is a new low.” Approximately 45 minutes later, Schatz tweeted: “Who gave the order? Did it implement or contravene policy?” He then tweeted “WHO GAVE THE ORDER?” in all caps.

    Schatz also failed to mention that the policy of using gas against invaders was put into place in 2010 by Barack Obama. He used pepper spray over 80 times between 2012 and 2016. He also used pepper balls, no fewer that 434 times.

    Ortega, a mother of four, reportedly thought she was able to vote because she was a permanent resident. She voted five times between 2004 and 2014 — once for the attorney general, Ken Paxton, who later prosecuted her, according to her attorney. She also reportedly served as a poll worker.

    “She doesn’t know. She’s got this [green] card that says ‘resident’ on it, so she doesn’t mark that she’s not a citizen,” her attorney told the Washington Post said. “She had no ulterior motive beyond what she thought, mistakenly, was her civic duty.”

    Prosecutors said that Ortega had correctly told authorities she was a resident alien on a driver’s license form, while incorrectly checking the U.S. citizen box for the purpose of voting, undercutting her claims that it was an innocent mistake.

    Republicans have claimed that the nation is rife with voter fraud, but credible examples are harder to find, and the handful of cases like Ortega’s that are uncovered have faced tough prosecutions and stiff penalties in recent years. Earlier this year, a former felon was sent back to jail for voting illegally while on supervised release from prison.

    “This case underscores the importance that Texans place on the institution of voting, and the hallowed principle that every citizen’s vote must count,” Paxton said in a statement celebrating the ruling. “We will hold those accountable who falsely claim eligibility and purposely subvert the election process in Texas.”

    Trump ‘Got In Jay Powell’s Head’: Market Analyst on Fed ‘Doing a 180’ on Interest Rates

    A stock market analyst said Wednesday on “Your World” that the Federal Reserve appeared to “do a 180” and stopped dramatically hiking federal interest rates because President Trump “got in” Fed Chairman Jerome Powell’s head.

    In October, Powell — who was appointed by Trump for the 10-year-term to succeed Obama’s Fed chair Janet Yellen — said the Fed rate was “world’s apart” from where it should be.

    During the Obama administration, the federal interest rate was dropped to zero for a long period of time, but Powell began to hike the rate back toward where it was in the early 2000s.

    Trump has repeatedly blasted Powell’s decision to hike the rate so drastically at once, appearing to pin October’s volatile stock market performance on that development.

    Migrants who came with the caravan are suffering from respiratory infections, tuberculosis, chickenpox and other serious health issues, Tijuana’s Health Department warned on Thursday morning.

    The spokesman told Fox News that out of 6,000 migrants currently residing in the city, over a third of them (2,267) are being treated for health-related issues.

    At least 101 migrants have lice and multiple instances of skin infections, the department’s data shows.

    It is now reported that Manafort was essentially double-dealing against Mueller and his investigators, with his lawyers allegedly reporting confidential information to Trump’s lawyers about his discussions with Mueller while he was supposedly cooperating with Mueller.

    If Trump does pardon Manafort, there is a high probability that these matters are ultimately litigated before and decided by the United States Supreme Court.

    If Trump does pardon Manafort, the public firestorm of anger and outrage would be so extreme that impeachment consideration would probably be initiated even by a Republican House, and certainly by a Democratic House in January.”

    If wrecking American sovereignty, lowering wages, and increasing the public welfare load aren’t reasons enough to oppose the influx of migrant invaders sitting in Tijuana, here is another: At least 30 percent of them are sick with communicable diseases they might spread to Americans in schools, hospitals, welfare and employment offices, and other public places.

    And by “sick,” officials in Mexico don’t mean the common cold. They mean serious disease.

    Some of the migrants are turning around and heading home after months of traveling through Mexico, as The New American reported today. But with a third of the 6,000 or so in Tijuana coughing and breaking out in blisters, now is not the time for the Trump administration to weaken.

    AIDS, TB, and Chickenpox That’s because the diseases many of the migrants carry are deadly — or can be.

    “Out of 6,000 migrants currently residing in the city, over a third of them (2,267) are being treated for health-related issues,” Fox News reported.

    So far, officials have confirmed three cases of tuberculosis, four cases of AIDS, and four separate cases of chickenpox, the network reported.

    Even worse, they’ve also brought in bugs. Real bugs. At least 101, Fox reported, carry lice and “skin infections.”

    That means the migrants might well start a typhus epidemic or bring in chagas disease.

    According to the Centers for Disease Control, the body louse is the vector for the typhus bacterium, Rickettsia prowazekii.

    “Epidemic typhus is spread to people through contact with infected body lice,” CDC says. It noted the disease is uncommon these days, although “epidemic typhus was responsible for millions of deaths in previous centuries.” But cases continue to occur, in areas where extreme overcrowding is common and body lice can travel from one person to another.”

    The Benito Juarez Sports Complex, where the migrants are housed, is one such overcrowded area: 6,000 are packed into an area meant for 1,000.

    Chagas is another of the many benefits the migrants might bring. And unlike louse-borne typhus, chagas is not rare. It’s epidemic in Latin America.

    Blood-scuking triatomine bugs cause the disease:

    These blood-sucking bugs get infected by biting an infected animal or person. Once infected, the bugs pass T. cruzi parasites in their feces. The bugs are found in houses made from materials such as mud, adobe, straw, and palm thatch. During the day, the bugs hide in crevices in the walls and roofs. During the night, when the inhabitants are sleeping, the bugs emerge. Because they tend to feed on people’s faces, triatomine bugs are also known as “kissing bugs.”

    Some eight million people in Mexico, Central America, and South America have it, and most don’t know it.

    Officials also worry about a hepatitis outbreak because of the filth in the Benito Juarez Sports Complex. “The location also has only 35 portable bathrooms,” Fox reported. “A sign reading ‘No Spitting’ was put up, as coughing and spitting by migrants are rampant in the shelter.”

    Multi-Drug Resistant TB Particularly worrisome is how many of the migrants carry a particularly virulent form of TB that is resistant to multiple antibiotics. Frightening data appeared in a paper published last year by the National Center for Biotechnology Information.

    It reported that 37,684 immigrants with TB entered the United States between 2005 and 2009. The most, 24.1 percent, or 9,098, came from Mexico. Another 1,154, or 3.1 percent, came from Guatemala, while 853, or 2.3 percent, came from Honduras, where the migrant invasion began.

    But that’s TB generally. Of more concern are the multi-drug resistant cases that came in: 482. Again, Mexico accounted for most of those: 66 or 13.7 percent. Fourteen Guatemalans had the disease, accounting for about three percent. None, apparently, came from Honduras.

    MDR TB is a pressing concern, CDC reports, because “it is resistant to … the two most potent TB drugs … used to treat all persons with TB.”

    Another 2,000 migrants are headed for Tijuana. They will pack the sports complex even tighter. If the 33-percent figure for sick migrants in Tijuana now holds true for those on the way, the town will be faced with another 660 very sick people.

    Question: Is the United States expected to permit the entry of nearly 3,000 sick people, and if so, who will pay to treat their myriad diseases?

    President Donald Trump sent a message to Democratic House leaders and former President Barack Obama on Wednesday — and it made everyone in the room sit-up and listen.

    If the new House Democrats decide to spend 2019 launching needless investigations into the White House, Trump has his own plan.

    He threatened to make public all the information about Obama’s wiretapping of Trump Tower during the 2016 presidential campaign — and what Trump said that what these documents contain is shocking.

    Before the election, House Minority Speaker Nancy Pelosi claimed to have a “hit-list” of 85 investigations that Democrats were planning to use to grind the Trump administration to a halt.

    Instead of governing and growing the economy, Trump and his team would be stuck answering an endless stream of subpoenas and legal requests.

    Conservative lawmakers called the plan “stomach churning” and warned voters that giving Pelosi control of the House would unleash “chaos” in 2019. Still, Pelosi won — and may even retake her speaker seat.

    In typical Trump fashion, the president went on the offensive — and warned that Democratic lawmakers weren’t ready to pay the “heavy price” that a slug-fest with the Oval Office would cost.

    Trump even challenged them to try.

    “If they go down the presidential harassment track, if they want go and harass the president and the administration, I think that would be the best thing that would happen to me,” Trump said in an interview with The New York Post. “I’m a counter-puncher and I will hit them so hard they’d never been hit like that,”

    The president said he would declassify the Obama administration’s FISA warrant applications and other secret documents involving special counsel Robert Mueller.

    The documents would expose that the FBI, Obama’s Justice Department, and the failed presidential campaign of Hillary Clinton all conspired against Trump during the election, he said.

    “I think that would help my campaign. If they want to play tough, I will do it,” Trump said. “They will see how devastating those pages are.”

    A group of Republican lawmakers, led by New York Rep. Lee Zeldin, asked Trump to declassify the documents in September. They claimed at the time the information would undermine the legitimacy of Mueller’s investigation, which Trump has repeatedly called a political “witch hunt.”

    But the president said he was holding onto the documents as a defensive tactic to discourage Democratic lawmakers from using the “legal hell” tactic post-election.

    “It’s much more powerful if I [release the documents] then. Because if we had done it already, it would already be yesterday’s news,” Trump told The Post.

    John. I do not know how much of the Law of Evidence you have studied, but no evidence is as cogent as that coming from a convincing liar who has the requisite demeanour.

    Trump is fun. What kind of Christian are you? Really, what kind of Christian enjoys racist and misogynist “jokes” from a man who has shown all intentions of following through with dehumanizing actions.

    For those who are the butt of these “jokes” it is no fun. It can be a matter of life and death.

    I think your claim to Christianity is the joke and in the end it will be on you.

    The Constitution itself contains only two restrictions: The pardon must be an offense against the United States — that is, a federal crime and not a state crime. Also, the president cannot use the pardon power to save himself or another official from impeachment.
