Earlier this week, news broke that a questionnaire ‘sanctioned’ by the Ministry of Education (“MoE”) and overseen by the Inter-American Development Bank (“IDB”), was administered to mostly 11 year old children in Barbados. It has also come to light that a similar project was undertaken in Jamaica and Belize.

Misleadingly labelled as a “Computer Science Diagnostic Pre-Test”, it included questions on “social and emotional health” that were of a very sensitive nature. Below is a sampling of the more than 150 psycho-social questions:

  • I drink alcohol without parents’ approval.
  • I deliberately try to hurt or kill myself.
  • I hear sounds or voices that other people think aren’t there.
  • I am overweight.
  • I physically attack people.
  • I steal from home.
  • I steal from places other than home.
  • I think about killing myself.
  • I think about sex too much.
  • I wish I were of the opposite sex.
  • I use drugs for non-medical purposes.
  • I see things that other people think aren’t there.
  • Physical problems without known medical cause:
    • Aches of pains (not stomach or headache)
    • Headaches
    • Nausea, feels sick
    • Problems with eyes (not if corrected by glasses)
    • Rashes or other skin problems
    • Stomach aches
    • Vomiting, throwing up
    • Other

The questionnaire was delivered using a paper form and required that students provide personal information such as their name, sex, and ethnicity. Also included were detailed questions about the education level and work status of parents (e.g., type of job, unemployed, homemaker, etc.).

There was swift and comprehensive social commentary accompanied by widespread public condemnation of the decision to administer this questionnaire. The political public relations machinery quickly sprung into action to contain the damage to the public perceptions of the current Barbados Labour Party (BLP) administration. The IDB immediately took responsibility for the melee, trying in vain to absolve the Ministry of Education of any wrongdoing. The Chief Education Officer, Deputy Chief Education Officer, Permanent Secretary, and the Director of Education Reform all embarked on a public apology tour. The Prime Minister set about with her usual articulate flare and penchant for press conferences to assure the masses that she was deeply outraged (while praising the IDB for their prompt action in shifting the blame from her government). However, it must be noted that the Minister of Education has been conspicuously silent amidst this public relations storm.

But now to the main reason behind this author’s musings…

So far, the public discourse around this fiasco has centered on the incompetence of the Ministry of Education staff, the arrogance of the IDB, the inappropriateness of the questions, and the mental stress inflicted on the children. What has been glaringly missing are the legal elements. So let me break it down.

  • The subject questionnaire is for all intents and purposes scientific research. Questionnaires are popular in academic research for quick and easy collection of large amounts of data for analysis of subject behavior, preferences, intentions, attitudes, and opinions.
  • To meet ethical and legal standards, and to protect the rights of data subjects, informed consent is an important legal basis for data processing as required by the Data Protection Act (Barbados), General Data Protection Regulations (European Union), Data Protection Act (United Kingdom), Personal Information Protection and Electronics Data Act (Canada), and other privacy and data protection laws across the world.
  • As per the Barbados Data Protection Act (“the Act”) and similar laws around the world, there are six lawful grounds on which data can be processed: explicit consentcontractual obligationslegal obligationsvital interests of the data subjects, public interests, or for purposes of legitimate interests of the data controller. The only lawful basis which the MoE can use for administering the subject questionnaire is legitimate interests. However, that lawful basis does not pass the three-part test which requires a positive answer to these three (3) questions: Is there a legitimate interest behind the processing? Is the processing necessary for that purpose? Is the legitimate interest overridden by the data subject’s interests, rights, or freedoms?
  • As per the definitions in the Act (and the other aforementioned laws), the students whose personal data have been collected are data subjects.
  • As per the definitions in the Act, the Government of Barbados is the data controller who determines the purposes for which and the means by which personal data is processed. The Inter-American Development Bank (IDB) is the data processor who processes personal data only on behalf of the data controller.
  • As per the definitions in the Act, a ‘child’ is a person under the age of 18.
  • As per the Act Part II 8(1-2), “The processing of a child’s personal data shall be lawful only where and to the extent that consent is given or authorised by the parent or guardian of the child” and “The data controller shall make reasonable efforts to verify in such cases that consent is given or authorised by the parent or guardian of a child, taking into consideration available technology.” From all accounts, neither the MoE nor the IDB obtained consent from parents to collect this personal data from children. This is a violation of the law.
  • As per the Act Part II 9(1-4), the data collected is personal sensitive data, which requires greater safeguards to protect the rights of the data subjects. Sensitive data includes data on ethnicity, health, and sexual orientation or sexual life. Collection of this type of personal data requires strong security and consent is required to share with third parties. From all accounts, the data controller (MoE) did not obtain consent from parents to share this sensitive personal data with a third party. This is a violation of the law.
  • As per the Act Part IV 58(1-10), the MoE (data controller) is required to have a Data Protection Agreement in place with the IDB (data processor) to ensure that the rights of the individual are being protected and that legal compliance with the Act is achieved. The public deserves to know whether a Data Protection Agreement exists between the two entities and to examine if it is fit for purpose.
  • As per the Act Part IV 55(1-6), the IDB must be registered as a data processor, pay a fee, be in possession of a certificate to conduct data processing activities, and nominate a representative who is resident in Barbados. Failing to do any of these things makes their representative liable for a “fine of $10,000 or to a term of imprisonment of 2 months or to both.” Is the IDB compliant with the law in this area? The government should present the general public with evidence to verify this compliance.
  • As per the Act Part IV 59(1-2), it is stated that “The data processor and any person acting under the authority of the data controller or of the data processor, who has access to personal data, shall not process those data except on instructions from the data controller, unless required to do so by any enactment” and “A person who contravenes subsection (1) is guilty of an offence and is liable on summary conviction to a fine of $500,000 or to a term of imprisonment of 3 years or to both.” In their public statement, the IDB asserts that their administering of the questionnaire was against the objections of the MoE. This is a violation of the law.
  • The Act Part IV 62 (1-3) requires that data processing of this sensitivity and high risk be conducted using online tools. Moreover, it states that the data is pseudonymized (not contain information that could identify a living person), which means that the names of individuals should not have been required on the document. Finally, it demands that strong security protections be in place to protect against unauthorized access. Given that the questionnaire was administered by paper, it is virtually impossible to guarantee that this very sensitive personal data on children was adequately protected from unauthorized access, misuse, and abuse. Moreover, it also attributed the sensitive and potentially harmful information to living, identifiable children and their parents. This is a violation of the law.
  • The Act Part IV 67(1-7) and 68(1-6) requires that both the data controller (MoE) and the data processor (IDB) designate an individual as a data privacy officer to advise them on the legal, technical, and administrative elements of processing personal data. A data privacy officer should be an individual qualified in privacy law and compliance. To the best of my knowledge, neither organization is compliant with this legal requirement with regards to data processing in Barbados. Given the number of violations of the law, this is not surprising.
  • One of the most alarming things about this matter is the eerie silence of the Data Protection Commissioner.As per the Act Part VII 70(1) and 71, the Data Protection Commissioner is “responsible for the general administration of this Act” and whose functions are to monitor and enforce the Act (including issue fines), organize activities to educate children (and parents) on the risks of processing their data, and monitor and audit data processing by data controllers and data processors, among other things. The individual in this role was equally silent during the February 2022 elections when the government leaked the entire voters’ list on the public Internet, which has, based on my discussions with officials at financial institutions in Barbados, resulted in several citizens being victims of fraud and identity theft. This seriously brings into the question the qualifications, capabilities, and independence of the Commissioner, and the ability of the individual to effectively serve in this important role.
  • As data protection laws are generally extraterritorial, the MoE and IDB have more than likely violated the General Data Protection Regulations (European Union) and other privacy/data protection laws from across the world. For example, there are many expats living in Barbados, and if European Union citizens were required to take the questionnaire, then that is a clear violation of EU laws. This also applies to citizens from other countries where robust data protection laws have been enacted.
  • There are numerous other areas of the Act that the MoE and IDB violate in their relationship (e.g., consultation with the Data Protection Commissioner, performing data protection impact assessments, records of data processing activities, etc.). Sadly, this is just the tip of the iceberg. There are several public agencies, educational institutions, financial organizations (including fintechs), retail companies, telecoms operators, and other businesses in Barbados who are in clear violation of privacy and data protection laws.

The “right to private life” is enshrined in the Constitution of Barbados and the Universal Declaration of Human Rights (UDHR). The rights of data subjects (including children) are legally protected by the Data Protection Act (Barbados). The Government of Barbados, its development partners, and private corporations need to do so much better as it pertains to upholding the rights of citizens. I shudder to think of what similar privacy rights abuses are happening in other Caribbean countries and across the broader developing world.

  1. Last week the blogmaster received word the controversial Science Test was also done in June this year BUT the offensive questions were not included. It is official, the same content was part of the June test. This makes the departure from process more egregious. Many are concerned (rightly so) with the type of questions included in the survey instrument, the blogmaster is equally concerned to ask – is this incompetence or arrogance by MOE management that the country finds itself in the position.

    THE CONTROVERSIAL computer science pretest which contained what parents have deemed as inappropriate questions to first-formers was not the first time it had been exposed to Barbadian schoolchildren.
    The revelation came from Chief Education Officer Dr Ramona Archer-Bradshaw yesterday.
    And the pretest is in no way connected to, or a conditionality of, a multimillion-dollar loan agreed to between Barbados and the Inter-American Development Bank (IDB), says Minister of Education Kay McConney.
    Speaking as part of a panel discussing the ongoing debacle yesterday on Starcom Network’s radio call-in programme Sunday Brasstacks, Archer-Bradshaw told Barbadians a similar test had been presented to first-form children in June.
    “As the information came to us with regard to the five schools affected this academic year and we began our investigation, it was found that the test given in June was of a similar nature to the one given in September. What occurred in June and what occurred in September was all part of the same project. As I became aware of it last week is when we began to take action and delved deeper into it,” Archer-Bradshaw said.
    “We checked the content originally and expected certain items to be removed and they were not removed, which has resulted in this situation,” she said in response to a question as to how the questions were allowed to remain.
    When contacted yesterday, general secretary of the National Council of Parent-Teacher Associations, Nicole Brathwaite, said they too were concerned.
    “There are too many questions to be answered and we need to do our own investigating of the matter,” she told the DAILY NATION. She opted not to offer further comment.
    McConney rubbished claims that the survey was a conditionality of a recent loan agreement between Government and the IDB. “The answer to that unequivocally is no,” the minister said.
    Last week, Archer-Bradshaw and the minister apologised to the nation four days apart, for the offensive questions which formed part of the IDB-sponsored project, stating they had been left on pre-test even after ministry officials had asked for them to be removed.
    During a press conference on Saturday, Archer-Bradshaw said the IDB, in its apology to the Government of Barbados last week, had indicated a “miscommunication” had led to the offensive questions not being removed.
    However, yesterday was the first time information was presented to the public that the recent computer science pretest was actually a repeat of one done during the summer.
    The ministry has indicated that all 733 tests taken by students from St George Secondary School, Queen’s College, Princess Margaret Secondary, Graydon Sealy Secondary and Coleridge and Parry were back in its custody, secured in a vault, while they await legal advice on how to destroy the material.
    Also on the panel yesterday was president of the Barbados Psychology Association, Dr Diane Forde. While accepting the apology from the chief education officer and the minister, she said surveys do have a part to play in research and development of the school system, but this one was way too long, even if more than 100 questions were removed.
    She added that had the ministry completed its due diligence, the offensive questions would not have been seen by the 11-year-old students. Forde said the questions in particular which could lead to issues with the children being asked if they liked members of their family, and about their gender identity.
    In response to a question from the panel, McConney said the role of the IDB as funders of the project was to conduct the evaluation associated with the survey as it was implemented in Barbados.
    Archer-Bradshaw said the project was to be rolled out before COVID-19 hit in 2020.
    “We then resumed discussions with the IDB about how we could have the project implemented in Barbados. The main aims of the project are to expand the technological skills such as coding that are key to the innovation and diversification in secondary schools. It was about creating close relationships with the Ministry of Education and the private sector as well, and helping the youth of Barbados to be ready and become world citizens,” she explained.
    She added that the ministry’s original objection to some of the material in the pre-test was because they considered it not contextually relevant to Barbados, and many questions were not related to coding. She added those objections were sent in writing to the IDB.
    Archer-Bradshaw said the ministry was not naive in not doublechecking to ensure the offensive questions were removed.
    “IDB and the ministry have a long-standing relationship. We’ve been working together for a long time and trust had been built up. We’ve never had a situation such as this one before and what happened here was as surprising to me, as it was to the parents.” (BA)

  2. The blogmaster agrees there has been a breach of trust between the public and government (MOE). In a scenario like this one it is important to address the root problem. The PM must request the resignation from the leaders at the ministry involved including the Minister and Chief Education Officer. The important work of leading the education sector should not be compromised by the fact those who lead cannot be trusted by its stakeholders.

    The students test papers should be recovered from whomever has now got them and the paper trail of who received them and what they did with them will reveal the true picture of their ulterior motives and they should be held accountable for the unacceptable fuck up.
    If these ‘esteemed’ agencies have proven to have acted inappropriately in this unacceptable fiasco they should be dumped like a sack of rotten potatoes.

    Three comments on the original post
    1. There is increasing use of digital tools, but I am not certain that this is automatically safer than the use of paper. The processes employed to protect the identity of individuals and the adherence to the law of those collecting information is important in determining the safety of personal information.

    Not certain that a questionnaire given to EU citizens on Barbados must follow EU law. If we wanted to use the resulting information in Europe or if a Barbados organization was collecting the information in Europe then that would be a different matter.
    Would have love to see him comment on how/if the data collected in this matter should be handled.

    There is still room for legal input.

    The acceptance of some teachers and their downplay of this wrong is frightening.
    It appears that our children only line of defense is their God given intuition.

    @David, I am still trying to understand what happened between June and now. When one peels the skin on this ‘onion’ it gets quite painful. I agree with the assessment that a public spectacle of job terminations at the highest level is required but a spectacle only will it be. As someone said previously these actors will simply move to other positions of comfort to assist their benefactors.

    To say publicly that correspondence requested removal of several questions of this 300 query doc because they were unrelated to coding begs the question of why the other questions were yet deemed as acceptable with a ‘named respondent’ identified! And why if this survey was done previously was there no very careful diligence to ensure that the directive was completed!

    But let’s also quote the psychologist Dr Diane Forde who noted in the article above that “surveys do have a part to play in research and development of the school system, but this one was way too long, even if more than 100 questions were removed.”

    She did not explicitly say that an anonymous survey of this type was acceptable but clearly that’s suggested. These queries and suggestions were raised here previously and thus goes to the heart of the “intellectual dishonesty” and PR prattle discussed on that earlier blog. Something is very, very amiss in this entire debacle.

    And now that it’s reconfirmed that this survey was done earlier the significant difficult to grasp question(s) asked by many are: ‘Why this high level of subterfuge’?; ‘Why did the professionals in the ministry EVER accept the use of names directly linked to the survey, to its extensive length and clear intention to gather significant personal profiles without informing parents’?

    As the attorney Harper suggests above, parents may have a legal case against this administration. Ideally some enterprising lawyer and very concerned parents do bring suit … and as we read often even now all parties involved should be on notice not to destroy any emails, texts or other communications. Let’s peel this onion!!

    Indeed, an absolute lack of transparency. I really can’t believe how nefarious this was intended to be … for a matter where it really need not have been so.

    Are the govt’ across the region so fearful of being honest with their citizens in gathering (ANONYMOUSLY) such sensitive date! I shudder to believe that the conspiratorial stuff offered by other bloggers has any semblance of truth.

    The parents appear to have a case but if we are to believe our officials and the surveys are not back in their possession and have not been analyzed then the question would be what lingering and thus potential or already caused ‘damage’ has been done?

    In short, would even a victory produce any meaningful monetary award … yes, of course this should be more than that so ideally there are truly activist parents and attorneys up for a fight!

    But as you know all legal matters take time and MONEY and going up against the govt and frankly the IADB would consume both of those big time.

    So the activism important as it is to flush out serious issues and truly negligent disregard by this admin will also not be easy nor inexpensive!

    Then there is the question on whether children of a minor age should be asked questions of personal sexual and sensitive nature absent parental permission while providing identifying details.

    What a clear and well explained piece by Niel Harper.
    Being a data collection ignoramus, while I was aware initially the “test” had obvious flaws, the illegality was not properly appreciated.
    Wow.
    There is no room for the IADB to dodge this. They HAD to know what they were doing was illegal?
    I am guessing a lot more than their past head will be exiting. (I note the OAS head has similar accusations)
    One is left to ‘guess’ that similar ‘tests’ in J’ca and Belize were also illegal?
    This maybe the tip of the iceberg.
    This one isn’t ‘going away’ anytime soon.

    @David, we are focused on this local make-war as we surely should be … BUT how does Moscow get the right to bomb civilian areas in Ukraine in retaliation to a bomb strike on a bridge!

    Zelensky continues to be in a tough spot: he can’t attack within Moscow itself for fear of just this type of civilian bombardment and Russians turning more against him, but he also must hurt Putin at his home base to really get himself into a stronger position.

    This is a difficult time for all of us small fry countries … whether IADB or a super power adversary they ‘does treat we real bad’ … like dirt on shoes … absolutely irrelevant and distasteful towards their livelihood!

    You say that we turn to them in time of need suggesting there is some kindred partnership but is this how partners, and in the case of Russia family relatives, treat each other!
