Your message to the BLOGMASTER was sent

At the outset of the Coronavirus crisis in this country, the Hon. Prime Minister, Mia Mottley, hosted a consultation with members of the Social Partnership and me at the Lloyd Erskine Sandiford Centre, to plan strategy for fighting this threat. I was impressed and congratulated her on the approach. I then went on to say to her that this was not a time for political controversy and that all sides must come together to defeat this scourge.

Rather than busy itself with measures to protect the people of this country, some twelve days after the consultation, Government rushed to Parliament and passed legislation that was already on the books, to manage the ensuing crisis. In essence, that legislation amended the Emergency Management Act by re-enacting certain provisions that already existed at section 28 of the same act; also at sections 2 and 3 of the 1939 Emergency Powers Act; and at section 25 of the Constitution. The amendment also went on to give powers to the Chief Medical Officer that he already had since 1969.

Needless to say, those initial steps did not give me any confidence that Government was capable of handling the situation, however I remained quiet hoping that somehow that they would get it right. I’ve tried to hold my peace but the situation has now reached a stage that I am compelled to speak-up before these bunglers unintentionally kill us all.

The handling of this crisis has been plagued with the bungling that is now characteristic of anything that this administration touches. So far, were are told that there is no evidence of any community spread of the virus. But it would seem that the end result of the Government’s initiatives would lead to what we fear most. What did the Government think would happen when it gave one day’s notice of a 24-hour curfew? As was reasonably foreseeable, people rushed to supermarkets in their thousands, ignoring any suggestion of physical or social distancing. Take some sobering time to imagine what could have happened if there were any carriers of the Coronavirus in those lines?

As if Government fails to learn from its mistakes, post offices were opened for a limited period in order to allow pensioners to cash their National Insurance pension cheques. The foreseeable result happened: hundreds of vulnerable persons throng the post offices thereby creating an incubator for the spread of the Coronavirus.

This virus is deadly and Government must come up with a series of measures that would protect the people of this country. These hit or miss initiatives just will not do.

    Family member: ministry dropped ball on COVID-19 case

    A FAMILY MEMBER of the 66-year-old woman who tested positive for the coronavirus (COVID-19) yesterday is charging that Ministry of Health officials mishandled her case, since this was over three weeks she suspected she had the virus.

    The angry woman said several family members had been exposed because they spent the previous 24 days caring for her.

    She explained that her relative, who was a Government employee, came home from work on March 27 and the next day, she started to feel sick.

    “She called up at Paragon on Sunday and they told her to get ready, that they will pick her up on Monday to be tested. By 9’clock in the morning she was ready and nobody came. She called back again on Tuesday and they told her they were coming. She waited and waited and nobody came.

    After six days with no change in the number of new cases or deaths from COVID-19, Barbados has recorded one of each.

    Speaking on the CBC TV-8 news this evening, acting chief medical officer Dr Kenneth George said a 70-year-old non-national man passed away around 9 a.m. Wednesday at the Harrison Point facility in St Lucy.

    George said the man, who had diabetes, had a “fairly difficult course” which ended with pneumonia.

    He expressed his deepest condolences to the wife, family and friends of the deceased on behalf of the Government and people of Barbados.

    Meanwhile, a 66-year-old Barbadian female tested positive and is currently in isolation.

  17. Magistrate knocks law

    Barbados’ COVID-19 curfew law has been described by a magistrate as badly drafted.

    Magistrate Graveney Bannister said yesterday while a section of the Emergency Management (COVID-19) Curfew No 3 Directive, 2020, spoke of the hours 6 p.m. to 6 a.m., another section referred to a curfew from April 15 to May 3 “without more, which would mean it would be a total shutdown”.

    He said it was “far safer” for police “to arrest someone or to deal with someone after 6 p.m. or at night-time, rather than trying to make a 12-hour curfew into a 24-hour curfew”.

    Barbados has recorded its sixth death to COVID-19.

    The Ministry of Health and Wellness has reported that the deceased is a 70-year-old CARICOM national who resided in Barbados. The diabetic gentleman became infected by a known case who travelled abroad.

    He was diagnosed and admitted into isolation on April 1. However, he passed away around 9:00 this morning at the Harrison Point Facility in St. Lucy.

    Acting Chief Medical Officer, Dr. Kenneth George, expressed his deepest condolences to the wife, family and friends of the deceased on behalf of the Government and people of Barbados.

    In addition, a 66-year-old Barbadian woman became the first person to test positive for COVID-19 after a six-day lull in cases on the island. She contracted the virus after being in contact with a known case on April 14. Aggressive contact tracing has begun.

    This brings the total number of positive cases to 76 – 39 females and 37 males.

    Sixty-four tests were conducted by the Best-dos Santos Public Health Laboratory yesterday, 33 of which were conducted on the Trinidadian contingent, who left the island later in the day. They all tested negative for COVID-19.

    On April 20, Minister of Health and Wellness, Lt. Col. Jeffrey Bostic, announced that the Ministry of Health and Wellness would broaden testing for COVID-19.

    He also said that testing centres would be established across the island and would include all the polyclinics. Increased testing for COVID-19 is part of the Ministry’s strategy to ensure that community transmission is not taking place in Barbados.

    The total number of tests conducted by the laboratory since February 11, now stands at 1,162. Two persons will also be released from isolation today after they tested negative twice within a 48-hour period.

    To date, 27 persons have recovered. There are now 43 persons in isolation.

    Attorney General responds to article on curfew law

    Attorney General Dale Marshall has responded to an article carried on the Front Page of the Daily Nation of April 23, where Magistrate Graveney Bannister described Barbados’ COVID-19 curfew law as badly drafted.

    Following is the full statement from the Attorney General:

    “In an article in one section of the Barbados press today, Magistrate Graveney Bannister was reported as having commented negatively on the enforceability of the Curfew Directive No. 3.

    “While judicial officers are called on to interpret our statutes and apply them, this duty only arises in the context of a matter over which they are presiding. It is, therefore, most unfortunate that he has chosen to step beyond his responsibility as a judicial officer, and to trespass on matters that are for the executive or the legislature.

    “It is also regrettable that his commentary is likely to lead Barbadians to doubt the validity of the Directive and its force in law.

    “As Attorney General, I am satisfied that the Directive is fully enforceable in law and I caution Barbadians against testing the legal system based on the magistrate’s expressed view. There are several specific provisions in the Directive that speak clearly and unequivocally to the fundamental rule that Barbadians are simply not to leave their residences except they are engaged in permissible activity and during the times allowed.

    “Be assured that the members of the Royal Barbados Police Force will continue to apply the terms of the Directive strictly for as long as this curfew remains in effect.”

  46. It seems to me that Magistrate Bannister owes the AG an apology for calling the Directive No 3 “poorly drafted”. He should stop being so polite and let his real opinion be known – the document is not even piss-poorly drafted. Surely the tea lady in the AG’s office would know that if the intent is to impose a 24 hour curfew you don’t word the very first headline clause of the directive: “A curfew is hereby imposed throughout Barbados from the 15th April, 2020 to midnight on 3rd May, 2020 between the hours of 6:00 p.m. and 6:00 a.m each day”.

    The AG is like the Emperor with no clothes here. What is obvious to everyone else he has failed to notice.

    Rather than publicly berating the Magistrate he should be thanking him for pointing out the confusion and issuing clarification for the public.

    Why not stay beyond any shadow of legal doubt by stating: ‘For any 24 hour period from 6.00 am on any day to 6: 00 am on the following until 6.00 am of May 4th 2020’.

    Or some other similar catchall clause to cover the square corners of the corral containing the law which is an ass.

    These are clauses from the three separate emergency orders issued to date:

    A curfew is hereby imposed throughout Barbados from the 28th March, 2020 to the 14th April, 2020 between the hours of 8:00 p.m. and 6:00 a.m
    A curfew is hereby imposed throughout Barbados from the 3rd April, 2020 to midnight on 14th April, 2020 between the hours of 6:00 p.m. and 6:00 a.m. on the following day.
    A curfew is hereby imposed throughout Barbados from the 15th April, 2020 to midnight on 3rd May, 2020 between the hours of 6:00 p.m. and 6:00 a.m. each day.

    Points worth noting:

    1/ Its clear that the clause from the first directive (when the curfew was not intended to be 24 hours) was just dressed up for versions 2 and 3 without much thought, especially with regards to the 24 hour issue. Lazy drafting.
    2/ By version 3 the AG’s office seem to have mastered time travel as the curfew is to go from “6 pm to 6 am each day”.
    3/ When is midnight on May 3rd? Is it as May 2nd expires, or as May 4th begins? For avoidance of doubt surely it should be stated as being at 12.01 am on either the 3rd or the 4th.
    4/ What sense is there in having a curfew expire at midnight – so some party cruises can be planned? Surely the curfew should end at 6 am.

    The Magistrate was more correct than perhaps even he realised. The AG should discontinue the display of hubris.
