What about Mr. Franklyn and major issues? Ermine lived with Zena. Upon receipt of her monthly pension, Ermine paid her utility bills, bought a case of dog food for Zena and cigarettes for herself. Each day she went to Holetown, bought her newspaper and smokes. The staff at the gas station spoke eloquently about her and even attended her funeral. Her sister and niece did not bother to show up.

@ Olivia Wellington, I can attest to the Fraud that Dale Marshall and George Payne has done. I have first hand knowledge, unlike Jackie I am not one to go on social media. Thanks to her it has been exposed. As the Solicitors Regulation Authority has said HE IS NOT QUALIFIED THROUGH THEM. Jackie was not the IT person who did his website. He did. Get over this issue. Can you Olivia seeing that you are so well versed in the George Payne saga, why he never attends court. He always sent one of the other associates and I have first hand knowledge of this. In order to fully understand the scope of Jackie’s arguments, I would like to see:
The paper trail of letter from Glenda to her sister requesting updates on the progress in settling the Estate as this would be the normal way to proceed. Since I have such a learned daughter protecting my interests, I would think she would be keeping track.
I would also like to know what comprised their plan of action to attend to the settling when they arrived in Barbados in 2016.
Since they owned 50% of the Estate, did they inspect the property, go through the house?

It is not necessary for any attorney in Barbados to be regulated by SRA. Barbados is a sovereign nation.
Mr. Payne is obviously not a strong litigator. At most major law firms, it is rare for a partner to litigate. Litigation dictates that one be articulate, calm and charismatic and perhaps Mr. Payne is not. I have never met him and cannot attest to whether he possesses these skills. I can only tell you what is common practice.
Olivia Wellington, When there are beneficiaries the rule of law is: Whatever is willed to someone should be given to them in a timely manner after the death of the estate holder, especially more so that there was and is a will written and signed by George Payne. There is no excuse for this to have happen, but because it is prime lands they were waiting for the other beneficiary to be deceased. This is a game they play at constantly. Again this has nothing to do with you. Glenda Stewart has children and the only one who is advocating for her mother is Jackie. If you are a family member and claim to have knowledge and know what goes on or went on in this estate, you are just a vile as those crooked attorneys to be chatting crap. If Ermine was very savvy, why would her relatives from England have to inspect her house? Was she savvy or a recluse? Where are you going with this.
One can be savvy and reclusive simultaneously. As I previously stated, Ms. Harewood opted to delay claiming her part because of personal reasons. In this life people have their priorities and she chose hers.

With the death of Ursuline, there remained two beneficiaries as tenants in common. Ermine owned 50% and so does Glenda. I own property with my siblings and you better believe that I inspect each one, pay my share of the upkeep and demand a strict accounting of all transactions. It would be grossly unfair and reckless of me to be out of the loop for an extended period and then show up making demands,
All that matters is that the rightful legal beneficiaries / owners of these properties receive their fair share whatever that is.
This family can make individual or collective choices how to resolve their problem.
If I were involved it would be a problem because of my personal character flaws.

@ John Executrices have a duty to the Estate and to do what is best to settle it and keep it solvent. It is black letter law–Executrix can dispose of property in the way she sees fit unless the Will has specificity and states that beneficiaries must be notified. This is universal. On a personal side, I would have been courteous and notified. However, as I have stated, there are other dynamics at play here which existed between the sisters.
In other words this Executrix did not have a good bedside manner?

For all of the back and forth here, the basic tenets of law: logic and reason are absent. You distrust the lawyer who is handling the Estate and yet you neglect to stay vigilant or have your own attorney check and keep you abreast for ten years? Makes no sense but is food for thought. Personally speaking, I would be in Barbados every 6 months accompanied by my lawyer but then I am a rational person.

This type of Fraud including George Walton Payne & Co., is far from being solated.
Like Jackie Stewart when I stood up to these guys I was accused of all the IDENTICAL things spouted by Olivia Wellington.
My Joint Civil matter as the Plaintiff which involved at the time around $240,000 plus Interest and which was given a Default Judgement against the Defendant in 2014.
This matter involves dirty shenigans and I was almost locked up.
The Lawyers are ruthless along with some dirty Police.
I always made sure I kept an Electronic copy of my records and not just left them in the hands of Lawyers.
This is no joke what is happening on the island of Barbados.

I shared Emails with the Nation Newspaper and VOB over a year ago and supplied documents Electronically to expose no response so they are a Major part of the problem.
However the Nation Newspaper had no problem running 2 stories over two days in 2009 saying I a well known businessman was charged for Fraud.
The charges came about to get rid of myself and my spouse at the time because we had started Civil Procedures.
Corrupt local Police were also involved and for 6 years of attending Court before charges were dismissed against both of us for LACK OF EVIDENCE.
They went so far in their plot as to post on BU in 2009 when the Nation Newspaper ran their story I was arrested for Fraud and that the Police caught me with a lot of overseas passports and I was Human Trafficking.
My teenage children brought the Post on BU 2 years ago to my attention and I brought it to the blogmaster’s attention and it was removed from BU.
The plan was to get us out the Picture and to steal with no opposition.
I fought and end up leaving Barbados because of having evidence planted NOT ONCE but TWICE and realised that these are not ordinary people I was dealing with.
Even though my mother died 2 years ago in Barbados I did not return, I have not spoken to my teenage children and family on the island well over a year as the stress and anger caused my closest relations to suffer.
George Walton Payne & Co., along with others feature very heavily in this matter.
I repeat I will be sending documents along with more detail today to BU and Naked Departure, and will go on Sherri Veronica show to expose.
I know a lot of what goes on because I operated and dealt with everyone at the top professionally in Barbados.
I have previously donated to both B & D Political Parties including to the current Prime Minister.

In 2003, 21 years after the grant of letters testamentary, the plaintiff in a matter took the executor to court because he would not give an account … even though in his affidavit of value in 1982, he had sworn to the court to have accounts done within a year!!!!!!!!!!!!
It took 10 years and appearances in the High Court, Court of Appeal and CCJ to finally get a judgement that went something like this:
[18) In the instant case no steps have been taken to ascertain the extent of the testator’s estate or to distribute it. Counsel for the respondent said that title to certain real property must first be obtained as no title deeds exist and therefore there is no property for which to account. This is an amazing theory! If it were correct it would operate to bar the claims of beneficiaries under a will or on an intestacy even before the extent of the estate was known and that would lead to the absurd result that all a personal representative need do is sit down and wait for the period of 10 years to elapse and then claim the property himself or deal with it in any manner adverse to the beneficiaries or otherwise as he pleases.
[19) In our opinion that is not a correct view of the law. The correct interpretation of sections 43 (a) and 44 is that time only runs against the appellant under section 44 of the Act from the date when the respondent, as executor, is in a position to dispose of the residuary estate.
Disposal
[20] Accordingly, the appeal is allowed, the order of Goodridge J is set aside and the respondent is hereby ordered to render the accounts sought. The appellant shall have her costs of this application to be agreed or taxed certified for two counsel.
Five years later, still no accounts … and the executor has died!!!!
The simple fact is that Barbados is a lawless jurisdiction.
The QC in this instance, one Vernon Olivier Smith, subsequently made the mistake of successfully getting a case to the CCJ and the CCJ cited him and co counsel, Hal and Steve Gollop for abuse of process.
Vernon Olivier Smith QC then appeared in the press and labeled the comments of the CCJ a diatribe.
Barbados could only be described as a complete joke, a lawless jurisdiction, a failed state …. you take your pick!!
