I am going to be extremely radical and repeat what I was told by an older lawyer and leave you to examine the facts before you light into me for being a racist.
Cottle Catford & Co. was probably the “best’ most respected” law firm back then.

What we are looking at generally in Barbados is that many people have no values.

The will is a basic will. It is no more cold nor impersonal than my father’s will. One does not have to use lovey-dovey language in a ill. Our parents loved us while they were alive. They CANNOT love us now that they are dead.
Many people including my family cut out the lovey-dovey crap and get straight to the point. Single page wills.
We had no difficulty settling the estate, which includes some potentially valuable land.

@Alan Winter, I doubt very much that The Solicitors Regulation Authority (SRA) would dispense such advice and the same goes for the The Caribbean Court of Justice (CCJ). I see correspondence that pointedly states that George Payne does not fall under the jurisdiction of SRA. Barbados is a foreign State so I fail to see how their lawyers would be regulated by an external regulatory body. I see where the letter advises Jackie Stewart to take her concerns to the Barbados Bar Association. A Simple Response: I have better advice to offer. SPEND ALL THAT YOU HAVE DOWN TO THE LAST DIME. Have fun. Enjoy yourself. Give expensive gifts to all of your spouse and to all of your children and grandchildren, that way when you die there is NOTHING left for anybody to fight over. Nothing left for lawyers either. Lolll!!!. And if they don’t feel like burying you out of THEIR OWN MONEY, then they can leave you lying there in your bed until you become dust. All problems solved.
I had a relative who did that. Spent everything on everybody. Including me. Lolll!!! Everybody appreciated the generosity. Everybody loved the relative. Nobody angry after death, because there was zero money in the estate, except for one month’s pension payment.
Have fun. Enjoy life. Give your spouse, children, grandchildren, nieces, nephews, godchildren whatever they want WHILE YOU ARE ALIVE. That way they thank you in person, you get to see their joy.
Olivia Wellington Iread the same letter it was sent to the Barbados Bar Asco and clearly states he is not qualified in Engand as he stated and highlited it and it is known down here that they Barbados Bar on a technichality and has been known for years in the boys club England has just confirmed what was the dirty secret
Mr. Winter, Martindale-Hubbell is the one place one can verify attorney credentials for any attorney and I checked Mr. Payne’s credentials myself. I stand by what I wrote.
@Simple, we have not seen the full document. You said “some” of your parents estate included land. While it may be possible, I do not know of any estate of a recently deceased person that is only comprised of land. She had to have had personal effects and we all know that she lived in a house. We have learnt that there is a bank account. There may be more than one bank account. Then they are legal documents that make up an estate like land tax bills for all of the properties. For all we know there was cash if Marie Stewart lived off a government pension. We must see the complete document.
Martindale Hubbell only publishes information that is sent to them..they are a PAID advertising site..ya could lie about all ya qualifications as long as ya pay them…ya in…they do not police lawyers, that is not their intent or purpose…that is the job of a regulatory board that should have been set up for lawyers by both governments decades ago…

And the reason is simple.
Most of the dispositions are done before death!!
There are tax advantages to leaving certain dispositions until after death.

@ David @ Olivia, your have both alluded that is a family matter and could have been resolved without Glenda taking Ermine to Court. I disagree on the evidence shown in the affidavit and the Attorney’s letter. Ermine did not say that she WILL sell the land. She said that she was selling the land. None of us were there to understand impact that this had on Glenda. The sense of urgency caused her to take action and rightly so. She sought legal assistance and was well within her rights to do so because based on the the time line in the above documents, the land was probably already sold. The letter that Mr Payne’s office must have prepared for Ermine to sign is dated August 31, 2016 and a mere 16 days later on September 16, 2016, Glenda’s lawyer received a letter stating that the property had already been sold.
Ermine’s statement that she was selling the land can only be interpreted two ways either that she was in the process of selling the land or that she sold the land.
Do we know the sale date of the land? It would be impossible to back date that now. Did Ermine ‘mislead’ her sister by providing her with inaccurate information?
And again I must ask the question, how could the property have been sold without the title deeds?
When Glenda turned up on September 6, 2016, she smelled a rat that could not have been resolved with a family discussion if the land was in the process of being sold or already sold.
PAIN and TEETS, the Judge who gave a fraudulent Judgement, Gollop, Cow and all the frauds involved in stealing and selling the Stewart Estate should be arrested…IT IS FRAUD..nothing can change that..

In her capacity as Executrix, Ms. Atwell sold a piece of land to satisfy the mounting debt on an estate. Independent counsel outside of Barbados verified that it was in the best interest of the Estate of a whole to stem the bleeding and satisfy the debt to prevent the interest from accumulating.

You might be interested to know that this was the advice I saw in 1995 from a local lawyer in connection with the accumulation of debt by the executor of the estate.
Letters Testamentary had been issued and there was an affidavit of value in existence which the lawyer inspected. He advised:
“If the Affidavit of Value is correct, then the only outstanding debts of the estate would have been the funeral and legal fees in connection with probating the Will. The Executors would not have the power to dispose of the furniture specifically bequeathed before resorting to residue and, in any event, for debts which did not exist at the time of the deceased death.”
Furniture and land are different but what I took from the advice seems applicable to the sale of the land.
But I am only half a lawyer.
Get the Affidavit of Value filed by the executor of the estate of Marie Stewart.
The “executor’s year” was up a while back.
The monthly cost to maintain that Estate was roughly $5000.00. Plus the legal costs to restore titles in the proper order, plus the costs of surveying land. The Estate debts go back more than 20 years. Perhaps Jackie can demonstrate her mother’s contributions to the upkeep. It is my understanding that Mrs. Harewood refused to meet with her sister and after her sister’s death she steadfastly refused to come and settle her business.
What titles..they are NO TITLE DEEDS>>>you hardheaded fraud..

It reminds me of the current ongoing story where the couple in the US raised GOFUND ME US$402,000 for a homeless man and through fraud stole it by constantly lying and moving the numbers.
In court the couple lawyer said there was US$150,000 remaining, US Judge said to turn it over by following day and have account audited because of MAJOR discrepancies as ponted out by the Homeless man lawyer.
Now they say there is nothing left in the Bank Account they are now being pursued on criminal charges for FRAUD and THEFT.
This is what needs to happen in this case.

If Jackie Stewart has a claim for fraud she needs to file civil suit and then all parties will have their day in court. She might not achieve the outcome she desires but filing a suit gives validity to what she is alleging. This melodrama and speculation is childish and pointless. The sad part of this sordid affair is that this will drag on for years as did the Estate of Marie Stewart simply because Jackie expects everyone else to do the work and make it easy for her. Jackie also needs to get a job and work for a living like anyone else.

@Straight Talk. Mrs. Harewood was duly advised as to the bank and amount. It is up to her to claim her half. Prior to mentioning it, I merely asked to see the statements so that I could verify its existence. Revealing its location is not within my purview. I am here for damage control. An entire law firm of young and old lawyers at an international law firm viewed her videos and postings and the consensus is that unless she can substantiate her allegations, she is headed for trouble. She is now known as Jackie Trump due to her impetuous use of Facebook.
