Savvy on the Bay matter- if the BTII failed to do due diligence by hiring Mr Kenneth Ward, both Mr Ward as the surveyor and Mr Kinch as the buyer had an obligation to legally declare a conflict of interest.

Blogmaster, I sent you 2 paragraphs governing conflict of interest by surveyors and engineers as outlined by law. The wording in US and British law is slightly different, however, both speak to a professional and legal obligation to the client.

The reason I sent this is because a blogger of yours touched on it, but I do not think many understand the legal liability that this places on a transaction in terms of the efficacy of the survey. Also I read where a blogger tried to down play it by saying [paraphrasing] so what if the same surveyor that worked for Mr Kinch worked for BTII, Barbados is a small place“. My point is – if the BTII failed to do due diligence by hiring Mr Kenneth Ward, both Mr Ward as the surveyor and Mr Kinch as the buyer had an obligation to legally declare a conflict of interest.  

Had this occurred in the UK or USA, the entire survey would be deemed null and void as outlined below.

The engineer or land surveyor shall exercise independent judgments, decisions and practices on behalf of clients and employers as follows:

(a) The engineer or land surveyor shall attempt to avoid all conflicts of interest with his client or employer, but when a conflict of interest is unavoidable, the engineer or land surveyor shall immediately inform his or her employer or client of any business association, interest, or circumstances which might tend to influence the licensee’s professional judgments, decisions or practices or the quality of services.

(b) The engineer or land surveyor shall not solicit or accept any gratuity, material favor or benefits of any substantial nature from any party, agent, servant or employee dealing with his or her client or employer in connection with any project on which he or she is performing or has contracted to perform engineering or land surveying services. This solicitation or acceptance includes, but is not limited to any act, article, money or other material possessions which is of such value or proportion that its acceptance creates a clandestine obligation on the part of the receiver or otherwise compromises his or her ability to exercise his or her own independent judgment.

In a related matter, I take the opportunity to apprise the public about a company by the name of KDL Limited created by Allan Kinch. He shutdown the company, paid out the partners, closed the company account before they could cash cheques issued as part of the dissolution. KDL sold construction equipment and the partners were Kinch, Bugelin and Lashley.

Blogmaster, this is an angle to the Savvy on the Bay story in need of exposure.

    It bothers me how some come here and act surprise when a next wheel falls off the bus. It is this continuing pretense that all is well which will keep us where we are.

    I agree the final plan approval would of been done by TCP but they would have been working off of plans submitted by the surveyor for his client BTII.

    From the article the other surveyor gave you which you published, the conflict seems to have come from the follwing point. So lets say Mr Ward worked for BTII once, but has worked for Mr Kinch 100 times, then this would create a major conflict of interest on this survey. As for how this affects the legality of the survey now we will have to wait and hear.

    This really surprised me as I was one accused of defending Mr Kinch on another post here and saying that this could never of happened. So i guess i was wrong on that count too!

  7. The simple truth is that there’s nothing that creates and floats corruption more than skillfully constructed confusion.
    We are playing loose with public property and then pretending that the powers that be are in the dark.
    I recall the Duffus Commision and it was stated that all roads lead to Barrow.
    A few decades later another Prime Minister , publicly stated, that all big works , must come through them.
    Whom are we trying to fool ?
    A whole lot of mumbo jumbo and we are lapping it up.

    I believe it was you sir that brought the fact here that the measurements on the plot did not tally back and that the plan in fact favoured Kinch. So my questions is this. In light of the facts you pointed out and the conflict of sale issues outlined by the Book Surveyor, does a legal sale even exist for the land now? Also is this why the AG has said he is not paying kinch for land he does not own?

    So many questions and so few answers, but alas I wait with baited breath for all to be unveiled by aunty Mia!

    Mr Kinch, breach your contract, take your losses for a more favorable parcel of land that has unlimited potential. Maybe that parcel of land adjacent to Barclays Park on the Easter side of the Island.

    With a pool of Arib and Chinese investors the biggest modern city in the immediate hemisphere can be.

    Had Allende lived maybe he too would be looking to build a not so savvy hotel on the Bay.

    The criminal savant Rumsfeld is now dead so too is America’s man in Chile general Pinochet, leader of the putchists. However, Cheney will never see the inside of a criminal court.

    There is something else you need to have as well which is far more important than any plan on a sheet of paper.

    A title schedule that tells you (your lawyer) that you are not buying a lemon.

    All releases of any encumbrances on the land you better have in your hand before you fork out any cash.

    Make sure you (or your lawyer) peruses every conveyance that traces the history of the land you want to buy or you may get an unpleasant surprise ….

    …… particularly with all this land fraud going around associated with so many lawyers.

    Many plantations were conveyed to companies in the 40’s 50’s and 60’s with a standard encumbrance for the day and are being cut up and plots sold to unsuspecting purchasers!!!

    Plenty people in Barbados may own more than what they think they own, but it may be a liability, not an asset.

    Some lawyers will change the title schedule on the land to conceal the encumbrance.

    …. and I can prove it!!

    Caveat Emptor.

    Your question is an interesting one. How is it that the buyers and the sellers attorney did not do a title search? Were they like the surveyor part of a conflict of intererest too?

    Does the tainted survey now mean that the sale is in fact null and void? So the question I have to ask is what exactly did kinch buy and from whom?

    You got to understand Bajans, they will talk hard about government and criticise the same government they elected about unfairing people and how they tell kinch to make the eye clinic look old again bla bla bla. All without knowing the facts of course. Even the Nation article was done without proper research. In other words its about the moment of glory and nothing to do with getting the facts to the people in a NON BIAS WAY.

    Have you notice though that now that the facts are coming out about what really happened at savvy, how the same loud mout bajans and the said 4th estate have gone quiet like church mice? Suddenly the so called victim of so much “state victimisation” is being seen in a different light. You think one of these “town cryers” would now come here and say ” i should of waited for more info and as the 4th estate i should of dug deeper.”

    The press is nothing now but a sensation grabber. It thrives on publishing conflict and as you saw from the PM chat, were unable to even mount any real questions to the PM. The days of men like David Ellis are over and that is why Bajans now will jump the gun and talk crap without facts.

    Have you not seen how few will even now touch this article?


  18. I am new to this blog and will confess like many I was mislead by the mouthings of some. There is one issue that went out there and was unchallenged which I now want to address and state the facts on.

    I saw a Sarah Taylor say how Mr Kinch was a rich poor man and ” had millions tied up in land he could not touch.” Well the lands that he speaks of were all bought by his ex father in law’s money. Mr Kinch did not invest a cent of his own money in any of these purchases. Yet it would appear he now wants to lay claim to them in a matter which is before the court.


  19. Sarah Taylor’s September 6, 2023 9:42 AM contribution to the ‘Players laughing at we 2’ thread, also remains unchallenged. Among the reasons she gave for ‘why Kinch STARTED to develop the site WITHOUT PERMISSION’ were, ‘he needs money to pay bills and his ex-wife.’ In my opinion, Taylor, who has been Kinch’s biggest supporter, essentially ADMITTED he DID NOT have permission to develop the area. There ended what little interest I had in the issue.

    The seller wanted to move land for which he was missing not one but nine releases.

    Bank that financed the seller wanted back its money quick as it was exposed financing the transaction.

    That bank also financed the source of the land and was being sued in Canada.

    The Seller’s attorney stood to benefit from the movement of the land as he was a director of a company that was “supposed” to get a big piece.

    He was also well connected.

    When the scam started it targeted high end buyers but high end buyers don’t hire “hungry” lawyers and knew how the releases worked and would not look the other way.

    They advised their high end clients not to touch the land!!

    Sales slumped at a time the Bank was pressing to get its money back.

    So, the seller dropped his price and enticed lower end buyers and their “hungry” lawyers who would look the other way as he had to get back the Bank’s money he had borrowed to buy the land.

    The Seller’s lawyer actually threatened lawyers who did not close in 90 days with being sued.

    It was in the paper!!

    Ah ok got a better understanding now. What I dont understand though is how did BTII as the seller, not know what they were selling? So yes they would of had Kinch’s surveyor Ward do a survey, so was this then the only document used in this transaction? How did this glaring conflict of interest not come to light to begin with, seeing that he never worked for BTII before while working for Kinch an abundance of times? Also is the buyer’ atttorney not also supposed to do a search of title before he committs his client to the purchase?

    My question is how can so many mistakes be made on what is a simple land sale? It looks to me like many are guilty of looking the other way so as to make this sale happen as fast as possible. Based on all these screw ups by so many, is this why the AG says he is not paying anyone for what they dont own?

    What I really want to understand John is how could so many checks and balances all fail at the same time.

    Yes that is evident even from this article. So many who know the truth are not touching this.

    The reason this is of concern to me is the family have a small piece of beach land that has been with us for years. So what is there to stop a licourish well connected developer from bushwacking my poor lawyer in a similar way as the savvy issue is unfolding? If the systems can be bypassed so easliy once you have money who protects us? So if the buyers lawyer says ” listen this got to wrap up in 90 days or else,” then all checks and balances go through the window now it seems.

    So I now have to go and find a brand name lawyer to defend me against the developer brand name lawyer, with the hope my interest will be protected, is that the approach I must take based on all of this?

    Well even if that was true it does not explain the surveyor issue, the lack of proper title searches and the whole other buriful of “mistakes” that were made with this sale. Then we have the work starting without aprrovals and on and on we go.

    If the state now feels that it can better put the land to work for the betterment of the people, then let them purchase the car park and other parcel in question back from kinch. But the AG says you cant buy from a man what he doesnt own, so clearly they are other issues at work here that must be addressed before the land can be sold to anyone else. All of which need to start with a new clean survey free of conflict, so that what is being purchased back by the state after legal ownership of said parcels are made clear, can then move forward without more mistakes.

    You know they say WHAT START WRONG DOES END WRONG.

    You don’t need any brand name lawyer, you need to keep control of your title deeds and pay your taxes.

    Put your deeds in a location no one can get at them.

    Don’t let arrears build as the Commissioner can order a sale of the land.

    If it is a particularly desirable plot it will be gone in the twinkling of an eye, vultures abound in Barbados.

    You may never find out till its too late.

    I see you noticed what I too noticed. All the fluff of Taylor’s bs highlighted that they went against TCPO instructions withOUT any permissions.

    She plays the victim well. As far as I can tell, the savvy issue doesn’t have much to do with his millions in land…. Or does it?

    All I know is I was always told, if you start wrong you will end wrong and it’s pretty clear with all the mistakes and oversights that Kinch started wrong. Maybe he was hoping with all the confusion no one would want the responsibility of unraveliing it all and he would remain the owner.

  33. Lol David what about the conflict of Intrest of George Payne’s Law office the Minister in the Ministry of Housing being the law firm that sold the land from BTII to Mr Kinch and then The same Ministry says they own the land.

    See the blogmaster’s comment above which crossed. The TCP at the time should have been aware of Kenneth Ward’s role as surveyor for parties involved.

  37. Ward was awarded the tender by BTII to do the survey Mr Kinch found our after and yes BTII knew that Ward had previously worked for Kinch because Mr Kinch told them after he became aware that Ward was the appointed Surveyor

    In I believe it was Oct 2019 A man from Housing came forward to say they owned some of the land. Now the Minister for Housing at the time was George Payne and his office was representing BTII. A Mr Smith made the claim but did not supply and proof of the claim despite the lawyers asking of it. Neither. BTII lawyers or Mr Kinch’s lawyers could find any evidence that the claim was legit as the land was not subdivided and the registry did not have any record of its division nor did land tax. It was said it was something Housing has previously attempted on other such property matters by the sea. BTII lawyers then said they were ready to complete and indicated the matter was resolved. BTII then had to have boats and trailers moved off of the area in question to provide vacant posession.
    A mess it was and is.
    You may remember Mr Kinch was involved with Pirates Cove and though he did not own the property the matter of accreted land came up and Housing tried to claim it was not part of the property and lawyers had to get involved and it was shown Housing was wrong… So you see for Mr Kinch it just appeared that they were trying to do the same thing again and ALL correspondence shows that. This was something he was told others also faced. I even overheard a conversation where the lawyer told him the minister told Mr Smith to stop harassing Mr Kinch. They reassured Mr Kinch everything was resolved and they could proceed and so he did.


  39. Yup and we have that on good authority. Plans were even done for them and they contacted a contractor and walked around years after Mr Kinch paid the deposit telling people they will own it

    They were aware as Mr Kinch advised them before the plans were done.
    Mr Ward won the tender from the government to do it and Mr Kinch only know when he himself won the tender to purchase the property.


  41. @David Your information on the company you mention is incorrect and I know this from one of the partners I am family to and have known long before I knew Mr Kinch

    What would make a more accurate story is Mr Kinch fighting and winning for the BS&T share holders to ensure they got a better deal which they did a much better deal. I have met many people those that like and dislike mr Kinch but state how grateful they are for what he did in the interest of their rights.

    If you do wrong there are consequences.

    Kinch is wrong. He did wrong and now after the fact he is playing victim.

    What BTII did and what the previous Government May or May not have done wrong is still waiting to be confirmed.

    Definitely what Kinch did by going ahead with renovations when he and Taylor knew they had no permission is wrong.
    How they incited the public with petitions, they never corrected the false narrative that was published in the Newspaper until after the Town Planning Department clarified the facts and gave timelines. Then they only provided excuses. As Artax noted above, they have yet to admit any wrongdoing

    It would appear that everyone else is to be blamed but Kinch and Taylor.

    1) How many times has Mr Ward worked for BTII ?
    2) How many times has Mr Ward worked for Mr Kinch?

    Let’s say since 2000 or 2005.

    surveyor is spreading false information @david you may want to remove this info as KDL is not a company Mr Kinch was a part of
    He was in one called KLB.
    It was sold by ALL partners to a foreign company…. One of the Partners is my family who where and are friends of Mr Kinch for years before I even knew Mr Kinch and my family only went into the company because of Mr Kinch’s honest reputation.


  47. I honestly do not know. The only person who can answer this is Mr Ward and the Lands and Surveys department I suppose.

    But I think you must agree it is more complicated as again BTII had to move items to give Mr Kinch vacant possession so they were the ones stating they owned the land and BTIIs lawyers were from George Waltons Payne’s Law firm and George Walton Payne was the Minister over Ministry of Housing at the time.
