Your message to the BLOGMASTER was sent

General Elections were held in Barbados on January 19th, 2022, and the ruling Administration the Barbados Labour Party (BLP) came away with a resounding victory capturing all 30 seats, leaving all the other opposition parties with zero. Today, 14 days after, now that the dust has settled, it is clear that despite this achievement, the government of Barbados is fighting for power.

The fight relates to the fact that Parliament cannot be seated as the Upper House or the Senate is not constituted. The winning party is like a ship without its rudder as it cannot steer or maneuver at sea. It is in limbo and at the mercy of the waves if caught in a storm. Without Parliament being fully constituted, the administration is unable to amend any law far less create new ones and start its agenda.

Based on the Constitution, two Opposition Senators are required in the make-up of the constituted Senate. Since no members of the opposing parties won any seats, it is left to the President based on the Constitution to act as the Leader of the Opposition and appoint 2 persons who opposed the BLP in the General Election.

The ruling Administration extended an offer to the Democratic Labour Party (DLP) which gained the second most votes to seat two of their Senators. The DLP refused stating that it was not a proper offer since the Prime Minister had no authority to extend the offer. Then the Attorney General walked back on the offer stating that the prime Minister was only seeking to facilitate their entry into Parliament and stating that there must be a meeting with the ruling Administration, the President and the DLP. At writing the DLP has not responded.

Is the Barbados Labour Party in Control?

Clearly the BLP wants to get on with its agenda which perhaps contains vaccine mandates, safe zones, IMF conditionalities and now the contentious issue of seating an 18-year-old in the Senate (even though they had previously opposed seating a 25 year old DLP Senator stating that he was too young). All these are now problematic due to the crisis of there not being a fully constituted Senate. In essence the government is operating in a system that they cannot control the outcome. At present it is powerless except for day-to-day administration. It makes one wonder how long the island can operate without a functioning Parliament. Perhaps there is some pressure based on a commitment to external forces that caused an offer to be extended to the DLP.

Does the Power lie in the Hands of the Democratic Labour Party?

Though it may seem a simple act of benevolence, the offer that was extended to the DLP cannot be construed as such. It was simply to use them to achieve the government’s agenda as the DLP simply will not have the numbers to halt any amendment or passing of a bill into law.

It is significant to note that accepting that offer would also set a precedent to exclude smaller parties from the House of Assembly at this time since they may not be the holder of the second highest tally of votes.

However, it is not only the DLP that has the power of choice; all the opposition parties and independent persons who took part in the General Elections have the same power of choice in deciding whether to accept an offer from the President simply because the Constitution does not recognize political parties, only people. If the opposition parties and independents signed an agreement to reject any such offer, the ship is rendered helpless, forced out to sea, or slammed into the rocks by the mighty waves. Clearly, the back of this Administration is against the wall.

Just selecting two Senators will not resolve this constitutional crisis. It is like prolonging agony not just kicking the ball down the road for someone else to correct later.

The System

The system controlled and manipulated Electoral and Boundaries Commission (EBC) based its decision to disenfranchise thousands of Barbadians and blamed it on the State of Emergency Protocols. This is unacceptable as the protocols were easily amended to suit tourists and celebrations for the Republic. It must be noted that the EBC did not disenfranchise its workers, some of whom must have been infected and spreaders of the virus because a few days later it had to close its office.

When the Attorney General lashed out at the DLP to stop playing politics, it came to light that he did not realize that the fight is not against them but against the voracious beast of a system whose actions his own party has taken to a whole new level by paying social media influencers from the public purse, by obtaining campaign funds from local and international financers as well as maintaining a Department of Communications while the Government Information Service still exists.

The system has now taken on a life of its own and as the song by Jah Cure says, “Babylon can’t feed this beast” and there is no mechanism in place to control it. The system is now working in overdrive to maintain the 2 Barbadoses’. One with the rich man in his castle and the poor man destined to remain at his gate. One in which the tourist sees a paradise and the workers go home to pull back the curtain to show the stark reality of their lives. One in which economic enfranchisement will never be given to the poor. The Poverty Alleviation Fund remains empty, yet government can hold a lavish celebration for a meaningless Republic. The system has made sure that justice is not for the poor. That poor black men are paraded like animals and incarcerated for a spliff like the inhumane conditions of slavery.

From independence, the system has made a mockery of the franchise with use of bribery through giving corn beef and biscuits to the gullible in exchange for their votes. The bribery has not stopped, the vote is now exchange for far more valuable items.

The system has also turned political campaign meetings into lavish parties with big stages and sound systems and bright lights to entice the youth to have a grand time as they listen to popular artistes. Those feel-good moments lead to a five-year sentence of hardship including lack of representation, high prices of food, constant increases in the cost of gasoline, lack of infrastructural development, lack of opportunities, no jobs and the desires for a better life come to naught.

The privileged few can escape the island for supposedly greener pastures, but the majority have no choice but to remain and face this hard brutish existence, yet they revere politicians more than themselves. The cycle of economic poverty for the lower class is perpetrated by political parties. They pay back their campaign financers with big contracts and titles, but they only provide scraps and promises to the people who elected them.

The actions of this system, expressed in the words of Bob Marley is “Babylon system is a vampire, sucking the blood of the sufferers.” The pervasive corrupt practices that start by ensuring that a party dominates the first pass the post Westminster System has been to the detriment of the social and economic life of ordinary Barbadians.

We must kill this beast. It has outlived its usefulness. But perhaps, the system is turning on itself, decaying from within, just like the Roman Empire and we can no longer choose to ignore this fact. On two consecutive occasions it has produced a winner without power. On the first occasion Mr. Joseph Atherley crossed the floor from the BLP, became the leader of the Opposition and formed his own party, the People’s Democratic Party (PDP). Mr. Atherley’s crossing the floor of the House of Assembly was not a solution, it was just respite. The administration ignored this, and the situation has presented itself again.

What decisions will the President of the Republic make?

The President’s authority rests in the Constitution. She can extend an offer to any of the candidates who took part in the General Election to oppose the government since the Constitution does not recognize political parties. However, if she does this the system remains unchallenged. The Senators will be unable to halt the amendment or passage of any legislation which they deem unsuitable or in the best interest of Barbadians.

The question one must ask is if the President can challenge the system by not siding with the BLP or the Opposition and if she can send the electorate back to the polls. The grounds for this being that the General Election held on January 19th, 2022, was neither free nor fair. The following must occur if the President has the authority and chooses to send the electorate back to the polls.

  1. A suitable time frame must be provided that allows the Electoral and Boundaries Commission (EBC) to get its act together to ensure that persons are not disenfranchised.
  2. Provisions be made for persons in isolation and quarantine to vote.
  3. Options be provided for voting such as by mail or online or other means to facilitate those who do not wish to attend a polling station during the pandemic.

In addition, a Referendum be held at the time of the General Elections to implement the Proportional Representation System in the House of Assembly as the best solution to the current constitutional crisis. One may ask, why such a system? The answer is that it will truly allow representation for all the votes cast by the people of Barbados, it allows for inclusion of all political parties and Independents in the Parliament if they meet a certain threshold of votes (1%).

Senators must also be elected. It should not be a privilege to sit in the Senate, it must be a right by achievement.

We also need a monitoring system enacted into law that prevents wealthy campaign financers from determining what happens and what will never happen in Barbados.

    The constitution….DRAFTED in WHITEHALL by some civil servant at the behest of colonials PRIOR to 1966….HAS ALWAYS BEEN FLAWED….as designed…

    so therefore EVERYTHING coming from or attached to it, will be flawed, it was not meant to benefit whom it was written for…AND NEVER HAVE….after accepting it, the parliament rats made sure of that…and are making absolutely sure in remains in Afrikan lives…when it should not be EVER AGAIN..

    The question to be asked what is the delay
    After all taxpayers money should not be treated as willy nilly
    There is much work to be done by those who have been elected and a transparent govt is necessary in a democracy

    But then sometimes an omnipotent blue guy sits at a table and makes an egg appear out of thin air to prove to a woman he loves that he has the ability to create life.

    Given their fragility, their purity, and the potential they contain, eggs are a long-established metaphor for life. Plus, they’re essential to the philosophical question of which came first, the chicken or the egg — the sort of fascinating paradox that defies actual answers.

    Fascinating paradoxes that defy actual answers are a Damon Lindelof storytelling staple, so it makes sense that eggs have been a key part of Watchmen’s iconography since the first episode, often in a not particularly subtle way. But the degree to which they matter as a metaphor, especially for the revelations of the finale, “See How They Fly,” means it’s worth examining just how they’ve been used over the season, whether as a seemingly random reference, a casual snack, or a literally life-changing gift.

    Episode 1: “It’s Summer and We’re Running Out of Ice”
    In her first scene of the series, Angela separates egg whites from yolks in her demonstration to Topher’s class, tying in to her cover story as a local baker. Here, by the way, is what she says as she shows off her water-bottle vacuum trick:

    “Egg whites are made of protein. When we whip them, we get bubbles, and it’s the proteins that form the walls of those bubbles. If we don’t have walls, it all comes tumbling down. Now, those walls are strong, but they won’t stay that way if just even a little bit of yolk gets mixed in with the whites. So that’s why we gotta separate them.”

    It’s both accurate when it comes to the culinary sciences and a curious note to include in a story about white supremacy. The yolks, of course, also invoke a smiley face (dabbed with a touch of red), similar to the iconic button featured in the opening panels of the Watchmen graphic novel.

    Episode 2: “Martial Feats of Comanche Horsemanship”
    Just how much Will Reeves knows about everything is one of the finale’s big unanswered questions, but of all the things he chooses to cook while waiting for Angela to return to her bakery, he picks hard-boiled eggs, even deliberately going out to the grocery store to buy them. (He’s also kind of a sloppy eater and tosses the peels on the counter for Angela to clean up later.)

    Note, of course, the episode’s closing music: the Beastie Boys’ “Egg Man.”

    Episode 3: “She Was Killed by Space Junk”
    Eggs only get a mention in dialogue this episode, in the joke Laurie tells Doctor Manhattan about the “three heroes” who are trying to get into heaven. Clearly describing Adrian Veidt’s scheme to save the world by killing 3 million people, Laurie imagines Adrian telling God, “You can’t make an omelette without breaking a couple of eggs.”

    Episode 4: “If You Don’t Like My Story, Write Your Own”
    The opening titles of this episode evoke the sound and image of an egg being broken open, followed by the letters of Watchmen spelled out in bright yellow yolk. And then we meet the Clarks, a nice Tulsa couple living quietly on their farm, selling eggs at a roadside stand during the day and doing jigsaw puzzles at night.

    The most important eggs in their lives, though, aren’t the ones they sell — they’re Mrs. Clark’s harvested ova, which were collected by a fertility clinic years ago when the couple attempted to conceive a child. When Lady Trieu arrives to buy their farm, she comes with more than cash to use as leverage; she has successfully conceived a child with their genetic material. In exchange for the baby and $5 million, the Clarks agree to sell.

    Also, when Will got airlifted away from Angela, he left behind a mess in the bakery, and what happens to the rest of the eggs he purchased is never addressed. They aren’t the same eggs Angela and Cal use the next morning to make waffles for the kids: If you compare the containers, you can see that Will’s carton is yellow cardboard (and there are only six left), while the Abars’ eggs are in a shiny Styrofoam container that appears to hold 18 eggs, not 12 — which feels right when shopping for a family of five and may also have bigger significance down the line.

    Episode 8: “A God Walks Into Abar”
    Watchmen took a three-episode break from making obvious egg references, perhaps because the writers knew just how big a deal eggs would be in the final two installments.

    The most important moment of episode eight is, of course, when Doctor Manhattan creates an egg out of thin air to prove to Angela his ability to create life, though it doesn’t exactly impress her: “A chicken would have been better.”

    He then explains that he would never pass along his abilities to someone else without their consent, but he could, in theory, transfer his “atomic components into some sort of organic material. If someone were to consume it, they would inherit my powers.”

    Angela asks him to clarify. “So you can put them in this egg, and if I ate it, I could walk on water?”

    “Theoretically, yes.”

    It’s a clear foreshadowing of the finale, but it’s also not the last time eggs come up in “A God Walks Into Abar.” The literal invocation of the chicken-or-egg paradox frames the death of Judd Crawford: Will killed Judd because Doctor Manhattan told him about Judd’s Cyclops connections 10 years ago, but Doctor Manhattan mentioned these connections back then only because Angela asks him to ask in the present.

    “Which came first, the chicken or the egg? The answer appears to be both, at exactly the same time,” Doctor Manhattan concludes, before realizing he’s hungry and transporting himself to the kitchen to make waffles. It’s here that a frustrated Angela smashes the levitating carton of eggs to the ground (which of course will become even more important in the finale).

    For the record, the carton that appears here is not the same one Cal and Angela were cooking with in episode four, as the label clearly says it contains a dozen eggs, and it also appears to be a cardboard carton, not Styrofoam.

    This could mean it’s the same carton of eggs Will left behind at Angela’s bakery; how it got from there to the Abar house is unknown, but there are countless answers. Or, hell, maybe Cal went to the grocery store that morning. Who can say for sure?

    Episode 9: “See How They Fly”
    So much of Lady Trieu’s aesthetic, in both her wardrobe and production design, has evoked eggs (especially the emphasis on shades of white). And nothing exemplifies this more than the ship Trieu sends to pick up Adrian and deliver him back to Earth — it has a distinctly egg-like shape.

    But that, of course, is not the biggest egg-related event of the episode.
    When, at the very end, Angela goes to clean up the broken eggs in her kitchen, she discovers one of them is intact. Perhaps a parting gift from her lover of ten years? Perhaps just a fluke?

    Whatever it may be, she can’t forget what Manhattan told her 10 years before, so she goes out to the pool, slurps down the egg, and tentatively extends a foot down to the water. At which point, cut to black.

    The closing-credits song is a cover of “I Am the Walrus,” by Spooky Tooth and Mike Harrison. Beyond the lyric used in the episode’s title, the song contains, of course, the famous line “I am the egg man,” which is one of those classic Beatles references with plenty of interpretations that defy exact definition. That in itself fits nicely into any attempts to understand what, exactly, is going on with Watchmen and the eggs. They are there, and on one level they clearly mean something. But some questions, egg-related or otherwise, will likely always defy explanation.

    Until the Leader of the Opposition (not the DLP!!) nominates 2 senators for the GG/President to appoint, there is no senate, no parliament and hence no Government to choose a temporary senator!!

    The BLP has to do the choosing of the Temporary Senator, not the Government!!

    There is no Leader of the Opposition and no way of forming a Government in a Parliamentary Democracy.

    A natural consequence of the 30 – 0 result!!!

    Another way of looking at it is to realise that:

    A) it takes 4 people to nominate a candidate to run for the seat the eventual leader of the opposition gets.

    B) It takes 2 members of the opposition in the HOA to nominate and second the eventual leader of the opposition

    C) Only when the Leader of the opposition is finally named by the GG can he/she act alone and indicate to the GG/President who are his/her choices of senators.

    When he/she finally appears before the GG/President with the authority on his/her own to name those two senators, he/she MUST have the support of 7 individuals – 4 to nominate him/her to run for a seat, 2 to choose him/her as the Leader of the opposition, 1 to make him/her the Leader of the opposition.

    Reverent Joe clearly bypassed the two opposition members of the HOA required to choose him.

    He chose himself as leader of the opposition and the GG employed her discretion to allow him to bypass the 2 members of the HOA who did not exist.

    The GG at the time need only have told Reverent Joe to go and come back with evidence of a proposer and seconder who were members of the HOA, because she can’t do anything until he showed her that.

    She used her “discretion” to by pass the Constitution in 2018 and we wound up with an unconstitutional Government.

    I don’t recall any lawyer speaking up back then.

    Even Caswell was silent!!

    Sad.

    he is telling it EXACTLY as it is, that’s why the island is SO CORRUPT….no one displays independent thought or bucks the criminality or speaks out against human rights abuses, or violations of protocols or non adherence to legislations in place to protect, just follow the corrupt while enabling and condoning EVERY CRIME they commit…nod in agreement to every NEGATIVE thing they say and do no matter how HEINOUS and then ATTACK the people who speak out…we see it right here and BU…anything to keep the slavery status quo in place, their comfort zone…

    that’s why they are all now at the POINT OF NO RETURN..and cannot see themselves…

    It may very well be, but for the moment it is in the same position as Garth Patterson and Trisha White, and indeed Wickham himself!!


  15. The blogmaster posted blogs and comments in 2018 about a contrived opposition and of interest the appointments of Drakes and Franklyn who were known not to be interested in being politicians. All of a sudden we have everybody throwing hands in the air. Always we prefer to kick the van down the road. Even Jeff Cumberbatch when he was with us authored a few pieces on the matter.

    I am with you on the abolition of the Senate.

    As for participation in the HoA, I think the involvement of the really relevant group is redundant. Our honourable businessmen have been controlling the politicians and therefore the masses since 1966. Mark Maloney can do whatever he wants.

    Therefore, I continue to support our Supreme Leader because she maintains the hegemony of the business community and puts the masses to sleep with the opium of the New Republic. Politics and business have never been better connected than now.

    This is the only way to transform our classical tropical socialism into a free market economy under the supervision of international financial capitalism. Democratic, free one-party state, capitalism and liberalisation of all areas of society go hand in hand. Just like in Chile under the legendary reformer Augusto Pinochet.

    As I said , we ought to be very afraid of those, who are trying very hard to deflect any criticism of the PM.
    I recall , when Barrow wanted , and in some cases succeeded , in making changes to the Constitution., he was berated by both supporters and opponents.
    We crowded into the Cathedral, almost every Sunday; every radio station on full blast , hearing Dean Crichlow taking turn after turn in Barrow. But today , to even misspell Mottley’s name is considered an act of political treason!
    The funny thing is that Barrow, never behaved like Mottley because he often made it clear , that he had the two third majority to do so, as Mottley certainly does, but he never said he consulted his AG and was told that he can effect change and was right, when he knew that the only way to get what he wanted was by changing the constitution.
    Mottley twice decided , to make an offer which she could not
    On this same BU we castigated Stuart and Company. We have insisted that the DLP must repent and apologize tor wrecking the economy. We have on two occasions determined that the DLP should not get a damn seat.
    But, when the PM entertained , on speaker phone, a citizen known to the courts, and interfered with the police carrying out their duties, we came here and defended, what was a brazen act of Prime Ministerial abuse of power
    This debate/ discussion , has more than put me on further guard and I see a very sinister political catastrophe coming our way.
    You are more than correct about Peter Wickham,; on a radio station, literally saying that Tricia Watson and Garth Patterson are lawyers and they can give lectures but the DLP should take the two senate seats. Imagine even after it was explained and exposed that Mottley could not give anything , he still berated the DLP . In other words, he now apparently believes that the Constitution does not matter. A view that is quite consistent , with some very frightening opinions here on BU.
    We don’t want to say that Mottley is more than wrong; we don’t want to say that
    its almost impossible , to believe that an AG, even one as piss poor as Marshall , does not understand the Constitution.
    I recall , when Mascoll , after cussing Arthur’s economic policy for twenty years and after bringing a No Confidence motion against the same Arthur and Company crossed the floor.
    A reporter , asked Mascoll, what he intends to do, now that he had joined Arthur. Mascoll said: “anything”the PM asks me to do.
    A man asked me if I thought that Mascoll and Arthur will “work out.” I said that I only hoped Arthur does not ask Mascoll to poison our water supply.

    The only matter of import is the post of the Leader of the Opposition.

    Everything falls into place once this is solved.

    It is all in the Constitution.

    Either there is a negotiated settlement of some sort or back to the polls … until there are a minimum of 3 seats constituting the opposition.

    There are no opposition benches and no floors to cross because there is no Parliament.

    The Senate is comprised of 21 citizens but on what basis of law is it founded that 17 cannot ‘constitute’ the chamber?

    A quorum is eight … although 21 is the designated allotment I am unclear why the body cannot be initiated and empanelled for duty with 17!

    (4) If, in the judgment of the Governor-General, the Leader of the Opposition no longer is able to command the support of
    a majority of those members of the House of Assembly who do not support the Government, or, as the case may be, the
    support of the largest single group of such members who are prepared to support one leader, the Governor-General may
    revoke the appointment of the Leader of the Opposition.

    (5) In the exercise of his functions under this section the Governor-General shall act in his discretion:

    Provided that, except during any period such as is mentioned in subsection (3) (a), if the Governor-General considers that it is doubtful whether a person commands such support as is mentioned in subsection (2) he shall, in determining the
    question, act in accordance with the advice of the Speaker.

    You misunderstand the true balance of power. The President is merely the herald and notary of the will of our Supreme Leader.

    All roads lead to our Supreme Leader. All decisions originate in her. Her power is absolute. She towers over the legislature, the judiciary, the administration, the security service and the police. No other power is equal to her.

    i suspect that’s what THEY HAVE ALL BEEN DONG, the people’s memories are TOO SHORT for certain things for the last half century, unable to put their situations into perspective…and it’s not normal/natural…and only tampering with the water or food supply could produce such negative results of memory loss and other strange occurrences….won’t trust any of them as far as i can throw them..

    The man who introduced Crystal Drakes to the Senate as a member of the Opposition has absolutely no problem with her now being named an Independent Senator.

    Former Opposition Leader, Bishop Joseph Atherley is in full support of Drake’s appointment to the Upper House and has described her as one of the island’s “brightest stars” who he believes has a significant contribution to make.

    Senator Drakes was sworn in by President Dame Sandra Mason as an Independent Senator on Tuesday.

    Back in 2018, Bishop Atherley in his position as Opposition Leader nominated Drakes and Caswell Franklyn as his two nominees for the Senate.

    And when he formed the now defunct People’s Party for Democracy and Development (PdP), Drakes joined the party.

    In an interview with Barbados TODAY, Bishop Atherley said Senator Drakes was well-suited for the job as an Independent Senator having done a fantastic job as an Opposition Senator during the last three and a half years and he expected her to continue in that same vein.

    “I think Senator Drakes is a marvelous pick by the President. She is a bright, young girl with a genuine interest in the betterment of Barbados and Barbadian people. She is progressive in her thinking and has some good ideas with respect to issues of the economy and growth but also with respect to issues of climate change resilience building and wider environmental issues. She has served in the Senate for the last three and a half years having been appointed by myself and she gave a very good account of herself,” Bishop Atherley said.

    “…It does not surprise me therefore that Her Excellency would choose her as one of the Independent Senators at all.

    “Certainly there are no hard feelings. I admire the girl and I wish her well and I think that she will make an invaluable contribution to public and parliamentary debate in Barbados and in a wider frame to policy development in Barbados, so there can’t be any hard feelings because I don’t look at that like that at all.

    “When I appointed Crystal and Caswell at the time there was no political party of which I was a part. I appointed them when I crossed the floor and I never became part of any formation of a political party until a year later and they would long have been appointed…As for Crystal she was a part of the PdP but she was never interested in the elective political arena or anything like that and she always presented herself within the group as fairly apolitical,” Atherley said.

    There is uncertainty about the ability of this country’s Parliament to begin carrying out the affairs of the state, without all 21 senators referenced in Barbados’ Constitution appointed and in place.

    On Wednesday, Dame Sandra appointed seven independent senators to join the 11 senators selected by Prime Minister Mia Mottley, leaving three controversial senate seats still vacant. They are the two opposition seats, which cannot be nominated according to custom without a sitting opposition leader and an outstanding government seat which the Mottley-Government has indicated, has been reserved for 18-year-old Khaleel Kothdiwala.

    Nevertheless, constitutional law expert Garth Patterson Q.C. sees nothing unusual about Dame Sandra’s delay in naming two opposition senators.

    He maintains that the president has total discretion to appoint them, but believes the process may require a more measured approach that includes consultation with various political parties.

    “She is not obliged to act on the advice of any of those persons,” Patterson told Barbados TODAY.

    “There is nothing that precludes her from seeking out the advice of others and it doesn’t have to be a political party or a politician. She could take her advice from whichever sources she feels are appropriate, that will uphold the constitutional function that she has to perform and honour the spirit of the constitution.

    “So it may be that she is taking the time to deliberate on the matter before announcing her selection, but there is no mystery. It is her job, it is her discretion, it is her function under the Constitution and she has to exercise it and she will in due course,” the Queen’s Counsel added.

    In the meantime, Patterson is adamant that the Senate cannot meet until the process of appointments is completed, potentially delaying the business of the two houses of Parliament.

    “The Constitution says there shall be a senate consisting of 21 senators. So until you have 21 senators, you don’t have a Senate,” said Patterson.

    “The Constitution doesn’t specify a timeline for [the President] to do it, but presumably to ensure that the business of the country is conducted in regular order, she will perform that function in the very near future.”

    But he added that even if the President nominates the two opposition senators, PM Mottley is yet to nominate one more senator. According to Patterson, the nominee cannot be 18-year-old Khaleel Kothdiwala, who, though touted by the Prime Minister is too young, according to the law of the land.

    “The Prime Minister has to nominate a 12th person for the senate to be constituted. I have no doubt that they will do so, because the same amendment that is called for to allow an 18-year old to sit in the Senate, that amendment cannot occur unless the Senate is constituted to be able to pass the law amending the constitution,” said Patterson.

    “It’s a chicken and egg situation. You want to put in an 18-year-old, but you have to amend the Constitution to do so, but to amend the constitution, you need to appoint 21 senators,” he reiterated.

    Meanwhile, veteran pollster and political analyst, Peter Wickham, is not convinced that the President has the power to independently choose the opposition senators.

    He described the period as a constitutional disagreement regarding the choice of Opposition Senators where the BLP’s lawyers believe a constitutional amendment is necessary while the DLP believes the power rests solely with the president.

    As such, Wickham favours Prime Minister Mia Mottley’s invitation for a meeting with the Democratic Labour Party to discuss the way forward.

    “While the Garth Patterson and Trisha Watson argument is compelling, the fact of the matter is that neither of them is in government currently and I think that we have to follow the inclination of the government in this matter and wait until such time as the parties meet,” said Wickham.

    “This leaves us in a interesting situation where the DLP is saying that they are not meeting with the Prime Minister to decide on anything because the president is the one who has to advise. And, the Prime Minister is basically saying that they need to advise the President based on a meeting and conversation that they will have and I think it may come to a situation where the two seats are taken up by whichever opposition parties are willing to come forward,” the pollster added.

    Wickham said it was even more unclear whether either of the Houses can meet without all senators being appointed.

    “But on the other hand, one can argue that Parliament is fully constituted because all of the principal advice makers have met and offered their advice, so then they can go about and do their business because it is fully constituted,” said Wickham.

    The post of Leader of Op can ONLY exist based on the results of the election… the constitution SPECIFICALLY provides for the possibility of NO SUCH person. ….To continually cite the clauses where it seeks the guidance of that person and dismiss the obvious fact that there is NONE and thus overlook those clauses that guide action when that person does not exist is absurd nonsense.

    That’s the behaviour of a ideological zealot not a rational free thinking intellectual ‘boss’.

    The BWU is represented in the Lower House. There is no need for representation in the Upper House as well. The President was also correct, in naming a representative to represent the business sector. This is very much in keeping with tradition.
    Furthermore, I don’t see any evidence that the President is favoring the government. She is merely taking time, to make decisions that we expect as citizens , that will find support and respect.
    And let me remind you again,; we do not recognize anything called proportional representation , and the President is not obligated , to appoint two DLP senators on the spurious reason that it got the second highest number of votes. That nonsense was put in the public domain by the PM. It is the root cause of all the crap with which we are now confronted.
