General Elections were held in Barbados on January 19th, 2022, and the ruling Administration the Barbados Labour Party (BLP) came away with a resounding victory capturing all 30 seats, leaving all the other opposition parties with zero. Today, 14 days after, now that the dust has settled, it is clear that despite this achievement, the government of Barbados is fighting for power.

The fight relates to the fact that Parliament cannot be seated as the Upper House or the Senate is not constituted. The winning party is like a ship without its rudder as it cannot steer or maneuver at sea. It is in limbo and at the mercy of the waves if caught in a storm. Without Parliament being fully constituted, the administration is unable to amend any law far less create new ones and start its agenda.

Based on the Constitution, two Opposition Senators are required in the make-up of the constituted Senate. Since no members of the opposing parties won any seats, it is left to the President based on the Constitution to act as the Leader of the Opposition and appoint 2 persons who opposed the BLP in the General Election.

The ruling Administration extended an offer to the Democratic Labour Party (DLP) which gained the second most votes to seat two of their Senators. The DLP refused stating that it was not a proper offer since the Prime Minister had no authority to extend the offer. Then the Attorney General walked back on the offer stating that the prime Minister was only seeking to facilitate their entry into Parliament and stating that there must be a meeting with the ruling Administration, the President and the DLP. At writing the DLP has not responded.

Is the Barbados Labour Party in Control?

Clearly the BLP wants to get on with its agenda which perhaps contains vaccine mandates, safe zones, IMF conditionalities and now the contentious issue of seating an 18-year-old in the Senate (even though they had previously opposed seating a 25 year old DLP Senator stating that he was too young). All these are now problematic due to the crisis of there not being a fully constituted Senate. In essence the government is operating in a system that they cannot control the outcome. At present it is powerless except for day-to-day administration. It makes one wonder how long the island can operate without a functioning Parliament. Perhaps there is some pressure based on a commitment to external forces that caused an offer to be extended to the DLP.

Does the Power lie in the Hands of the Democratic Labour Party?

Though it may seem a simple act of benevolence, the offer that was extended to the DLP cannot be construed as such. It was simply to use them to achieve the government’s agenda as the DLP simply will not have the numbers to halt any amendment or passing of a bill into law.

It is significant to note that accepting that offer would also set a precedent to exclude smaller parties from the House of Assembly at this time since they may not be the holder of the second highest tally of votes.

However, it is not only the DLP that has the power of choice; all the opposition parties and independent persons who took part in the General Elections have the same power of choice in deciding whether to accept an offer from the President simply because the Constitution does not recognize political parties, only people. If the opposition parties and independents signed an agreement to reject any such offer, the ship is rendered helpless, forced out to sea, or slammed into the rocks by the mighty waves. Clearly, the back of this Administration is against the wall.

Just selecting two Senators will not resolve this constitutional crisis. It is like prolonging agony not just kicking the ball down the road for someone else to correct later.

The System

The system controlled and manipulated Electoral and Boundaries Commission (EBC) based its decision to disenfranchise thousands of Barbadians and blamed it on the State of Emergency Protocols. This is unacceptable as the protocols were easily amended to suit tourists and celebrations for the Republic. It must be noted that the EBC did not disenfranchise its workers, some of whom must have been infected and spreaders of the virus because a few days later it had to close its office.

When the Attorney General lashed out at the DLP to stop playing politics, it came to light that he did not realize that the fight is not against them but against the voracious beast of a system whose actions his own party has taken to a whole new level by paying social media influencers from the public purse, by obtaining campaign funds from local and international financers as well as maintaining a Department of Communications while the Government Information Service still exists.

The system has now taken on a life of its own and as the song by Jah Cure says, “Babylon can’t feed this beast” and there is no mechanism in place to control it. The system is now working in overdrive to maintain the 2 Barbadoses’. One with the rich man in his castle and the poor man destined to remain at his gate. One in which the tourist sees a paradise and the workers go home to pull back the curtain to show the stark reality of their lives. One in which economic enfranchisement will never be given to the poor. The Poverty Alleviation Fund remains empty, yet government can hold a lavish celebration for a meaningless Republic. The system has made sure that justice is not for the poor. That poor black men are paraded like animals and incarcerated for a spliff like the inhumane conditions of slavery.

From independence, the system has made a mockery of the franchise with use of bribery through giving corn beef and biscuits to the gullible in exchange for their votes. The bribery has not stopped, the vote is now exchange for far more valuable items.

The system has also turned political campaign meetings into lavish parties with big stages and sound systems and bright lights to entice the youth to have a grand time as they listen to popular artistes. Those feel-good moments lead to a five-year sentence of hardship including lack of representation, high prices of food, constant increases in the cost of gasoline, lack of infrastructural development, lack of opportunities, no jobs and the desires for a better life come to naught.

The privileged few can escape the island for supposedly greener pastures, but the majority have no choice but to remain and face this hard brutish existence, yet they revere politicians more than themselves. The cycle of economic poverty for the lower class is perpetrated by political parties. They pay back their campaign financers with big contracts and titles, but they only provide scraps and promises to the people who elected them.

The actions of this system, expressed in the words of Bob Marley is “Babylon system is a vampire, sucking the blood of the sufferers.” The pervasive corrupt practices that start by ensuring that a party dominates the first pass the post Westminster System has been to the detriment of the social and economic life of ordinary Barbadians.

We must kill this beast. It has outlived its usefulness. But perhaps, the system is turning on itself, decaying from within, just like the Roman Empire and we can no longer choose to ignore this fact. On two consecutive occasions it has produced a winner without power. On the first occasion Mr. Joseph Atherley crossed the floor from the BLP, became the leader of the Opposition and formed his own party, the People’s Democratic Party (PDP). Mr. Atherley’s crossing the floor of the House of Assembly was not a solution, it was just respite. The administration ignored this, and the situation has presented itself again.

What decisions will the President of the Republic make?

The President’s authority rests in the Constitution. She can extend an offer to any of the candidates who took part in the General Election to oppose the government since the Constitution does not recognize political parties. However, if she does this the system remains unchallenged. The Senators will be unable to halt the amendment or passage of any legislation which they deem unsuitable or in the best interest of Barbadians.

The question one must ask is if the President can challenge the system by not siding with the BLP or the Opposition and if she can send the electorate back to the polls. The grounds for this being that the General Election held on January 19th, 2022, was neither free nor fair. The following must occur if the President has the authority and chooses to send the electorate back to the polls.

  1. A suitable time frame must be provided that allows the Electoral and Boundaries Commission (EBC) to get its act together to ensure that persons are not disenfranchised.
  2. Provisions be made for persons in isolation and quarantine to vote.
  3. Options be provided for voting such as by mail or online or other means to facilitate those who do not wish to attend a polling station during the pandemic.

In addition, a Referendum be held at the time of the General Elections to implement the Proportional Representation System in the House of Assembly as the best solution to the current constitutional crisis. One may ask, why such a system? The answer is that it will truly allow representation for all the votes cast by the people of Barbados, it allows for inclusion of all political parties and Independents in the Parliament if they meet a certain threshold of votes (1%).

Senators must also be elected. It should not be a privilege to sit in the Senate, it must be a right by achievement.

We also need a monitoring system enacted into law that prevents wealthy campaign financers from determining what happens and what will never happen in Barbados.

    WITH NO OPPOSITION SEATS in the House of Assembly or Senate, some Independent senators sworn in yesterday say while they are fully aware the public will be looking to them as alternative voices in Parliament, they will not be opposing just for the sake of doing so.
    The seven senators selected by President The Most Honourable Dame Sandra Mason were sworn in by her in a brief ceremony at State House, Government Hill, St Michael. The addition of former Opposition Senator Crystal Drakes was one of two changes from the 2018 allotment of the President (then Governor General), with the second being businessman Andrew Mallalieu. They replace Julian Hunte and Althea Wiggins.
    The five returning Independent senators are Kevin Boyce, Dr Christopher Maynard, Lindell Nurse, Reverend Dr John Rogers and Monique Taitt.
    Critical analysis
    Following the brief ceremony, Drakes, who previously represented the Bishop Joseph Atherley-led People’s Party for Democracy and Development, told the MIDWEEK NATION that she will be non-partisan in her assessment of Government’s measures, but she intends to apply the same level of critical analysis as when she was on the Opposition bench. The economist added she was especially looking forward to contributing on issues pertaining to Barbados’ economic development.
    “I think we found ourselves in a similar situation to what happened after the election in 2018 and the Senate will once again have to become the checks and balances on Government again. My premise is that regardless of where you sit in the Senate, we have to really look at the country and take the concerns and the needs of the Barbadian public first and then make our decision,” said Drakes.
    “I have always tried to be as impartial as possible and a lot of contributions which I would have made in the past have always been to the betterment of Barbados. So, in terms of policy decisions, I will always have that critical analysis in terms of providing solutions, expanding on anything that needs critiquing, but I assure you that I would serve in the most independent way possible. Given my background in academia, this should be a natural fit for me because I was never one to be truly partisan; this is a purely nonpartisan job.”
    Boyce said while Government, with its overwhelming mandate from the people of Barbados, had a right to set its policy, it was the duty of the Independent senators to assess it objectively.
    “The role is one which was enshrined in the Constitution from its first iteration; it obviously was contemplated by the framers. It is less about checks and balances and more about an opportunity to add a different perspective to any dialogue,” said Boyce, adding he was keen to have discussions on the new Constitution that will guide the republic.
    Rogers, rector of St George Parish Church, said he plans to assist
    the Government in policies that redound to the betterment of Barbadians, but will be equally critical of those which will not benefit the people.
    “My role will be very much the same – to be independent, to assist the Government where possible in policies that are for the betterment of the people, and to critique where I feel that critique is necessary and people are being disenfranchised . . . .
    Get involved
    “I look forward to the consultations on the republic . . . . This is not just the duty of the parliamentarians but for all Barbadians to state what they feel is necessary,” he added.
    Addressing the senators immediately after the swearing-in, Dame Sandra impressed upon them the importance of staying true to the precepts of being an independent legislator.
    “I want to say a sincere thank you to the ones who are returning for again agreeing to give Barbados the valiant service that you have given for the past three years or so. I expect that you would continue in the mode in which you have fashioned being an Independent senator for the past few years. To the two new senators, I want you to fully understand what independence means, not only in reference to independent Barbados but independence in giving of service to Barbados,” she said.
    “I do not know what political party to which you belong or for which you voted, but I want to get your full acceptance and understanding that you are serving the people of Barbados and you would do that in a real independent fashion. I do not want to have anybody who is going to feel that their independence is going to be in any way tarnished, although I don’t expect that it will be.”

    The beauty of proportional representation is that it could eliminate the possibility of the farcical 30 – 0 result.

    Financiers would have to realise that it is possible to watch their money being blown when the final apportionment of seats is made.

    Let’s say the 30 – 0 result was purchased.

    Proportional representation would remove 9 or 10 seats and allocate them to the opposition.

    30 – 0 would become 20 -10 at the twinkling of an eye.

    The 10 weakest Bee wins would end up going to the 10 strongest Dee performers … or any other party able to win enough votes.

    We therefore urgently need a constitutional amendment by emergency decree of our Supreme Leader abolishing the Senate and punishing the opposition.

She will then call two by elections and the faithful DLP stalwarts in those constituencies will fill the places.

    a. act in his discretion in the exercise of any function in respect of which it is provided in this Constitution that the Governor General shall act in accordance with the advice of the Leader of the Opposition; and

    b. act on the recommendation of the Prime Minister in the exercise of any function in respect of which it is provided in this Constitution that the Governor General shall act on the recommendation of the Prime Minister after consultation with the Leader of the Opposition.

    I said on this very BU that you had maintained that same honest style of writing,which you used in going after the DLP.
    This is a remarkable piece of writing ,littered with facts that cannot be questioned by the pathetic apologists , who come here every day, some who want to be prosecutors ,and will go so far as to suggest that a constitution is irrelevant.
    A Constitution can be as flawed as Ms. Brathwaite’s ackee tree , that is bent almost from the roots, but it produces fruit. The fruit is the issue not the imperfect looking tree.
    You said , in your article , that this same BLP’s twin sibling, the DLP., put or wanted to place a young man of 25 years old , in the senate. This was opposed by the BLP.
    Today, the BLP. for pure political grandstanding, once more designed as magnanimity toward the youth, wants to fool us that a young man is going there to represent the youth, when in fact it is nothing more than giving an articulate , young , impressive member , supporter or follower of the BLP , a reward for his brilliant defense of all things BLP.
    I have never forgotten, back in 1991, at a meeting of the NDP, Richie Haynes said that anything “hatched” in iniquity must eventually fall or it will tend to destroy everything around it and then itself. I do not often quote Haynes , and certainly., he was never any political idol of mine, but I have not forgotten that reference in the speech.
    This entire embarrassing episode was hatched in iniquity by the PM. She deliberately attempted to circumnavigate the Constitution by pretending that she was being considerate and magnanimous. Her followers fell for it hook , line and sinker.
    We note that the President reappointed or reselected almost all her previous seven. She also reappointed , a senator who was sent there by the magical former Opposition Leader and his almost mystical political party.
    The President,in my humble estimation, was sending the message that the just concluded general election, was really an intermission , once more contrived by a Prime Minister, who thought that an election , in a pandemic with a wholly unprepared EBC, as far as conducting one in a pandemic is concerned, was more important than protecting the lives of the citizens of our country.
    Deny it however they wish, the surge in the numbers of people now contracting the virus, is a result of that election; the cricket series at Kensington along with other missteps in dealing with the pandemic.
    I still maintain that the overall effort with the pandemic , by the administration is more than commendable, but it’s obvious ,that in recent times politics and the struggles within the economy contributed to these missteps.
    The beast of the Duopoly is feeding on itself and I politically pity and not disdain , those who continue to support political iniquity because in their minds , all that matters ,are political victories and elevating mere mortals to political gods.
    The picture of them in Bay Street and Independence Square tells a very poignant story. One step, maybe a half step , from what Jim Jones did in Guyana to those whose minds have been taken over by the mortals we make gods.
    This piece ,in my humble opinion, is one for the ages, when it comes to social /politicalcommentary in our beloved country.
    If this blog lasts for a thousand years, in my opinion, it will go down in the history of BU, as perhaps the best political commentary ever written or at the very least one of the best.
    If we have never to given @David credit for giving all who come here, myself included, the opportunity to air our views, we must certainly thank him today.Thank you David.

    If you read Section 75 carefully you ought to note that the President (formerly GG) does have the overarching authority to ‘act’ accordingly in lieu of any ‘vacancy’ for the post or absence of the Leader of the Opposition.

    This hiatus in the Senate can be easily resolved by appointing Lynette Eastmond and Caswell Franklyn and Bob’s your uncle.

    This move should allow the DLP to lick it wounds with purposeful contriteness which did not take place when there were NO senators in the Senate reflecting that party’s parliamentary presence except, of course, Ms Taitt appointed as an Independent voice of the People.

    The first holder of the post of the Leader of the Opposition is selected by atleast 3 members of the House of Assembly.

    There are none qualified to do the deed.

    What discretion could the GG possibly exercise to select anyone from 30 loyal BLP supporters who would fill the position of the leader of the opposition to any future BLP Government?

    The first step is for there to be a leader of the opposition!!

    Everything moves from there.

    In 2018, Reverent Joe stepped forward to aid and abet the BLP in its insurrection to void the Constitution.

    Going to the DLP to attempt to fill the positions of 2 senators when it is clear that the task is the Leader of the Opposition is a waste of time for any adult to consider and is insurrection against the constitution.

    Overall, an excellent piece of political analysis!

    If Barbadians want to continue to brag about its so-called Constitutional Democracy then they cannot treat the Law as a mere piece of paper and discard its requirements when it suits the political whims and fancies of some citizens when confronted by or with the inconvenient Truth.

    The Constitution is the Supreme Law of the Land and the embodiment of the Voice of the People until so amended!

    It is not the plaything of any PM, political party, president or even the misguided voices of any sections of the politically-brainwashed rabble.

    And that is precisely the gist of the argument! But not disregarded for mere political grandstanding as is being played out with the convening of the incoming Parliament.

    Any amendments must come from the bowels of the People talking through the mouths of their elected Parliamentary Representatives.

    In the meantime, respect and obey the Law as required by All citizens in the new republic.

    Substantively, there is too much noise about this issue of oppo senators …
    1) clearly there is no constitutional crisis on THAT as 2) what DIFFERENCE does 2 out of 21 make!

    The naming of these 2 senators is NOT an issue in a body that requires eight (8) of 21 for a quorum.

    I readily appreciate that our current circumstances shines a spotlight on the efficacy, role and non-elected status of Senators and that a healthy debate thereof is great. Further accept that the benefits of propotional representation can be discussed but as currently established the Senate has its quorum and business of governance can be initiated.

    This entire debate is fundamentally a logical and legal NONSENSE….. it is nothing other than a technical hiccup and will be resolved as promptly as is feasible.

    Why should we reward deficient and ineffective individuals with seats in the HofA simply for getting up and canvassing for a vote..
    WHY! They have been despatched by the people they sought to represent so to offer such rewards is a mockery of our will and desires.

    If we allowed that then there is nothing preventing well coordinated riff-raff group of extremists, nativists or whataboutists from having representation in a legislative body … how would that be to our benefit!

    Let’s carefully look at our elections and address any inherent flaws but we cannot force fix non-exsistant problems… a 30-0
    result is legitimate because the voters freely acted. Why are we trying to suppress that!

    It (all seats majority) was also legitimate in Jamaica and Grenada … they overcame the alleged constitutional crises … so will we!

    BTW.. why are folks like @AC quoting the constitution so subjectively… was sect 75(b) invalidated?? … To paraphrase: If there is no qualified LofO then the PM can make such recommendations to the GG (President) wherever it’s noted that said President would otherwise have sought the advice of the LofO.

    I agree . I am certainly out of my league, whenever I go near anything dealing with science.
    I am still trying to get pass what H2O means. Chemistry, Physics and Maths , did not like me from day one. Reached a fairly good level with primary school arithmetic and that was it.
