Your message to the BLOGMASTER was sent

General Elections were held in Barbados on January 19th, 2022, and the ruling Administration the Barbados Labour Party (BLP) came away with a resounding victory capturing all 30 seats, leaving all the other opposition parties with zero. Today, 14 days after, now that the dust has settled, it is clear that despite this achievement, the government of Barbados is fighting for power.

The fight relates to the fact that Parliament cannot be seated as the Upper House or the Senate is not constituted. The winning party is like a ship without its rudder as it cannot steer or maneuver at sea. It is in limbo and at the mercy of the waves if caught in a storm. Without Parliament being fully constituted, the administration is unable to amend any law far less create new ones and start its agenda.

Based on the Constitution, two Opposition Senators are required in the make-up of the constituted Senate. Since no members of the opposing parties won any seats, it is left to the President based on the Constitution to act as the Leader of the Opposition and appoint 2 persons who opposed the BLP in the General Election.

The ruling Administration extended an offer to the Democratic Labour Party (DLP) which gained the second most votes to seat two of their Senators. The DLP refused stating that it was not a proper offer since the Prime Minister had no authority to extend the offer. Then the Attorney General walked back on the offer stating that the prime Minister was only seeking to facilitate their entry into Parliament and stating that there must be a meeting with the ruling Administration, the President and the DLP. At writing the DLP has not responded.

Is the Barbados Labour Party in Control?

Clearly the BLP wants to get on with its agenda which perhaps contains vaccine mandates, safe zones, IMF conditionalities and now the contentious issue of seating an 18-year-old in the Senate (even though they had previously opposed seating a 25 year old DLP Senator stating that he was too young). All these are now problematic due to the crisis of there not being a fully constituted Senate. In essence the government is operating in a system that they cannot control the outcome. At present it is powerless except for day-to-day administration. It makes one wonder how long the island can operate without a functioning Parliament. Perhaps there is some pressure based on a commitment to external forces that caused an offer to be extended to the DLP.

Does the Power lie in the Hands of the Democratic Labour Party?

Though it may seem a simple act of benevolence, the offer that was extended to the DLP cannot be construed as such. It was simply to use them to achieve the governmentโ€™s agenda as the DLP simply will not have the numbers to halt any amendment or passing of a bill into law.

It is significant to note that accepting that offer would also set a precedent to exclude smaller parties from the House of Assembly at this time since they may not be the holder of the second highest tally of votes.

However, it is not only the DLP that has the power of choice; all the opposition parties and independent persons who took part in the General Elections have the same power of choice in deciding whether to accept an offer from the President simply because the Constitution does not recognize political parties, only people. If the opposition parties and independents signed an agreement to reject any such offer, the ship is rendered helpless, forced out to sea, or slammed into the rocks by the mighty waves. Clearly, the back of this Administration is against the wall.

Just selecting two Senators will not resolve this constitutional crisis. It is like prolonging agony not just kicking the ball down the road for someone else to correct later.

The System

The system controlled and manipulated Electoral and Boundaries Commission (EBC) based its decision to disenfranchise thousands of Barbadians and blamed it on the State of Emergency Protocols. This is unacceptable as the protocols were easily amended to suit tourists and celebrations for the Republic. It must be noted that the EBC did not disenfranchise its workers, some of whom must have been infected and spreaders of the virus because a few days later it had to close its office.

When the Attorney General lashed out at the DLP to stop playing politics, it came to light that he did not realize that the fight is not against them but against the voracious beast of a system whose actions his own party has taken to a whole new level by paying social media influencers from the public purse, by obtaining campaign funds from local and international financers as well as maintaining a Department of Communications while the Government Information Service still exists.

The system has now taken on a life of its own and as the song by Jah Cure says, โ€œBabylon canโ€™t feed this beastโ€ and there is no mechanism in place to control it. The system is now working in overdrive to maintain the 2 Barbadosesโ€™. One with the rich man in his castle and the poor man destined to remain at his gate. One in which the tourist sees a paradise and the workers go home to pull back the curtain to show the stark reality of their lives. One in which economic enfranchisement will never be given to the poor. The Poverty Alleviation Fund remains empty, yet government can hold a lavish celebration for a meaningless Republic. The system has made sure that justice is not for the poor. That poor black men are paraded like animals and incarcerated for a spliff like the inhumane conditions of slavery.

From independence, the system has made a mockery of the franchise with use of bribery through giving corn beef and biscuits to the gullible in exchange for their votes. The bribery has not stopped, the vote is now exchange for far more valuable items.

The system has also turned political campaign meetings into lavish parties with big stages and sound systems and bright lights to entice the youth to have a grand time as they listen to popular artistes. Those feel-good moments lead to a five-year sentence of hardship including lack of representation, high prices of food, constant increases in the cost of gasoline, lack of infrastructural development, lack of opportunities, no jobs and the desires for a better life come to naught.

The privileged few can escape the island for supposedly greener pastures, but the majority have no choice but to remain and face this hard brutish existence, yet they revere politicians more than themselves. The cycle of economic poverty for the lower class is perpetrated by political parties. They pay back their campaign financers with big contracts and titles, but they only provide scraps and promises to the people who elected them.

The actions of this system, expressed in the words of Bob Marley is โ€œBabylon system is a vampire, sucking the blood of the sufferers.โ€ The pervasive corrupt practices that start by ensuring that a party dominates the first pass the post Westminster System has been to the detriment of the social and economic life of ordinary Barbadians.

We must kill this beast. It has outlived its usefulness. But perhaps, the system is turning on itself, decaying from within, just like the Roman Empire and we can no longer choose to ignore this fact. On two consecutive occasions it has produced a winner without power. On the first occasion Mr. Joseph Atherley crossed the floor from the BLP, became the leader of the Opposition and formed his own party, the Peopleโ€™s Democratic Party (PDP). Mr. Atherleyโ€™s crossing the floor of the House of Assembly was not a solution, it was just respite. The administration ignored this, and the situation has presented itself again.

What decisions will the President of the Republic make?

The Presidentโ€™s authority rests in the Constitution. She can extend an offer to any of the candidates who took part in the General Election to oppose the government since the Constitution does not recognize political parties. However, if she does this the system remains unchallenged. The Senators will be unable to halt the amendment or passage of any legislation which they deem unsuitable or in the best interest of Barbadians.

The question one must ask is if the President can challenge the system by not siding with the BLP or the Opposition and if she can send the electorate back to the polls. The grounds for this being that the General Election held on January 19th, 2022, was neither free nor fair. The following must occur if the President has the authority and chooses to send the electorate back to the polls.

  1. A suitable time frame must be provided that allows the Electoral and Boundaries Commission (EBC) to get its act together to ensure that persons are not disenfranchised.
  2. Provisions be made for persons in isolation and quarantine to vote.
  3. Options be provided for voting such as by mail or online or other means to facilitate those who do not wish to attend a polling station during the pandemic.

In addition, a Referendum be held at the time of the General Elections to implement the Proportional Representation System in the House of Assembly as the best solution to the current constitutional crisis. One may ask, why such a system? The answer is that it will truly allow representation for all the votes cast by the people of Barbados, it allows for inclusion of all political parties and Independents in the Parliament if they meet a certain threshold of votes (1%).

Senators must also be elected. It should not be a privilege to sit in the Senate, it must be a right by achievement.

We also need a monitoring system enacted into law that prevents wealthy campaign financers from determining what happens and what will never happen in Barbados.

  10. If a PM feels Government does not have enough time left in a term to complete it’s primary missions then it can take a gamble and call an election which gives it a risk of exposure of losing.

    But, BLP were odds on favourites with ~80-90% chances of winning, with DLP expected to gain up to a handful of seats.

    But, DLP came out with their dicks swinging and got dropped and floored and lost with a big fat 0.

    @Heather, not sure which of the Dean’s work to which u refer but based on my earlier review of some of his
    BU archives I would say NO.

    In one of his essays he spoke of the Parliament being prorouged by its natural constitutional life i.e. 3 months beyond the five year term (as memory serves) WITHOUT an act by the PM to initiate elections. He opined that the GG (Pres) would have the legal power to herself dictate the election writ etc in such a case ….

    But that was NOT the case then and certainly not a few months ago.

    She would be WELL OUTSIDE her legal role to do as u suggest.

    of course I am NOT an attorney so that above means squat because of course one has to be an articled attornet at law to understand English when written as laws and statutes!

  17. To the issue at hand. What Jeff said is the only interpretation that makes sense. Otherwise the Constitution would be seriously flawed, not having provided for a entirely foreseeable event.

    And if it had not provided for such, it would have to be taken as a given.

    The people chose a government according to the law of the land.

    NOTHING can stop the government legitimately chosen by the people from taking their seats as authorised by the people!

    Certainly the fact that the people rejected opposing parties as an official opposition cannot negate the fact of the people having chosen a government.

    That sort of absurdity would certainly qualify us as a banana republic!

    The spirit of the law is a phrase that came to mind yesterday. Today I noticed that it popped up in a legal analysis.

    You nitpickers are wasting your time. A solution obviously must be sought that accords with the will of the people expressed on January 19th.

    It would indeed be appropriate for her to move in there. After all, our national hero Errol Barrow is her mentor and spiritual father.Truly, Barrow paved the way for our one-party democracy, making him the architect of our New Order. What an irony of history. Indeed, Barrow was a BLP mole.

    And so the circle is complete from the Declaration of Independence to the New Republic’s quest for absolute power. What was left incomplete in 1966 must be completed by 2026. Namely, the transformation of the Westminster system into a People’s Republic of a new kind.

    Let us celebrate together henceforth the 21st of January. As a day of divine prediction, for the mentor of our Supreme Leader and architect of supremacy.

    It’s a facetious smack down of those who become instant experts on all things they can Google but realistically it’s also an indication that as @Sargeant said above … one gets very wary (and weary too) when you see a critic question a person’s credentials (expertise).

    In the latter case can u tell the blog why a lawyer of Mr Patterson’s long years of practice would be unable to read, decipher and opine with authority on the Bdos constitution?

    Why would he need to be a so called ‘expert’ of constitutional law to offer a valid opinion???

    That type of back-handed ad hominem is always quite ridiculous yah don’t think!

  25. Apart from Pachamama, there are not many on BU who have an interest in geopolitics. There is a region in Africa called the Sahel which stretches from the east to the west of this continent. It has witnessed poor governance, instability, and a rise of Muslim militants. Within the last month we have seen no less than three coups in Africa; whilst in the Caribbean we have witnessed an alternative coup in Barbados according to the article below in today’s BBC. Take a look at their definition of a coup. Check out the third from last paragraph.

    Said Djinnit is a veteran Algerian diplomat who has worked for the United Nations and the African Union at the highest levels, including mediating in past coups.

    “The perennial problem and contradiction is between democracy and security,” he tells BBC Focus on Africa radio, saying those in power all too often “give precedence to security rather than democracy”.

    “When there was a coup in Mauritania some 10 years ago, countries in the region gave consideration to their own security.”

    Mr Djinnit has tried to help create the architecture to “coup-proof” countries through transnational institutions like the AU and Ecowas. He tells the BBC that the agreed definition of what constitutes a coup needs to be updated.

    There’s the “classic coup” of the military stepping in and seizing power, but there’s also the democratic coup, he says – where an “incumbent government manipulates the constitution to perpetuate itself in power”.

    Diplomacy and governance are key in his opinion – given that sanctions appear not to deter coups, and “the military solution” of deploying AU forces isn’t one he has much faith in either.

    “It has to do with the key role of the African Union to continue working and promoting the governance agenda of the continent,” he says.

    Ran into him at Sheraton today.

    I’ve gotten to know him over the years through Barbados History which we usually discuss when we run into one another.

    My first words to him after calling his name were “We back to square one”!!

    He laughed his head off.

    Remember he is Maisie’s son and Maisie was a Dee.

    As far as I can tell the only difference between what I am saying and the view he holds is that whereas I think 3 are needed to make an opposition, he thinks 2 will do.

    Got the impression he was thinking new elections may have to be called.

    I think we are agreed that Reverend Joe’s position was one of pure farce.

    If we are right, the last “Government” was unconstitutional.

    Now that will turn lawyers’ heads as if they were asked what that may mean to the previous government’s actions they may very well blow a gasket and use the Star Trek phrase “That does not Compute”.


  28. I was thinking what would happen if the GG/President were to resign.

    My first reaction was go back to HRH for a caretaker.

    However, the Constitution makes provision for a vacancy in the office.

    The CJ is next in line and can easily step in.

    However, it was under the previous unconstitutional government that he took up office.

    So what happens then?

    Back to the Constitution!!

    .81. (1) The Chief Justice and other Judges of the Supreme Court shall be appointed by the Governor-General, by instrument under the Public Seal, on the recommendation of the Prime Minister after consultation with the Leader of the Opposition.

    Looks like the appointment was by the GG who ascended to office under a constitutional government. Froon would have been PM back then and probably the same Ms. Mockley would have been the Leader of the Opposition.

    If there is any reason the CJ can’t act in the office, then next in line is the President of The Senate who is elected by the senate which does not yet exist!!

    (1) When the Senate first meets after any dissolution of Parliament and before it proceeds to the despatch of any other business, it shall elect a Senator, not being a Minister or Parliamentary Secretary, to be President of the Senate; and whenever the office of President becomes vacant for any reason other than a dissolution of Parliament the Senate shall, not later than its second sitting after the vacancy has arisen, elect another Senator to fill that office.

    (2) When the Senate first meets after any dissolution of Parliament, it shall, as soon as practicable, elect a Senator, not being a Minister or Parliamentary Secretary, to be Deputy President of the Senate; and whenever the office of Deputy President becomes vacant for any reason other than a dissolution of Parliament, the Senate shall, as soon as convenient, elect another Senator to fill that office.

    It is by election that the President and Deputy President of the Senate are chosen!!

    They are not appointments of the PM or GG/President..

In Mr.Patterson’s long years of practice have you heard anything from the gentleman on constitutional matters whether in the courts, papers or newspapers? I am just asking. How many Senators were at the 1st sitting in 2018?

    The description of this issue being formed in my mind is that of a dog trying to dig his ar..se out of a deep hole while other dogs at the top barking and looking for some kind of help to get the dog out
    This issue has gone past being blatantly ridiculous
    Wish the President well hope she digs her way out of that deep dark hole
    Anyhow by the look at those dogs barking at the top it is not going to be easy
    Most likely the dlp and their lawyers are waiting for the trap to spring
    A trap that Mottley placed at the hands of the dlp but as of now looks as if the trap would snap and break PM fingers

    Yep. Anybody who opposes, questions or differs from Mottley is a Dem. Peter Wickham is a Bee? Is Corey Lane a Bee? Ezra Alleyne a Bee?
    What are we to โ€œ expect โ€œ from them?
    Man, Lorenzo, you need to just stop branding people and look at the issues.
    If Patterson and Watson, had taken a different position, they would be the best attorneys in the island .

  34. We seem to have forgotten our countryโ€™s President outstanding legal/Judiciary career , it far eclipses, all the instant legal experts such as William Skinner et al.
    A brief look :
    High Court Judge , St. Lucia;
    Court of Appeal Judge, Barbados
    First woman to serve on our countryโ€™s Supreme Court etc
    I donโ€™t think she will be intimidated by @ac; @ William Skinner et al.
    She certainly will not be intimidated by Mottley; Marshall ; et al.
    I am certain, our President will do what the Constitution demands.
    We are in good hands. Luckily, Marshall is not President because by now Caswell would have made legal mincemeat of him .
    We ought to be thankful for small mercies.

    @Enuff, I have no answers beyond the simple point: _Patterson is an attorney of many years, a old time QC, as far as I am aware. Based on that I am confident that his ability to research, understand and speak expertly about the Bdos Constitution is above reproach.

    I do not recall precisely re the 2018 Senate but the suggestion was made that Williams and Bradshaw were appointed to get to 21 however exactly when that full slate was in place, no recollection.

    @John, I dun wid u .. your ability to maintain such a steady stream of consciousness verbiage on a disabused point is astounding … it’s beyond my mental flexibility.

    Prof Welch’s position on the Bishop’s legality was explained away by then Dean Cumberbatch just as he deconstructed your thesis back in 2018.

    But to u and @David, I did revisit his opinion from the 2018 blogs on the the 21 member Senate and how/if it was properly (legally) constituted.

    So pending any future case taken to the courts I have to accept that the Senate must first be empanelled in full to be legally constituted because:

    Thereshall be a Parliament of Barbados which shall consist of [The Pres], a Senate and a House of Assembly.
    (1) The Senate shall consist of twenty-one persons who, being qualified for appointment as Senators in accordance with the provisions of this Constitution, have been so appointed in accordance with the provisions of this section.’

    The plain English interpretation of ‘shall’ is to assert or have a definitive intent I imagine.

    Doesn’t get plainer than that!!

    The Senate/senators comes after the Leader of the Opposition!!

    No LoO = No opposition senators

    No opposition senators = No Senate

    No Senate = No Parliament

    No Parliament = No Government

    There are other clearly defined clauses which speak of the eventuality of no LofA. You are wrong to conflate ‘shall’ on that clause as re the Senate.

    Moreover, the Dean also spoke of the necessity construct of the constitution… namely: “However, in my view, the doctrine of necessity would step in to hold that there ought to be an Opposition in a democracy and thus permit the current scenario,”

    You sir are a Bdos scholar please stop being infradig and bowing to nonsense so deliberately …

    I said I accept the plain English meaning as the Dean opined but he also said that regardless of the scholarship of the person offering an opinion it remains legallu just an opinion until validated by the courts.

    That coupled with the aforementioned concept of the ‘necessity’ and intended impact of the constitution document requires that we give a PRACTICAL READING and not create a legal nonsense or absurdity as you continue to offer.
