It was recently announced, by the Government Information Service, that the Protective Service Commission has approved the appointment of Mr. Oral Williams on promotion to the post of Deputy Commissioner of Police in the Royal Barbados Police Force, with effect from May 1, 2020.

I really don’t know if I should congratulate or offer commiserations to Mr. Williams. This has nothing to do with his fitness for the post. I do not know of his work or performance as a senior police officer and cannot speak to his fitness. My concern is that he has been appointed to a non-existent post, since someone is already substantively appointed Deputy Commissioner.

The Police Act, Chapter 167 of the Laws of Barbados, states at section 6:

The Force shall consist of a Commissioner, a Deputy Commissioner and such number of Assistant Commissioners, Superintendents, Inspectors, subordinate police officers and constables respectively as does not exceed the number provided by any order made under section 2 of the Civil Establishments Act: but the members of the Force at 16th October 1961, shall continue to be members of the Force and shall be subject to this Act.

The number of persons appointed to the post of Commissioner and Deputy Commissioner is subject to primary legislation, in this case the Police Act, and can only be changed by an amendment to that Act done in Parliament. On the other hand, the Police Act goes on to give the Minister responsible for Civil Establishments the power, by subsidiary legislation, to determine the number of Assistant Commissioners, Superintendents, Inspectors, subordinate police officers and constables.

For completeness, the Civil Establishments Act was repealed and replaced by the Public Service Act on December 31, 2007. The power to determine the number of posts in the Public Service is now found at section 13.(1) of the Public Service Act.

The power to make appointments to public offices and to remove and to exercise disciplinary control over persons holding or acting in the Public Service is vested in the Governor-General, acting in accordance with the advice of service commissions, in this case the Protective Service Commission. That service commission, like all others in Barbados, can only recommend the appointment of persons to post that are available. There is only one post of Deputy Commissioner available and that is already filled.

Who is responsible for this cock-up? Is this yet another example of this Government not getting anything right the first?

    some agree with Ezra’s opinion that the Ministerial Order laid but not debated or passed in both Houses gave legitimacy to the 2nd post of deputy being created but Ezra also said-

    for clarity i dont agree with Ezra.

    if they are so confident in the doctrine of implied repeal why is there a need to amend the Police Act which Ezra doesnt argue but rather he points out that the matter will be tidied up by the passage and i assume debate of the Ministerial Orders that have been laid in both houses. which is legalistic gymnastics, in my opinion, to say that they will finally get it right in any case

    The AG said “[w]e take note that the Police Act only speaks to a single Deputy Commissioner of Police and it is therefore to be regretted that the required amendment did not take place in advance of this confirmation”. The PM says it is lawful but admits the same Section 6 needs amending to tidy up the appointment. As I asked early on this thread, after the amendment then what?

    The Senator is totally misinterpreting legislation. He’s just a legal layman and doesn’t know any better. He interprets laws the way he probably interprets the Bible as a layman, all too literally.

    “A deputy” is different from “ONE deputy” or “SINGLE deputy”.

    Let me give you an example: When you say “politician X is AN idiot”, it doesn’t mean he’s the only idiot. Then it should read: “Politician X is the ONLY idiot” or “There is only ONE idiot, namely politician X”.

    I am very sure that the senator would therefore fail with any lawsuit brought before the SC or CCJ. I therefore fully support our leader in this matter. The senator must apologize to her immediately.

    it is MAM and her BS legal reasoning and her perception that one of her ministers doing an about face is somehow a sleight on her administration and herself that re ignited this.

    that seems to be a chink in her armour, that i shouldnt lose an argument attitude. it is comparable to how she behaved when she was accused in Parliament of not having an LEC. she simply should have said no i dont have an LEC but i am admitted by the Bim Bar Association to practice and left it there, but no, in addition, she responded by saying she will bring her degrees and certificates to Parliament which she never did

    Nor how absence of such process, is relied on during litigation, and that implied inaction IS NOT A LEGALLY ACCEPTED DEFENSE.

    And when asked by the police AND THE INSURANCE COMPANY about where you had your keys, you responded that “dem is my keys and I intended to put them up, but I forget!”

All I remember about her stint as AG is that Glendairy burned down under her watch and in the subsequent inquiry everyone in the chain of command was called as a witness except u know who. It can be said that her Gov’t protected her from testifying, it was the only case of quarantine in Bim until the recent pandemic.

    Despite the legal gymnastics, double speak and avoidance of facts and reality on the part of Verla De Peiza, her DLP colleagues, others and many in this thread, one thing remains unchanged. Whether you believe the appointment is lawful or not, whether you think there needs to be an amendment, whether the AG said this or that, and when whoever did something else it does very little to change the facts of any significant import.

    The Commissioner of Police judged that his Force required the benefit of a second DCP to deal with HR etc. The man who has been appointed to that role is eminently qualified, and there is a case to be made for a promotion being substantially overdue. Those facts can’t and won’t change despite the best efforts of some to exploit a non-issue for personal political benefit and others to seek to propel their insignificant, warped political agendas.

    After this storm in a tea cup subsides and the circus of seven days is over, those facts will remain the same. If persons are really interested in the welfare of this country, they can engage on matters of importance for the lives of people in this country. Despite the best spin in the world, the elderly woman living next door to me cares very little about this issue, but does care about the fact that the government of this country acted proactively to arrest the spread of a disease to which she is particularly vulnerable and is now acting to make the Force run smoother to protect her from any vagabonds who may wish to deprive her of a life’s worth of deserved property. Or the gentleman who cuts the lawn and washes the windows who has suffered immensely under the lockdown and is grateful for the assistance of Welfare and others. Or his daughter who works in a hotel and is grateful that government will not allow her bread and butter which supports herself and educates her children to simply keel over and die because some think she is no longer relevant. She understands the need to retool and for the country to pivot, but equally she would like her job which the Tourism Rejuvenation Fund assists with ensuring.

    There are real problems across the country and within the Force that people deeply care about. And then there are issues such as these over which there is a divide, but to which few people in the country really are paying attention because they understand the enormity of other issues, within and outside of the Force and have the good sense to know an important issue when they see it.

    If it’s a mistake, it will be fixed. If it isn’t a mistake, then fine, just tidying of the legislation needed. But at the end of the day, the country will have a much-needed second DCP and the Force will make important steps to continue in their efforts to deliver quality protection and service to people in this country, and government more generally will continue to work for this country and the people of this country. No spin nor non-issue can take away from that.

    And that is the point!
