Well it finally had to happen and CHIEF JUSTICE MARSTON GIBSON’s known competencies, or renown incompetencies had to come to the surface or, as bajans say, “day has run, till night catch it”. Here is the matter in a nutshell.

The City of Bridgetown Credit Union made a qualified loan to Mr. Morris Lee and some family members. They were all members in good standing with the credit union BUT FATE WOULD HAVE IT, because a certain CEO, had his eye on Lee’s properties, it is purported that he directed THAT THE SECURITIES FOR THE LOANS were to be (a) Lee’s Minibuses, (b) a house and land, (c) and apartment building  and (d) ½ acre of land all valued at roughly $5.2M which was TWICE THE AMOUNT OF THE LOAN secured.

But what is really disturbing is that “the assets that were used to collateralize the loan”, WERE NOT THE PROPERTY OF THE MEMBERS WHICH THE CREDIT UNION GAVE THE LOANS TO. Yes sireeeee, Steve Belle and his ingrunt CoB lawyers, securitized the man loan with assets of private companies!

Now let me explain to wunna people cause wunna is not idjits how this works. The CoB can lend money to its members, AS WELL AS “bodies corporate”. BUT THESE BODIES CORPORATE have to become members of the Credit union. IN LEE’s CASE, THIS STEP WAS NEVER DONE so what happened was that while there were 4 companies involved in the loan transaction, Lee’s bus company and 3 real estate companies, NOT ONE WAS MADE A MEMBER! Well once wunna understand the above backstory, wunna is up to speed with all the background CoB trickery in this matter.

Now let us deal with the incompetence of CHIEF JUSTICE MARSTON. It would appear that the Chief Justice HAS BEEN MAKING SOME REAL BIG INGRUNT MISTAKES.

Illegal Orders to repossess the incorrectly listed assets of the 4 non credut union companies, were given to the court by Court Master Debra Holder. She did not listen to TO THE EVIDENCE PROVIDED BY MR. LEE who told her that CoB had not properly securitized the loans.

One further detail for all readers. Wunna remember a man called Ernest Jackman, the lawyer who always getting lock up for client funds? He was Lee’s lawyer and he was doing some of his famous underhand tricks but we will return to that.

So now, when the illegal order gets executed on the assets THAT WERE NOT LEGALLY SECURED, Steve Belle CEO of CoB, gives instruction to get the various assets repossessed. These  included 6 buses and 2 SUVs which Steve claimed “were all inoperable at the time of repossession” ALL OF THEM!

Now here is another joke. Even though the bailiffs drove these vehicles away from the bus stands, WITH POLICE ESCORTS, (and wunna dun know that the Royal Barbados Police Force does only arrest poor black people cause Tasker still free and Innes she still free) Steve say that they were inoperable cause he can auction them off cheap. Lee approached the impotent CJ for an approval for the injunction concerning CoB Credit Union cases CV993/2016 and CV994/2016 to be heard as an urgent matter. And the CJ so orders an urgent hearing on 15th March 2019

The same impotent CJ Marston sends the matter to Dr. Sonia Richards and she refuses to hear it and returns the item to the CJ, without explanation. Even though he is Chief Justice what has happened over the last 4 months, is that all his instructions to 2 judges, to hear the matter on an Injunction with Urgency have been ignored by his subordinates.

By now, all of you readers can see why this submission has the word IMPOTENT because the CJ is so ineffectual that HE DOES NOT KNOW WHAT OTHER STEPS HE CAN TAKE IN THIS MATTER. The man is really just “winging it”. It is obvious there is no respect for this man and if MARSTON IS TO BE FIRED, THIS MATTER SHOULD BE THE INCIDENT THAT CUASES THIS TO HAPPEN.

Wunna all unnerstan whu happen so far?

  1. In simple terms City of Bridgetown did not securitize their loans properly to their loan recipients.
  2. They gave loans but the security DID NOT BELONG TO DE PEOPLE THEY GAVE THE LOANS TO.
  3. The assets belonged to 4 non member companies.
  4. When Justice Debra Holder gave CoB the Court Order she erred in that action big time!
  5. Lee and his family rightfully sought to appeal said incorrect Court Order
  6. The CHIEF JUSTICE agreed that his matter had merit for urgent consideration
  7. Marston’s subordinates refused to carry out his instructions for 4 months
  8. During this time, Steve Belle and the City of Bridgetown is using its agents, the Royal Barbados Police Force, the Court Marshalls, the external lawyers, to ride roughshod over Mr. Lee

None of you will believe this but Steve Belle, CEO of CoB, up on the trucks dat are now repossessing properties that ARE NOT THEIRS UNDER THE LAWS OF BARBADOS and taking people’s contents to the St Thomas landfill.

Yes siree, Steve Belle got a bolt cutters and drilling machine and drilling out people locks WHILE PROTECTED BY THE COURT MARSHALLS who say dat “Marston is a boy in de yard and that “they are acting upon an authority that is higher than he!” Which has to be Attorney General, or the Governor General, or the Prime Minister.

Look what Barbados has come to – the criminals are killing us in the streets and the other criminals are killing us through the Court.

    Is the purported impotence of the Honourable Chief Justice the underlying issue or the nasty behavioiur of the underling judge who refused to carry out the instructions of her superior?
    but as is clearly evident our judicial system is under threat both from those who break the law and thos charged with the responsibility of upholding the law.
    in times past, disobeying the orders of the Head of Department was not tolerated and could result in dismiissal. Now anything goes at all levels and and as the country continues to slide further and further into the depths of despair we hypocriticallyask why

    I am surprised that you are younger than Stuart. But it confirms something I have been saying for sometime: a proper sociological analysis will pinpoint the generation – even the schools – that have kicked off the decline of Barbados. This is a challenge to the UWI.

    Funny, but I think you will find families associated with the decline.

    At the root I think you will find the first generation Duprey operating from Trinidad and spreading tentacles into the various islands.

    Clement Payne would be an agent sent to destabilise Barbados.

    When I was looking at Carrington Village in Professor Marshall’s book I saw it figures in the Penny Bank Saga.
    I always heard about it but never really looked at it in any detail.
    He writes:
    ” However, the mid-1940’s brought disruption to the life of a vibrant community where co-operative institutions like friendly societies, had thrived. George Lamming depicting “Creighton Village” in his autobiographal nove, In the Castle of my Skin, has vividly described that disruption.
    Land speculators in the shape of the Cooperative or Penny Bank bought the tenantry, offered the land for sale at rates most tenants could not afford, tripled the rent and evicted those who either fell into arrears with rental payments or were occupying spots for which purchasers presented themselves.
    Christine Barrow in her doctoral thesis has pointed to the direct results.. Over 80 percent of the residents moved their residences: only about 15% bought the spots on which they lived and remained resident on the; and the Penny Bank collapsed in 1962, some of those who had contracted to buy their spots faced huge difficulties in acquiring legal title to those house-spots.”

    Growing up I heard of some of the people, eg Stuart & Sampson was an old Roebuck Street(?) business.
    There is even an Ashby involved, possibly a descendant of RCA.
    I remember there was the “Ashby Medford” building in Roebuck Street just above ECAF.
    … and then there was Joe Tudor, another with ties to Roebuck Street.
    Where was Sir Grantley when all this was happening?
    … and Errol Barrow in 1962 when it collapsed.

    Anyhow, yes Mr Blogmaster I will desist and leave this for the CJ….Simply I would note that like Sir Marston another British knight Darroch is being lambasted and in his case surely will be out of his current job very shortly …and he too thought the other fella was competent…to create mayhem and be “uniquely dysfunctional”.

    IT would be better if Sir Kim Darroch had paid attention to the disparaging remarks made by the former Head of the British Intelligence agency MI6 who in no uncertain terms decried those persons presently charged with the responsibility of governance in the Parliament England and was of the view that tthey were none which would include his boss suitable at the moment to take the former Empire forward

    I have 2 concerns with how this matter was handled at the credit union.

    First the attorneys for the credit union failed miserably in securing the exposure of the entity. Also who is to say the assets now leaned on by the credit union are not already being used by the owner as security on another bank, hence leaving the credit union ” blowing in the breeze”. Clearly a legal search was not done as is customary on this level of loan.

    Secondly and my bigger concern is that how many more loans have these learned gentlemen secured in a similarly carefree manner hence exposing the credit union members for serious loss?

    The members need to rally enough votes for a extraordinary general meeting and hold the board responsible for answers. They would just need to check their articles and see how many members are needed to call such a meeting.

    You can’t expect to be seen as a viable option to the official banking sector and be doing such foolishness, if in fact the article is correct.

    Sometime ago I said that @William should follow the names. Not just the family names, but the marriages and in-laws. You are right, the decline started in the late 1950s early 60s, and progressed rapidly after constitutional independence. But t st art ed before that As a student of history you will To recover, we must correct those historical wrongs.

    Where have you been living over the past 50 years?
    Massa days done. Do you know the reasons for returning the case to the CJ ? Do you know if he accepted the reasons for the referral? We are all speculating of course.
    No one should interfere with the Independence of judges under our system of governance. I believe that any judge can recuse himself from a case.
    That is my limited understanding of the conventions and laws.

    I note the point you are making. The juxtaposition of the comparison of his credentials with Trump the outsider was clumsy on my part. The comparison with the outsider was meant to depict the obstacles placed in both paths by entrenched power brokers. As for his credentials, there was some talk that due to his lack of familiarity with local practices( most of his experience being in the USA) that he might not be the most suitable candidate.

    Chief Justice Marston Gibson whom my Brother Hants tells me plays the guitar was well aware that an illegal rather incorrect Court Order that was given to COB Credit Union on CV993/2016 and CV994/2016 on March 13th 2019.

    Said incompetent Chief Justice marston Gibson was also aware Mr Lee’s lawyer had filed an Injunction and Certificate of Urgency on March 8th 2019.

    What the Chief Justice MIGHT NOT HAVE BEEN AWARE OF was the fact those same Injunction documents filed were purposely misplaced or, is bajan vernacular “loss way in the Registry” by agents of the City of Bridgetown AT THE REGISTRY (I going show wunna later why I say that he might not have been aware)

    But the same purposefully lost documents were only “found back” five days later, on March 13th 2019, AFTER THE ORDER WAS GIVEN!

    AND Chief Justice, on March 15th 2019, approved the Urgent request that the matter for an application for a Stay of the CV993/2016 and CV994/2016 orders be heard.

    So true but if they want to be seen as being an alternative to the status co they must not only do as good as they do, but better than them.

    I don’t want to take the article as carved in stone in terms of it being correct, so to advance an argument based on that front may not be wise.

    If however we focus on the fact that the loan is now basically unsecured as it was not secured correctly, then surely this should be a major concern for the membership. Then again this is cropover so nobody might be studying that now anyhow!

    All with an attempt to maligned his potential and credentials forcing govt hand to dismiss him
    The blp yard fowls in their ardent attempt in the pursuit of having the Chief Justice canned by present govt would leave no stone unturned
    What said in this article about the chief justice all adds up to left over stale soup posted on Bu which would add to the volume of articles about the Chief Justice over the years
    Meanwhile one would be hard pressed to find any articles abour Mia influence or ties to her Father tax waivers

    A very informed exchange between you two. GP succinctly expressed the flaws of the post independent Barbados. I particularly under stood ” MY EX WIFE DECLARED THAT THAT WAS TOO FAR”.
    I lived once in St. Phillip which according to my ex-wife was too far from Bridgetown. I tiled the processing area of the plant in the business I had at the time,:she found doing so to be below the level of a professional person.

    I am not surprised about all this. A couple years ago someone approached me and asked if I would like to be part of a small group formed to give the chief justice support. I am not sure that the CJ was aware of the group, but I was told there are people trying to undermine him.
    If this is the case, and that rumour could reach as far as London, then it must also have reached the offices of the attorney general and prime minister. They have to put systems in place to support the CJ. The real losers are the public.

    The difference between your beloved judge and our Mia is that Mia doesn’t present a CV on the Internet that focuses on leisure activities. Also, I have never heard of Mia saying that she can’t work as hard as the office requires because of “family and life”.

    This whole issue is yet another example of how our legal system is a joke, if you want a further joke then consider this.

    The AG says he is putting measures in place so that those caught money laundering can be dealt with in a civil case.

    So let me ask the evidence and burden of proof wouldn’t be the same in a civil case as in a case brought by government ? If after 13 months you couldn’t even get Donville charge locally for parking, you really think anybody taking you serious ?

    I wish when some went to lunch gatherings them would just eat the people food and hush!

    You are clearly very perceptive. This attitude, of what is or is not below us, is reflected in public policy. So we find that governments, both BLP and DLP, talk about economic growth in terms of tourism, foreign direct investment, and other white collar and service sectors, but never an industrial policy. They have no perception of industry.
    A good example of this is that on the very site of the white elephant of a court building used to be the Barbados Foundry, the leading engineering works of its kind in the Caribbean, rivalled only by the Central Foundry.
    We got rid of the Barbados Foundry to build a court building for our lawyers dressed in their robes; the spot of the Central Foundry is abandoned; and what was the leading dry dock in the Eastern Caribbean is rusting and decaying. Whatever happened to the 15 shrimp trawlers we had at independence?
    That tells you everything we need to know about our so-called leaders.

    What I find amusing about the court building are the provisos put in place before John public can gain admittance.. There are rigid dress requirements,failure to meet them result in in non-admission. I understand that visitors where possible should be clean and dressed in a fitting manner. I have always been of the opinion, that courts are there to ensure justice for every one in a timely manner and that the matter of dress is of minor import. and should be subordinated to the dispensing of justice. When I was in the States there was a case of a homeless man who used to frequent the New York Public Library. He would spend as long as possible in the library. This annoyed the users and the officials of the library since his personal hygiene needed some attention. There was a court case and judgement went in favor of the homeless man. It was explained that the library was paid for by the citizens and that his personal hygiene was not grounds for ejection. He won some damages. Imagine a homeless person having to attend court in Barbados,there is no way he/she would be allowed into the court. There is too much stress placed on form and not substance in this country. The judiciary and lawyers are a pack of bombastic idiots strutting around the place in wigs.

    I don’t expect you to know anything about the demise and collapse of Barbados Foundry,Central Foundry, nor Cotton Factory,but besides the collapse of the sugar industry these companies suffered the customary raid on assets especially liquid assets,the usual crooks and liars syndrome that affect white owned and run businesses in Barbados and other parts of the world.Ask Steve Mnuchin.Ask Donald Trumpf.If Barbados is a failed state it is people like you who spread false information and people like you who are always employees who cant make a decision if it was going to save your life.

    I have been a victim of this stupidity, a fact I have mentioned on BU before. I went to collect some certificates in short trousers and slippers and the so-called security man would not allow me in at first. Can you imagine wearing long trousers in that heat.
    The point is Barbados has become an ideas free zone; we are victims of learning by rote. Once we are told what to believe we go about it with gusto.

    Purely speculative. check your information again. when the foundry went out of existence as opposed to when the white elephant as you called it was constructed.

    It was all of the above plus economics also played a role.. I think the going rates in those days was maybe $50-60 dollars per day for a tiler. The problem was I only got a shell from the BIDC. BIDC had never done any work on buildings for the food industry. So I had to put in screens, tiles, paint and grade the floor to ensure water drained to a central drain and then to the grease trap which I paid to get installed. So money was tight and since I used to help my cousin do his mason trade. it was natural for me to help myself..

    Freundel Stuart changed the Laws of Barbados in the dead of night to make the path straight for Marston to be anointed King of the Courts of Barbados.The electorate got rid of Staurt but Marston there until age 70 or a max of 72.Politicians have a habit of destroying a good thing just to be popular and ‘relevant’.Barbados’s boast of about 1400 lawyers must be a record per capita yet we have a very dysfunctional court system and we wonder why there is a lack of confidence and a lack meaningful investment.

    What does this mean? Only an idiot would believe that foundry was bulldozed to build the court. The foundry was closed, it was put of business because its main business came from the sugar factories. The point is that the business was mothballed in the early 1970s and the site became an eye sore. The site of a world-class engineering site was replaced with a white elephant of a court building.

    The property, at the time, was occupied by 65 year old Andrew Lee, (brother to Mr. Morris Lee) and his 5 year old daughter.

    This team of thieves raided a non CoB member’s property and threw most of their possessions into the St. Thomas landfill!!!

    You are remarkably dumb. If it was not clear to you and others, then ask a question. Do not bow to your ignorance all the time. No one closed the foundry down overnight and said let us build a court. It is the Bajan condition: speculate rather than ask for clarification. Let me explain to you: the business failed, for whatever reason, and eventually was replaced with a vanity new court building. A waste of a resource.
    I could have talked about the Harp Project and the Iraqi Supergun affair. That does not mean the gun was made n Barbados. A writer assumes a certain level of intelligence on readers’ part. You were clearly absent from school on that day.

    You are correct about the Foundry. My Uncle Albert used to work there. The place was closed down for more than twenty years and fell into disrepair. It became an eyesore and was demolished eventually. It is a pity that there was no foresight, if there had been, the parts for the Swing Bridge could have been machined and an iconic structure with world heritage appeal would have been preserved. As far as I can recollect, the original Swing Bridge was one of few examples of such a bridge in the world. It was a great sight; its replacement is a shadow .
