Johan Bjerkhamn

On behalf of the BU household we express our deep sadness at the unfortunate death of 11 year old Luke Bjerkhamn. Luke  was allegedly shot by his father Johan Bjerkhamn a couple weeks ago at his father’s residence. This is a matter which BU has been reluctant to offer public comment in deference to the the grieving family. However, in light of the recent development that Johan Bjerkhamn evaded police questioning by waltzing out of Barbados on a private jet yesterday, we have been driven to comment on the matter.

Firstly, there is the erroneous position which has been propagated by the traditional media that Johan  Bjerkhamn has been under 24-hour police guard at the Bayview Hospital. Our source indicates it was his doctor who played a pivotal role to keep the police from questioning Johan  Bjerkhamn. It has been said that his doctor kept him heavily sedated. Keeping him in a drowsy state the doctor was able to feed the Police the story that Bjerkhamn was not medically fit to give a statement. Why the Royal Barbados Police Force would leave  Johan  Bjerkhamn unguarded at Bayview Hospital is highly questionable.

The breakdown in communication between Commissioner Dottin and his Deputy over the recent Movada Kartel Show merits probing questions about Dottin’s competence to manage the Police Force. We suggest had the alleged perpetrator of this incident been Black the statement would have been taken and the charge laid in quick time.

Interestingly, it is Sir Richard Cheltenham who is at the forefront of this matter. Didn’t he successfully keep Jippy Doyle out of prison for almost seven years? It was reported by the media that Sir Richard accompanied Johan Bjerkhamn to the private hangar at the Grantley Adams Airport yesterday. Again, isn’t it amazing that in a very high profile Police matter we are witnessing such a  high level of incompetence by our Police Force?

We are left to speculate about what happened two weeks ago at the house of Johan Bjerkhamn. What we do know from our source is that the recent incident of gun play is not the first to have been heard by neighbours. There is the unconfirmed report that Luke was the victim of a family squabble. The question now remains, will the Royal Barbados Police Force ever get the opportunity to interrogate Jonan Bjerkhamn.

An upset BU commenter posted the following comment on the matter:

Now I shifting from BFS to Barbadians in general. I am writing this article as a chance to vent before I BLEVE . Them corrupt, nasty sorcerers who are in charge of law and security in this country , Responded to a suspicious call about a rasta man ‘in quick time’ resulting in him ending up over a cliff on sharp rocks to die some moments later.

This same security dept. took a subtle and ‘hands off’, luke warm approach to deal with a shooting death of a little boy. Questions I must ask myself,What if Mr. Bjerkhamn was driving the crash tender and his service number was 109, would he he be dragged violently from behind the steering wheel by police?

Would Mr Bjerkhamn be treated with the same ROYALTY if he was a black rasta whose son was shot? Why was he discharged and the police not notified by the hospital pending an investigation? Who gave the order to withdraw police presence creating that window of opportunity? Why is it that someone from the  health care profession not wearing HMP silver bangles? And the list goes on. My conclusion is that commissioner Dottin is a Mock face , hard face ass and he need to be removed from office like yesterday.

The white people in this country are more powerful than Castro is in Cuba. We have two laws in this country, the extreme one which serves the blacks and not so fortunate and the other customized “we would make up as we go along one” which serves the whites and people from higher echelons. Where are the Hamas and Hezbollah when you really need them?

  2. I wonder how some of you would feel about this scenario:

    A man over-drinks and gets drunk and then drives his car with his 11-year-old child in it down the road, and accidentally runs off the road and slams into a wall killing the child while he survives with injuries.

    Would you say that he is guilty of nothing and that the lost of his child is sufficient punishment? And what is the difference between that and a man cleaning a loaded gun, or trying to remove a jammed bullet with his child present in the room?

    To me there is no difference, and both should be treated in the same manner. If the drunk driver should be punished under the law, so too should the man with the gun, or they both should go free without charge.

    AS I have said Rok I am both American and Bajan I am for Obamas universal health care which is cauising an outlash in the states.
    When some 40.000 Americans die per year from not being insured .
    I do feel we need to revamp the Barbadian health care get a new hospital
    How is it that all these condos starting with the previous party went up and nothing when things were better before the recession was done about QEH
    F the Roadworks ABC Gems fiasco QEH is a horror story.
    Johan had grangrene set in his hand this is bad …from his time in both QEH and bayview.

    Thanks Anon for the advice about neurosurgery which there are nerves in one hands which I beleive I read there was a nuerosurgeon on hand as well.
    Look , I wish the healthcare was bettter here but bottom line it isn’t the state of QEH is that the hospital is on it’s last leg and needs an overhaul.
    In BIM we get used leftover medical equipment.
    We needed to fix the damn hospital before the ABC highway which has enormous overcosts associated and If we had done so and the hosp had new equipment state of the art surgey facilities so we could keep doctors from the west indies here perhaps johan would still be in BIM and perhaps grangrene wouldn’t have set in…I am highly doubting that the state of QEH is in that it is OSHA approved / accredited or JCHO???
    Am not sure though!

    Atman first of all with alcohol use you know it impairs one judgement there are laws against drinking and driving under the influence there are no laws about one cleaning ones gun in their home or premises.
    Like I have stated in one of my earlier posts I am for strict gun control,
    I want to see johan speak as I have said to children, teens and young adults about the dangers of guns.
    I hope even in this dreadful situation none of us forgets that a gun destroyed a familys life forever,
    Let us pray change how guns have become glamourized by ( Hollywood) rap stars, rock stars, reggae,
    That guns as I will keep saying kill more innocent victims than that of the bad guys

  10. No response yet to my suggestion that guns should be banned in Barbados. I wonder why? I think we have managed to ban cigarette smoking, at least in public places, surely a law banning private ownership of guns would quickly go through Parliament, wouldn’t it?

    Do we go further down the path of the USA or Jamaica, or do we, as a nation, show considerably far more acumen than these so-called civilised nations?

    I never said that. What happened is that the one friend I wrote about, lost functionality and feeling in his leg. Most of all, my point is that he had to suffer for years because he did not have the money.

    The other point of note is that there are now many Bajans who have suffered gunshot wounds to their limbs. You only need to talk to a few. Visit the QEH. I am sure you will find some in there right now. The guy (Ian Gilkes) that got robbed and shot a not quite two weeks ago (or just about) is in the QEH suffering right now. I saw his brother only yesterday who was telling me about his condition. If he had money, he would not be in that position today.

    Even with the money, it seems that Johan will not regain all the functionality but will avoid the years of suffering.

    Well, I have no more information than what has been reported. However, I don’t think that someone should be charged with a crime unless the prosecutor is confident that the crime was committed. From what I have read so far it doesn’t seem like the police are too confident; hence the delay.

    Regarding your point about the competent gun dealer, I don’t think that cleaning one’s gun is, in and of itself, reckless. As I said, it seems to be extremely important to clean one’s gun (based on what I have read online). But is it reckless to clean one’s gun when another person is in the room? I don’t know.

    The test for gross negligence manslaughter is higher than the test for negligence in tort. I suspect that Mr Bjerkhamn either thought he took all the bullets out of the gun or was in the process of doing so when this happened.

    Based on what we have read so far, I think everyone can agree that he did not shoot his son deliberately. The question is whether his behaviour amounted to blatant disregard for the life of another. I am not convinced that it was.

    The only similarity between the young girl that drowned at Miami beach ( Barbados ) and young Luke, is that both children lost their lives. I must confess to not being as familiar with the details of the Miami beach tragedy.

    The main difference between the two incidents is the “recklessness” involved.

    One could say – and I must be sympathetic to the lady who took the girl to the beach – that what happened was an ordinary occurrence and the lady believed that in this “ordinary situation” – taking a young person to the beach – all would have been well.

    In the Luke situation one could say it was not ordinary, in that not many people in Barbados clean their guns in the presence of children aged eleven years…it is therefore not an ordinary event.

    You could then say should a competent person know the risk involved. The argument could be “yes” because as a gun dealer he should have the level of competence to be a dealer.

    It follows therefore there was an element of “recklessness” because he being a competent person should have known the risk involved. That is my opinion as you have asked.

    On a separate issue my sympathy goes to the bereaved family, nothing I say will make any difference to them now. However, it is “right” that they know black Barbadians are not so lacking in understanding and human kindness not to share their loss and that goes also for the lady who lost her daughter at Miami beach.

    Driving while drunk is definitely reckless. There is case law to support that. But let me give you a scenario:

    A man is driving down the highway (sober). He changes the radio station from 95.3 to 98.1 and takes his eye off the road for a split second. Due to that distraction, he veers into an oncoming truck. His 11 year old son, who is in the passenger seat, dies on impact and he comes out of the wreckage with minor injuries.

    Was he careless? Yes. Should he be charged with manslaughter? I would argue that he isn’t guilty of the offence.

    I am sure you know that the police do not not as a natural occurrence or “should not” divulge all their information to the media…as it could hamper further investigations.

    Having had a military background and cleaned weapons from heavy machine guns to pistols. You do not have live amunition around or should not when there is a possibilty of accidental discharge, particularly with others about as in a cleaning situation. Young people in the vicinity compounds the error…that should be done in a secure location.

    You never point a weapon even when not loaded at another person…in the military you could get into serious trouble for such an action.

    The gentleman concerned should have discharged the weapon in a “sandpit” with the weapon pointing away from him in a “secure location” certainly not with a very young person present. This should have been done until he was sure the bullets had been discharged. Until that time the weapon should have been in front of him and pointing away and all persons present should have been behind him and at a safe distance.

    I share your sympathetic concerns, not many people certainly not I, think he expected any harm to his beloved son Luke. [ I was just putting forward arguments that the prosecution could have]

    I do not think Luke’s age made his father’s actions any more or less reckless (if the gun cleaning story is accurate).

    If Luke was a 35 year old BDF sergeant, this accident could have happened in the same way. I think that age would be more of a factor if Luke was handling the gun himself. However, any bystander, young or old, could have been killed in these circumstances. In other words, Luke being a child, was not any more susceptible to being injured by a stray bullet from and accidentally discharged gun.

    I am no gun owner so I don’t know what is general practice when cleaning guns. Maybe someone can enlighten me. I am not in a position to say that Mr Bjerkhamn was competent or incompetent.

    But when I read this story my heart sank. I was reminded of a tragic incident that happened last year in another Caribbean jurisdiction. A father (who was a registered gun owner) came home with his wife and daughter. Gun toting burglars were at his home and ambushed the family. The father, in an effort to protect his wife and daughter, opened fire on the miscreants and accidentally shot his daughter (a 17 years old straight A student).

    I suppose the scenarios are different but I don’t think either father should have been charged with a crime (assuming that there isn’t more to either one of these stories).

    If Bjerkhamn was driving drunk or allowing his children to play with guns I think that there would definitely cause to charge him with manslaughter. However, in these circumstances, I don’t think he should have been charged. But we will see how things turn out.

  19. From reading Bjerkhamn’s Affidavit, I empathize with him more having learned about the circumstances which caused him to leave the Island so soon after being involved in a tragedy.

    I had mixed feelings about his initial departure and like many others rushed to judgment without the facts, even though I did not express them publicly.

    I’d wait on the sidelines to see how the law plays out in this incident, that is if he would be subject to ANY type of charges.

    I am not sure I would agree with that.

    A parent would be expected to exhibit a greater standard of care towards their young child than say towards a bystander while carrying out an activity that is known to have some level of danger.

    Having said that, I agree that he may still not be criminally reckless and like you feel it harsh to charge him with a crime.

    Its going to be a tough call by the jury.

    Both scenarios could be deemed ‘negligent’. If you take a child from its ‘safe’ environs at home you are supposed to pay undue attention to its safety. No way could I take a child to the sea of all places and get so caught up in the moment that I lost tract of the child. The child would know beforehand that the sea is off limits to you unless accompanied with me. No other adult but me. My children were not allowed to go to the sea not even with my dead mother. And if their school had an ‘outing’ near at the sea, I always made it abundantly clear to their teacher, ‘NO sea baths for MINE. Plain n simple.
    Like I said, both incidents are tragic and it doesn’t make sense making those involved feel any more guilty. We’re all human and shit happens.

    All I can say is that at very worst scenario this is reckless involuntary manslaughter or reckless endagerment. But as you have so intelligently pointed out to all of us ( to be a registered gun dealer/owner he had to show a level of competence and responisbility to do so.
    What I feel is the police do not know how to handle a case like this. What charges they charge johan with etc.

    As I gave references to cases in the USA , where prosecuters decided to not press charges or drop charges when parents left children ( accidentally in cars where the heat index was extremely high and the unthinkable happened the children died from heat exhaustion and oxygen deprevation.
    Do you not think the images of these children suffering deaths like this being played over and over in the parents mind is not enough punishment to last several life times?

  25. I am truly impressed with the “management” of this case.

    A medical team in Barbados that includes a Psychiatrist.A top notch legal team “controlling” the
    Investigation and the “right” people using their house and boat as sureties for bail.

    Barbados Today helped by including photos of the sureties in their publication.

    This style of case management should be taught in Law school if it isn’t already.

  27. Bonny Peppa, I know the bad boys have guns, hence my reference to other criminal behaviours. Passing a law will not take the guns out of their hands, just as laws against domestic abuse does not make it go away.

    However, I was trying to make the point that as a nation, and as a civilised society with a respected and competent police force, individual citizens need not possess a gun.

    As my username indicates, I am a permanent resident here in Barbados, and if my Barbadian wife told me that we ought to get a gun (as she might if we were in Jamaica) then I would be saying we should domicile in another country.

    As retirees I think Barbados is one of the safest and most desirable places to be, and I want it to stay that way. We ordinary citizens do not need guns, they should be only available in the circumstances I outlined, and in the hands of the forces of law and order, I think.

    Barbados has a lot more crimes that go unreported that is ( they do not want tourists to get wind just how much problems really exsist.There are more rapes that never go unaccountable from locals and tourists.
    The Social workers have reported many cases of incest and this is young girls being violated by relatives where many of these that do this shoule be in jail
    Many women sadly are in domestic abusive relationships with no way help very little help for these women not enough social programs . Barbados has changed but I can’t say for the better !

    What I meant to say is there are rapes occuring where locals and as well as tourists are victims.
    Incest is an issue here .
    As well as an onging never ending domestic abuse crisis.
    Women here just are subdued , subserveant and submissive because often they have no where to go,
    Until the courts and police get tougher this will continue and continue!

    But I have no qualms about a firearm being issued to a businessman to protect himself and his ‘interest’ when de bandits come a calling. Too many armed robberies and innocent persons getting injured by these felons man.

    Only a few days ago a friend of mine was among the four fellas that got injured by a ‘drive-by’ shooting in Long Gap or Spooners Hill. He is out of hospital now but nursing a serious injury to his thigh n knee. He’s a really cool fella. Probably wrong place , wrong time. One of the injured may be crippled. That is sad.

    Praedial larcenist is another group that want shooting on sight too. Kill or cripple. A farmer toils all day in this hot-ass sun when the days come and these bitches coming by night to reap what they didn’t sow. I say , ‘shoot, then ask questions after”. Make one or two an example and you won’t have to worry about the others.

    The Police can only do so much. They can’t be here, there and everywhere. To rely on them solely would be to follow blindly like sheep.

    Well I really couldn’t care less what you feel about me. I do not know Johan and never had any dealings with him. I hava as much compassion for his as I would any other stranger. Sorry to disappoint you if you expected me to be a bleeding heart over this issue, but I’m simply looking objectively at it as it pertains to the legal aspects, and all that has transpired from the time the incident occurred up to this point.

    If you choose to launch a person attack against me because I may not see things from your point of view then GO SCREW YOURSELF. I would prefer to have no further discussion with you on the matter.

    If you don’t have a gun, don’t slit your wrists across… Soak in a warm bath, and then cut your wrists and ankles length-wise.

    MY God what sickness is that.

    What about the parents that accidentally have left children to die in hot cars, or let a child drown in a pool. answered a phone the child choked and died.
    DO they not deserve to at some stage try to have a little happiness left to a life they will always have regrets in the could of’s , should of’s ?
    Do you think Johan will ever in his life forget Luke or how he died.
    Do you think Gail will forget, the aunts ? cousins?
    The grandfather? Grandmother he is still and will always be a part of their lives.
    Many times as I will give references in the USA where I went to live after growing up here the parents when involved in accidental neglience that has caused deaths they are not prosecuted.
    AS I have always said “I would like to see johan heal as much as he ever can. do community service try to go to schools as hard as it will be and tell other youngsters the dangers of guns.

    I agree with you that guns should only be in the hands of police. I am not even sure about the army, as I am not even certain that we should have an army. A well trained armed coast guard yes to deal with the people who seek to corrupt our children with drugs but an army. I am not sure…

    The truth is too many of us are in love with guns and money, because we have been fooled into believing that money and guns make us powerful and safe.

    The truth is that too many have convinced ourselves that guns will keep our families safe.

    Sadly this is not the first time that a child died from a gunshot fired at the home of family or friend.

    The truth is that THIS IS NOT THE LAST TIME THAT A CHILD WILL DIE IN THESE CIRCUMSTANCES.

    The truth is that wealthy people do not trust the police to protect their money/property.

    The truth is that people do not buy guns to protect their women and children.

    The truth is that people buy guns to protect their money and property.

    The truth is that if we had to give up ALL our guns in order to keep ALL our children safe, most of us will choose to keep our guns and let the children (ours and other people’s) bear the risk.

    The truth is that we have no large animals in Barbados that have to be hunted with guns.

    The truth is then that guns ALL guns in Barbados are designed to kill (OTHER PEOPLE’S CHILDREN)

    The truth is that guns are lost/stolen/mislaid from/by registered gun owners and dealers.

    The truth is that ALL of those lost/stolen/mislaid guns end up in the hands of criminals.

    The truth is we do not know how many stolen/lost/mislaid “legal” guns have ended up in the hands of criminals and been used to KILL OTHER PEOPLE’S CHILDREN and for whom “legal” gun owners and dealers HAVE SHED NO TEARS.

    The truth is that “legal” gun owners and dealers are part of the problem.

    The truth is that guns do NOT make a family or community safe.

    The truth is that what works most to make a family or community safe is when families and communities work to look our for each other and especially when they work to look out for other people’s children.

    But looking out for our children and for OTHER PEOPLE’S CHILDREN is hard work, so we find it easier to juck a gun in we pocket and pretend we safe.

    Now we know that neither money nor guns can keep our children safe.

    Or do we???

    I think you’re becoming delusional or something of the sort. First of all I hope you’re not confusing me with Chris Hassel.

    I called you a creep because the cap fits. You’re going to attack me because I’m focusing on the legal aspect rather than than the emotional aspect, and say that you feel I have a beef with Johan when I know nothing of the man except for this incident that we are all discussing. You are out of line, and I see it fit to get you back in line.

    I don’t come on public blogs to get emotional and wear my heart on my sleeve, I’m just here to make my contribution from an objective point of view as it relates to the legal aspects of the situation. I never said that I was glad that any of this happened, and that should suffice as far as any emotional contribution from me.

    I also said much earlier in this thread that I would advise anybody who is related or close to the family not to read any of these blogs because people are going to have varying opinions, some of which may be upsetting to those close to the situation.

    If I was to ever find myself in a similar situation to Johan, I would be depending on my family and close friends for support and compassion, but not the general public because opinions and emotions will vary from one extreme to the other.

    So I say to YOU, AND THOSE LIKE YOU, stop attacking other posters for having there own views on the matter.


  43. The truth is that since Luke died not a single fella (or gal) in Barbados has turned his “legal” gun into the police.

    The truth is that tomorrow Sunday morning a full 2 weeks since Luke died our children will still wake up in houses in which both careless parents and guns live.

    And tomorrow Sunday a full 2 weeks since Luke died not a fella (nor gal) in Barbados will turn his “legal” gun into the police.

    The truth is that many of us on this blog crying are crocadile tears saying we would have done anything to keep Luke alive. Anthing that is, except the only thing that could have kept him alive. We are willing to do anything except give up our guns.

    So we say that we love our children, but we love our guns so much more.

    So at another time, ANOTHER CHILD WILL DIE.

  46. I do believe in GUN CONTROl,

    I do believe in Gun Control and less guns period ,
    Who are the victims here a whole family is torn apart !
    What could the charges be negligible manslaughter .
    Johan Bjerkhman will have to live with the aftermath of this preventable tragedy.
    The father will have to live forever with the horrible guilt associated with the taking of his son life. Some say that this is all the punishment that is needed but some of you are not so sure. But his gnawing guilt is enough punishment I truly feel this is enough punishment.
    . The Father paid the most ultimate price, the loss of a la child., a friend and Son. Even to look in the Mothers eyes is beyond words and comprehension. What harsher punishment can be, even Capital Punishment to some would be welcome to end the heart and soul sheering pain of the loss of a love one yet alone another life Gun Safety is always paramount and we can never be complacent and must be vigilant at all times.
    My heart and prayers as I will continue to express goes out to the family, and I only hope someone learns something from this tragedy!

Rok, Look when I Told Chris I wished it had been him if he dares want to say a parent should not continue to live after what happened that is sick and what is sicker is Atman referrering to what I said without putting what I was replying to , I dislike persons who leave out bits and pieces and tell half the story which often does not give you the whole story.
    I am blogging in my pj’s Ok….I am just one person sometimes inmypj’s or blogginginmypj’s one in the same !
