The American Republican Party may very well welcome back President Trump as Leader. Former President Trump has actually never left the leadership since this past election cycle. Many Americans hoped Trump would pass into the lecture cycle so many ex-legislators do, but people in the know surely believe that Trump will not leave the national stage until he is pressured to do so. 

What makes Donald Trump such a force of political and economic persuasion? Why will he not just go away gracefully? Does Canada’s Pierre Poilievre,  who is seeking The Canadian Conservatives Party Leadership share similar characteristics  with Trump?

-So called grass roots movements that often employ undemocratic means to achieve a win.

-makes promises that are attractive to the electorate but maybe not good for the nation.

-Will appear with just about anyone to promote themselves (Truck Protest in Ottawa).

-Their political platforms are based upon -Make America Great Again – Make Harperism Great Again.

-Both platforms are based on returning to “past moments in time”, lacking new concepts-new promises.

-Both men are tied to The Right Wing politically and economically, dependent upon their wealth and     influence to achieve a political win. 

-Both men are tied to foreign national influences and crisis…Trump to Russia, Pierre to USA.

– Both men are destructionists, tearing down regulations, public organizations and governmental   regimes such as Environmental Protection Agency and CBC.

-“Freedom” has become a state of mind for these men and their followers, not knowing exactly what   that means. A umbrella like statement encompassing a great deal.

– Both men’s ideologies support a greater and more powerful military complex.

If you look for any form of imaginative, creative and new political, economic or public concepts you will be dumb founded to fine any. Remember Conservatism Lives in the Past. Conservatives overall fear change, the unique and different. Well not in Ontario, where The Ford Government has shown a unique ability to seek out and work with all their citizens, Conservatives that spend money when needed(Pandemic) while managing their budgets realistically. Trump simply cancelled many social programs, and redirected the funds to places that satisfied their back room supporters needs. Pierre will certainly do everything he can to bring back Alberta’s Energy Industry, and forget all about Climate Change because “its all about the economy” and the pocket books of his supporters.

In America, President Biden may very well retire and not run due to his health, leaving Vice President Harris to face a up surging Republican crescendo. The primary’s are showing Republicans who do not support Trump are falling by the way side, and Capital Hill may have many more Republicans to deal with, creating a “yellow Brick Road” for Trump onto a Second Presidency. Pierre Poilievre has pretty well decaled himself The Conservatives new leader while still fighting the leadership campaign. 

Liberals. Environmentalists, those dependent upon public funds, those seeking a new frontier may all need to quake where they stand, as Conservatism is on the march towards future victories. 

Conservatism means to conserve what was, not what will be. Conservatism does not present hope for better, new approaches to politics and governance. Oh the good old days eh!

    So, in other words, the BRILLIANT Donald Trump, took home documents, “ranging from classified to top secret.”
    The FBI executed a search warrant and found them.
    Trump attempted to sue the DOJ to prevent it from reviewing the documents.

    If, according to the ‘resident Trump-eter,’ Trump declassified the documents, then, WHY would it have been necessary for the FBI counterintelligence personnel and DOJ attorneys conducting the review, to REQUIRE ADDITIONAL CLEARANCES before they were PERMITTED to REVIEW certain documents?”

    One explanation could be that they do not consider the simple act of taking home documents to be in itself a declaration that the documents have been declassified by the President.

    The more I see of this the more I think that either Trump set up the FBI and DOJ or a far higher hand did.

    So a court would need to determine if section 1 of Article 2 of the Constitution gives a President the power to declassify by fiat.

    A quarter of the voters who voted Begich were allocated to Peltola which saw her past 50%.

    Had there been one Republican candidate the result would have been totally different.

    Different election system.

    We’ll see if the majority voters figure out how to use the new system to get a Republican in the House this November.

    It can be defeated easily if voters get their priorities straight.

    Just fill in the first choice only on the ballot!!

    This is a guy who found difficult to accept he lost the last election and did not want to move out of the White House.

    @FellowJohn, you make deductive reasoning and logic which I always believed to be grounded in scientific based evidence presentation into a magical alchemy of BS absurdities, legal inaccuracies and alternative facts ! It’ll work here well everyday but definitely not in a court of law!

    1) You have been reminded repeatedly: This guy is a FPOTUS … he no longer has ANY privileged right to possess ANY government records related to his presidency. Not by statute or by Presidential Executive Order!

    2) So whether records are ‘classified’ or ‘declassified’ they are the property of the US Gov’t. They asked him very nicely over several months to return them and he refused … they demanded he comply with their subpoena and he told his lawyers to say that he had nothing more although he still did. They came with a search warrant and took back what belonged to the government.

    So logically and scientifically based: All POTUS accumulate personal records when in WH and when they become Ex-POTUS they must turn them over to the NARA from whom they will have to specifically request (and get approval) to review any records to write their memoirs , submit to their Presidential library or as they may otherwise require.

    This is so crystal clear that the proverbial blind man sitting on his lame trotting horse can see that sign as he slowly rides up … but you like your magical alchemy! 😎🤦‍♂️

    Good luck in court today … simple prediction says he loses — even if he wins!😂🤣 At best he achieves nothing other than to waste more time!

    When it comes to the National Archives, history has a funny way of repeating itself. And legal experts say a decade-old case over audio tapes that Bill Clinton once kept in his sock drawer may have significant impact over the FBI search of Melania Trump’s closet and Donald Trump’s personal office.

    The case in question is titled Judicial Watch v. National Archives and Records Administration and it involved an effort by the conservative watchdog to compel the Archives to forcibly seize hours of audio recordings that Clinton made during his presidency with historian Taylor Branch.

    For pop culture, the case is most memorable for the revelation that the 42nd president for a time stored the audio tapes in his sock drawer at the White House. The tapes became the focal point of a 2009 book that Branch wrote.

    U.S. District Judge Amy Berman Jackson in Washington D.C. ultimately rejected Judicial Watch’s suit by concluding there was no provision in the Presidential Records Act to force the National Archives to seize records from a former president.

    But Jackson’s ruling — along with the Justice Department’s arguments that preceded it — made some other sweeping declarations that have more direct relevance to the FBI’s decision to seize handwritten notes and files Trump took with him to Mar-a-Lago. The most relevant is that a president’s discretion on what are personal vs. official records is far-reaching and solely his, as is his ability to declassify or destroy records at will.

    “Under the statutory scheme established by the PRA, the decision to segregate personal materials from Presidential records is made by the President, during the President’s term and in his sole discretion,” Jackson wrote in her March 2012 decision, which was never appealed.

    “Since the President is completely entrusted with the management and even the disposal of Presidential records during his time in office, it would be difficult for this Court to conclude that Congress intended that he would have less authority to do what he pleases with what he considers to be his personal records,” she added.

    The judge noted a president could destroy any record he wanted during his tenure and his only responsibility was to inform the Archives.

    As to whether records a president concluded were personal can be forcibly seized after he leaves office, the court concluded it was unreasonable to force NARA to go get the tapes

    “Because the audiotapes are not physically in the government’s possession, defendant submits that it would be required to seize them directly from President Clinton in order to assume custody and control over them,” Jackson noted. “Defendant considers this to be an ‘extraordinary request’ that is unfounded, contrary to the PRA’s express terms, and contrary to traditional principles of administrative law. The Court agrees.”

    That defendant was the same Justice Department that authorized the raid on Trump’s estate. You can read their arguments a decade earlier here:

    Jackson also concluded that a decision to challenge a president’s decision lies solely with the National Archives and can’t be reviewed by a court. If the Archives wants to challenge a decision, that agency and the attorney general can initiate an enforcement mechanism under the law, but it is a civil procedure and has no criminal penalty, she noted.

    The search warrant the FBI enforced sought two types of records: classified materials and records created during the Trump presidency. Trump has been adamant the records he took to Mar-a-Lago were both declassified and deemed personal by him.

    Some government lawyers reached out privately to Just the News in recent days questioning the use of the FBI to collect presidential records, citing Jackson’s ruling and suggesting it was a civil and not criminal matter where deference to Trump is required by law.

    On the classification issue, both Presidents George W. Bush and Barack Obama signed executive orders — which remain in force to this day — declaring that presidents have sweeping authority to declassify secrets and do not have to follow the mandatory declassification procedures all other government officials do.

    The Jackson ruling and the declassification powers have left some experts worried the FBI raid was heavy-handed under the current laws.

    Kevin Brock, former assistant FBI director for intelligence, told Just the News the bureau’s search warrant was overly broad and went beyond what the FBI manual for agents recommended. “Specificity is important in order to protect fourth amendment rights from exuberant government overreach designed to find whatever they can,” he told Just the News.

    Brock added he did not believe DOJ and FBI had authority to criminalize the retention of presidential records.

    The warrant “apparently makes a novel legal assertion that any presidential record kept by a former president is against the law,” Brock said. “You have to wonder what the other living former presidents think about that. They have the right and, apparently, clear desire to remain silent.”

    Tom Fitton, the president of Judicial Watch who was on the losing end of the Clinton sock drawer case, said he believes Jackson’s ruling could have a profound impact on the coming legal battles over the Trump search.

    “The government, the lawyer for the Archives, said, ‘You know what? If documents are in the former President’s hands, where they’re presumptively personal, we just, you know, we presume they’re personal,’” Fitton said.

    “The Justice Department previously had told us in response to a question about Bill Clinton: ‘Tough luck, it’s his.’ But they changed their mind for Donald Trump?” he asked. “… The law and court decision suggests that Trump is right. And frankly, based on this analysis, Trump should get every single document they took from him back. It’s all personal records.”

    Actually @Artax, it’s very simple I am merely citing the stated law. Even more simple, all of us must return to our employer any materials either produced by them which we used or that we created as work product while an employee. We CANNOT keep to ourselves their ‘proprietary’ data as personal records.

    Now, surely a POTUS is different because as deemed by court ruling cited above “Under the statutory scheme established by the PRA, the decision to segregate personal materials from Presidential records is made by the President, during the President’s term and in his sole discretion,”.

    But let’s be clear about the SELECTIVE precedent used above. A higher court (SUPREMES) also ruled in the Nixon tapes case that a POTUS does not have ”an absolute, unqualified privilege to withhold information.” particularly and specifically when the grounds for asserting that privilege relates to a subpoena in a potential criminal case. That is PRECEDENT too!

    Furthermore, POTUS cannot decide that specific secret classified govt docs are HIS personal records and segregate them as such. That would be a nonsense. The case with Clinton related to audio recordings NOT specific gov’t owned and produced classified info for which (like nuclear of Human Intel files) there are other very CLEAR statutes that in themselves PRECLUDE any type of automatic declassification from a POTUS.

    So with those basic perspectives along with the other rules and regs in mine which @JohnFellow can easily reference I would agree that he (and his right wing media folks) are “spewing ‘shiite’”!

    The legal issues will be determined by iudges for sure but the attempts to use precedents wrongly can NEVER succeed .. FACTS still remain FACTS and the law must be followed as no man or woman is ABOVE the law!!

    As far as John is concerned, the discussion should really have ended at least as long ago as 21st August almost 2 weeks ago when John produced references to Judges decisions, George W. Bush & Obummer’s Executive Orders to support what he said.

    The Special election primary produced 4 candidates a couple of months ago.

    Al Gross was #4 and ran as an “independent”.

    He decided to withdraw and promptly thew his support behind the Democrat.

    #5, Sweeney petitioned the court to allow her to take the place of Gross.

    Like Peltola, she was also Native American and could have divided the Democrat vote as they were no doubt promoting being Native American..

    So, the slate was reduced to three, 1 democrat and 2 republicans.

    The result was as could be expected, 60% of the state voted Republican and 40% voted Democrat and some of the Republican vote was given to the Democrat to get her over the 50%.

    Murkowski, the Republican RINO Senate candidate backed the voting process change in Alaska.

    Mukowski’s position in the 2022 midterms should not be under threat but who knows, voters might get mad at her support for the change.

    Voters know now what to do in the 2022 midterm to counteract the change, but the Republicans need to get one of their candidates to withdraw from the House race in the midterms to avoid splitting their 60% support in the state.

    Trump blasts FBI over leaked photo from Mar-A-Lago raid

    Former President Donald Trump accused the FBI of trying to frame him by leaking a misleading photograph taken during the agency’s unprecedented raid of his Mar-A-Lago home in August.

    In a social media post, Trump accused the agency of taking a “deceiving” image by leaving documents “haphazardly” on the floor and then sharing it with the world to smear him.

    The widely publicized picture of “top secret” files was unveiled in the DOJ’s legal dispute with Trump over having a third party “special master” appointed to review files seized during the raid.

    Where the left saw a smoking gun, many on the right saw the photo as yet another in a long series of underhanded efforts by the Deep State to tarnish Trump.

    Many, including Trump, also questioned the sincerity of the DOJ’s insistence on the secrecy of its investigation into Trump’s alleged unlawful possession of classified records.

    “Thought they wanted them kept Secret? Lucky I Declassified!” Trump wrote in a Truth Social post.

    THAT IS A VERY GOOD POINT.

    Trump’s legal team similarly called the photo leak “gratuitous” and alleged it was intended for “dramatic effect” in a court filing accusing the DOJ of wanting to “impugn, leak, and publicize selective aspects of their investigation with no recourse.”

    More dirty politics?
    Of course, this isn’t the first time that leaks involving Trump have raised suspicions of dirty politics. Days after the raid, an anonymous report suggested Trump was keeping nuclear secrets, but it’s not clear what came of that story as the DOJ continues to stonewall.

    In a blow for the DOJ, however, the judge overseeing the special master dispute agreed Thursday to release a more detailed inventory list of the items seized during the raid.

    The DOJ has conceded that a “limited” set of materials was seized that is covered by attorney-client privilege, but the department insists a third-party review of records would be unnecessary.

    Yet Trump’s lawyers claim the DOJ is seeking to avoid any “judicial oversight” of the “unprecedented, unnecessary, and legally unsupported” raid.

    That sounds like a legitimate concern, given the DOJ’s track record concerning Trump, not to mention its clearly favorable treatment of Joe Biden.

    Former Supreme Court Law Clerk: FBI Case is ‘Blown Apart’ By G. McConway on September 1, 2022

    Mike Davis is a former clerk for Justice Neil Gorsuch. THAT MEANS HE IS RIGHT WING ——-AND MUST THUS BE WRONG UH LIE?

    He joined Fox News this week to talk about the FBI raid and possible charges being filed against former president Donald Trump. If Davis is anywhere in the ballpark on this, the case against Trump is starting to fall apart.

    Davis is a bit more confident than I am regarding charges eventually being filed against Trump.

    I have already stated that I think this entire thing was a setup that Trump walked right into.
    When agents did not take all the documents from Mar-a-Lago the first time, which they could have, they set the trap for obstruction.
    The moment Trump’s attorney signed the document verifying all classified documents were out (and yes, I am aware that Trump said he declassified everything), they had set the trap.

    If the DOJ can somehow prove these documents were not declassified and property of the government, they get Trump on obstruction. This does not mean they will be able to convict him, but they can indict him, which I believe is the real object here.

    Davis stated, “There’s a 2012 decision by an Obama judge that former presidents can take personal records with them when they leave office. “So there goes the obstruction allegations. It’s legally impossible to obstruct non-crimes like they’re trying to investigate here.

    “There’s a track record of lying in this case. They leaked out that Attorney General Merrick Garland did not personally approve this raid. That’s a lie.

    “They leaked out that Trump had nuclear documents at Mar-a-Lago. That’s a lie.

    “They leaked out that President Biden and the Biden White House was not — did not have a heads-up about this raid. That’s a lie.”

    My head is honestly spinning with the different narratives coming out over this raid, but I still think Davis is off the mark here.

    This case has quickly gone from classified documents to Trump lying about documents other than personal documents remaining in his possession.

    This all comes down to whether Trump took documents that typically go to National Archives, then lied about them still being in his possession. If he did that, the DOJ has its case.

    Will we see an indictment against Trump after the 2022 election cycle so Dems can eliminate him from the 2024 ballot?

    I think it is simply another Democrat smoke screen to cover up Joes involvement in the Hunter scheme with no real evidence against Trump they did not invent.

    @David, you said a few days ago that there will always be fanatics and agitators on the right and left who refuse to deal with legitimate facts. We can all agree with you that b. However, it becomes very troubling when subject matter experts prostitute themselves so blatantly to twist facts to validate nonsense…. How can sane people look at what’s happening with this ‘records handling’ crisis and defend this FPOTUS.

    In the latest reports on the inventory list of documents found the FBI noted: “There were more than 48 empty folders with a “classified” banner and 42 empty folders marked to return to the staff secretary or a military aide.”

    The questions are troubling and daunting: WHY did the FPOTUS need to remove and review these documents as is suggested by them being out of their folders? … WHY are they intermingled with his personal mementos or passports and other stufff??

    Obviously we do not know exactly what was in those folders (as apparently they were not indexed to a registration system) and maybe all of the materials are intact amidst the boxes but WHY were top secret details being handled as they were! ?????

    The US (many Republicans too) wanted to capture and or kill Assange and Snowden and have jailed a number of folks who released confidential data but in this instance although it could be much more damage to the US as they actually DO NOT know what this man has released to external sources yet they defend his actions (and possible treachery)!

    Can we even comprehend how Moassad or MI5/MI6 or the German and French intel services are reacting to this stunning series of events where a FPOTUS appears to be actively ‘marketing’ top secret intelligence reports to his friends in Middle East, Russia and elsewhere.

    That attempt on Fernandez in Argentina has no connection to Trump whatever but in the scheme of life I would suggest that he should really boost his security.

    If Barack Obama or Hilary Clinton had done ANY of this insanely treacherous behavior I would have already said all my prayers for their souls and wished them well as the two and their entire families would have been ‘cancelled’ post haste.     Former Judge Andrew Napolitano is predicting that former President Donald Trump will be indicted by the U.S. Department of Justice (DOJ).

    Napolitano made the prediction in an op-ed that he recently wrote for the Washington Times. He gave a preview of it during a recent interview on Newsmax TV’s The Balance.

    There, Napolitano was asked why he believes Trump will be indicted by the DOJ. He replied:

    Because I don’t think the government would’ve gone through this without planning in advance to indict him. It pains me to say it, and I don’t think he should be indicted. But I think the people that will make this decision have already made up their minds, and they’ll make this presentation to the grand jury right after the midterm elections.

    Napolitano concluded by saying that he hopes that he is wrong.

    Napolitano went into far more detail about why he thinks that Trump will be indicted by the DOJ in his op-ed for the Washington Times.

    There, he predicted that Trump will be indicted for three crimes: “Removing and concealing national defense information (NDI), giving NDI to those not legally entitled to possess it, and obstruction of justice by failing to return NDI to those who are legally entitled to retrieve it.”

    Notice that, contrary to what news media coverage has been suggesting, Napolitano does not believe that the DOJ will indict Trump for possessing classified materials. Rather, the indictment will center around the possession of NDI.

    Napolitano explains that, regardless of whether they are classified or not, “it is simply and always criminal to have NDI in a non-federal facility, to have those without security clearances move it from one place to another, and to keep it from the feds when they are seeking it.”

    Napolitano, in the op-ed, continues by going through the elements of the charges that he believes Trump will be indicted for.

    One of the elements is that Trump knew that he had the NDI documents, another is that the documents actually do contain NDI, and a third is that “Trump put these documents into the hands of those not authorized to hold them and stored them in a non-federally secured place.”

    Napolitano writes that the first element is already met since Trump stated publicly that the NDI was no longer classified. And, regarding the other two elements, Napolitano writes:

    Intelligence community experts . . . are prepared to tell a jury that they contain the names of foreign agents secretly working for the U.S. This is the crown jewel of government secrets. Moreover, Mr. Trump’s Florida home is not a secure federal facility designated for the deposit of NDI.

    Napolitano concludes that Trump is “in hot water.” He says that he “cannot think of a legally viable” defense. If he’s right, then the former president appears to be in some serious trouble.

    Yet the bulk of liberal commentators are ignoring the dark overtones of Biden’s message. Even CNN edited out the red lighting and slanders against nearly 80 million voters.

    Trump concluded that Biden’s performance suggests that he is “insane” or “suffering from late stage dementia.”

    Nobody knows for sure, since Democrats have refused to allow Biden to take a cognitive test.

    But moments like this should have everyone wondering.
