Your message to the BLOGMASTER was sent

The following is an abridge version of a communication received by the blogmaster. To protect the author names of some parties were withheld. In the opinion of the blogmaster the submission reinforces several blogs on the subject of the need for effective regulation to monitor and discipline lawyers in Barbados – David, Blogmaster

A moral injustice prevails when the legal fraternity within any society can act with callous disregard to ethical principles which it is supposed to operate under and it is not held to account for actions which oppose these rules. Barbados sought to ‘leave its Colonial past behind,’ and has become a Republic but it will remain ‘shackled’ by its own heavy man-made chains, which unbalance the scales of justice if it does not act with enforcing accountability on the country’s legal profession.

Undeniably, a country’s government cannot police personal morals; unarguably, principles and standards under law, which govern the actions and behaviours of lawyers should be kept under vigilant scrutiny by a properly functioning body, that is robust and transparent. 

Significantly, people who suffer at the hands of unscrupulous lawyers, many of whom are women clients undergoing high emotional trauma, are reluctant to speak out, for fear of reprisal by a societal culture of ‘blaming and high religious righteous indignation,’ levelled at the victims.  Therefore, these lawyers in a superior position, take advantage of their victims at a time of high vulnerability who have put trust in them and they abuse that trust. This not only results in financial damage but the emotional cost factor is untold, with substantial injury inflicted on susceptible individuals who have turned to these lawyers for help.  

For those reading and about to take a judgemental position, please ask yourself these questions: if a blind person asked you to escort them across a busy cross road intersection, would you feel right about navigating them into the middle of traffic and abandoning them?  If an anxious child asked you to hold its ice-cream to urgently go to the toilet, would you eat it? These analogies resonate with those in desperate need of legal help, who turn to lawyers in Barbados and in particular, powerless women seeking help.

There is one former prominent lawyer (now deceased) who took on divorce cases, where property was involved, wielded position and power over young women for his own personal and financial gain. His conduct of fraternising with his client was merely reprimanded by one judge in closed court, unchallenged and never reported to the BA by any of his peers; even though, they all were aware of his conduct. Back then, an upcoming ambitious attorney, who is now the present Attorney General, was informed about this lawyer’s unprofessional conduct and client liaisons; but did he report that individual? No. No lawyer wants to report another and would it do any good reporting to the BA so the behaviour continues.  Conversely, more can also be said about abuse of power within other sectors; the exercise of harmful influence over others, who approach business institutions to engage in lawful pursuits only to be forced into relationships with those who head these business entities.

Incumbent upon the Barbados government is addressing, the lack of challenge of this wrongdoing which spills over into an unwritten law, that abuse of position and power is acceptable. This pervasive social view has become entrenched and inherent, written into the subconscious, and into an ‘invisible constitution,’ that those who hold other offices, see it as the natural progression of being empowered, to control others with resulting tangible rewards, thereby functioning under their own circle of ‘self-regulated systems.’  Seeking justice by engaging and soliciting the help of a lawyer or participating in conducting business, should never become a mine field of being preyed upon, exploited nor swindled.

Government ministries are closely tied to the legal fraternity; indeed, several government ministers are lawyers or affiliated to legal firms.  Negotiation and deals can become rather personal; intertwined and often blurred, creating more inequalities in society when there is the absence of accountability of the ethics which guide the legal profession. Within this current atmosphere, abuse of power and trust, and whereby lawyers are not vigorously monitored, all support injustices being solidified, which in turn create a new type of slavery, that is not perpetuated by the White Europeans but an acceptance of the ‘the way things are,’ one which is a social construct, called ‘Black Manipulation.’

    The legal system worldwide is a scam where lawyers paid for time drag cases out to accrue costs.
    The only people who benefit from skillful lawyers are criminals who need help skirting around law.

    The population of Barbados is predominantly black (91%) or mixed (4%). 3.5% of the population is white and 1% South Asian. The remaining 0.5% of the population includes East Asians (0.1%).

    Why aren’t these lawyers exposed beyond pictures in the papers where are the investigative journalists.

    All I have said is that lying is counterproductive and calls her credibility into question. This allows her targets an opening to discredit even the truth in the message.

    I have had 10 YEARS…a whole decade worth of EXPERIENCE in the high court system, outside of working WITHIN THE SYSTEM for longer than i shoudl….. you don’t get more knowledgeable than that….you have to be there to see it to even believe it…..and it’s well OUTLINED in my book.

    William…my book dedicated a WHOLE CHAPTER to that from the perspective of my personal injury case……those who gave me reviews said straight up they have heard about it for years, but that was the first time they actually saw it in print….that someone actually had the courage to write about that , the politicians and the criminal minorites….they never thought they would see it ever happen..

    I happen to share this same opinion. You can hear of this wrong and that wrong and quite often there is no person named. What is worse when we know of a person’s name nothing really happens. In a case where a lawyer misappropriates his clients funds and it takes years to resolve the case, the client will most likely get a pittance at the end. If there is sufficient evidence of a misdeed, one of the first steps should be an attempt to locate and freeze the funds. Winning a drawn-out case and then having the lawyer unable to repay missing funds is a meaningless win for the client..

    Society cannot correct or protect itself if wrong-doers are not named. This reminds me of not-snitching where persons who refuse to call names eventually end us as one of the victims. Why is there this fear?

    But not naming extends far beyond the legal profession and is just a part of the problem
    Can you tell me the name of the company that destroyed the underground water structure?
    Can you identify who are involved with EWBSB?
    We became aware of the vaccine scam only after it blew up.
    We became aware of overpaying for a slogan only after the the slogan was delivered
    The list is endless

    Integrity legislation and Sunshine laws are a part of the solution

    and it is well appreciated William….apparently i was not EXPECTED to OVERCOME the criminality against claimaints…that might have some people out of sorts, they are still dealing with that SURPRISE……but i’ve long moved pass that, was doing VERY WELL before the outcome and any pay out….

    ……they too love the cuddear results so that they can snicker, smirk and laugh at the victims behind their backs, happy that they were victimized, that they can’t contain themselves with their glee……but i was NEVER A VICTIM…..sorry, for them, that they were disappointed…

    My next book, exposes the WHY completely, it touches on some very, very sensitive areas…….and will definitely help those who have to navigate that pit of criminals…just like this first book is doing for those who need it the most, from the perspective of my court experience and other areas that some people never knew the full story, and are very appreciative for what i wrote……and they tell me all the time.

    I don’t understand some people, was VERY VOCAL for 10 long years about that dangerous system….even gave MANY, MANY.. examples on BU….they may not have picked up on HOW CLOSE i was to it for a very short period, which was WAY TOO LONG in my estimation…because they only read and understand what they want…

    ….but it was SO SHOCKING to my system, especially after my experience in the NYC legal system, that i could not believe that it was not UPENDED decades before with the help of those now pretending they did not know just how destructive it is to Black people……it’s nothing anyone should want to become a part of…and it does not do justice to its man-made EVIL unless you are up close and personal to it to get a better understanding of it and the criminals who perpetrate the whole thing…..

    That’s why i don’t get the people on BU….my case was no secret, and when i got REALLY PISSED OFF….was NOT SHY to SOUND OFF….on everyone i saw as trying to victimize me, so i have no clue what game these are playing now, pretending that no one knows EXACTLY WHAT IS WHAT, not those pretending they know and don’t;;;;…..the archive is choc-a-bloc..

    fortunately for me, i happened to have much more information than the average person…and that presented a problem for them THROUGHOUT THE 10 YEARS…..

    so let them play their BU games, all of us have moved on and are quite happy with the outcome, i have gone merrily on my way and no threat to them whatsoever….they are now safe to continue doing what they do best to those who would allow it….i no longer have any fight with anyone.


  26. The justice system with extortionate disproportionate legal fees is only available for rich to engage and partake in, the poor are excluded as they do not have available financial resources. Therein lie the rub. There is justice for the rich but not the poor.

    Naming and shaming has gone on in Bim for quite a while, as clearly evidenced by the various bits of info that find its way into the public domain…. without any prejudice or recriminations I’ll go way back in time and cite the ‘Boys in the Band’ exposé as an example. Of course Cahill and many others have also came to the public … so quite clearly your point is well taken.

    And @Skinner you know well that your glib remarks about ‘investigative journalist’ lacks the reality test. Wherever you are but particularly in small, interconnected societies it is almost IMPOSSIBLE to offer truly investigative journalism on ‘burning’ political issues without long term dire consequences… you have lived it here and know the inner workings of things so please don’t fall into these unreal tropes, fah real.

    Take a comment from @John Fellow (assuming he is valid on this 😊) from the other blog as an example …. he said this nugget: “[she was advised] by her lawyer to bring [a case] against the AG citing delay. The third was last heard in 2013 and it had reached the stage where the AG had to defend why an inquiry into damages against the office of AG should take place. Everything shut down!!!! […] After all, 2013 – 2022 is 9 more years of delay.”

    As he then alludes to so dryly, this former AG (who happened to be AG in 2013) and this current gov’t are using the same judicial process to supposedly get JUSTICE although they so GRIEVOUSLY ABSUE Bajans daily in the same courts … how ABSURD can it be that a case (or three) brought against the govt to EXPEDITE adjudication in a previous matter is itself in ABEYANCE for almost 10 years! That is ludicrous And we have heard it ALL before… waiting for folks to die!

    Am well qualified to say that from 1940-present 82 YEARS…they have only managed to perfect the art of SELF-DESTRUCTION especially to the people who traverse those areas…..and even less capable of reversing any of it..

    This business of dysfunctional lawyers is VERY LIKELY the VERY ROOT cause of the ALL the really serious problems that we face as a country. The issue of ‘calling names’ or of individuals fighting the system is moot.

    Those people who stand up ONLY DO SO WHEN PERSONALLY IMPACTED.
    This kind of ‘self-interest’ resistance is only to be expected. It means nothing. WHAT is REALLY needed is PRINCIPLED outcry from the masses who do it because it is the RIGHT THING TO DO (ie righteous)

    So far, ONLY YOU (via BU) has taken ANY SUCH STAND. Keeping the crooks ‘in the news’…(Bushie don’t miss these things)
    The rest of the press in Barbados are 98.5% ‘for sale’ to the highest bidders, and the other 3 are SCARED. … and so are fully OWNED by the crooks.

    Add this to the FACT that EVERY SINGLE major Statuary Board is chaired. or infested. by lawyers – and it is easy to see why we are in duck’s guts as a country.

    The VERY fact that there continues to be NO PROVISION for the annual AUDIT of client fees held by lawyers in Barbados speaks volumes – PARTICULARLY when the same CROOKS in government have been frustrating honest Bajans with idiotic Anti-Money-Laundering rules against people who are barely making a living – WHILE LAWYERS COLLECT MILLIONS WITHOUT ANY SCRUTINY.

    People ALWAYS get exactly what they deserve….. that is what we Bajan BB’s are reaping.

    what i can tell you it’s a very NASTY BATTLE…that not many people are up for, fortunately i have what it takes to THROW DOWN in all types of nastier ways, and that’s the only thing that worked in my favor..

    it took me months just to WIND DOWN from it after 10 years…you don’t want to hear the details, some people only think they do….the lawyers are the key to if you reap success or not, don’t stand up on their asses with a BIG STICK and see what happens, they will just laugh at you……= ANOTHER VICTIM…

    from the Blogmaster on down know ya don’t get payouts just so….one bedridden young man went to his grave without his money…..the sum quoted was a 13 million dollar payout, not sure if the amount is accurate, but the insurance company said they paid out a lot, all the crooks lined up and TIEF EVERY DIME of it, he went to his grave afraid to name the SCUM LAWYER who set him up……….one crook who allegedly benefited from the theft of the same bedridden man’s compensation just got buried recently himself…..there a countless such cases too numerous to mention…….this is no joke and unless something is done with those accused of these types of daylight robberies, it will NEVER END…..

    Some of us choose to criticize the justice system and legal fraternity, when it is convenient to do so or suits our particular political agenda.

    I’m sure you remember when you were vilified for keeping the issue of Michael Carrington withholding funds and property from his former client, Michael Griffiths, ‘in the spotlight.’

    Ironically, Sarge said, ” Stuart is a lawyer…….And wunnah expect lawyers to be policed…….”

    Rather than admonish Carrington for his dishonest deed, Stuart advised him to ‘get a lawyer,’ and argued ‘legal mumbo jumbo’ to separate the actions of Michael Carrington, ‘the lawyer,’ from Michael Carrington, ‘Speaker of the House.’

    If you were to peruse the various articles BU published on the ‘Carrington affair,’ such as “Michael Carrington’s Immoral Act Goes Unpunished,” for example, you would realize the resident DLP supporters DEFENDED the former Speaker’s actions, while making references to questionable activities undertaken by BLP politicians, so as to JUSTIFY his “immoral act.”

    I’m sure you also recall when Gregory Nicholls became embroiled in a controversy relative to funds he borrowed while canvassing in St. Michael North West, the same resident DLP supporters were quick to criticize him, PURPOSELY IGNORING the fact that BOTH men essentially COMMITTED dishonest acts.

    As to Bush Tea’s point about dishonest Bajans wishing they were in the position to do the same, I made that point long time. Not all……but enough of them to give the lawyers cover. If you can believe that you are doing to your client what your client wished he could do to you, then you can sleep with conscience clear.

    And there are plenty of Bajans who think a politician would have to be a fool to go in broke and come out broke. One orderly at the QEH told me rathèr loudly and proudly that he would do exactly the same as the politician, so he cyan say nutten.
