On Nov 9, Gore calls for a manual recount in four strongly Democratic counties, including Palm Beach. Bush appeals, but it is dismissed by a federal judge.
The legal battle begins in earnest. Lawyers arrive en masse in Florida.
On Nov 26, Florida declares Bush the winner, with 537 more votes. Gore contests the result, arguing thousands of votes have not been counted.
On Dec 8, Florida’s Supreme Court agrees with Gore and orders a manual recount of 45,000 ballots that were rejected by the machines.

On Dec 12, the US Supreme Court steps in for the first time ever in a presidential election.
The election was on 7th November 2000, 2 days later, Gore begun the process in the lower courts in Florida.
It looks as though no one appealed to the Supreme Court, it just stepped in of its own accord and stopped the count with Bush the winner.

If it just stepped in without being moved it would have done so to meet the deadline which was about to come due after it had its say.
If that is the case, the Supreme Court may choose NOT TO STEP IN THIS TIME .
In which case the litigants would be engaged in protracted litigation when the dead line passes and a CONTINGENT ELECTION would be called.
The winner would become the new President Elect and would be sworn in on 20th January 2021.

A CONTINGENT ELECTION would have been called and Bush would have won.

There is a long practice of observing conventions to ensure the smooth transfer of power. We are told the transition teams have been working as per the historical practice.
So it looks as though the Supreme Court was in fact moved to stay the count in 2000.

Dec. 8, 2020: Deadline for Resolving Election Disputes.
All state recounts and court contests over presidential election results must be completed by this date. (3 U.S.C. § 5).
For the majority of states the date of certification is the same as for all contests, but in eight states there is a deadline that either directly references 3 USC §5 or uses similar language, requiring that disputes surrounding the selection of presidential electors be resolved in time to meet the “safe harbor” deadline: Indiana, Iowa, New Jersey, North Carolina, Ohio, Tennessee, Texas and Virginia.
So, does the new or old Congress and Senate elect the President and Vice President?
If it is the new one the Georgia run off’s for 2 senate seats will be important because that may tie the Senate.
That isn’t going to be known till January!!
