There was a time not long ago Michael Lashley was a minister of Crown. He made his mark building many houses and during his early tenure was perceived as a most productive minister of Housing when Esther Byer-Suckoo did not quite measure up to expectation.

In the days post 30-0 defeat of the Democratic Labour Party, Michael Lashley has become one of the most sought after lawyers in Barbados. The blogmaster must be careful to state Lashley has the right to defend any person in a justice system that presumes the party is innocent. However, one must be honest to note Lashley attracts a fair share of clients not of this world.

    A reminder to comment responsibly? Why is this even a topic for discussion? Michael Lashley is also known for his craftiness in orchestrating procurement benefits from the number of houses he was able to give consent to for construction. Barbados is now a crime hub, lawyers such of his type would attract interesting clientele.

    Bail Act amendment is timely

    A significant increase in the incidence of gun-related crime over the last three decades, and growing concern among all Barbadians about the island’s current murder rate, are among the catalysts for Government’s decision to amend the Bail Act.

    As he introduced the amendment in the Senate this morning, which will restrict bail being granted to people who are on remand for serious offences like murder, Leader of Government Business in the Senate, Jerome Walcott, quoted statistics from the Criminal Justice Research and Planning Unit which indicated just how serious the problem had become.

    “Between 1989 and 1998 there were 184 murders in Barbados, and only 24 were firearm-related. For the period 1999 to 2008, we recorded 267 murders, with 101 involving firearms, and between 2009 and 2018, there were 260 murders, with firearms accounting for 140 of them.

    “So far this year half of the 20 murders we have recorded involved firearms. Years ago there was a practice of not granting bail to murder accused, but that is limited now and only applies if they fail to surrender, interfere with witnesses or if the Court does not believe the person should be granted bail.”

    He added that there were too many recent incidents in which people who were charged with murder received bail, and ended up being charged with murder or firearm-related offences after their release from custody.

    Opposition Senator Caswell Franklyn, in welcoming the amendment, said ideally murder cases should be “fast-tracked”.

    “If a person is accused of a crime, spends seven years on remand but turns out to be innocent, the state will have destroyed this man’s life because in the interim he would have lost his job and possibly his family as well. There should be some kind of compensation for those who spend years on remand and are proven innocent.”

    Senator Franklyn said once all the evidence and witnesses were in place, it should be easy to get murder cases heard as quickly as possible. “It is best to bring these things to court when they are still fresh in the memories of all the parties involved, because with the passage of time, people might not remember exactly what transpired or may remember only certain aspects of it. There are also too many people who end up on remand for frivolous matters, and this is choking up the system.”

    Government Senator, Lisa Cummins, said she was disturbed at the fact that criminals were being hailed as heroes in their communities via social media and other platforms, and called for greater community involvement at all levels to help stem the tide of deviance which had resulted in the spike in murders recorded so far this year.

    Following on from this point, Senator Dr. Romel Springer lauded Government’s decision to put more social workers and guidance counsellors in the primary schools and cited four main reasons why society was heading down the wrong path.

    “First, parents are not insisting that their children go to church anymore, so they are lacking that moral and religious grounding. Second, parents now want to be ‘cool’, they want to be their children’s friend, as opposed to setting the standard for their children; children as young as 11 and 12 years old are at fetes and other events with adult men and women while their parents are at home sleeping. All too often parents are letting technology raise their children; that is, they are giving them a tablet and they are looking at all kinds of videos and websites which send their moral compass off track.”

    In lending her support to the bill, Barbados Workers’ Union General Secretary, Senator Toni Moore, agreed with Senator Cummins that more Barbadians needed to get into the community and offer their services as mentors to young people.

    “We must move beyond words to save our young people. There are many children in our schools without the tools they need to advance at a proper rate, and many who are living in environments where they do not have home support to show them a brighter future. While this current amendment is not the answer or the perfect solution, it will help us pull our society back from all the negatives that have entrapped us for a number of years now. Therefore it should not be politicised.”

  9. If we are discussing Michael Lashley who, as a private citizen, can represent whomever he choses to, we could also discuss Arthur Holder who is Speaker of the House and the type of clients he rushes to represent.

    I believe Holder should be removed from that position. He is overseeing Parliament where laws are enacted and then goes to represent clients who breaks those laws to ensure they “get off.” This is sickening.

    And people don’t see anything wrong with this?

    A Government senator was emotional today as she recalled her experience being the victim of a gun-related crime.

    Speaking during the Bail (Amendment) Bill 2019 debate in the Upper House Senator Dr Crystal Haynes gave a touching account of a criminal act against her while studying in Trinidad.

    “I was the victim of an armed robbery when I was a student in Trinidad and that fear is something that changes you. It is something that you carry throughout your life. It just hurts me to see the place where we are at today. It hurts me to know that it has taken this for us to get here…”

    Referring specifically to the recent brazen act of violence where a man was shot at Sheraton Mall, the senator said when she heard the news she could only imagine the fear felt by those who were present.

    “That murder that sent shockwaves from Sargeant’s Village, Christ Church to St Lucy. I saw a video where a former president of this senate was assembled with a group of visually impaired persons with the intention of encouraging other members of the visually impaired community to be bold, be brave, get out Sheraton is a safe place. Then it turned into a frightful scene that can only be compared to an act of terror.”

    While throwing her full support behind the Bill, Haynes lamented that criminal acts where no longer confined to certain districts.

    “Once upon a time we would have liked to believe that crime would have been concentrated in specific enclaves: in Crab Hill and Silver Hill… That anyone in the food court that day, any member of Ms Ifill’s delegation could have become a victim is something that pains me.”

    The senator, whose voice was inaudible at times as she was extremely emotional during her presentation, said tough decisions have to be made in order to address the ‘crisis’.

    “If a toe has an infection and you don’t treat it the whole body can develop sepsis and the person dies that is why we are here today doing what we can in our roles as legislators to do something to stem what has become a crisis. Even more worrying is that when we see the face of the perpetrators of these acts they are children, our nation’s children.

    The doctor by profession said the entire country must take responsibility for the current situation.

    “During my time as a medical student I delivered ten babies and I have never seen a Barbadian mother give birth to a monster. None of these young men became that way overnight. Whatever deprivation they face at home, whatever abuse they faced at home, we, not just their immediate families, we the wider community failed to respond to their cries.

    Haynes continued: “Now we are facing a situation where they fear no God, they fear no man. They don’t fear the police and they are convinced that if they do the crime at 17 that they could be back out before their 30th birthday.”

    Equating Lashley business interest to his political ministerial duties does not wash since he is no longer a member of parliament and is free to practice in law to his own preference which is legal
    On the other where u should be sending your spot light is a PM who have entertained known drug dealers in Parliament
    Also Mia has closed mouth to allegations on corrupt partices done by some of her ministers which are being blasted across social media
    Out of a need to be transparent and remove any form of illegal attachment to her ministry one would have belived Mia would have adressed those problems dealing with the Stewarts issue

    Have “we” really? Arthur Holder private citizen is not the same as Arthur Holder Speaker of the House. Utterances by a private citizen (not withstanding the fact that he was seeking a Parliamentary seat) is very different from the actions of the Speaker when he doffs the robe of his office and dons the robes of a criminal defence lawyer.

    you seem unable to separate issues. we had an election. Lashley along with his fellow DLP reps. were voted out. Lashley is now a private citizen practicising his craft. how can we compare him and his actions now with an elected official? in fact why are we even discussing it? should he not represent criminals?

    his actions as a politician is fair game and ought to held under the microscope if need be. but that is not the case here. hence the false equivalency tag.

You let Mia Mottley talk about DLP corruption and when she got what she always wanted, she is all about evidence, and interested only in pointing fingers at the last administration and that is all.     That is the symptom of our beloved duopoly. Second it a symptom of elective politics. John Public can only vote for those that put themselves forward as candidates. The individual constituency machinery of all parties are to blame for selecting knowingly unfit persons as a candidate for election. A third symptom maybe the first-past the post system that ensures the most popular corrupted candidate gets the prize/seat. It is quite apt to note that “To to winner goes the spolils”. and “history is usually written by the victor(s) not the vanquished”.

    The saying that birds of a feather flock together is quite apt, as the party machinery select certain fowls/birds and the party machines is filled with certain birds/fowls. Then we have a HoA filled will selected fowls/birds that stick together?

    The judicial system requires that innocent people should be represented by lawyers and in Barbados

    We as electors on the election day may reject in droves the slates of candidates that are nominated by the known parties machinery and those that are considered independents. But with the first past the post system we are using the most popular(vote wise) candidate still wins.

    Image a scenario in any constituency. They are 4000 registered electors. The respective party machinery nominates 3 persons. 1 BLP; 1 DLP 1; SB and there is 1 independent . A total of 4 candidates contesting the seat in HoA. The electors in the constituency detest all of these candidates as their reputations and associations are well known etc. On election day the majority of the electors effectively boycott the poll as a sign of protest of the quality of candidate etc.

    At night fall here are the results. The return officer says something like this

    Total number votes counted = 70 Spoilt = 6, Effective votes cast 64. Mind u 4000 person have the right to vote.

    Candidate John Doe (profession very corrupt) (BLP)) = 14 votes
    Candidate Jane Dough (profession exceedingly corrupt) (DLP) = 11 votes
    Candidate Mary Dhoe (profession abhorrently corrupt ) (SB) = 21 votes
    Candidate Irie Doughe (profession frequently corrupt) (I) = 18 votes

    If the above were to occur Mary Dhoe will be sent to HOA. She will right fully claim to have gandered 21/64 = 30+% of the vote.

    But what about the 3930 person that objected to the slate of candidates that were presented. We need to examine the system that puts person in the HoA just as much as the system that nominates these persons in the first place. An election for any seat should be null-&-void unless a quorum of electors can be had. That quorum being a min percentage have to cast a ballot in the election. that way we will be giving some more power to John and Jane Does in choosing the person that sits in the HOA that are to represent us.

    Spot on. Having a different opinion is enough to bring out the nasty side in some people. It is all down to the chairman. I have always understood the role of chairman is to set the rules, the broad parameters, under which discussion takes place. Maintaining order and discipline.
    S/he remains impartial, not taking sides, but making sure people adhere to the rules. Once this breaks down it is anarchy. If the chairman wants to talk more than the contributors, and with strong opinions, then all hell breaks loose.
