Your message to the BLOGMASTER was sent

It would be remiss of me if I did not congratulate Prime Minister, Mia Mottley, and the Barbados Labour Party on their emphatic victory at the polls on May 24th. I would also like to commiserate with the vanquished Democratic Labour Party (DLP), the other parties and independent candidates who failed to make any appreciable showing. The people wanted to rid the country of the former administration and have spoken in a loud clear voice. But as they say, “Vox populi, vox dei” – the voice of the people is the voice of God.

That said however, I am forced to point out to the Miss Mottley that one of her first proposals as Prime Minister reeks of contempt for the wishes of the electorate to my mind. It would seem that she has not heard that loud clear voice of the people/God. And in an effort to appear magnanimous, she announced her intention to amend the Constitution to allow for the participation of the DLP in the Senate. She has advanced some specious reasoning about them getting the second highest vote to justify tampering with the Constitution. So far, this country does not rely on a proportional representation system to constitute the Senate. If that is her intention, let her put it before the people in a systematic way rather than in the knee jerk way that she is going about the matter.

The people of this country have given Miss Mottley an unprecedented mandate to govern which she is apparently questioning. The electorate appears to be saying, we trust you to do the right thing but by her proposed action, she is seemingly saying that she is incapable of managing her parliamentary group and would be happier with oversight from the DLP.

I am therefore forced to ask, why the DLP and why not Solutions Barbados, the United Progressive Party or the Barbados Integrity Movement? Why this indecent haste to resurrect the DLP? Is she afraid of the new talent that is located outside of the two musical chairs political parties that have swapped places with each other since 1961?

Literally while writing this column, I learned of another proposal to amend the Constitution this time to qualify two of the Prime Minister’s picks for appointment as senators. How is this different from the last administration amending the Supreme Court of Judicature Act to secure the appointment of their preferred candidate as Chief Justice? Mind you, the BLP while in Opposition castigated the Stuart Administration for changing the law to accommodate their man.

These two impromptu proposals to amend the Constitution, just because you can, should give the people of this country cause for concern about electing a potential dictatorship. With an opposition of one and no backbench to speak of, I am fearful that if the dear leader does not like something, however desirable, she has the unrestrained power to do as she pleases.

Under our present system of governance a cabinet minister would first have to resign if he/she opposes government policy on the floor of House of Assembly. On the other hand, backbenchers are free to oppose government policy. By appointing almost all of her colleagues to the front bench, the Prime Minister has effectively silenced any dissent from within.

After appointing almost all of the elected members of parliament to the Cabinet, Miss Mottley still saw it fit to appoint three persons from the Senate as ministers. In making that announcement, she claimed that the Constitution requires that three members of the Cabinet should come from the Senate. That left me to wonder if this would be one of her spontaneous amendments to the Constitution, since I know of no such requirement. As far as I am aware, section 64.(1) of the Constitution which provides for the Cabinet. states:

There shall be a Cabinet for Barbados which shall consist of the Prime Minister and not less than five other Ministers appointed in accordance with the provisions of section 65.

Section 65.(1) provides for the appointment of the Prime Minister and subsection (2) goes on to say:

The other Ministers shall be appointed by the Governor-General, acting in accordance with the advice of the Prime Minister, from among the members of the two Houses.

The way things are shaping up, it looks like we have the makings of a Mottley Dictatorship but only time will tell.

  2. Spot on Caswell. It is now ten days since this government was elected, and in a frenzy of urgency, promised lot but so far has done nothing. A big PR stunt, with the cabinet and senior civil servants, followed by the media, visiting the sewage dump; a series of press conferences, just more PR, revelations about potential malfeasance in public office (no promise of a judicial inquiry or calling in the police); and an army of economic advisers (Persaud, Mascoll, Caddle and Straughn) along with technocrats and the central bank.
    She has given a prominence, undeserved, to the so-called Social Partnership. Ten days in and nothing of consequence has happened. We must keep a close eye on how thing progress.

    Nothing beats a strong foundation.

    It would do them well to have a strong well read Constitutional lawyer on board.

    Criminal lawyers and personal injuries lawyers know very little about constitutional law and vice versa….each are separate and distintly individual legal disciplines..

    Get a strong constitutional lawyer to complement the senate team and new government..

    Here is how simple it is.

    The Leader of the opposition controls the existence of the senate.

    This is the check/balance that assures that a 30-0 result cannot stand.

    There shall be a leader of the opposition.

    The senate needs 21 seats filled out of 22.

    You are one of two possible appointees based on the advice of the Leader of the opposition.

    You legitimize or deigitimise the senate.

    A roti man serving a friend yesterday was on about the mock leader of the opposition.

    This is going to become more nd more the standard reference to Reverend Joe.

    If he is mock, then you are a mock opposition senator.

    The senate becomes a mock senate and all of the 21 seated senators become mock senators if they ever get seated.

    You need to really understand why two of the Government appointees were not sworn in.

    It could be a simple to explain but I think they are not risking the label of mock senator to enable the Mottley Dictatorship.

    Reverend Joe has spread his mock virus to you.

    You will spread it to the senate and other senators if the seats are filled.

    The senate will make the Parliament mock.

    The Parliament will make the House of Assembly, the ministers, including the Prime Minister and the cabinet mock,

    The Mottley Dictatorship will also become mock!!

    If 21 seats are needed to constitute the senate and you bail at any time, it is trouble in paradise ….

    You, if you are the only appointee, determine if the GOB stands or falls.

    … but not if the mock parliament has changed to constitution to allow for 2 senate appointees from the mock PM

    Are they suggesting increasing the number that constitutes the senate from 21 to 23 to maintain the check/balance?

    Find that one out!!

    That should direct you what to do if you don’t already know..

  9. Happy to see Bishop Joe “crossing” to avoid the need to amend the Constitution to allow the DLP to appoint two Senators. The proposed amendment, however, given the circumstances made sense. If the premise for doing so was democracy, then the party/individuals with the largest number of votes would have to come from within the DLP. The comparison to the Marston amendment is specious: judicial experience v residency? The 12-month requirement in the age of the internet and other technological advancements is a nonsense. Indeed, one can be living outside of Barbados and be more attuned to what is happening than a resident. This was evident in comments made by a number of candidates that just contested the election. It is often argued that there are many laws on our books that are outdated, is it not also true that parts of the Constitution are too? Would not any decision to move to a fixed date election or MP recall require a constitutional amendment?

    What I see here is that Senator Franklyn has Asserted that his Voice will be Challenging…

    But his voice has not been elected; he speaks for himself just as I or you can and we welcome his voice as we welcome all voices for it is always up to the people to hold the Leaders feet to the Fire.

    On the other hand ten day in to a New Administration without giving the Elected a chance to operate…Hal Austin, “It is now ten days since this government was elected, and in a frenzy of urgency, promised lot but so far has done nothing. A big PR stunt”…….. Do not Rush to Judgment, nor would you want your Government rushed to do anything without Proper Consideration. They have been bringing the people of Barbados up to date with their findings. They are touring to get a first-hand look at the damage and a hands-on feel for what is going on the ground. They have had important meeting including with the Social Partnership and ten days is not Ten Days God even rested on the Seventh.

    A tiger crouches before it springs give them a chance to do what is needed. But your fears of such a super majority and what it could possibility bring is good to hear because it means that we are aware.

    That is why I always say you have to be a man of conviction.If you don’t stand for something you will fall for anything.

    Lets hope Bishop Atherley don’t drink too much wine this morning and put someone like Commisung as senator.A man who has been operating like his cousin Mia’s mouthpiece and lackey.

    Glad to see Caswell in. Will watch his performance too.

    However I regard the whole thing as another example of the DLP’s slow and poor decision making. They had an offer of two seats in the Senate and big men and big women could not even make up their minds. They could not make up their minds to say “yes” and they could not make up their minds to say “no” They retreated into “Freundelian” silence. They dithered, and Joe and now Caswell has preempted them. So the DLP is now ABSOLUTELY shut of of Parliament, which was the people’s intention anyhow, but still…even though I am not personally into “duppy” politics I am sad to see this happen to the party of the late great Erroll Barrow.

    If the DLP was a man, the DLP would be the man who gets horned in every relationship, and even into his old age wonders “why?”

    Why? If you don’t do your job, somebody else is always eager to do it for you.

    Sen. Franklyn, excellent first column under your new designation. Just as witheringly no-holds barred as your former non-senatorial self but yet a special oomph given your more public bully pulpit!

    By her actions it does appear PM Mottley is trending towards a non-benign dictatorship. Just three examples:

    *as you suggested, it Is counter intuitive to ordain such a bloated cabinet and at the same time preach and warn of pending IMF intervention…over staffed govt expenditure is a first cut of any such program.

    *also as suggested, she has the comprehensive ability to ordain full transparency by all her ministries on spending, contracts and all the people’s business. Yet she contrives to establish a heretical DLP formed Senate opposition and her minions are crowing about what a shaft of light this foreshadows…No, it does not. Shadows surely but foreboding ones.

    *despite her loud noises about financial/integrityl regulations, she yet has an unresponsive senior minister with a public charge against him for alleged legal malfeasance…which may be totally false, it must be stated. However, despite her fulminations about dishonest DLP and their lack of transparency she has not made any remarks on this and demanded that her minister address this matter in a forth right manner. Surely it is incumbent on a crusading benign dictator to get the facts before her adoring public to start to prove her minister HAS done nothing wrong.

    Continue to prosecute Bajan life on behalf of us Bajans Sen Franklyn and continue to ‘flame on’ like the blazing Fantastic superhero.

    Since he is a guru at ensuring that men like his namesake Thompson don’t die under his watch he can revive, like Lazarus, the DLP which is now heading the way of its founding fathers.

    It would be interesting to see who would be appointed to the Senate to represent the interest of the Church

    Let us hear he or she pray to God, like the imported Rev. Bonke, for the return of the DLP to Parliament.

    BTW, it’s time that religious interests be represented in Parliament other than through the “established Church”. These people can’t even get their own political house in order, so how can they be seen a guiding light to the rest of civil society.

    Why not appoint an imam to represent such interest?
    Can’t the Muslim community also speak on behalf of God?
    After all, Vox populi is also Vox Allah.

    Yuh betta go back and read what I wrote, I did say he “may be a maverick” and followed up with “and the nuptials short lived” with respect to the Rev. who still has a strong affiliation to the Mottley brand.

    It is evident that the column was written prior to the more recent elevation and the heading is provocative but it will provide aid and comfort to the DLP in the coming days.

    It will also be a test of the resolve of the LOO who appointed (selected?) him and one who is seemingly compliant with the wishes of the Gov’t he left, when one of the first acts of your appointee is to question the ultra vires of the PM and her partiality to democratic institutions.

    You are NOT COMPUTER LITERATE and so what you need to do is get someone who is to isolate your machines from the payloads that will be sent to your various machines to compromise your seemingly private messages and documents on your IPad and other devices

    Say for example I wanted to know what you were writing or thinking to write next week or that I wanted to know who is in your contact list OR I wanted to know what you proposed to do concerning what you perceived as a Draconian measure of the incoming government what I would do is to send you a document for you to view, a specially prepared document which once you have viewed it ALL OF YOUR USAGE OF ANY OF YOUR DEVICES THEREAFTER BECOME KNOWN TO ME

In all of this, please keep an eye on what is happening on the outside, I know many are only now accepting the realization that you are more or less still owned by a monarchy and a crown, but it will not hurt to keep your eyes wide open and aware of what is happening in the world currently….as everyone else is for their own good, future and safety…, no sense remaining insular given the recent revelations to be found in the constitution..

    it will be great to hear the opinions of the reparations movement…greater still to read the Namibia constitution..post independence,,

  43. We gave the past DLP government lots of time and patience and now want to rush a new government. The past DLP government was woeful in its performance. I will pee on anything that is not right in this country and will watch this government carefully. I will however give them some time to see what they are all about. I have stated in the past that we have continued for years with ideas that have not been working over and over again and the past government was a clear example of that. We need to rethink all our development models and especially the main industry tourism. We have had 74% tourism leakage rate for decades and did nothing to address it as we did not even want to recognize it. We have had a really horrible appraisal system in government for decades and have not had the courage to change it over the decades as it was to the benefit of corrupt management who lacked good ethical and moral standards.

    I can state from personal experience that George Walton Payne has been involved in legal cases to deprived others of investment illegally through the Barbados Supreme Court.

    My own case and experience is separate from the Stewart’s family Case which I learnt about via a social media video.

    For me it confirmed my case is not isolated but may be the tip of the iceberg of legal shenigans by that Law firm.

    Wily is holding judgement on Caswells Senate appointment, C.F. now in a position to influence a favourable outcome, HOWEVER could easily fall pray to the present myopia system. Caswell now finds himself between a rock and hardplace and I hope he has the skill to negotiate the turbulance and keep his head above water.

    Warned him that prior to the election, that as a Union leader, his employment after the election was dubious. A Senate appointment gives him short term employment security, just hope he makes the most of the opportunity.
