Barbados Today Online newspaper was today [30.10.2017] ordered by the Barbados Court to pay Leader of the Opposition an undisclosed settlement resulting from an article it posted that questioned her qualification to practice law in Barbados.

    The DLP stages a political meeting yesterday with the LEC theme. Today the Barbados Court awards settlement to Mia because she was able to show proof that she is qualified to practice law in the Courts of Barbados. Who is the Jackass, Hal Gollop or the DLP directorate!


  3. After allegations by the DLP insinuating that Mottley is not qualified to practice law in Barbados and she subsequently winning a defamation suit against Barbados Today, relative to that on-line paper posting articles that questioned her legal qualificationsโ€ฆโ€ฆโ€ฆโ€ฆโ€ฆโ€ฆ

    โ€ฆโ€ฆโ€ฆโ€ฆโ€ฆ the FIRST news item on tonightโ€™s (October 30, 2017) CBC TV8 Evening News, featured Stuart criticizing Mottley at a constituency branch meeting.

    It is interesting to note that CBCโ€™s management said the station broadcasts political messages only during an election campaign, but the cameras were at Deighton Griffith School, recording Stuart, in his CAPACITY as president of the DLP, addressing the party faithful.

    It appears those LEC exemptions happened across the Caribbean…at that time, at least that is what someone from those times involved in certain processes was able to reveal……

    …..but yardfowls did not want to hear, they just swallowed the koolaid from the dummies of parliament and viola…lol

    Now they look so foolish….can they ever appear on BU again, they don’t have that many blogging options, not just anyone can put up with them….lol

    They will all be poisoned with koolaid by their fool ministers before they can vote in 2018…

    The facts of this case Law case with MAM is beyond your level of comprehension.

    And I donโ€™t necessarily BLAME you and others who have doubts about this matter.

    But here is what you all have to prove:

    โ€ข Evidence of her certification to practice in the UK
    โ€ข Evidence of her LEC from a Law School in the Caribbean to practice law in the Caribbean
    โ€ข Is her degree a pure Law Degree or a Degree with another subject and Law ?

  21. David anyone with a modicum of commonsense understood this was a nonsense issue. Clearly the DLP were happy to throw mud at Mottley and basically smear her in the eyes of their faithful.

    None of their team or the media should have been so foolish as to get caught in a legal trap to face the courts…but now this court settlement clearly shows these folks are absolute JAs.

    The parallels to US are stark.

    There the WH also uses blatant lies and misdirection to keep their base agitated with the Russia matter but just as here a few of them got into legal tangles and they will all pay a hefty price. The Flynn indictment will be huge.

    As far as I am concerned this is also huge because it makes the current AG Brathwaite look like a JA cubed…. did he not promise to get back to the country with clarity on the allegations. Clearly he was investigating a fabrication and perpetuated the folly.

    Is that what we expect of our chief law officer: cheap party political tricks. Of course not.

    If this party – of which admittedly I used to admire its officials – is returned to power then we Bajans are truly the absolute JackAsses.

    But then again Trump won so who knows what will happen.

    @ David, this is not strictly correct. Ms Mottley did not have to prove anything. There is a presumption of falsity applying to all defamatory statements. The more likely scenario is that Barbados Today was unable to establish the truth of what was published.

    Very similar to the Chris Gayle v Fairfax Publishing Ltd case in Australia.

    Jeff…that is why it appears suspicious…Jordan I believe is the editor in chief….according to my daughter who was on the board of her university newspaper….while the owner or chairman of the newspaper knows of Mia’s existing qualifications…..he or she will not get involved in the day to day publishing, particularly WHAT is published….Jordan having had years of experience at Nation prior to barbadostoday….would have known much better….about Mia’s qualifications..

    Hence it is not clicking….

    Whst makes this even worse, the attorney general after making a big show about an investigation in LEC….never followed up or refuted the claim from parliament….never felt it necessary to tell the public….it was a misunderstanding or anything, he allowed the lie to float for 2 years..

    A total disgrace.

    The above statement is not quite correct. As far as I can recall, special provision was made to benefit one caucasian lawyer. Mia and two other black lawyers found themselves to be fitting into the same set of circumstances that were tailored for the white guy and they took advantage of the loophole that was opened.

    Hal Gollop was also made to look like a JA as well.

    In June 2015 Brathwaite promised to commit the office of the AG to investigate whether or not Mottley was qualified to practice law in Barbados. As at October 30, 2017 (2 years and 4 months after), Brathwaite has not revealed the results of that investigation.

    What made this shiite more silly was the fact that recently, DLP General Secretary, George Pilgrim, announced at a press conference at DLP Headquarters that formal correspondence was written to Brathwaite requesting him to โ€œclear the airโ€ on the need for a legal education certificate as a condition to practice law in Barbados……….. in keeping with the following:

    Legal Education Certificate Resolution No.8 passed at the (DLP) 62nd Annual Conference 2017:

    WHEREAS there has been much debate in our Parliament, call in programs and social media about the possession of a Legal Education Certificate in order to practice law in Barbados

    AND WHEREAS doubt has been cast on the possession of such a certificate by a practicing lawyer,

    ANE WHEREAS there is need for clarity in this matter,

    BE IT RESOLVED that this conference calls on the Attorney General to clear the air on the legitimacy of the requirements for the LEC as a condition of practicing law in Barbados.

    Thanks Jeff for the clarification. Is it fair to say that Barbados Today would have had access to what is known about those who qualified for a pass from the LEC and therefore the ruling today (30/10/2017) will stand as a good precedent?

    Unable to defend their dismal record, the DLP has resorted to the politics of distraction. Barbados Today has already paid dearly in a legal settlement on October 30, for repeating the DLPโ€™s propaganda.

    Here is the truth.

    โ€ข Mia is appropriately qualified to practise law in Barbados.

    โ€ข At the time Ms Mottley was admitted to the Bar, there was no legal requirement for persons trained in the UK and Commonwealth countries to hold the Legal Education Certificate in order to practise law in Barbados and other Caricom countries.

    โ€ข Mia was allowed into membership of the Society of the Middle Temple of the Inns of Court of the United Kingdom on the 6th of August 1984, while still a student of the London School of Economics where she was reading for a degree in law.

    โ€ข She was awarded the degree of Bachelor of Laws from the London School of Economics on August 1st, 1986.

    โ€ข Mia was called to the Bar in the United Kingdom on July 23rd 1987.

    โ€ข Mia was admitted to practise law in Barbados on December 18th, 1987.

    โ€ข Ms Mottley was presented in the UK by Sir Henry Forde QC the former Attorney General and (The Right Excellent) Errol Barrow, former Prime Minister.

    โ€ข She was presented to the Bar of Barbados by Sir Henry Forde, Q.C, M.P and former Attorney General, and joined by Sir Maurice King, Q.C, MP, the sitting Attorney General of Barbados at the time.

    Mia’s application for admission to practice was presided over and approved in Court by the then Chief Justice, His Lordship, Sir Denys Williams.

    What was the law at that time?

    โ€ข The Council of Legal Education was established to standardise legal training across the Caribbean for admission to the Bar.

    โ€ข Caribbean law schools awarded its graduates the Legal Education Certificate for practise.

    โ€ข The law exempted from requirement from the LEC, โ€œAny national who prior to January 1985, has undergone or is undergoing, or has been accepted for a course of legal training leading to the qualification.โ€

    โ€ข This exemption applied to all persons who returned to Barbados after completing legal studies in the UK or Commonwealth, including Ms Mottley.

    โ€ข There is currently one judge and several attorneys who were trained in the England and have been admitted into practice under this legal provision.

    Mia Amor Mottley M.P, is an attorney at law and from 2002, held the senior rank of Queenโ€™s Counsel. She is a former Attorney General of Barbados. In the course of her legal profession, she has practised in Barbados, Dominica, Jamaica, St Kitts and Nevis, before Her Majestyโ€™s Privy Council of the United Kingdom and acted as a legal consultant on matters in Jamaica, as well as Trinidad and Tobago. She is properly qualified to practise law in Barbados as she has done for years

    There is a Treaty governing the establishment of the Council of Legal Education and several pieces of legislation which apply to this matter. The Legal Profession Act Chapter (Cap) 370 of the Laws of Barbados, the Legal Profession (Qualifications for Admission to the Practise Law) Rules 1985, Statutory Instrument Number 24 of 1985 and the Supplemental Agreement Act Chapter 366, and the Council of Legal Education Order, Statutory Instrument Number 23 of 1985.

    It is telling that we are not hearing any DLP Attorney General, present or former, leading the charge against Mia and saying she is not qualified to practise at the local Bar.

    Keep your eyes open for many more DLP distractions before and after the bell is rung. Do not fall for Dem.
