On 30 July, Barbados Today reported on the comments of Donville Inniss and the response by the Bar Association’s (BA) new president, Liselle Weekes.

BU has long stressed the necessity of removing from the BA all matters disciplinary and responsibility for the Compensation Fund. Therefore, Mr Inniss’ comments are welcome, if a little late. Mr Inniss proposes, “…the establishment in law of a new legal services council – similar in structure and form to that of the medical council; a council that comprises of members of the legal profession and individuals who may not be attorneys; a council that is supported not just by statute, but also by the resources of the state.”

 BU recommends to Mr Inniss that he takes a look at the Solicitors Regulatory Authority (SRA) of England and Wales, as we have repeatedly suggested. This is a body with the power to fully regulate and discipline solicitors AND to make payments out of the Compensation Fund. It is separate and distinct from the Law Society of England and Wales, which is England and Wales’ version of our BA. The SRA has not only the power to discipline and to compensate, but also to step in if they have reason to believe that a firm is not acting properly, so as to protect the consumer.

In Barbados, the qualifications to practice law and be issued a practicing certificate is a legislative decision, unlike in England and Wales where such a decision devolves on the Law Society of England and Wales. The disciplining, however, falls on the SRA. In addition, the SRA can discipline on its own authority and does not refer the matter to the courts unlike the BA that must refer matters to the Court of Appeal.

On the SRA website, it provides a list of the members of its disciplinary committee, along with a brief resume of each. And surprise, surprise! A large percentage of them are NOT lawyers. Ms Weekes’ spurious claim, “I am not certain that those persons would be in a better position to interpret what is a breach of the Code of Ethics than the attorneys-at law who currently sit on it,” is asinine. Take a look at the Code of Ethics of the BA and then honestly say if you do not think that a senior student at one of our schools could interpret them.

The cases before the disciplinary committee that enter the public conscience always involve an element of criminality, like fraud and theft. And if the DPP got off his ass and prosecuted the malefactors, would they be tried by lawyers, or a jury of their peers taken from all walks of life and professions?

Ms Weekes blathers about her favourite “get out of jail” word “perceptions”. Ms Weekes, the “perception” of the majority of Barbados agrees with Mr Inniss when he posits, “If we are truly to have a legal profession in Barbados, as opposed to just . . . a collection of lawyers, then we as a society and you as lawyers, must unshackle your minds and help create a system that not just sustains faith in your profession, but also enhances the profession.”

Mind you, if the Bar Association does not determine the qualifications by which practicing certificates are issued; has no authority over to whom they are issued; cannot constitutionally enforce membership of the BA; cannot actually discipline; and loses authority over the Compensation Fund…..what exactly is its function, other than running a website and e-mailing court lists provided by the Registrar to BA members only, instead of forcing the Registrar to e-mail the lists to all those with practicing certificates?

Ms Weekes makes a valiant effort to hide behind the useless amendments to the Legal Professions Act but fails to record just how long the BA has taken to get back to the Attorney General with its views on these useless amendments.

BU really hates to apportion credit to Donville Inniss but fair is fair. Now, let us see what he does about this matter BEFORE the next elections, so we can know whether his sentiments are real or political. For if he is genuine and “puts his money where his mouth is” he will actually have made a big difference. The icing on the cake would be Bhana being cited for a breach of the chicken wing laws of Barbados.

    If you read Inniss’ statement you would realise that he was talking nonsense. Fortunately for him people understood what he was trying to say and interpreted his words to make sense. Whoever wrote that speech for him should have been fired. That man has no depth and his speeches reflect it.

    Donville is now adept at stating the obvious with regard to policy changes. This is after bring elected a policy maker in 2008 and doing precious little to make the changes needed to legislation.

    With specific reference to the ministry he heads; Whether it is liquor licences being processed via the magistrate’s court or the indiffence of the FTC to set standards of service for the mobile telecom providers.

    Via the last comment, Bhana is not going to be touched. Inniss is backing him all the way, but I do believe the article has some semblance of reasonableness and will hope the Minister will adhere to the writer. We await with baited breath to this suggestion Mr. Inniss.
    Let’s hope he reads these articles since he is always putting his foot in his mouth.

    I only heard a recording of part of the speech but even if you relied on the BT report, he was not making sense. The Bar Association does not regulate the legal profession as Inniss believes.

    Minister Inniss is a long time reader and sometimes contributor to BU, we ask him now to share his prepared text he delivered last week quoted by BT. Of course in any other developed country in the world a check on the MP’s Twitter or Facebook account would satisfy this request.

    Today’s Sunday Sun carried an interview Gercine Carter did with Philip Nicholls who is still in hock to clients because the other two partners either will not admit guilt and who are advised and assisted by crooked and bent counsellors who are either dishonest or immoral or both.Its the type of lawyer the learned attorney Amused support and encourage and who in my humble opinion the legal system should be in a position to sanction.Criminal intent is also purposely frustrating the court system to benefit a thief of client funds.Where is the extradition treaty to bring these people back to settle these lawful claims.Bastids all.

    @Gabriel. I am not quite sure what you are accusing me of. Can you elucidate? As for Philip Nicholls, well, obviously, unlike you, I did read the documents posted by BU showing that Nicholls/Cottle Catford had indeed been repaid monies owed by at least one of the other two former partners. There were cancelled cheques etc. You must have missed that report, but it is still there online and you can search it out. To what “still-owing” funds does Mr Nicholls refer? Did he specify, or is a mere general accusation without documentary support?

    @David. Like BU, I have very little time for Donville Inniss. However, this time I believe that he is on the right track, but then again, I have not seen the full text of his speech and will reserve final judgement until I have.

    @Mr Inniss, I echo @David’s call for you to publish the entire speech. Casewell’s “perceptions” based on having “heard a recording of part of the speech”, are woefully insufficient. Casewell also “perceives”, based on having heard only a part of the speech, that, “even if you relied on the BT report, he was not making sense”. I disagree. In fact, I could not disagree more. For far too long, consumer complaints against attorneys have been decided as to whether they should be referred to the seriously backlogged Court of Appeal for hearing and discipline by an incestuous and likely conflicted and biased panel of other lawyers who, in defiance of the legislation, are elected and not nominated. Being elected, as opposed to nominated means that their continued “status-enhancer” is subject to re-election and all which that implies. Far better to have an independent body, not solely, or even predominantly, comprising other attorneys, with the power to discipline, instead of having to refer their “findings” to the Court of Appeal. And with the power to make awards out of the Compensation Fund.

    But it also seems to me that the time has come, given the number of complaints and the larcenous thrust of many of them, for attorneys be required to take out personal indemnity insurance. I realise that this is an unwarranted expense for those innocent attorneys who scrupulously administer their accounts with integrity, but the protection and interests of the consumer have to be paramount. Hopefully, Minister Inniss will add this to his wish list.

However, your blanket rejection of such a sensible approach as Minister Inniss has apparently suggested reminds me of the worst nepotistic and protectionist policies or David Simmons as both AG and CJ when the clear light of day was never allowed to shine in. And I find that I don’t give a damn about Minister Inniss’ alleged connections to pornography in Florida as it has nothing to do with the measures he is recommending here. If he has committed a crime in Florida, which I don’t think he has under Florida laws, then that is a matter for Florida. Our concern ought not to be from whom his recommendations come, but instead what those recommendations are and their validity and beneficial application.

    All well and good but your unbridled criticism of Mr Simmons in this forum over the years certainly does not reflect your profound observation and i quote “Our concern ought not to be from whom his recommendations come, but instead what those recommendations are and their validity and beneficial application” Certainly the informed world of Jurisprudence does not share your view.

    why can’t this reasoning be applied to Ms Mottley intellectual ability and the fact that she stands head and shoulders above all others in parliament rather than throwing her purported deviant sexual behaviour into the mix with the sarcastic comment ” @Old Baje.     I might be wrong but from his ‘off the cuff’ pronouncements Mr Inniss strikes me as one who knows how to attract cheap publicity aided and abetted by a lazy media seemingly lacking in investigative skills. I think Mr Inniss would better serve the public if he confines his remarks to matters falling within the purview of his Ministry such as the high import duties on items which impacts on the high cost of living or why the VAT has not been reduced as promised or the functioning of the toothless agencies like the Fair trading Commission and the Office of public counsel with respect to the operations of the telecommunications agencies to the detriment of the public and why Flow has been allowed to continue sending bills to customers without details.

    What a nasty bunch of sexual deviants being let loose on unsuspecting people, in the people’s parliament no less, do they expect the young people to be any better when the leaders and self proclaimed role models are such sexual psychos.

    I have no problem with what people practice in their private lives, but when it affects and involves the public, it gets criminal.

    The only reason Mia is not behind bars for assault is because no complaint was made and money paid out to victims, Donville should also be in prison…..but….what miss ya ain’t pass ya…and both will see their wicked activites return to bite them both in their asses when they least expect it and cannot afford it…no wonder they are both such good friends, Donville and Mia, both psychopaths.

    The Association exists for the purpose of ensuring that Legal Services in Barbados is offered in the highest degree of professionalism and to provide general information to the public and to Attorneys-at-Law.

    We have a new president of the Bar Association and to a man, in this case woman, they all parrot the same lines i.e. he or she is willing to allow some time by working with stakeholders blah blah blah. Does it not make since to acknowledge that the president and work at the BA should operate as a continuum?

    Miss Weekes time to trash the ‘I will give them time’ line.How are you lot able to defend your profession and at the same time acknowledge that the judiciary is dead? To quote your ‘senior’ colleague Wilfred Abrahams and FORMER BA President.

    Could not help but register talk show host and lawyer support of Abrahams for Attorney General if the BLP is elected next time around.

    @balance. The way I understand it (and correct me if I am wrong) is that Mr Inniss’ alleged activities occurred in Florida, Not in Barbados. Is this also true of Ms Mottley? Understand me clearly. Unlike many others, I have no problem with the non-violent consenting proclivities of others. But I do have a big problem with those proclivities when there is no consent either to the proclivities or the violence or the threat thereof, which, by the way, is called “assault” and is both a crime and a tort. Now, here is the link. If lawyers who steal from their clients are not criminally charged by the DPP, what makes you think that an assault on a fellow MP will be charged? Are you actually living in Barbados?

    But, more to the point, do you agree or disagree with Minister Inniss’ proposals? Regardless of whether he is involved in what he is alleged to be involved in in Florida. Is he right in his proposals or wrong, do you think?

    Can anyone, maybe you @balance, provide me with directions to the website that Minister Inniss is alleged to be involved with? I want to see how bad it actually is – and that is what I will tell SWMBO and anyone else who questions me. I remember when I was at university and to remember that far back requires a really good memory. Playboy was the porn of choice then. Photos of women showing their breasts, and very nice breasts they were too. I made sure to buy my copy every month, just for the articles, you know. Certainly NOT for the photos of those nubile and well-endowed ladies. I never ever even gave them more than a passing (and deeply shocked) glance and secreting my copies behind the lavatory cistern had absolutely NOTHING to do with convenience and EVERYTHING to do with sparing my mother’s embarrassment and ire – and it made it more convenient for my father and brothers to read the articles as they were enthroned – and I have always believed passionately in sharing. Heffner became a very wealthy man out of that, supported (successfully) US presidential campaigns (which accepted his donations with thanks) and we all looked on in envy as he paraded one “bunny” after another before our admiring gaze. Then, there was Penthouse and then a number of others, all of which we followed, mostly secretively, because, of course, we considered it our civic duty to keep abreast (pardon the pun) on the advance of this disgusting pornography, so we could salivate over it in private and roundly condemn it in public. I do think that with the advent of the Internet, pornography has gone too far, but I am old and not sure that my views are not as a result of my antiquity. I mean, the amount of appendages they now show in theatrical release films and even on Broadway and the West End, is disconcerting. When I was in England a few years ago, I went to see Harry Potter in Equus, where he cavorted on stage with all his dangly bits showing. So society has “evolved” outside the bubble of Barbados from the Victorian mores so beloved, publicly, of all and, in fact, reverted to pre-photography and film days of the ancient Greeks and the Renaissance of Michelangelo (as exhibited on the ceiling and behind the high alter of the Sistine Chapel). Indeed, a few years ago, I was shown some ancient Chinese art in which the people were frankly copulating, some men and women, some men and men and some women and women. Ditto with some Greek urns that now reside in those centres of culture known as “museums” around the world, where we Bajans gawp at them, because it makes us feel “cultured” – after all, they are antiques. And as film and photography are the new art form, I am not sure exactly where one draws the line between art and pornography. Well, I know where I personally draw it, but that is only my view – and I could be wrong – it has been known to happen – frequently. BUT, I have to see those images alleged to Minister Inniss to see if they meet my standards of pornography. And no, I have never been moved to join the chorus of disapproval about Minister Inniss’ alleged involvement in porn, as to do so would be to deny my adolescent and post-adolescent enjoyment of Playboy and Penthouse and hypocrisy has never been one of my besetting sins. As for the Victorians that Barbados, publicly, seems so intent on deifying, at least publicly, have you any idea of the endless trove of Victorian pornography that abounds and, like the ancient Chinese, men with women, women with women, men with men etc? But I have noted that, except in the modern porn, there are no teeth or whips in evidence, but maybe my exposure to the habits of the ancients is inadequate. Anyway, I want to see Minister Inniss’ alleged website. You never know, in centuries to come, it may be considered the artistic equivalent of the Sistine Chapel.

    @Well well. Excellent. Loving your comments. I have to agree that the allegations of pornography against Minister Inniss do not engender a great deal of confidence in him as a member of government and certainly they undermine the respect one should have for an MP, even if carried out outside the country. Forgive me for getting carried away and amusing myself by taking on the hypocrisy of some (not you), but it really gets too damned much for an old man like me sometimes. I have heard of “Born Again Christians” and I can accept that concept, but “Born Again Morality” experts make me sick. “Beholdest thou the mote in thy brother’s eye…etc.” And they forget that this is Barbados and we know exactly what they used to get up to.

    If former commish of police Dottin had not been so compromised, he would have been able to arrest Mia because she hit so close to home, but that is the price public officials pay when they are corrupt.

    What is truly frightening Amused, when the likes of Donville and Mia aspire to lead the country and actually succeed, carrying the baggage of their questionable private lives, impressionable young people will tell themselves……”wuh none ah dem in no good and look dem is ministers and politicians, so dey ent nutting wrong wit prostitution and pornography or beating, brutalizing and sexually assaulting women.”

    This clearly shows why the US with all it’s deadly warts and the larger countries…..expose, arrest and imprison such public miscreants. …they are a blight on society, dangerous to future generations. ..

    That is where all the dangers liess in the society continuing the deviant behaviors for decades…cause ya have deviant ministers and politicians.

    Abrahams would do the same thing his daddy-in-law Davud Simmons did, destroy the court system for their master Peter Harris and other minorities to gain financially, disadvantage land owners etc, they are already corrupt, ya dont decide to become straight and honest overnight and only until after elections,…Abrahams was bar association president when Simmons was CJ….things just got worse.

    BU logged a few years ago the infelicities of Donville and his wife in regard to a matter before a court in Delaware involving a minor.Donville in my opinion is deficient in his representation of St James South and is known as a ‘wufless’ politician who learned nothing attending Kolij.
    A reminder that a former partner of CC is living off the company’s funds in the US and cannot return to Barbados for fear of arrest.You know that,yet you pontificate innocence of that party but guilt of Nicholls.How unreasonable a man you prove yourself to be.

    That is the reference.I recall seeing an invoice for sex items viz whips,handcuffs,manacles used by those whose fetish is regarded as unsocial and bordering on lunatic fantasies.It is suggested that this company catered to that demented lot of the society.I have no idea if this group of sickos is of such number as to garner representation in our parliament.Maybe I should enquire of Liz who seem to have the goods on Donville big time and caused him such grief in the last election that he had to appeal to the swine Stinkler to send help “cos I in trouble,I losing this election”

    At what time does when I was a child I spake as a child and did childish things, but when I became a man I put away these childish things…when does that kick in?

    It would seem that with your Playboy narrative you set the fox among the chickens AND introduced with such Rembrance, fond as it was, a buffer zone where you suggest? that, with the effluxion of time, such deviance may one day be okay and the age of consent may well enough be two, or in utero.

    @Piece. I had to look up “scatology” and I can now say that you have the advantage of me as I have never seen one nor, frankly, would I ever wish to…..YUCK!!!! Nor necrophilia nor, so far as I am aware, paedophilia. But then again it must be obvious that I have led a very sheltered life – behind, not in, the cistern. Wouldn’t want those articles to get wet now, would we? You, on the other hand, appear to have led a far more adventurous existence.

    As for art, well I don’t pretend to know what that is these days. The homoerotic art of Worhol and Mapplethorpe don’t seem to me to be art and I don’t get the point of them, but to others they are the epitome of art. They have an artist in England called Tracy something or other and those look to me like junior high school daubs. So, I am merely suggesting that these alleged involvements of Minister Inniss may, for all I know, be high art.

    I understand law quite well and the mechanics of what goes into a justice system and on that I have to say that Minister Inniss is correct in what he proposed and indeed it would bring a greater degree of confidence to the practice of law from the consumers. Inniss is right no matter how we try to slice and dice.

    @balance. You refer to a partner, un-named by you, of Cottle Catford who is living in the States and who, you allege, is fearful or returning to Barbados in case he gets arrested. Well, I know of two such, one of which came to Barbados some years ago to attend his sister’s funeral. By this torturous process of elimination, I have to assume it is the other one you are referencing, in which case, I am also aware that there is not now nor has there ever been an arrest warrant issued for him, nor has he ever been sent notice that the Police wish to interview him. In fact, I am only aware of one CC partner who was arrested – and he lives in Barbados and has written a book in which he claimed that his former partners did not pay certain monies back, a myth/lie which BU debunked by posting the cancelled cheques that you have clearly decided not to look at.

    Your heart is in the right place and I harbour a wish that such as you were where Pornville is.

    Pornville is a sound bites man, full of hot air and signifying nothing much like default prime minister Mugabe Mottley.

    So many rules and laws that we must employ, no longer are men driven by code or throwing oneself on one’s sword we are into self preservation big time.

    The man who made the decision not to fix the dam in California in the early 1900’s when it burst and killed all those people, withdrew from public life until he died, such was the personal guilt he had.

    To be honest, I could not ever think of getting myself involved in politics. I have worked too long and too hard for my reputation to have it soiled by association. I mean, there is one commenter who accused me (and he don’t even know me) of taking loans from clients accounts simply based on his “perception” that I am an attorney and, in his book, all attorneys do that. Can you imagine the meritless false accusations I would have to fight off from people who never even met me and are not going to believe me anyway, even if the evidence is staring them in the face, that I have not been feeding at the public trough and taking back-handers – just because that it what politicians do? It is like our friend @balance who, without reviewing the evidence to the contrary right here on BU, will actively promote the “distortions” emanating from one P Nicholls, just cause he tell a reporter so. So, like you, all I can do is to anonymously try to set the record straight and give my views, for whatever those views are worth. And keep being amused by it all.

    And it is my not entirely un-expert view that Minister Inniss is on exactly the right track. But then again, I think almost everyone, with a few inexplicable exceptions, knows that. BUT, the problem lies in Minister Inniss’ follow-through. Is it just electioneering hot air, or is he going to hold his clothes up in Cabinet and the House and demand these things? Like NOW, not if he and the present government get back into office. No good putting it in a manifesto, because none of us are fooled by them any longer.

    Mr Amused perhaps it is because I am not too bright that your logic astounds me at times. In one breath in your defence of Mr Inniss you are asking me to ignore the alleged immoral /unethical pornographic behaviour of Mr Inniss and deal with his intellectual discourses but in another you are asking me to ignore Ms Mottley intellectual discourses and judge her on her alleged immoral /unethical/deviant sexual behaviour which you constantly deride. Moreover your preference for Mr Stuart over Ms Mottley is equally astounding. How can an intelligent man like you ignore the blatant untruths told to the people of Barbados with respect to the Cahill by a Prime Minister sworn to uphold the laws of the land.

    @balance. There is no suggestion/allegation that Mr Inniss ever threatened to, or did indeed, bite or whip, in Barbados. So, forgive me, but trying to compare the two just doesn’t do it for me. And please remember that I have no time for Mr Inniss at all, well maybe marginally more now. On this one, he is RIGHT! You might try another comparison test. Mugabe was AG for quite a while for which she was made a QC. So why didn’t Mugabe, from her legal loftiness, discern and speak about what Inniss has spoken about? Now you might argue that maybe Nitwit should have, but since he hasn’t got anything between his ears, it is hardly surprising. Therefore, it must be argued, since Mugabe QC did not bring forward the idea, that she too is deficient anything between her ears.
