Your message to the BLOGMASTER was sent

I should start this week with a disclaimer. Despite its title and the epigraph, this essay has nothing at all to do with the identical hendiadys so frequently encountered in the Holy Bible and in the admonitions of the modern day end-timers. It treats rather, less loftily, a physical local sign by now notorious and the wonder of a recent judicial pronouncement emanating from the European Court of Human Rights.

That “RH” sign and public expression

For the quantum of public discourse that it has generated, that notorious sign featured on various social media, and more latterly in one section of the local printed press (not the Barbados Advocate), should have been wildly successful in raising public consciousness, if not for citizens to cease littering indiscriminately, at least for them to conjecture as to the meaning to be attributed to the letters “RH” in the sign. There is a well known Barbadian expletive that fits this abbreviation perfectly; indeed sometimes the two letters themselves are used for emphasis, and this might reasonably be presumed to have been the intention of the sign’s creators, especially since the other offered suggestions offered so far do not fit the bill, syntactically speaking.

Moreover, since the letters are used in an adjectival sense[to describe the littering], as would be the expletive at times, it might be objectively considered that the letters denoted that expletive.

This last point cannot be made too forcefully however, since the expression I am referring to, as most others of similar kind locally, may be used alternatively as a noun, an adverb, a preposition and maybe a conjunction all in the same sentence and to express varying notions. For instance one may be as bright as it, or one may be as “dumpsy” as it, as, equally, one may be either as poor as RH or as rich as RH. In fact, any two contrasting concepts will serve to make the point.

Nevertheless, in spite of its colloquial variety, it is an expression that would probably attract the attention of the local constabulary if used in a public space, and thereby render the user liable to a criminal charge of using indecent language. The constitutional guarantee of freedom of expression in section 20 of our supreme law simply does not extend that far. Indeed, it may be argued that this freedom is expressly qualified in this regard by section 20(2)(a) that immunizes from challenge any law that makes provision that is reasonably required in the interests of public morality, inter alia.

The offence of this nature is usually committed when the expletive is uttered orally. Should it make a difference that the words are not voiced here but rather suggested in a sign and not even expressly but, at worst, impliedly? There are some areas of the law, most notoriously in that pertaining to defamation, where the subjective intention of the publisher is treated as irrelevant and the meaning of the publication is guided by what the ordinary reader or listener would have understood it to mean. It is at least doubtful, however, whether such a holding should form the basis of a criminal charge where a criminal intention to use the expletive would normally be required.

Furthermore, I recall having read somewhere once of a proceeding in one of the local magistrate’s courts when an accused, wearing a T shirt with ostensibly Chinese or Japanese characters, was severely censured by the presiding judicial officer when it was finally recognized that the characters spelt out an expletive if read either upside down or from an appropriate angle. I cannot now recall whether the accused was cited for contempt although, given the nature of the expression revealed, he very well could have been. Was he any less a publisher of the offensive expression in that case than the anonymous creator[s] of the RH sign?

The wonder of the European Court of Human Rights [ECHR]

For those Barbadians, arguably not so few in number, who are opposed, bitterly, fundamentally, diametrically or otherwise, and for whatever reason, to the concept of same-sex marriage becoming a possibility in this jurisdiction, the recently reported June 2016 decision of the European Court of Human Rights that there is no human right under the European Convention on Human Rights to be party to a same-sex marriage might have come as a pleasant and welcome surprise, especially after the US Supreme Court decision in Obergfell v Hodges that imposed homosexual marriage as a right applicable in all the states of the union. In fact, the European decision is over one year old and is consistent with at least three previous holdings of that court that there is no human right to a homosexual marriage and thus the member states cannot be compelled to recognize it. This in spite of Article 12 of the Convention that reads;

“Men and women of marriageable age shall have the right to marry and to found a family. According to the national laws governing the exercise of this right.”

Despite the apparent breadth of the text however, the European Court has consistently ruled, utilizing the principle of subsidiarity; whereby the Court limits its ability to review a domestic authority’s decision and that of the doctrine of the margin of appreciation; through which member states are permitted to vary in their domestic law from their Convention obligations just so long as this variation does not cause the very essence of the Convention right to be impaired, that there is no obligation on a member state to legitimize homosexual marriage. In 2010, the ECHR held that the right in Article 12 was granted in the context of strictly traditional forms of marriage so that an Austrian couple could not allege discrimination because they were denied the possibility to marry or have their relationship recognized by Austrian law. In 2012, The Court held in a case involving a lesbian couple in a civil partnership who complained that the French courts would not allow them to adopt a child as a couple, that “in view of the social, personal and legal consequences of marriage, the applicant’s legal situation could not be said to be comparable to that of married couples.” And in 2014, the Court pronounced, in a matter from Finland, that the law did not require member states “to grant access to marriage to same-sex couples…”

I have already argued in this space that the local antagonists to same sex marriage have little to worry about. While we have not as yet enacted a provision equivalent to that in the Jamaica Charter of Fundamental Rights and Freedoms 2011 to the effect “no form of marriage or other relationship…other than the voluntary union of one man and one woman may be contracted or legally recognized in Jamaica”, This is precisely the common law position that now obtains locally and would have to be changed by appropriate legislative action, if at all.

    GP you are an accurate barometer of the Bajan collective thought patterns. In any developed jurisdiction, academic lawyers are rewarded for their contribution to legal knowledge – jurisprudence, the sociology of law, law and economics, etc.
    To my knowledge, the only academic lawyer in Barbados, nay the English-speaking Caribbean, prepared to put his or her ideas out in public is Jeff. For that alone, whether one agrees with him or not, he should be made an honorary QC. That inferior advocates can become QCs and not someone who makes a genuine contribution to our knowledge says a lot about or society.
    We on BU can do a lot worse than campaign for Jeff to become a QC. In fact, Caswell, despite himself, should be awarded a honorary LlB from the UWI. His knowledge of Bajan law is phenomenal.
    As someone who is not a lawyer, what do I know, but a well known Bajan lawyer/politician once taught me law at Westminster College in the late 1960s, early 70s (and he was educated at Waterford). Let him identify himself. I apologise to him for not being an advocate.

    being more familiar with UN Articles of human rights, which did not address same sex union as a human right..until very recently..it never even occurred to me that the issue is being addressed at the UN or the European Court Human Rights level…

    Separately, it was announced in July 2014 that the United Nations (as an employer) would extend equal benefits to its employees who have entered into same-sex unions in jurisdictions where they are legal.

    i suppose for the foreseeable future, each jurisdiction is left to create their own rules and procedures for or against legalizing same sex unions and marriages.

    re the RH signs, its quite obvious the creator is trying to communicate with bajans in a language with which they are most familiar and can better identify since all other attempts and everything else has failed to educate the population of the dangers of their unhealthy and very dangerous littering habits….

    ….and outside of a few thousand of them drowning during a storm or violent hurricane, because of their repulsive littering,one still has to try to send the message since innocent lives are at stake.

  12. The sign has achieved its goal by generating a lot of discussion about the garbage situation of Bim some areas perpetuated by its inhabitants and some areas the responsibility of govt brought worse. Hopefully the discussion will lead to a cleaner Bim.

    They are lots of RH gper-types who do their dance every bright Sunday and our beloved GP can be considered their RH prince , he does it here daily…what can one do wid royalty. 😂

    The signage was effective. It was designed to shock and to attract attention and it did. Those of us who pretend not to know what was intended may interpret it to mean:” Stop the right hand littering”. It is very difficult to litter with your left hand. LOL!!!

    The second part of the featured article’s interpretation could hang on the words “marriage” and “found a family.” One may argue scientifically that there is no” marriage” except between heterosexuals and that homosexuals cannot” found a family.” But then one can argue that that is a matter of semantics.

    The connection/ link between the two sections of the article is that words can mean whatever we want them to mean. Meaning is subjective/personal. We see what we want to see. And know what we want to know. RH is neutral. Marriage is neutral and “founding a family” is neutral. The remarkable thing about it is that an effective communicator knows how to frame messages for the market/audience he wants to reach. More often than not this approach is effective.

    If they were not so busy with themselves and their greed and raping the country , the ministers could have found a very effective way to handle the serial litterers who from high school are taught to believe that other people are there to pick up garbage their nasty hands dispose of….and if that innocent child don’t pick up another child’s garbage….they are expelled from school….

    The nastiness runs deep.

    When they start teaching children from primary school level that they are responsible for disposing of their own garbage, maybe in 10 years ya will see a cleaner island.

    In saying that, that World Bank and IMF report from last week, effectively downgrading any future growth for Barbados up to 2018…haha…..seems to have effectively muzzled both the ministers and their irritating yardfowls….so watch out for longer, stinker smelling stretches between garbage collections.

    We find the first part about linguistics viz a viz the written word to be a magisterial exposition.

    Such displays of creativity should attract the attentions of the powers that be.

    As you know, we are as far from being a monarchist as can be. However, since knighthoods are the best our country can do, we would so recommend such be properly bestowed for daring to attempt to integrate language commonly used by Bajans into what others may feel to be standard English, despite the legal challenges.

    There is no other expression this writer is aware of, in any language, which comes close to the meaning of the RH inclusive.

    Indeed nothing has given this writer more pleasure that to used that expression at a Board Meeting, in a foreign capital, to express the deepest loathing for a particular action, knowing full well that the audience had no clue as to its meaning.

    On the second part about homosexual marriage or legalized bulling you also rightly locate this within a Eurocentric setting.

    No doubt you are seeking precedent for local application, interpretation, even justification under the rubric of civil rights.

    You will no doubt find that the people here who so readily accept European religion and so forth will see the current state of the law as anathema to their dirty religion – Christianity.

    For us there is no difference. Both the European dominant religion and they historic acceptance of bulling have always been part and parcel of the same religious cultural construction.

    It is a pleasure to read your articles as part of my “continuing education / life long learning habit.”

    My limited vocabulary and interest in fish and fishing has prompted me to use the words

    “wrasse whole” to describe some who I perceive to be “wrasse whole idiots” .

    RH more easily understood than WW.

    Wunna nasty stinking Bajans got to stop littering…. buh I doan mean none ah wunna BU bloggers. lol

    Now you mentioned that lot of intellectual dregs occupying a place which has turned into a waste dump for poor performers, why not apply the same abbreviation “RH” to that lot of ras(s)cals calling themselves “honourable” especially those with the self-appointed elite right to call themselves the real “RH” (Rt. Hon) or king rat of the hill forming the current landfill.

    Since we don’t want to stoop so Lowe(e) why not see “RH” as just the ‘offensively neutral’ compound adjective of ‘Ridiculous-Habit’; only requiring the preposition ‘of” to give it full meaning to what nasty Bajans clearly understand when translated into simple polite language as: “Please don’t’ litter. Why not take your garbage to the closest bin, please, pretty please?”

    A white man puts up a sign RH letters that represent a crude cuss words and he is applauded by blacks on BU. Let a black man risk the same thing and fire and brimstone will be visited on him by the same blacks.

    In the Sunday Sun a white man who called blacks lazy has a company with only lily white directors. What makes this paint company’s all white directors revolting is that Barbados is overwhelmingly majority black. Not only that the people who buy the company’s paint and make the all white directors rich are black consumers. Ah lie Bruggadung! That is something that should engage BU bloggers not the celebration of a white man insulting black people’s intelligence with RH.

    Tell you what! How about putting some of those newly-minted currency notes in the UK to good ‘native’ use and buy some junk bonds to save the GoB’s ass in the coming weeks?

  37. Bus stops are nice. Bus shelters with solar lights too, are even nicer. But we really need to have big, big RH bins at every busstop, and the Sanitation Service needs to get its act together and clean the bins RH regularly.

    And while they are at it pick up my RH garbage, which has not been picked up for three RH weeks now.

    Hants I noticed that in Toronto there are bins big as RH at the busstops.

    Probably true at a certain level. But there are religions where the members do question and can question the interpretation of what is written. The Judaeo-Christian religion ,on which our legal and morality systems are based, allows such challenges to the existing dogma. So religions do evolve in the same way that legal systems evolve to meet certain societal challenges.
    Like most things in life, religion is made by man for man.
    In my search in your garbage can ,I found a page from the book of Habakkuk chap 2 :15- 19 I quote:
    “Of what value is an idol,since a man has carved it? Or an image that teaches lies?”

    Jeff , like Habakkuk, in his Sunday column is challenging us to look on some ideas that we have taken for granted and is asking us to review them.

    your attention, you simply ignored the
    contributions or told those complaining
    to just deal with it.
    I suspect that you are only going after
    Georgie Porgie because of Jeff’s status.
    I have read Hal Austin being abused on this
    blog in far more nasty ways than that of
    which you now take offense.
    In my humble opinion you are like most
    people who believe that only those of
    a certain status should be protected.
    I hope you have now turned the page and
    will refuse to publish the inferior garbage
    usually posted on BU those who ought to know better.

  46. @WilliamSkinner your 11:03PM does NOT reflect the realities or nuances of this blog and though I hesitate to accuse you of such, it does appear you have an awfully disjointed bias on these matters of free speech.

    My recent years involvement with this blog has allowed me to witness a rather free wheeling style permitted by the blog master. His intervention on Jeff’s behalf was in keeping with other times he has interceded on behalf of others.

    To suggest that he did so because of Jeff’s status when there were several other demonstrably valid reasons is surely an indication of YOUR perspectives and priorities.

    Valid 1… Jeff unlike all other regular contributors does NOT respond to vitriol. When one considers that this was the second week consecutively that the blogger attacked with personal, insipid remarks it is absolutely fair that the Blogmaster sent a ahot across his bow.

    Valid 2… Hal unlike Jeff often uses his pen to cut deep with his ‘nice’ words. That his opponents use crude words in their attempts to cut him down is unfortunate but you can’t wage a war with a musket and cry bloody murder when your opponent uses a Winchester auto rifle.

    Valid 3… The Blogmaster enhances his blog with Jeff’s articles and the public advocacy offered. He certainly has every right to defend this featured writer with as much vigour as he chooses.

    Everyone has a right to publish their inferior garbage…so there is no page to turn.

    The very same Mr Cumberbatch would surely be the first to defend all bloggers’ right to speak their piece as long as it’s not slanderous, libelous or contravenes laws on vulgarity.

    Let’s celebrate that free speech is alive and well on BU….seems to me David has the balance perfectly weighted.

    Jeff and GP are two controversial figures on BU. The former dazzles us with his beautiful form of writing whilst steering clear of the elephant in the room. That is to say he remains mute on the genuine structural issues that need to be addressed in order for Barbados to move forward. I see no sense of urgency in his writing style. For example why is it that after fifty years of independence that the country’s negro population remains largely poor and indebted?

    Whilst the latter, GP, has always used this forum to regale us with his bonhomie, his undoubted intellectual prowess and his knowledge of latin. To this day GP remains something of a drama queen, what we would call in the UK a publicity seeker. We love him for it but for a so-called Christian he does employ a lot of words from the gutter.

    However, GP has thrown up a challenge to Jeff, a challenge which Jeff should look at carefully and ask himself: are are my columns truly reflective of the everyday reality of Barbados and if they are, do they carry sufficient bite within them?
