In the last report, we merely reported the allegations of Agard contained in her affidavit. We did not comment or editorialize. We also warned that we had not had sight or a bare recitation of any defence filed by the defendants Mottley and Walcott, that allegations of Agard were not proved in a court of law and we now reiterate our invitation to the defendants to provide us with a copy of their pleadings and undertake to publish them with the same prominence as those of Agard.

We deny that in publishing on these matters that we are taking a political position or breaching defamation laws or seeking to conduct a โ€œtrial by blogโ€. This is a matter that the traditional press should have reported as a matter of public interest โ€“ and has failed in its duty to so report.

We also want to make it clear that we are not taking any political position, B versus D, but merely giving voice to the concerns of many of the voters of the country who have no political affiliation, and no agendas, other than the well-being of Barbados and their rights.

Trimming the whole matter down to its barest essentials and with the 20/20 vision of hindsight, what have we actually gleaned from Agardโ€™s allegations?

It is established that Agard was voted in as candidate for Christ Church West.

It is established that this met with the approval and support of the then leader of the BLP, Owen Arthur.

It is established that Agard went on to garner the majority of the vote of the constituency of Christ Church West and became its MP.

It is completely irrelevant and immaterial to voters whether a faction of the BLP members in Christ Church West approved of Agard or not. What is relevant is that: the majority of the electorate of Christ Church West are not members of the BLP, but simple voters; Agard, in winning the nomination to stand for Christ Church West, was chosen by the majority of the party membership; and in winning her seat, Agard was proved to have gained the approval of the majority of the voters in her constituency. If, therefore, Agardโ€™s allegations are proved correct and there was indeed a faction of the BLP that sought to undermine her, then it must be concluded that this faction denies and actively works against the whole concept of democracy and by extension, denies the rights and wishes of voters in that constituency. And that is all we the voters need to know or to consider. And if that faction for whatever reasons, which are irrelevant and immaterial to us, found that they could not work with Agard, then their option was to either put up, or shut up and leave, but never to gang up and undermine the democratic process and the wishes of the electorate.

If Agardโ€™s allegations of the roles of Mottley and Walcott are proved by a finding of fact, then they will have conspired to deny the constitutional rights of the constituent electorate, as well as having sought to deny and abrogate the constitution of the BLP and to betray the democratic process.

We are well aware, all of us, that the BLP is a dysfunctional party with a lot of infighting between factions supportive of Mottley and those supportive of Arthur. Arthur himself now sits as an independent, alongside Agard. We are also, all of us, aware that some of this infighting is the subject of legal proceedings, as in Payne vs Hinkson.

So while the BLP, the official opposition, tears itself to pieces in the public domain, we, the electorate, are the ones that suffer as our choice between a lacklustre government and an opposition apparently committed to the political party equivalent of civil war/suicide, does not offer the electorate of Barbados the choice to which we are entitled and that we must now demand of our candidates for Parliament.

Political posturing aside, under Owen Arthur there was a unified BLP, but the rot set in as soon as the BLP lost the last election and Owen Arthur, as is custom, resigned leadership of the party. It was up to his successor, Mottley, to step in and heal the divisions. Indeed, any person stepping in had the obligation to heal the breaches. But to do that, there would have been a necessity for give and take and a leader capable of compromise and accommodation within reason. Too long has passed and the fracture is now a gaping chasm, which suggests that Mottley lacks either the willingness or the capacity (or both) to heal the breaches or is herself leading the demolition. We note that Payne vs Hinkson is still outstanding and no successful mediation had been achieved or, as far as we are aware, even taken place, to resolve this peacefully, quietly and to the benefit of the electorate.

We were also treated to the unedifying spectacle of Owen Arthur, our longest-serving PM, being forced to either resign from the BLP or be expelled. A credible successor would have managed the change-over and diffused the explosive situation quietly and to the benefit of both party and country, not got hung up on a campaign of revenge against her predecessor and all who backed him. Egos that have no respect for the voters is what it comes across as.

Regrettably, this leads to the inevitable conclusion that Mottley is not fit for purpose as leader of the BLP and leader of the opposition and what the BLP has to do now, in the interest and expectation and demand of the electorate, is to find a leader who has the capacity and willingness to heal the breaches and bring it whole and unified into opposition and into the next general election. The electorate will expect no less. And there is time and more to do this, before we go to the polls and are asked to choose between a lacklustre government and a fractured party whose members are fully prepared to dump democracy and the self-evident rights and of voters in the trash can in a mindless rush to replace the present government wild boys feeding at the national trough and personal โ€œsupportersโ€, as opposed to supporters of the country and its votersโ€™ rights.

Agard is merely one instance of the dysfunction of the BLP. A major and historic political party should never allow itself to become a battleground between two factions โ€“ Mottley versus Arthur (one with no track record to speak of as a leader and the other the longest leader in our history). Because this demonstrates that the focus of the party is not on the well-being of the voters, but on the personal agendas of its leaders and wannabees. And we, the people, suffer for it. For if the BLP cannot solve its internal problems, how can it possibly manage to convince the voters that it can solve the problems of the country.

We therefore urge: the BLP to sort out its leadership so that the partyโ€™s fractured limbs can be set and healed and to provide us with a unified and credible opposition and possible unified and credible government where the denial of our democratic rights are not in doubt.

My question here is the role played by Duguid and his faithful in the downfall of Mrs. Agard. How come he can leave not only the party, but the island and return and just slip back into being the representative for that constituency? Was that election fair? Does that not smell of corruption?

  2. A deservedly stinging rebuke of the ‘leadership’ of the Barbados Labour Party.Based on the performance of the LOO,the possibility of a ‘more of the same’ is likely when next the bell tolls. We appear to be in duck’s guts.

  3. Has anyone seen Miller? Is he providing his counselling services toโ€ฆโ€ฆ

  4. Would the matter of Barbados’ continual downgrades be a top topic for discussion? Isn’t that more important than Maria Agard’s impetuosity?

Maria Agard decided that she was not going to be a team player so what the hell did she expect? Add to more “dysfunctional” as you say in the party? She was a problem…….what was the leader to do?….allow her to continually disrupt the already “dysfunctional” party? OSA and George Payne had the problem and just kicked the can down the road for Mia to now end up with all the blame.

Whatever is the outcome of this, she cannot come back and think she would be welcomed after all she dragged the party through. The dems already told her that they have rules she would have to abide by.

By the way, OSA resigned on his own after the plot that he and his henchmen were planning bombed when they ‘plotters” bailed out on him.

The DLP is very dysfunctional……they are just waiting to get through this 50th celebration and we are only focusing on the BLP.

Why are we not focusing on dem, they are the government and are destoying this country…..people are suffering, businesses are seeing hell, some are closing and we are worried about Maria Agard?

  5. expecting a fire starter to out fire is like pelting big rock at fire . Under Mottley the Blp has become the party of division ever since she has been leader her modus operandi is to attack ,,Attack any and everything that she regards as irrelevant even the country has receive some body blows from her futile attacks ,When one considers her actions no surprise in the way the Agard matter was handle in a nefarious and undermining actions resulting in a court battle between the party and agard .Rather than let the voters have their say she and Walcott becomes sharks with a bombast agenda to disregard the voters choice in agard .Then she gets up in parliament and attacks representatives as being bombast ,Now pray tell Mottley who is the real bombast

  6. this time of the year Miller goes into hibernation since he no longer holds the job of shining OSA boots

  7. Why dont you talk about the civil war that is being hushed up in the DLP?

  8. This matter again, again! An attempt to bring back an outdated OSA. OSA , himself destroy the BLP with his politics of inclusion. Notwithstanding Mia limited leadership , she is better for the BLP than OSA. Stop the canvassing for OSA!

  9. MAM and her how great thou art choir are hell bent on turning what should have beeen a foregone conclusion into anything but that. Woe unto us indeed.

There is something wrong with an electorate that subjects itself to the whims and fancies of the political class but I know not what. People die and the next of kin inherit the constituency. A representative can quit, return whenever he feels like and is elected unopposed. This in a country that boasts about its highly educated citizens.

The Dems ain’t worth wuh Paddy shot at and the Bees worth just as much. Woe unto us indeed?

  10. The case concluded yesterday and the Judge promised to deliver his ruling sooner rather than later given its national interest.

  11. @Prodigal Son April 7, 2016 at 9:55 PM. I think the BLP needs a better spin doctor than you.

“Maria Agard decided that she was not going to be a team player….” So, is Agard hired by the electorate to play on Team Mottley or Team Barbados? And you then go on to admit that the BLP is dysfunctional. Well done.

“Whatever is the outcome of this, she cannot come back and think she would be welcomed after all she dragged the party through. The dems already told her that they have rules she would have to abide by.” What has she dragged the electorate through? That is what you should be asking. Also, the dems told her, you say, that they have rules she would have to abide by. Presumably these rules, like those of the BLP, are written down and, unlike the BLP, not subject to change at the whim and agenda of the leader. Might it be the unilateral changes mirrored in local constituency branches that Agard refused to accept?

Personally, I do not think that OSA is a viable alternative to Mottley. He has already led the party into two election defeats. The thing is that Mottley is going to hang on like grim death no matter how much whipping and biting and unilateral rule changing it takes and no matter how much it fractures the BLP and denies the country a viable choice. Like Bushie, since the choice is between the devil and the deep blue……at least I respect FS and the way he handled the all-but-forgotten coup attempt inn his own party – it barely lasted two weeks and both it and FS’s handling of it are now not only things of the past, but all but forgotten.

In the UK, I see there is a sort of parallel with the EU referendum. I see that some political commentators are saying that Cameron will have to go if the UK votes out. My take on it is that if the UK does vote out, Cameron’s party will rally behind him to carry out, not unilaterally change, the wishes of the electorate and that, even though he is not in favour of an exit, Cameron will lead the UK through the exit, because it is the wish of the majority of the people. So my questions are: In similar circumstances and given her record, could we expect Mia to do the same and not simply ignore the will of the people? Hell no! In similar circumstances, could we expect FS to do as Cameron is likely to? I say yes. And that decides for me which party I will vote for. Pity. I had high hopes of Mia. I thought she had grown out of adolescence. Apparently not.

THE OUTCOME of Dr Maria Agardโ€™s legal challenge to her expulsion from the Barbados Labour Party (BLP) will be known later.

Yesterday after submissions from both sides were completed, Justice Olson Alleyne reserved his ruling in the matter.

The Christ Church West Member of Parliament is seeking damages from the BLP, and yesterdayโ€™s hearing lasted over five hours in the No. 11 Supreme Court. Agard, who now sits as an Independent in the House of Assembly, had been expelled by the National Council, which cited public utterances that were deemed harmful to the BLP, as well as her alleged refusal to acknowledge and work with her constituency branch executive as the reason for its disciplinary action.

Since her expulsion in November, her predecessor Dr William Duguid was again nominated by the BLP to contest the seat after a three-year break. (TS)

De Judge could seh wuh eva he feel like, dem ain’t going wid Owen….I mean Maria. Dem ain’t care how bad um look, a message has to be sent and it will be delivered.

Anyhow, time still longer than twine. Who knows, perhaps a few more might grow a pair and we could finally get that elusive third party.

  14. @Raw Bake II

This is not so much about Maria being selected to run again. It is about the respect for natural justice as exercise by political parties. Remember the case is about whether the BLP follow the tenet of natural justice in the expulsion of Agard. It is about an indivual’s right to challenge what he or she perceived as a wrong under our system.

  15. Notorious American Hate Group Heads to Barbados

HRC stands in solidarity with LGBT advocates and allies as anti-LGBT activists descended on Barbados for a regional gathering hosted by the World Congress of Families (WCF). Designated an anti-LGBT hate group by the Southern Poverty Law Center, WCF provides a platform for some of the most virulently anti-LGBT extremists from around the world.

This WCF regional conference will take place in Barbados from April 8-9.

โ€œThe World Congress of Families focuses on bringing in the most notorious anti-LGBT activists from around the world, leaving harm and discrimination in their wake,โ€ said Ty Cobb, Director of HRC Global.  โ€œTry as they might to hide behind flowery language, the World Congress of Families is a hate group that convenes thousands of extremists from around the globe to strategize about how best to further endanger LGBT lives."

WCF works closely with a dangerous group of activists spreading anti-LGBT rhetoric and promoting laws and policies that criminalize LGBT people and the speech of those who support them.  HRCโ€™s report on the group, Exposed: The World Congress of Families, makes clear that the organization and many of its affiliates are laser-focused on promoting policies and rhetoric that put LGBT people and their families at incredible risk.

The conference speakers include Theresa Okafor, who has compared LGBT people to Boko Haram, and notorious exporter of hate, Brian Brown.  Brown is the president and co-founder of the National Organization for Marriage (NOM), a once-prominent anti-LGBT equality group. In 2011, Brown said, โ€œWhen you knock over a core pillar of society like marriage, and then try to redefine Biblical views of marriage as bigotry, there will be consequences. Will one of the consequences be a serious push to normalize pedophilia?โ€

โ€œWCF  has honored a Nigerian activist who claims LGBT advocates conspire with terrorists with a โ€œWoman of the Yearโ€ award, and lauded  Vladimir Putinโ€™s โ€˜morality,โ€™โ€ said Cobb.  โ€œThe work of WCF  supports positions and policies that harm LGBT people around the world. Their advocacy abroad incites hatred against LGBT people from Russia to Nigeria and beyond.โ€

In October 2015 HRC worked with with LGBT advocates and allies in Salt Lake City as 2,500 anti-LGBT activists descended on the Beehive State. As part of its larger effort to call out WCF and its allies for their nefarious activities, 14,000 HRC members signed their names to a two-page advertisement in Sundayโ€™s Salt Lake Tribune. HRC also sponsored the Inclusive Families Conference in Salt Lake City in advance of the conference, which gathered local leaders, citizens, and advocates and promoted a positive vision of LGBT people and their families.  On the eve of the gathering, HRC gathered local advocates and international witnesses of the exportation of anti-LGBT venom abroad in a press conference inside the Utah State Capitol. HRC also hosted a screening of Hunted: Gay and Afraid, a brand-new documentary that shows in vivid detail both the efforts and impact of WCFโ€™s advocacy abroad.

In 2013, WCF forcefully advocated for the draconian anti-LGBT Russian โ€œanti-propaganda law,โ€ met with the lawโ€™s author in the Russian Duma, and released a public letter in support of the measure. As a HRC report documented last year, harassment, investigations, arrests, and acts of violence against LGBT Russians have followed in the wake of the lawโ€™s passage.  When a Mother Jones reporter asked WCF Managing Director Larry Jacobs if the organization had contributed to the Russian crackdown on its LGBT citizens, Jacobs said, โ€œYes, I think that is accurate.โ€  Additionally, WCF may be in violation of U.S. sanctions against Russia because of the organizationโ€™s dealings with two Russian officials who appear on the Treasury Departmentโ€™s Specially Designated Nationals and Blocked Persons List.

Active across five continents, WCF has organized large international โ€œpro-familyโ€ conventions that bring together a wide range of vehemently anti-LGBT activists. WCFโ€™s activities range from holding conferences in Nigeria focused on denying rights to LGBT people to working to silence the Russian LGBT community.

WCF affiliate Scott Lively, who may also be attending the conference, traveled repeatedly to Uganda, claiming that LGBT people are responsible for the Holocaust, the Rwandan genocide and the spread of HIV and AIDS.  Some Ugandan officials credit Lively with the idea of introducing new legislation to further criminalize homosexuality in the country, and prominent Ugandan LGBT activists say that the bill "is essentially his creation."

LGBT people throughout the Caribbean face immense challenges. Eleven countries in the Caribbean retain laws that criminalize sexual acts between men. In Barbados LGBT people can face life in prison, while in Jamaica they can face hard labor while in prison. Even in countries without this form of state-sponsored discrimination, LGBT people are often targeted and face discrimination and harassment.

Some of you are happy when the blogs are critical of the government then along comes a BLP blog doing the same and we see the true colours. Is anyone or entity above being criticised? What is wrong with advocating a position over and over and over until there is redress? It is the same on talk radio, to satisfy rating/popularity calls are encourage to bring new ideas or discussion points, never mind matters remain outstanding. Where is the logic!

And DLP lackie Hal Gollop gets his picture taken with Agard. Looks to me like she is not only no BLP team player but possibly a DLP wannabe. I suspect her removal from the team was necessary to start the healing process within the party.

We all know the DLP cabinet members do not communicate with each other and none communicate with the PM. The asinine decisions coming out of gov’t and the drivel coming out of Fumble’s mouth confirm this fact for even the most detached among us. No connected group of intelligent, reflective people could make their decisions so either there is no intelligence, no reflection or no group.

It would be a tragedy for our country if our next cabinet attempted to function like the DLP cabinet does(n’t).

There will be no economic recovery under Fumble’s Fools, the best we can hope for is survival.

    • Mr. David BlogMaster,

I have no quarrel with what you are saying, but we all know that there is no justice and even less respect to be had in political parties. Dem doan really operate so.

When it comes to political parties, it is all about who knows who, whose pockets are deeper and who can convince more members that they can provide the bacon. Possess these things and ideals like natural justice become subjective and secondary. Coupled that with enough friends in the right places and the masses will even clamour for Barabbas.

Let me clarify my earlier post; dem doan care wuh we think bout natural justice. How then do we, the ordinary voters, make them think otherwise? They actions to date in said constituency suggest that ordinary voters are powerless against the party. No?

Where do these ignorant statements come from? What sort of idiocy are we raising in Barbados?

      Is Gollop behind the camera?

Does it not make sense for the Barbados Nation, reporting lies, or whatever to sell newspapers, to take a shot with the woman AND HER LAWYERS one of whom is in the centre of a contentious ERT waste foop as well as a suspicious matter of murder of Marcelle Smith where he and the woman’s brother in law seem to possibly be persons of interest? (Note all the verbs of disclaimer utilised)

NO LAWYER IN BARBADOS, mindful of the coming of the TROIKA, led by MIA AMOR MOTTLEY, would be so idiotic to represent Maria Agard and thereby estrange the leader of the Troika?

Barring the Blogmaster, Bush Tea, Raw Bake, WW&C, my gf SSS, and a few others that de ole man cant remember right now, very few come out and say, THIS SHYTE IS WRONG when it is Mia Mottley.

Why is that? Why do men like you with big wallets, and big balls, why do you have such unbridled fear? We don’t fear Fumbles, or THompson, he dead now, but look how evident our fear is of Mottley!!

So Owen, by your reasoning, having been cast out of the BLP, or removed himself, he too must be a DLP wannabee.

Just like your friend the sleeping giant Lord Fumble I am resurrected from a โ€˜comaโ€™ of political somnambulating. While walking in the light of day I had a dream of nightmarish proportion that the foreign reserves were back at their 1991/92 levels and the King of Lies was on his knees begging the IMF for a loan but without the Devaluation string attached.

Guess what the Inspector from the Monetary Force (IMF) said? The same thing the Trinidadian Police Inspector said to the Smart Bajan by the name of Three Gold Coins in the Fountain Cephus (Granville Williams): Not this time! No, Not this Timeeeeee!!

Now the bet is on: One Million pre-devaluation Bajan dollars to your one US$ that the Bajan dollar will not โ€œDevaluedโ€ (because that has already taken place) but the exchange or trading relationship between it and its United States of American counterpart is formally adjusted to reflect the reality on the ground. The question is the percentage of the adjustment. If you use Stinkliarโ€™s arithmetic you might just end with a 0.5 adjustment; or why not call it 50 cents.

Barbadians needs to remove the now broken-down financial Mercedes-Benz vehicle from โ€˜in front ofโ€™ the rotting chattel house and live within their means. You have regional friends as examples to learn from and follow.

It is not the broken-tip political arrows fired by Mottley and poisoned with the placebo effect of the Maria Agard affair or even the imaginary third coming of OSA heralded by the likes of Bushie and Gabriel but the looming spectre of devaluation about to descend on poor Barbados that would be the imminent downfall of your deceitful lying party as the government of your once proud and effectively functioning country once the envy of the developing world.

      Prodigal Son;

By my count MAM has brought 2 No-confidence votes against members of the DLP. The first one was punished with laughter by Freundal Stuart, The second one he punished with silence, Those two strategies will not work this time if Mia uses the vote strategically to inform the general public of the case against the Government with clear and focused inputs from all her members.

She may be a glutton for punishment but I don’t think she is an idiot which would be the case if she had no or little support from her side, but the short BT report suggests that she does have the support of the current membership of the BLP. If that is so they could ignore the laughter and silence while noting that none of the Government members are willing to defend themselves and bring a comprehensive case of absolute loss of confidence in the current government.

There is copious evidence, from continuing poor management of the economy to the apparent optics of rampant corruption, that could be systematically brought against this Government.

Actually, a vote of no confidence at this time is obligatory. MAM can do no less and continue to call herself Leader of the opposition.

She must bring this vote against the Government if she and the Opposition are to be taken seriously.

Now is also the time to see, which of the Government members, are willing to allow the various sins of omission and commission which would be itemized against them to be recorded in Hansard for posterity and for use in any upcoming election. or to see and possibly hear the contributions of the ones who think they have a political future.

This can’t be about winning a no confidence, more about making noise to win hearts, minds and goodwill with a very frustrated public.

    • then what?

    • Mia had seven years to win hearts body and souls if she did not in the seven years it would be almost impossible to do so in a year and half

      David;

Perhaps I wasn’t clear in my above post.

I didn’t try to intimate that I felt that Mia would or could win a no-confidence vote at this time. All I was trying to intimate was that a no-confidence vote at this time was perhaps the best strategy for getting structured and possibly sensitive information on all types of possible misfeances by this Government out to the public.

It would be just one step in the ultimate legal removal of this Government.

It wouldn’t be “just noise”. It would be a deluge of facts delivered by most of the members of the opposition, which if uncontested by the Government members of parliament, would be eminently usable in a future election or other event.

Even OSA and Maria Agard might be shamed into speaking.

    • @are-we-there-yet

Thank you for the clarification. Given the government’s almost 8 year strategy of secrecy in how it communicates with the public, there is little hope it will flip that approach when the no confidence motion is debated. Mia needs to share licks a la Cahaill revelations last year.

    • Mia needs to a vote of confidence from the electorate, her leadership rating is falling. Will the debate in parliament do the trick? After the Agard crisis, the recent poor public meeting and the confusion in St Michael central: Haynes vs Holder( Sunday 10th April )

Mia would be more credible, if she states all she knows about all the damage done to the country and taxpayers by the ministers, their friends and business partners, since Owen refuses to say why he knows Mia is unsuitable to be PM….everyone holding secrets, but they will come out.

    • Wunna talking, but some of those DLP members may well be smart enough to know a sinking boat when they see the horizon tilting badly…..
…added to that, the pension money is now secured and they can now focus on the next ten years pickings….

Perhaps two or three DLP members will now take the opportunity to stand on principle and tell Froon to eff off….

How hard could it be for Mia to offer ministries to Kellman, Estwick and Paul in exchange for them voting on ‘principle’?
Lowe is also an option as he appears to be off the Allard and Cowan payrolls at this time and on the market for a new owner…

Wishfull thinking….nothing wrong with dreams but the egos at play will never allow for such crossing/stand on principle to happen.

The no-confidence vote has to be done,win/lose/draw in order to maintain the credibility of the opposition.

The crash and the domino effect will come like a thief in the night as circumstances come together and dictate the situation.
