Foremost Authority on HIV and AIDS in the region says: no published data to substantiate the hypothesis that decriminalising the practice of anal intercourse among consenting adults would lead to a reduction in the incidence rate of HIV infections among men who have sex with men (MSM).

The matter of Professor Brendan Bain, head of the Caribbean HIV/AIDS Regional Training (CHART), makes for compelling reading in the Jamaica press. It has its genesis in a case on the way in Belize where the goodly Professor gave expert testimony in a matter against a Gay Belizean Caleb Orozco. Orozco challenged in September 2010 Section 53 of Belize’s criminal code which states, “every person who has carnal intercourse against the order of nature with any person or animal shall be liable to imprisonment for 10 years“. The gist of which he argues that, “the code violates his right to the recognition of human dignity, to personal privacy and the privacy of the home guaranteed by the Belize constitution”.

At a point in the case Professor Bain, regarded as an expert in clinical infections and an authority on HIV/AIDS in the Caribbean, gave expert testimony which has resulted in calls for his dismissal from the UWI by Gay advocates.  Part of Bain’s testimony which has created a furor is quoted in the Jamaica Observer article.

BU’s interest in the case will be to observe how the privilege accorded to Academicians by the University of the West Indies is weighed against the strident LGBT lobby.

BU states for the record it does not support a Gay lifestyle.

  20. GP, my sentiments are well expressed by your last thread. I do not interfere with bullers neither do I hate them . But they went after a non buller like Bain without cause. The man is a professional academic. I just cannot understand why bullers do not do their thing and leave out non bullers. They seem to be on the crusade to bully the world into accepting bulling and I have a problem with that.

    Brendan is a very nice person who is not militant at all.

    He presented facts and staistics….thats all.

    He did not state anything that attacked bullers per se. He gave views based on his expertise experience and education, but 35 groups lobbied , because they dont want men like him to come and reveal the findings he gave.

    The fact that he is a believer means that he can be made into a criminal.

    THE EDITOR, Sir:

    Professor Brendan Bain is the Mother Teresa or Father Ho Lung of HIV/AIDS treatment in the Caribbean. He has walked the talk when it comes to breaking down the barrier of discrimination against people living with HIV/AIDS (PLWHA). He has been researching the disease and treating PLWHA long before the Johnny-come-lately pseudo-HIV/AIDS advocates.

    Studies have shown that a critical factor in reducing the discrimination against PLWHA is to educate the health practitioners, along with members of the wider public. Bain has been doing this through his professional life work. Attitudinal changes by health and other occupational groups towards treating PLWHA are arguably more critical than repealing/passing laws.

    Therefore, the call by a coalition of rights and advocacy groups for Professor Bain to be pushed from his job is not only a display of rank injustice and discrimination, but is a stab in the back.

    The real mischief makers in this instance are those who are conflating/equating the HIV/AIDS-prevention campaign with gay-rights advocacy. Gay-rights advocates want the buggery laws removed, while many health professionals think removing this law will cause HIV/AIDS among gay men to worsen. This is based on empirical data reported in health journals.

    The twinning of the HIV/AIDS-prevention campaign with the gay-rights advocacy is proving to be counterproductive and will continue to cause tension between people of goodwill who want to assist in the fight against HIV/AIDS, but are being driven away by gay-rights activism.

    If Professor Brendan Bain can be attacked, who is next?

    Caving In To Lobby Hijackers

    Freedom of expression took a severe body blow yesterday when the University of the West Indies sacked Brendan Bain.

    Professor Bain’s crime? His expert affidavit was used in a high-profile case in Belize brought by Caleb Orozco, a gay man attempting to strike down Belize’s anti-buggery law. Most modern, well-thinking individuals support Mr Orozco’s mission because anti-buggery laws everywhere are dark-ages relics and seek to breach persons’ privacy by criminalising non-public acts between consenting adults.

    Professor Bain has been under pressure from gay-rights groups and is in danger of being cast as one of those archaic thinkers. Why? Because his affidavit, which stated countries that repealed buggery laws experienced HIV/AIDS rate increases among men having sex with men, was presented by churches opposing Orozco’s application.

    Since then, Brendan Bain has been haunted, hunted and vilified. He’s been painted as anti-gay; as pro-retention of anti-gay laws; as pro-retention of anti-buggery laws; and an all-round wickedness. The truth is that Brendan Bain simply reported his scientific findings without editorial comment but, because these findings were used by opponents to the buggery-law repeal, Bain has been tried, found guilty by association, and fried in his science’s fat.

    The Caribbean HIV/AIDS Regional Training (CHART) Centre was a CARICOM initiative and is not a UWI programme. UWI operates CHART on contract to CARICOM. It was created “for the purpose of contributing to systematic capacity development among institutional and community-based health-care workers involved in prevention of HIV/AIDS, and in care, treatment and support of persons living with HIV and AIDS”.

    How can that charter be accomplished without detailed understanding of the sources of the infection? Are studies about the virus’ origins now to be banned because gays might be offended? Or are health-care workers to continue to labour in ignorance regarding how their patients may have contracted the disease or how communities may protect healthy members from coming into contact with the virus?

    Is it viruses that are off limits for research or just HIV? Should we not have researched the cause of the bubonic plague or smallpox? Oh, I know, we can do the research but can’t tell anybody what our findings are.

    Brendan Bain has been in charge of CHART from its inception in 2003 until now. The programme has recorded monumental successes. Bain led the team that wrote the grant application for the ongoing CHART project. As a result, the project was awarded a five-year grant for the period, April 2012-March 2017, valued in 2012 at US$ 9 million.

    This grant is one of the largest UWI has received; is also the first grant awarded by the US Health Resources and Services Administration to a university outside the USA; and was awarded on the basis that Professor Bain was identified in the grant document as the principal investigator and project director.

    Programme’s ruination

    Brendan Bain should be a hero to all people living with HIV/AIDS. Suddenly, he sends an affidavit of his scientific finding to a Belize court. The result? Brendan Bain’s continuation at CHART would mean the programme’s ruination.

    UWI, taking this disgraceful action in Caribbean governments’ name, had the gall to put the following in writing: “…The university recognises the right of Professor Bain to provide expert testimony in the manner he did”, yet, unilaterally terminates the gentleman’s sole source of income because “it has become increasingly evident that Professor Bain has lost the confidence and support of a significant sector of the community which CHART is expected to reach …”. What rot! Has one single CHART-trained health-care worker complained about Professor Bain? CHART wasn’t formed to reach lobby groups.

    UWI has exposed itself as a cowardly eunuch. Gay-lobby groups have a justifiable vision of a world bereft of discrimination against gays. But their anxiety to achieve that vision by any means necessary can endanger the very vision. They’ve weakened a programme beneficial to gays and destroyed a good man’s reputation, livelihood and freedom of speech.

    Be careful. Is this the thin edge of the wedge resulting in doctors refusing to assist litigants?

Soon we will here that anyone opposing LGBT should be imprisoned. The LGBT will never be satisfied until they have succeeded to shut up everyone with a dissimilar opinion and lock down all institutions with dissimilar views on their lifestyle.

    KINGSTON – THE University of the West Indies (UWI) yesterday announced that it has sacked Professor Brendan Bain as director of the Regional Co-ordinating Unit of the Caribbean HIV/AIDS Regional Training (CHART) Network, echoing a view by gay and human rights activists that he has lost the confidence of the programme’s target community.
    The UWI publicised its decision two days after the Sunday Observer reported that a coalition of 33 lobby groups from across the Caribbean had been advocating Bain’s removal because of expert testimony he gave in a constitutional challenge brought by a gay Belizean man against that country’s criminal code in September 2010.
    Caleb Orozco had argued that the code, which states that “every person who has carnal intercourse against the order of nature with any person or animal shall be liable to imprisonment for 10 years”, violates his right to the recognition of human dignity, to personal privacy and the privacy of the home guaranteed by the Belize constitution.
    In August 2012, Professor Bain offered expert testimony in the case on behalf of a group of churches seeking to retain the 1861 law.
    Bain, regarded as a pioneer in clinical infectious disease practice in the Caribbean and a leading medical authority on the HIV epidemic in the region, pointed out in his testimony that the risk of contracting HIV is significantly higher among men who have sex with other men (MSM).
    He said this was true for Belize, as well as other countries, including those that have repealed the law that criminalises anal sex.
    “The risk to MSM and their intimate sexual partners is not just to their physical health. The adverse physical and physiological consequences of STIs (including HIV) in MSM create significant and avoidable financial costs to individuals, households and governments. These important considerations must be included when considering whether to give public approval to risky behaviours such as are often practised by MSM,” Bain said in his testimony.
    But those views, which Bain made clear were his and not the UWI’s, angered the lobby groups who have been pressuring the university to cashier Bain on the basis that they represent a conflict of interest.
    Yesterday, the UWI said, “Many authorities familiar with the brief presented believe that Professor Bain’s testimony supported arguments for retention of the law, thereby contributing to the continued criminalisation and stigmatisation of MSM. This opinion is shared by the lesbian, gay and other groups who are served by CHART”.
    According to the UWI, “the majority of HIV and public health experts believe that criminalising men having sex with men and discriminating against them violates their human rights, puts them at even higher risk, reduces their access to services, forces the HIV epidemic underground thereby increasing the HIV risk”.
    The university said that while it recognises Bain’s right to provide expert testimony in the manner he did, “it has become increasingly evident that he has lost the confidence and support of a significant sector of the community which the CHART programme is expected to reach, including the loss of his leadership status in PANCAP (Pan Caribbean Partnership against AIDS), thereby undermining the ability of this programme to effectively deliver on its mandate”.
    On Monday, Dr Carolyn Gomes, executive director of Caribbean Vulnerable Communities Coalition (CVC), and Ivan Cruickshank, the group’s finance manager, raised that same argument in an interview with the Jamaica Observer.
    Dr Gomes said that when the CVC learnt that Bain was thinking of putting in the affidavit, he was approached and asked not to do it.
    “We sat down with him and said this is at complete variance with your role in CHART,” Gomes said. “You’re leading a programme that says stigma and discrimination are wrong… If you put in an affidavit that says you’re for discriminatory laws, how can you lead the programme?”
    Cruickshank said that some of Bain’s colleagues who are working in the same field were approached to engage him on the issue.
    Asked what Bain’s response was to those efforts, Cruickshank said he was not the one who engaged the professor, however, he learnt that Bain raised the issue of his conscience on the matter.
    “He didn’t see the negative type of implications that were being pointed out to him, because in his view he was providing a sort of biomedical representation of information,” Cruickshank said.
    Gomes interjected: “He hadn’t thought about the effect it might have had.”
    She added: “None of this is aimed at Brendan; it’s aimed at the position taken… it’s about how can the university have a credible programme against stigma and discrimination… led by somebody who is saying in public, not in private, keep the stigma and discrimination.”
    Colin Robinson, manager of Caribbean Forum for Liberation and Acceptance of Genders and Sexualities (CariFLAGS), one of the lobby groups in the coalition, agreed.
    “We’re not asking UWI to hold Professor Bain to any lesser standard than Dr Gomes’ board or mine would hold us,” he said.
    “We can’t just run off and do things in private and still want to hold positions that have particular values and principles attached to them, and that’s the simple matter that brought this large swathe of organisations together… it’s about protecting the leadership of the HIV epidemic in the region. We can’t have people who are not adhering to those principles leading this, and UWI’s leadership is important,” Robinson said.
    Gomes, Cruickshank and Robinson reiterated that their objection to Bain’s testimony was not intended to stifle his academic freedom to voice his scientific opinions.
    “We don’t have a scientific freedom issue, we don’t have an opinion issue, we have a conflict of interest issue, so Professor Bain is free to keep any opinion he wants,” Gomes said. (Observer)”

    Professor Bain quotes the Lance, one of the world’s leading medical journals, at Annex 6 of his report. His reference to what was a series of articles, mentions the Executive Summary only. He fails for some reason to look at the reason behind the series. For information, they covered:
    “the application of science to defeat the epidemic, [also the] second neglected, yet crucial, element …the cultural dimension of stigma and homophobia. Men who have sex with men have been, and continue to be, pushed to the margins of the HIV/AIDS response. Our Series not only aims to put men who have sex with men back into the centre of those debates, but to reassert the importance of the cultural and political dimensions of HIV/AIDS, which have been neglected in our fascination with technical breakthroughs.
    Although there are many countries that should be credited for showing enlightened responses to HIV/AIDS in communities of men who have sex with men, such as Brazil and South Africa, the extraordinary global polarisation around basic human rights for these me – in what Dennis Altman and colleagues – in this Series call “political homophobia”—points to the existence of deeply rooted cultural barriers. While South Africa led the world in recognising sexual rights in its Constitution, about 80 countries still criminalise homosexual behaviour. In many African and Caribbean countries, the former Soviet Union, and most of the Middle East, citizens face persecution for discussing safe sex behaviour, are unable to access harm reduction services, are unable to talk openly about their lives, and cannot get tested for HIV without the fear of being stigmatised.”
    I guess the good Professor just forgot to mention what the series was really about.

    “The papers in The Lancet Series on HIV in men who have sex with men (MSM) tell us about how far we have to go in providing care, in acceptance, in ceasing to withhold our love. They also tell us what we each already know, if we are prepared to be honest with ourselves—that lesbian, gay, bisexual, and transgender (LGBT) people are a part of every human community. LGBT people already have God’s full love and acceptance — they are his children too. But they need our acceptance, our love. And to the extent that legal discrimination, those old laws and statutes that make them inferior still exist, it is up to all to work to change those laws. I have no doubt that in the future, the laws that criminalise so many forms of human love and commitment will look the way the apartheid laws do to us now—so obviously wrong. Such a terrible waste of human potential.”

That’s a job for the Almight God…. when ask us to give an account for our lives here on earth. It was morally acceptable for a adult man to married a nine year old girl in the Roman Empire, and to have sexual intercourse with her by the age of ten. So don’t tell me about secular morality because history teaches us that it is relative to its period and time.

    “Millett and colleagues found greater HIV disparities in MSM relative to general populations in African and Caribbean countries where homosexual sex was criminalised than in countries without state sanctioned criminalisation policies.”
    So they are saying that having anti-gay laws results in a higher rate of HIV. Not quite the same as saying removing the laws reduces HIV, but close.
