(A) Letter of 13 September 2013. I suggest that the content is self-explanatory.

(C) Documents evidencing Shares issued in September 1998 following consultation by Gordon Seale and myself with Ernst & Young and Lex Caribbean. The Shares carry the signature of Gordon Seale. The original Certificates also carry the BBR Corporate Seal. The Share Certificates are legal documents of title wherein Mr Seale certified the Shares issued. In the 15 years since the Shares were issued no legal action has been taken to set aside or challenge the validity or legality of those Shares issued to Woodbank, my Company, and Sand Acres Limited.
(D) Inspection of Accounting Records: you will note that Mr Seale states “Mr. McHale does not own any part of Sand Acres but he does have 30% of BBR Ltd”. Mr Seale has yet to provide me with accounting information with respect to BBR’s water supply diverted to Sand Acres. There are many items of correspondence from the Seales which similarly evidence my shareholding.
(E) Sadly, when I visited Bougainvillea on the evening of last Friday 13th to give copies of the letter in (a) above to Security and Front Desk, Security were instructed to remove me from the premises despite my being a Director and owner. That matter is now with the RBPF.
I suggest it is somewhat pathetic that I have been excluded for well over seven years from the management and direction of Bougainvillea, and especially from the Annual Staff Awards. At the same time I am very pleased that BBR has been as successful as it has been and I thank you all for your efforts.
You may draw your own conclusions from the above correspondence.

After experiencing prison life first-hand in Barbados, a Canadian businessman wants to throw out a line of hope to those who may run afoul of this country’s laws.
Dan, who owns a business here and has several investments in countries around the world, spent just under three weeks at Her Majesty’s Prisons Dodds in St Philip on charges related to drugs and witnessed first-hand the bartering for food and favours, among other things. In his view, though, it was time well spent.
“I met some terrific people in there, on both sides of the bars, including the two induction officers. After a week I was really down; and when I finally received my induction interview, I asked for something to read.
“Miss Innes, one of the induction officers, asked if I read The Bible. When I answered no she asked, ‘Why not?’ I just hung my head and told her I’m Catholic but I guess I had just drifted away from the Lord . . . . So for two weeks, all I did was read The Bible every day until my eyes couldn’t read anymore, and I truly believe that the Lord subjected me to that because He wants me to do something about the situation in Barbados’ prison,” he told the SUNDAY SUN.
Upon emerging from behind the barbed wire fencing at Dodds, he wrote his ideas for the Hope For Justice Foundation, offering some alternatives in a justice system that, in his view, was unfairly angled against the poorest members of Barbados’ society.
The white Canadian behind this vision wishes to be referred to only as Dan. In his interview with the SUNDAY SUN, Dan’s legal representative Angella Gittens, of Pilgrim & Associates, expressed support for the concept and intends to not only donate the necessary legal services to launch it, but to be the face of the organization until Dan’s court issues in Barbados are resolved.
“I have heard the stories Dan is telling me from many of my clients in the past. However, he is the first one to propose some concrete, proactive steps in addressing this very important issue and I am happy to support this valuable cause,” said Gittens.
“There are just so many things that are wrong,” Dan added. “People are spending time in jail for no reason really; just for the mere fact that they can’t afford to pay their bail or fine. It’s just not right.
“You have a system here right now where, if somebody has money, they could be committing the same crime as the person who doesn’t have money but they’re not suffering nearly as much. They can pay the fine, they can pay their bail and get out while their case is being heard, which takes a long time in Barbados, and nobody can deny that,” he explained.
“I met a guy in prison with a $750 fine. For somebody like me, that’s nothing but neither he nor his family could afford it, and all he did was get caught . . . . He’s an older guy, caught with a spliff, and he has to spend six months for that? It’s not right,” he added.
Dan, who has been residing here since early last year overseeing the establishment of his business, has had to spend the last four months awaiting the outcome of his court case. He expects challenges in his effort to improve the system; so with the support of Gittens and his former employee and friend Tramayne, he wants to launch the foundation based on Helping Others by Providing Equity (HOPE).
The foundation’s main goal is to work cooperatively with the legal and prison systems to address inequities and shortfalls to help improve overall conditions in Dodds.
“I mean if you’re going to incarcerate them, don’t take away their humanity!” said Dan, pointing to what he perceived as basic human needs and nutritional requirements not being met by the island’s prison.
“I’m not exaggerating when I say this: to be given first thing in the morning a choice of a piece of bread with a little bit of butter or maybe a bit of jam or peanut butter, and either watered-down tea or flavoured water, means effectively you’re getting bread and water for breakfast, three scoops of rice with a little bit of gravy for lunch, and bread and water for dinner. That’s it!
“Basic nutritional requirements aren’t being met and nobody can convince me it’s a budgetary thing. Look, there’s a tree or shrub out there, moringa, and people talk about the seed pods but the leaves provide more nutritional supplements than carrots, tomatoes and other fresh vegetables; and moringa costs next to nothing to grow,” he said, suggesting that inmates could grow this plant and use it as a source of basic nutritional value.
In terms of the barter system behind Dodds’ walls, he said: “Some guys sell their food to get a mattress or a piece of a mattress from somebody who does have one; or you can trade stuff for a pen or piece of paper to write a note for your family.
“Then there’s no outside communication whatsoever. No newspapers or magazine can go in there so you lose touch with the world. You can’t even make a phone call. There are phones in every block but none of them are operational. The only way people in there can get word to their families is to write a little note, give it to the guard, the guard makes a call and reports back to the inmate,” he said.
“How do you expect people to go in there, especially those spending ten years or more, totally out of touch with the world, to cope when they get back out? What does it cost to have some newspapers or magazines to let them see what’s going on in the world? What does it cost to let them use the phone to talk to their families once a week or so?
“When I was there I noticed a prison posting saying there was a competition between the four quadrants in the block and whoever kept theirs cleanest would get the TV for a weekend that month,” he recalled.
A check with Superintendent of Prisons Lieutenant Colonel John Nurse revealed that he was not surprised by unfavourable comments from former inmates, and insisted that good nutrition, mattresses and basic needs were a priority at Dodds.
“All of our prisoners have beds and mattresses, and nutrition is properly looked at. Furthermore, I don’t know that there’s a bartering system, and if so it would have to be sub rosa and against prison rules. Perhaps he should share any information with us so it can be investigated,” said Nurse, who cautioned that officials regularly inspected the prison so its operational standard needed to be high.
Dan, meanwhile, is also concerned about inmates who may be innocent but pleaded guilty in order not to end up being on remand for four or five years while awaiting trial.
“Why spend five years waiting when the penalty is only a year if you plead guilty?” he asked rhetorically.
The Hope For Justice Foundation, therefore, is aiming to help convicts and accused persons improve their lives, reduce what he and Tramayne termed “unnecessary incarceration”, improve living conditions at Dodds and, by extension, improve the social fabric of Barbados.
The foundation is to be a local non-profit one governed by a board of directors comprising a former inmate, representatives of criminal and corporate legal firms, a church representative, an official of Dodds, a judicial officer, a member of Parliament and a physician. It will be funded mainly via donations and fees charged for services.
“I am confident that the many people who are aware of this situation, as well as those who are now aware as a result of this story, will support what we are trying to do,” said Dan.
“We need people to get involved by offering moral support, contributing their time and/or offering future commitments of financial contributions when the Hope For Justice Foundation is established. It can be done and should be done! This is a beautiful country full of good people.”
