Your message to the BLOGMASTER was sent

By circular dated 1st April, prepared by the Bauxite Company of Guyana Inc (BCGI), workers of Aroiama and Kwakwani are being advised of a Workers Committee for them, headed by Orin Ford. This is yet another violation of the laws and an imposition on the workers by Management to determine or facilitate any acceptance of any group or committee of workers other than the recognized Bargaining unit of GB&GWU. As recent as March 25, 2010, Labour Minister, Manzoor Nadir, is reported in Kaieteur News acknowledging that the “Labour Occupational Safety and Health department does recognize the GB&GWU as the recognized union for the bargaining unit” for BCGI workers.

The efforts to coerce workers into establishing a Workers Committee (a defacto bargaining unit) by Mohamed Akeel, BCGI Labour Consultant, and the company’s Human Resources Manager commenced 18th March after the failed attempts to get the workers to sign up to have NAACIE replace the GB&GWU. For more than a decade Mohamed Akeel was this country’s Chief Labour Officer and Secretary of the Trade Union and Recognition Board. He knows his actions are illegal and in violation of the Trade Union Recognition and Certification Act, Chapter 98:07, Section 23 (1), Compulsory recognition and duty to treat, which expressly states,

“Where a trade union obtains a certificate of recognition for workers comprised in a bargaining unit in accordance with this Part, the employer shall recognise the union, and the union and the employer shall bargain in good faith and enter into negotiations with each other for the purpose of collective bargaining.”

No workers committee can replace the GB&GWU until and after such time as the GB&GWU is no longer the official recognized bargaining unit. This can only be done if or when the GB&GWU is derecognized by the TURB. Mr. Ford is advised not to allow himself to be used as Pontius Pilate or to be the new pawn in the ring to front the aggressive policies of BCGI and the Government of Guyana against his friends and colleagues of the Bauxite industry. Mr. Akeel and BCGI are reminded that the Certificate of Recognition between GB&GWU and BCGI, was signed on 26th July 2007, by he, Mohamed Akeel, as Secretary of the Trade Union Recognition and Certification Board.  They both know that it is illegal to form and/or entertain a Workers Committee or any other such grouping to take the place of GB&GWU when the Recognition is in place. Minister Nadir acknowledged this recognition but fails to enforce same. Mr. Ford must remember that history will judge him and that he has responsibility to set an example of manhood, dignity, valour and pride for his children and grandchildren. He must remember that the struggles of our ancestors and those who laid their lives down for us to have better conditions of work were often betrayed by those who were naive, mislead, greedy, power seeking and self serving. Many such were discarded after they served the masters’ purpose and outlived their usefulness.

After five months, the inaction and refusal, by the Minister of Labour and the Chief Labour Officer, to intervene to resolve this matter that they know is in violation of the laws is nothing short of imposing conditions of life on workers that are reminiscence of an era when workers had no rights, no laws to protect them and the employer or Massa determined their existence, work and value. Guyanese have come a long way, having given of their blood, sweat and tears to ensure these sacred rights to association and choice are protected, to now have a foreign company in collusion with a government financed by the people, to revert them to conditions  not of their choosing and in violation of the laws. If these discriminations are intended break the spirit and determination of the bauxite workers, they will not succeed. The Union shall not be deterred and will continue to explore its options to have the rights of these workers respected. Bauxite workers are no less deserving than sugar and any other workers in this country.

  1. BU continue to follow the abuse of workers rights in Guyana with little being said by regional unions and governments. Although in fairness to former general secretary of the NUPW Joseph Goddard he wrote a long piece in the Barbados Today this week on the matter. God forbid a similar thing happens in Barbados and we need to reach out for help from our regional brothers and sisters what can we expect given the stony silence to date of our unions and government. It is time we stand up and do what is fair.


  2. Additionally BU maybe under the mistaken view that the government has a role supported by law to support workers rights in supporting the trade union of their choice. The Giyana government should be able to supervise a polling to determine if the GB&GWU has the required support from the bauxite company.


  3. What a sad day in Guyana and even sadder for a man like Mohammed Akeel who was labour Commissioner for years.
    It seems as if a dollar will make some of us do anything. The Govt of Guyana under jagdeo has proven to be anti-union for years.
    The Labour Movement in the Caribbean has proven to be ineffective but that does not mean that strong Unions like the BWU, NUPW, NWU, OWTU etc cannot speak out. All of these are disappointments to workers in the region.


  4. The Guyana Govt is targeting some unions for destruction because of their racial make-up. Don’t understand how David Thompson is not seeing what is happening and trying to help his fellow man. Errol Barrow would have spoken out were he alived.

    Jagdeo should never be able to come to Guyana nor any IndoGuyanese, including Shridath Ramphal, Rickey Singh, Ron Sanders and Norman Faria without them knowing our displeasure with what they are doing to our sisters and brothers in Guyana.

    It was the great Dr. Martin Luther King who said “injustice anywhere pose a threat to justice everywhere.”

    African Guyanese need the support and solidairty of African Barbadians. What is happening to these people has all the making of genocide

    The PPP support for the rights of workers and the laws protecting those rights are selective. Indians will have it, independent Blacks won’t. BCGI is owned by the Guyana Government and the Russians. There is no doubt the workers are sticking by the GB&GWU. I have been told about the numerous failed efforts by the company with the support of the government to get the union out. After the company couldn’t get enough workers to sign up to their petition to say they didn’t want the GB&GWU they tried bringing in another union ( the PPP/Jagdeo NAACIE) When that didn’t work they told workers to form workers committe, when that didn’t work they appoint a committe for the workers! All illegal but you know illegality is a norm and modus operandi of the Jagdeo regime. If you know the history of bauxite workers, they will not budge. This is the dilemna the government faces.This is not a passive group of Black people. They will fight tooth and nail. They fought the well loved Burnham, Hoyte and PNC who they vote for every five years, and they will fight the racist Jagdeo government and the Russians.

    What the PPP is not publicly saying is that their target is Lincoln Lewis. The GB&GWU is the union of Lincoln Lewis, General Secretary of the Caribbean Congress of Labour. He is one of the most vocal critic of the government. His regional profile and constant criticisms of the PPP they find annoying. Last year they locked him up for protesting agiant them. They are hoping they can weaken the union and by extension weaken him. So far it is not working and if Lincoln Lewis does not back down, and I suspect he won’t, they will not be able to penetrate the union. What I know of the man he will not go down without a fight.


  6. One would imagine that given Lincoln Lewis is under attack this should have brought Sir Roy et al to the fore by now in a public way.

    Sir Leroy is all about Sir Leroy. If there isn’t a personal opportunity for him to flaunt his knightship he won’t be bothered. Ask trade unionists around town about this Knight (not) in shining armour. They are two types of trade unionists- the one who represents the workers and the other who uses the workers to represent himself.
