On Monday 8th, the hearing of the jurisdictional motion before the Honourable Justice Bryan Shaughnessy of the Ontario Superior Court of Justice in Nelson Barbados Group Limited v The Country of Barbados and others had to be adjourned because of a convenient last-minute motion for leave to appeal the decision of the Court (that BU posted) whereby the videotapes of the cross-examinations in Barbados and Toronto of the defendants, including our Chief Justice, would NOT be released to counsel, but sealed by the Court. Little Willy was up to his tricks manipulating the system for all he was worth as usual (he stands not the slightest hope in hell on an even playing field) and desperately trying to get his hands on the videos so they can (suitably edited and added to) be posted on Keltruth and BFP with links to YouTube, of course.

The matter of leave was heard and decided by Shaughnessy J. and today Fergusson J. will sit to decide if leave to appeal ought to be granted.

I am attaching the Ruling of Shaughnessy J. so that BU and its family and readers can be updated on events as they occur in a case that is taking millions of dollars from our foreign exchange and putting it into the pockets of Canadian lawyers and which is being used by Peter Allard/Madge Knox controlled blogs to denigrate Barbados. All I can say is that judging from the decision, this is one seriously pissed-off judge.

I realize that this comes hard on the heels of the Factum of the Defendants, however as the Advocate, the Nation and VOB and CBC seem to think that Barbados being expensed for millions of dollars for a case in which it is sued in Canada, is of no merit and not worth reporting. BU has filled the void of credible and responsible reportage for Barbados. So let us leave the Advocate and Nation et al to do what they do best, school sports reports, and leave the serious stuff that affects our economy and our ability to pay for and maintain those schools – and how we are perceived internationally – to the big boys, like BU.

I will update you as soon as the decision of Fergusson J. is delivered.

  1. This is an update. The Motion brought by Little Willy was heard yesterday in Ontario before Fergusson J. The learned judge did NOT reserve her decision and DENIED the motion of Little Willy with reasons to follow in the coming weeks. These reasons, as soon as they are published by the Court, will be sent to BU for Davis, in his discretion, to post.


  2. Sorry, that should read ‘David’. We know Kathy Davis ain’t gonna post those reasons – or anything else that will give Bajans both sides of the story.


  3. Well, I could tell from the last decision of Judge Shaughnessy, that he was upset with the tactics of McKenzie. There is now no doubt in my mind that he is royally pissed and, in my opinion, plans to throw the book at him. He is keeping all the costs for a Cost Order to be handed down at a later date.

    I will not be surprised, since Nelson Barbados Group has no assets, if the Judge ordered McKenzie to pay and Nelson to hand over its “supposed” shares as part of the payment.

    It is my opinion that McKenzie’s reputation as a lawyer is toast in Ontario. Maybe he will make enough from this case to support him the rest of his life.

    I wonder what BFP and Keltruth are saying about the delaying/postponing tactics of McKenzie. Afterall, they are very fast to criticise the Barbados courts.

    The Honourable Justice Shaughnessy has ruled in his decision has ruled that the publication of this case in the press (BFP & Keltruth) has cast aspersions on the defendants.

    I suppose you would say that the Honourable Judge is telling a lie.


  4. Pat, you and I have been saying for MONTHS that McKenzie is going to end up having to pay these costs himself if Nelson was a shell company. It is very rare that a lawyer is made to pay costs himself, but this is a shoo in.

    Madge Knox continues through Alair Shepherd aka Lilli Marlene (but I think Doris Day is a better name for him) to bring actions that are all lost and no-hopers. One wonders when costs will start to be ordered against Doris.
