Your message to the BLOGMASTER was sent

Barbados hosts a significant number of visitors, from countries that are serious about protecting their citizens’ personal information or data.  In Barbados, their data can be held by Government agencies, and every business that records any information about its customers.

To facilitate international trade, Barbados needs to have a Data Protection law that makes selling or sharing someone’s personal data, without their consent, illegal.  Our Data Protection Bill was developed in our Senate, and was referred to a joint select committee of the House of Assembly and the Senate.

The Committee requested public comment on the Bill, and Solutions Barbados submitted its comments on 20 June 2019.  We received no acknowledgement.  After seeing others being allowed to present their concerns about the bill to the Committee, I called several times requesting the opportunity to be heard.  I also sent e-mail correspondence, but got no response.

This experience was different from the respectful way we were treated, when we presented on the Integrity in Public Life Bill.  We were allowed to discuss the loopholes we found in that Bill, that allowed persons who received bribes to legally avoid punishment, and keep all bribes paid to them.  The Data Protection Bill contains loopholes that are a lot worse – for us.

The Data Protection Bill makes a weak attempt at protecting the privacy of personal data.  Worse is that it can easily be used to terrorise businesses and individuals for political reasons, with the end-game of politicising the private sector.  That makes it a very dangerous bill.

I was shocked to learn that the Senate passed the Data Protection Bill on 24 July 2019.  I read the amended Bill and found that that our senators left all of the vulnerabilities for politically directed harm intact.  Why would they do that?  Further, by not allowing us to express our grave concerns to them in private, they have forced us to make them public.

If the amended Bill becomes law, then you may wonder how your competitors obtained your most sensitive business and personal information.  If that information is used to bankrupt you, then you can thank our senators for failing to protect us when they had the chance.  Thanks senators.

Since our senators seem not to have acted in our best interests, my only recourse, as one who has reviewed the Bill in the public’s interest, is to appeal to the members of our House of Assembly.  Our main concerns follow.

The Bill requires every business in Barbados, who records any information about their employees or clients, to pay a fee (or tax) and register with a politically appointed Data Protection Commissioner.  If you choose not to register, then you may pay a fine of $10,000 or be imprisoned for 2 months, or both.  If you do not maintain your registration, then the Commissioner can fine you $50,000.

The Commissioner can go through your files at any time, and must report any results to the Minister.  Once you have attracted many clients, or are a school with many students, then you are rewarded for your success.  You must employ or contract a Data Privacy Officer, whose allegiance is to the politically appointed Commissioner.  This Officer must have expert knowledge of data protection law and practices.

The Data Privacy Officer is like a Government spy in your business, who must provide all information about your business, including your clients, to the politically appointed Commissioner, whenever they ask for it.  In return, your Business must provide the Data Privacy Officer with all of the resources needed to both spy on your business, and be educated in the latest spy-craft.  They must also be given unfettered access to your employees.

If you get fed-up with the spying, then you must learn to lump it, because the Data Privacy Officer cannot be dismissed or disciplined for spying.  If you do not employ or maintain a suitable Data Privacy Officer, then the Commissioner can fine you $50,000.

If the Commissioner feels that you are not complying with the Data Protection Act, then they can effectively close your business.  If you resist, then you get to pay a fine of $15,000 or spend six months at Her Majesty’s Prison.  Also, the police can forcibly enter your business and seize your files and computers.  If you do not assist the police in their search for incriminating evidence on you, then congratulations, you get to pay a $100,000 fine, or spend two-years in prison, or both.  Lucky you.

You can always appeal the politically appointed Commissioner’s decisions to a Tribunal of five persons.  However, all five members of the Tribunal are selected and appointed by the Minister – so get with the program.

The 102-page Data Protection Bill provides an unnecessarily complicated bureaucracy, that can easily be corrupted for politically partisan reasons.  If we want to protect the privacy of personal data, then why not simply state that?  Why not simply define personal data, and state that sharing or selling a person’s personal data, without their consent, is an offence which entitles a victim to damages.  Why is that so hard?

The victim can then quantify their loss of business and/or reputation, and a judge can determine what is valid, and award damages accordingly.  What type of Barbados are we designing for our children to live and work in?  How can they possibly prosper in such a quasi-police state?  How dare our senators pass something so ridiculously dangerous to the public of Barbados?

    I noticed that a link to the the amended Bill was inserted in my article. If that is the link to which you refer, then it was placed there by the Blogmaster.
    You may notice that PDP members of the Select Committee, Atherley and Drakes, shamelessly voted with the BLP to reject every recommendation by the private sector to improve this bill.
    If the PDP is essentially the BLP’s corrupted B-team, then you should expect Caswell to obey the BLP’s orders and also support the passing of this most dangerous Bill in the Senate. If he did not, then he would have proved himself to be the only independent senator as you are suggesting, and I would actively support him – because he is all we have. Drakes has proved that she is already compromised by her behavior in the select committee. We shall await the minutes.
    To their shame, all 30 MPs decided to rush this bill through the House today (30 July 2019). We will see if Atherley decided to repent of his shameless support for the bill in the select committee and choose to represent the public’s best interests, or whether he confirmed his allegiance to the BLP and supported this most dangerous bill with his BLP colleagues. We shall await the minutes.

    There is a fundamental principle of journalism that if a story/article has someone’s name on it the person must agree to such a change. The only exception is in news stories and headlines. It is simply bad editing.
    I know from experience that David changes copy, as we call it. He may think there are minor matters, but changes can sometimes alter nuances, underlying emphases, soft assumptions. In other words, it changes the author’s intentions.

    The days of Barbadians’ data been misused are coming to an end, Minister of Small Business, Entrepreneurship and Commerce Dwight Sutherland, has pledged.

    The St George South MP promised that as part of the Data Protection Bill, Government will govern the collection of all personal data.

    Speaking this morning in Parliament, Sutherland said the bill would regulate the collection, keeping, processing, use and dissemination of personal data, to protect the privacy of individuals and to provide for the regulation and the protection of people’s digital lives.

    He said that most people who used the internet did not have a clear understanding of how their personal data was stored and used.

    He declared: “This is a threat to companies, to individuals and what this legislation is seeking to do is to address some of these concerns.

    “As this Government seeks to promote and encourage the use of information and communication technologies and as this Government seeks to provide more of its services online leveraging digital technology, and as this Government seeks to transform into a digital economy and create an enabling environment for the ease of doing business, it must ensure that its legal and regulatory framework is indeed one that the key stakeholders will have the confidence in us as we seek to build out our digital eco-system to enhance Barbados’ competitiveness as it relates to trade and the ease of doing business.

    There is no electronically stored information anywhere which is not available to the 5-Eyes, other selected agencies and some corporate entities willing to pay.

    Once this writer has an ‘identifier’ we can see and hear too!

    This is precisely the issue at the heart of the current trade ‘war’ between Beijing and Washington. For 5G networks would make all of the established backdoors for the 5-Eyes to collect data on all of us antiquated. It’s more an intelligence war, with Washington demanding backdoor access and Beijing saying an insistent no.

    We already have a Big Brother society. There is nowhere in London or New York, and much of the world, that one can go without appearing on hundreds of monitoring devices. All those images are stored in massive data bases.

    Google knows every search this writer has made, every purchase made, every email sent, for thirty years.

    So much is known about us that psychological profiles have been constructed to tell us how to think, how to vote. and everything else.

    Did Grenville just wake up! Has he not read 1984 – Orwell or A Brave New World – Huxley. Such a man will make a dangerously ignorant leader. But such are currently in bogue thanks to the Big Brother society imposed on us all.

    All of these foolish calls for laws are just to mislead people who know no better.

The only change that would have occurred with his 2 and 3 thousand word submissions text formatting is not consistent when copied and pasted to the WP visual editor. Such a petty little man.

    That is BS. Look at the American experience. When the agencies were caught harvesting metadata and it became a public spectacle, laws were passed but business continued as before, and even increased.

    The stated aim of the Data Protection Bill 2019 is to:
    (a) Regulate the collection, keeping, processing, use, and dissemination of personal data
    (b) Protect the privacy of individuals in relation to their personal data
    (c) Provide for matters related to (a) and (b)

    We all acknowledge that the world is changing rapidly so Barbados will have to introduce new laws from time to time. As “the man who would be King”, have you been briefed by your advisors as to whether or not our existing laws put individuals and their data at risk? Can you provide an example or two of the risks that individual Barbadians face and the consequences they will suffer if their data become compromised?

    In short, is the government of Barbados justified in addressing the whole issue of individual data privacy and protection at this point in time?

    We are dealing with an international collection system which routinely spies on world leaders, even as they negotiate with them, kid yourself if you must, but we see not the sobriety you presume.

    The EU are negotiation with the US about trade. Central to those discussions is the EU ‘demand’ for US concessions on Google, Facebook, Amazon. They are unlikely to be successful. As a result even its staunchest allies will deploy the spectre of Chinese 5G, which shuts out the US, as counter.

    2…I have not read the Act as I did not want to dload the PDF last night…will revisit later.

    However, coupled with @Walter’s 7:43 there are aspects of Mr Phillips’ piece that don’t make sense legally or practically…so if he or anyone can clarify I would be happy.

    How can any govt officially and LEGALLY … go through your files at any time, and must report any results to the Minister.???

    What exactly does that mean?

    S/he surely can’t cull your company data and pass it on to any minister.

    I interpret the intent of the law to be that the compliance officer can seek to validate at any time that your client register is properly secured/encrypted and there have been no unaccounted breaches and so on.

    This must be about the technical management and handling of client data NOT about some willy nilly access of private company data…that’s confidential and proprietary!

    How can any govt TELL a private company that they can’t discipline or fire an employee?

    Grenville’s concerns re the hurried nature of the legislation are valid but I am confused by his interpretations!

    I appreciate the inserted link and take no offence. Linking to the amended bill was convenient to readers – which is part of the responsibility of the Blogmaster.

    I also maintain blogs and must, from time to time, reformat comments (adding spaces between paragraphs) to improve readability, or redact portions (with xxxxxxxx) to hide defamatory information. When I do, I would note that it was redacted.

    As an improvement (not a criticism) you could note something like “Link inserted by the Blogmaster for convenience”. This is only because Piece thought that I inserted the link, which has resulted in this unnecessary thread of comments.

    In my opinion, this Bill, if proclaimed, can formally turn Barbados into a police state. The aim seems to be to politicize the private sector. The Bill is not yet legal, but we have grave concerns.

    Section 68.3: “A data privacy officer shall not be dismissed or penalised by the data controller or the data processor for performing duties and functions referred to in section 69.”

    Section 69.1.d & e: “A data privacy officer shall d) cooperate with the Commissioner; e) act as the contact point for the Commissioner on issues relating to processing, including the prior consultation referred to in section 66, and to consult, where appropriate, with regard to any other matter.”

    I am reading the linked document but one of the words I search for and did not find is anonymization.
    I worked in a job related to the healthcare industry and for some of the data we received have patient identifiers removed. There are times when it is unnecessary to have such information.

    On “anonymization”, it is addressed in Section 62.1 as pseudonymisation and encryption of personal data.

    On Atherley and his senators, so far, they have consistently sided with the BLP when it counts. Therefore, it is 30-0. We have no independent opposition in our Parliament.
