Mia Mottley Prosecutes Government on CORRUPTION in Her Reply to 2015 Budget

Those  Democratic Labour Party (DLP) members in parliament advocated the need for Barbados to enact Integrity and Freedom of Information legislation prior to being elected in 2008. There was an expectation Barbadians would have seen movement on this issue within 100 days of the DLP government […] taking office. It is an indictment on civil society we have not been able to pressure government to treat this issue as a priority.  In fact, the DLP was re-elected in 2013 and transparency legislation did not feature as a key platform issue.

It is ironic Mia Mottley’s contribution in the 2015 Budget Debate  has positioned the issue of graft and corruption in government squarely in the public’s domain. If we are to evaluate the fervour which some members of parliament on Mottley’s side supported her on the issue there is a lot to be said about the political class closing ranks.

    This week strike by PSV workers because of govt implementing a standard dress code is one of interest in that the PSV is a private enterprise and govt intrusion in a matter which should be of no concern to govt opens up an area of legitimacy as to whether govt has a legal right to interfere on issues which should be directed by owner

    I was especially intrigued this week by the action of the PSV employees to strike against commuters because of their dissatisfaction with being compelled to wear uniforms emblazoned with the logo of the Barbados Transport Authority rather than that of the owners of the vehicles, and the ensuing discussion in which I believed I heard, though I might be mistaken, that the owners of these vehicles are mot responsible for the wrongful acts committed by the workers on them.
    These two issues raise interesting points for legal study; first; the statal authority’s entitlement to prescribe the form of dress that a worker engaged in a private contract of employment under its regulation should adopt and, second; the notion of an employer’s liability for the wrongs of those in its employ, the common law doctrine of vicarious liability that is currently undergoing what may be justifiably described as seismic change.
    As for the first, we may take as our point of departure that what one chooses to wear is essentially an exercise of his or her constitutionally guaranteed freedom of expression, although it is entirely possible individually to cede away this right by contract or some other mechanism. Indeed, the opening words of the relevant provision in our Constitution makes this clear-
    “Except with his own consent, no person shall be hindered in the enjoyment of his freedom of expression…” (emphasis mine)
    Most frequently, this freedom of expression in respect of dress is conceded in the context of schools or other kindred organizations and of employment where the state, school authority or the employer competently determines what would be considered acceptable dress while engaged in the contracted activity.
    It may also be subject to the demands of the occupier of the premises upon which the individual proposes to enter lawfully. And while some of these conditions may be questioned for their correlation with common sense such as the prohibitions on arm holed dresses for women and shorts for men in some places, it is perfectly within the remit of the occupier, whether the state or a private entity, to determine the conditions of entry onto their premises. And, of course, there may be constitutional legislative prohibition on certain forms of dress may be gleaned from the recent Caribbean Court of Justice ruling in the Guyanese cross- dressing case
    According to the state action doctrine however, the constitutional fundamental rights are ordinarily enforceable against the state or state entities only, so that at first blush, unless the state or the entity falls within the role of school authority, employer or occupier or unless there is appropriate legislation, the state and its corresponding agents should have little authority to determine what an individual chooses to wear at any time.
    Moreover, the unilateral requirement for the PSV workers to wear the logo of the Authority would seem impermissibly to override the managerial prerogative of the owner/employer of the PSV operation to determine the required mode of dress of its employees. One could scarcely conceive of the Fair Trading Commission mandating the uniform of the workers of the telecom company or of the BWA or of the Financial Services Commission directing what the employee of any given credit union should wear.
    On these bases, the Transport Authority would be required to show that its mandate is a proportionate response or, as the Constitution puts it, that it is reasonably required in the circumstances. The
    objective of bringing some order to this notoriously intractable sector is doubtless a laudable one, but reasonableness in this context would demand that the Authority should infringe as little as possible on the fundamental right of the employee and, arguably, in this case, the employer.
    The notoriety of the sector would naturally make it difficult for the commuting public to see any virtue at all in it, but on this occasion I do believe that it has a valid point. If the owners are of a similar view, I do not believe that the door is or should be closed for further collective negotiation and compromise on the matter.

    ………building their own bus terminals;

    ………regulating how PSVs should be painted;

    ………regulating increases in bus fares;

    ………to pick or set down passengers at places other than designated bus stops;

    Essentially, your suggesting since “the PSV is a private enterprise,” owners have the right to operate their businesses as they see fit, because “government does not have the right to make laws or regulate private businesses.”

    I know your politically motivated agenda is one that includes criticizing and opposing this arrogant BLP administration, even in cases where it is not warranted……

    ……..this is why I believe you should think carefully before rushing to post nonsense to BU.

    Never have i heard any govt intervening in a dress code for private business
    In barbados their are Private businesses who are grantedby govt million dollar contracts and large co concessions and needless to say govt have never intervened or implement rules or regulation to a formal dress code
    There is a legal concern as to if govt have a right to issue or regulate any form of dress code to privately owned and operated businesses even if the business owner is contractually bound to govt to perform a public service on behalf of govt

    Well for me Corruption is what successive BLP governments have been seeking to unfairly do – that is – use the power of compulsory acquisition to rob a average black family in Six Mens St Lucy of their land.

    Now they have over 300 Squatters – a lot of them non nationals taking over the people land.Bdos Light & Power was instructed by Owen Arthur to give the squatters at Rock Hall St Phillip Eletricity – as was publicized in a 2017 Sunday Sun Article – and now it seems he did the same thing for these squatters at Six Mens.

    My hear bleeds for that family.

    Cow Williams,David Seale nor Goddards will never have to fear that happening to them.

    This black face – white heart & mind BLP party as currently exists (as distinct from the Tom Adams administration) is a curse on this land.

    Squatters in Six Mens – St Lucy

    The aim of the BLP is too give non nationals – whether legal or illegal – so much rights – that these non nationals will always see the BLP as their party who helps them out.

    You see what happened 2 weeks before elections.

    A subliminal or maybe overt message was sent out – Mia went on air and said – these non nationals who are not on the electors list must vote in THIS election.”Gregory Nicchols be prepared to go to court in the morning” – and that’s exactly what he did.

    So much so – that for the first time in the history of Barbados – boxes were still coming in close to midnight.

    People were turning up with pieces of paper at polling booth in the dead of night to vote.

    Police had to run back to the election stations and re- open them long after voting had stopped.

    So wait – Mia was so concerned about these non nationals getting to vote in this elections – that she didn’t care if she had to disrupt the whole elections … but wait ….

    Mia ain’t care no more bout de lil rasta child that get killed at that protrusion at Maloney -Villages at Coverley ?

    Ohhhhh I see the rights of non nationals and the power of their vote are more important to her. Hmmmm.

    And wunna tink Mia and dis BLP party sweet

    The part about denying citizens the right to vote is true.

    However the other part about in the dead of night reopening voting stations suggests that it was ammmmm after 12 etc and that is sort of a stretch.

    How many voters were added to the list after the court ruling?

    Where I would suggest that you augment your campaign is with the pictures of the drug dealers that Mugabe invited to parliament.

    This simple act of relaying social media content, whether photos, videos, or gifs, causes a recipient to profile the sender, over the course of time.

    so that content has to be carefully crafted or it can seem to be “visceral hatred”

    So take for example the grandson’s “Mia Cares” messages that are all over Barbados and across the diaspora.

    You notice that the content of these Stoopid Cartoons ALWAYS shows how Mugabe is changing laws selectively.

    They highlight her breaking promises, firing public servants, hiring her own people, making the post of the Chief Personnel redundant…and other pointed observations.

    So when messages like “Veteran Hotelier reminisces over something distracting…” take the forefront on BU, de ole man has a concern.

    People get distracted, and sheeple more easily, and fail to understand that, the reason the Chief Personnel post is abolished, is purposed.

    It is because SHE IS THE ONE PERSON WITH OVERSIGHT OVER THE UNDERHAND HIRING PRACTICES OF THIS NEPOTISMIC MUGABE GOVERNMENT.

    THE CPO is one of the few person who will be able to report to the IMF, and bajans, that the BLP IS LYING WHEN THEY CLAIM TO HAVE REDUCED THE PUBLIC SERVICE.

    That is why there are some things I don’t do on this site.

    What I don’t want to do is to elevate Mugabe to some extraordinary status – and create such fear of her because that is exactly what she wants.

    Certain things were revealed to me – the week of the elections that I cannot speak here – but most of the citizens are like a baby asleep – but they really need to be like the 5 wise virgins – who were alert and ready.

    Do you think they give a flying FVUCK?

    First: No politician in Barbados, NONE, has the power to compel anybody to vote. Don’t 40% of the registered electorate routinely stay away from the polling booth? Thankfully wunna politicians don’t have nearly as much power as wunna like to imagine.

    Second: Commonwealth citizens have ALWAYS had the right to vote in Barbados’ elections, as Bajans have the right to vote in other Commonwealth jurisdictions. I have voted in places other than Barbados.

    Third: The Caribbean Court of Justice ORDERED the Barbados Electoral and Boundaries Commission to registered those Commonwealth who wished to vote. The government of Barbados HAD to obey.

    Fourth: During the May 24th election, Mia Mottley was NOT the Prime Minister of Barbados. Freundel Stuart was.

    Support the DLP if you wish. But I beg ya please stop telling lies.

    Nobody admires a person who tells lies.

    Had the squatters been ousted, the plantation would have been returned to it rightful owner and the MARINA could not have been built far less on an aquifer. There was a concise plan of development for the area including hotels and schools.

    Your above comments are correct……and to imply Mottley was responsible for ballot boxes arriving late is also untrue.

    I thought about responding likewise…….but decided to remain “silent” out of fear of the George Street brigade…….

    ………and lest I’m accused of defending Mottley…….. or called a “BLP yardfowl sitting on the fence,” a “BLP stool pigeon” and most recently, “a limited range chicken.”

    Reminds me of member of the brigade that keeps spewing the UNTRUTH that government gave rich people tax waivers.

    However, I believe if you are going to criticize……. you should be FAIR and HONEST.

    including writing off all taxes owed for tax years 1968 to 2000 and waiving interests and penalties due and owing between tax years 2000 and 2017 as long as outstanding payments were made or a payment plan agreed with the BRA.
