The Barbados Bar Association has been recently getting itself involved in a number of matters that have caused us to question whether it has now become an official arm of the BLP!

It is significant that the past president Wilfred Abrahams whose election to office as a junior lawyer was orchestrated by former BLP Attorney General and Chief Justice David Simmons and and the present president, another junior lawyer Lissel Weekes are colleagues in the same law chambers and the Association under their leadership has shown a recent eagerness to mount challenges to legislation passed in our Parliament. The matter of the registration of non Barbadians by the Electoral Department has come up before the law courts for determination and the matter has ended up before the Court of Appeal where the decision has been reserved; in the language of the law the matter is SUB JUDICE.

But to the amazement of many Abrahams along with his political allies from the Bar convened a press conference at  no less a place than the headquarters of the Association in Perry Gap to discuss the matter contrary to all the conventions of the legal profession. It was significant that in a story appearing in one of the newspapers where he and his colleagues were photographed at their conference he was quick to point out that the event was not political; one wonders if a question leading to that response was posed by the press.

However, it must be a cause for concern that the Bar Association’s facilities could be used by a politician to mount an exercise that is against the very practice which the Bar should be promoting,  refraining from entering into public discussion in matters which are before the law courts. The general membership of the Bar should therefore be calling on its president and executive to give an account of this willful break from a tradition that has been respected by members of the legal profession all these years. In addition the executive must be called upon to respond to the concern of many among the profession, namely that Abrahams with the concurrence of his associate has been dragging the Association into the realm of party politics in this country.

It is also noticeable, that like the BLP, the Bar Association has not lifted its voice in concern of the problems that have been plaguing its members in their day to day experiencing in that work building because of its faulty structure and general lack of facilities that go to make the practice of law comfortable in any court.

The Bar Association has certainly lost is way and its membership should be duly concerned.

A notable feature of the Supreme Court building fiasco is the conspicuous absence of ANY comment from the opposition BLP or its leader on the matter.

This is significant because the BLP never lets slip an opportunity to expose the alleged ineptitude of the DLP Government in maintaining its buildings and other projects even though they were conceived and built before they took office.

One glaring example is the South Coast Sewage Treatment Plant which had the BLP wallowing in the sewage in order to criticise the Government for its lack of adequate maintenance.

Of course recent disclosures have led to the conclusion that sabotage has been one of the main reasons for the the problems of the   plant after all kinds of foreign objects that cannot be flushed by any known toilet or sink or drain were used to sabotage the system.

The items range from sheets and pillow cases, to beach towels and concrete both in the poured form and concrete the block form.

All of these items are still being being plucked from the system.

Barbadians should therefore be made aware why there has been such a marked silence about the matter at the Supreme Court of Barbados.

The facts are as follows.

It was planned and built under the tenure of Mia Mottley as the Attorney General ( even though she does not own a LEC ) and her cousin David Simmons Attorney General and later Chief Justice of Barbados.

And you would not believe it that the project manager was one Arnold McIntyre the Godfather of David Simmons’ son to whom the whopping salary of Bds $ 40,000.00 per month was paid to manage a project that has all the faults we have been hearing complaints being made about.

If this is not nepotism and downright CORRUPTION at the highest level we don’t know what is.

Simmons has been having a very loud voice in public affairs recently!! maybe he can speak out on the involvement of his cousin Mia Mottley and friend McIntyre in the disaster at White Park Road for which the burdened tax payers now have the responsibility to put right.

Let him speak up on this matter ! let the opposition also speak up.

The public is eagerly awaiting to hear from them.

  1. The Supreme Court to the recall of the blogmaster was constructed under a BOLT arrangement managed by Whitepark Development. If this is a BOLT arrangement then there is a responsibility to the company managing the BOLT to properly maintain the building.

    Why would a new building have so many problems?

    This building had to have a maintenance agreement that clearly was not executed nor maintained.

  3. Imagine that the local elite, not foreign investors, operated the Sandy Landy resort. The whole resort would be run down just after five years with mould, rats and other nasty things.

    It is a fact that maintenance is not known in Bim and that the lazy public servants behave like termites! So the whole tragedy with the Supreme Court is about the fact that the Barbadian public service did not reach the level of a civilization which knows how to operate and maintain modern public buildings. Do they know at all what cleaning is and that a A/C system must be cleaned as well?

    And who is the victim? The Barbadian taxpayer, as always.

    And who is responsible? Marston Gibson, the failed family lawyer from NYC who came to the SC without ANY managerial experience for a CJ, and his registrar, the daughter of a DLP stalwart.

    So we are back at the DLP again! As always.

  5. But the Chief Justice and his registrar MUST ENFORCE the agreement. It is their DUTY to supervise the company and the maintenance. They obviously failed to do so for many years.

    The Barbadian public service cannot operate in this way, that everybody high bureaucrats drives around in a silver Mercedes for 400,000 BBD, getting 200,000 BBD salary and blaming others.


  6. Not one to follow the crowd. However connecting dots is what intrigues me . These dots thus far links and connect my interest to similar issues which had tentacles steeped in sabatoage with intent to compromised the economy of barbados
    It is not happenstance that these problems keep reoccuring and the same covert voices hiding in the wings are heard the loudest.
    The sewer system had its share of covert action via sabotage. The combermere school also had it share of sabotage unexplained and voluntarily actions. Now all and sundry waits to hear the assessment of cause to similar failures which is calling for the supreme court to be closed

    Your above comment may be correct if one looks at the state of the Barbados economy from a DLP yard-fowl perspective.

    However, if one were to reasonably and rationally analyse the economy, surely the abysmal failure as minister of finance whose economic policies have failed to achieve the desired objectives………

  13. The sewage system was not sabotaged, it was misused by those who did not want to pay tipping fees. It is much easier and less expensive to dump everything down the sewer. This was compounded by the lack of maintenance, which seems to be endemic with all government responsibilities, however in all fairness some private businesses seem to be guilty of the same.It is time to stop blaming and get on with the job. These situations are noticed in the rest of the world, as per the travel warnings. If the government, regardless of which party does not act, there will be no tourists , therefore little money and Barbados will find itself in in a Catch 22 situation.

    It would be interesting to know how many non Barbadians were/would be registered by the Electoral Department?
    It would add clarity to the matter to know if they were all in one location or dispersed throughout the island?
    Are they expected to vote en masse for one party?
    Are they enough in any location to move the win from one column to the other?

    One my part, I feel this is a “tempest in a teapot”, the kind of mental masturbation that educated Bajans get off on.


  15. In a capitalist and democractic country individuals has a right of freedom to purchase items providing they have the financial wherewithal to do so legally.
    However purchase of land on property which has been deemed hazardous and which have contaminants detrimental to personnal health would be foolish planning and as well be likened to shooting one self in the mouth.
    The lands upon which used to be govt owned propertyon bay street and which has been specifically used for medical purposes for many years is contaminated and presents a health risk if any proprietor choose to build on it

  20. On the subject of the supreme court it is my understanding that the blp operatives as employees are the ones standing ground against working in the complex.
    It would be note worthy and of interest if any test were done that specifically pin points what causes or if any can be traced to any workers health because of enviromental concerns and if any worker who was sick was able to produce a doctor certificate stating there was a recurrence of an illness which lend itself to enviromental problems in the complex

    The wheels of justice grounded to an abrupt halt today and will remain the same tomorrow, as frustrated workers downed tools at the Barbados Supreme Court Complex, due to worrying environmental conditions.

    A second meeting between the workers’ bargaining agent, the National Union of Public Workers (NUPW), Attorney General and Home Affairs Minister Adriel Brathwaite, Chief Justice Sir Marston Gibson, Supreme Court Registrar Barbara Cooke-Alleyne and other officials, is now slated for Friday at

    10 o’clock to discuss the way forward.

    “The staff came out this morning because of concerns they have [with] the building. We have met with the Attorney General, the permanent secretary, the Chief Justice, the NUPW [and] shop stewards [to] discuss the matter. We are going to close the courts today and tomorrow, and Friday at one o’clock the staff will come back and we will let them know what is happening,” Cooke-Alleyne told reporters following a two-hour long meeting with the various parties this afternoon.

    Pressed to disclose the source of the problem, the registrar would only say, “we do have some environmental issues at the court”, but “scientists [have been] on board with us since last year November”.

    The workers, including clerks, employees at the Registration Department, marshals, lawyers and other staff, along with NUPW shop steward Bernadette Williams, began protesting from as early as 9 a.m. over the conditions which some said had been ongoing from June 2011 when the Whitepark Road, St Michael building was opened.

    Members of the public who were seeking to conduct business at the complex were also affected.

    However, while Cooke-Alleyne was mum on the exact environmental issue affecting the structure, NUPW General Secretary Roslyn Smith condemned it as a “sick building”.

    “The main area is the roof [and] that would have to be changed because mould is dropping down onto the workers. This is a matter where the roof is not a small issue so it will have to take some time, and it is going to be a high cost to have this building repaired.

    “There are other conditions that are affecting the workers at different levels because, as we know, from the time that this building was erected here they always had environmental issues because of where it is situated,” Smith told reporters.

    The NUPW official also expressed concern about the number of workers who have fallen ill as a result.

    “They cannot work from this building because the [number] of workers who are coming out ill with respiratory and other problems is too high. It is alleged that one of the judges is also ill as a result of working in this environment.

    “The Government is supposed to be providing a safe environment for workers. We had the issue with the Treasury [Building] and now we have to look for these persons

    . . . [and] as you know we are [also] working with the immigration to get them out of that building,” she said.

    Barbados TODAY can confirm that last week a High Court judge “came to work alright” but by the middle of the sitting she lost her voice and was coughing incessantly.

    Back in February business in courtrooms on the third floor also had to be abandoned due to what several sources said was “mould on the walls and doors”.

    It is a problem that veteran attorney, Hal Gollop, QC, said had been ongoing for quite some time.

    “That matter has been complained of from day one. From the first day this building opened, persons have complained about the environment in the building. I myself have had a few problems where my voice went in the early days but it seems to have gotten worse for some people,”

    Gollop, who was among those standing on the court steps, said.

    The situation also affected noted attorney and former president on the Barbados Bar Association Tariq Khan who expressed concern for the health and well-being of workers.

    “The staff who have complained about their conditions . . . [have] to be taken seriously. Something has to be done to address that and I hope that the authorities look at this carefully. I hope they are able to restore the service to the members of the public who are entitled to have their matters heard, but the staff need to be able to function in a clear, clean, secure and safe environment,” Khan, who raised the issue some years ago, said.

    “This is the courthouse for Barbados. This is where everything happens. There is a sense of urgency. This is a top priority, otherwise everything comes to a standstill,” he added.

    The lady also said that measures were being taken since nov to resolve the problem
    Taking her comments into consideration one would belive that by now after six months that the scientific procedures or testing (taken) would have provided some kind of evidence of purpose that would define if the building is contaminated and should be officially closed for cleanup

    And one wonders why things don’t get DONE in Barbados. We are happier to point fingers.
    IF this was a BOLT, then the Building Maintenance, not the daily operational maintenance, is the responsibility of the contracted party.
    The symptoms reported can have several causes, yet HVAC is the starting point. It can have several causes. It shouldn’t be too difficult to figure it out? It isn’t some massive multi-level structure.
    To attempt analysis along political party lines doesn’t address the problem issues, it only serves to detract and delay.

    But it amazes members of the BLP and DLP can be seen socializing in the Bush Bar on Thursday nights, for example, while they send people like you, Fructured BLP, Mariposa, Kevin et al to frequent social media forums to “wash each other in cuss.”

    However, there has been controversy brewing in Solutions Barbados and Grenville Phillips II confirmed that he receive the resignation letters following a request made about two weeks ago by several Solutions Barbados candidates because they had difficulty with a clause in their contracts.

    What makes your comments ironic………… is the fact that Grenville Phillips II did not reveal his candidates, including the Weatherheads, were not comfortable signing the integrity agreements in the contracts. Although there was a “compromise,” the credibility of Solutions Barbados must fall under similar scrutiny given to the BLP & DLP.

    A few days ago I asked if anyone heard the rumor that the Weatherheads and Grenville Phillips II parted ways. Obviously, I did not expect a response because Phillips II is a member of the BU elite and has “diplomatic immunity.”

    It seems as though the words “integrity,” “honesty” and “disclosure” are “taboo” for seasoned and aspiring politicians.

    In MY opinion, there aren’t any ideological or philosophical differences between the BLP, DLP, UPP, BIM, Solutions Barbados……

    And this says a lot about how SB is managed. Grenville Phillips II is essentially forcing his candidates to agree with his policies. But what can one expect from an individual that implied if civil servants do not accept ISO 9001 they face the possibility of termination.

    If this is true, it is not only anti-democratic, but it flies in the face of our parliamentary system in which members of parliament are there to represent constituents, not any political party. I warned earlier about the autocratic tendencies embedded in Solutions Barbados, and her is the evidence.
    It is dictatorial to ask members of parliament to vote according to a party contract, and not their consciences. Solutions Barbados is an example of the little Hitler in some Barbadians. ISO9001 is the Mein Kampf. But Grenville is not the only one.
    We only have to look at the other cultural expressions of intolerance, aggression, anger, free speech, public abuse and the other core beliefs that have made us who we are.

    Both of you make meaningful contributions to BU and I read every single word that you write.

    Here is my assessment of the situation.
    From the outset, SSS told readers that she intends to develop her brand on this blog as one based on honesty, forthrightness, and genuineness. She allowed us to know, through the use of repeated colourful expressions (Bajan cussing is an art form in itself. The standards which I am always held to do not allow me to express myself in that way, but on many occasions just listening to Bajan cuss words has been a source of entertainment and mirth for me), that she holds nothing but utter contempt for any person in an influential position who is scheming, pretentious, deceitful, untrustworthy, “thiefing”, and self-serving. She wants nothing but the best for Barbados. Along those lines, she has lambasted the current crop of “DLP” ministers, and have openly stated that, unlike her father, she has lost all respect for the DLP and will not be supporting the party in the 2018 Election. When it comes to denouncing the performance of the current government and the actions of ministers, no one has consistently used harsher language on this blog than SSS. At the same time, to her credit, she has consistently demonstrated a balanced approach by identifying some missteps which the “BLP” has made in the past, and which have left her doubtful about the ability of that political party and its members to set wrong things right.
    Therefore, looking through my eyes, I must view any attempt, by anyone, to label and accuse SSS of being a “DLP” yardfowl or lackey as being unjustified, unwarranted, and downright unfair.

    You Artax have contributed significantly to the intellectual development of BU readers by injecting analysis, logic, and a love for country into your arguments. Many laughable, weak, puerile, sophomoric excuses for “propaganda” (you can’t call them arguments) have been put forward on this blog in support of the “DLP” (sometimes I ask myself if it possible that “BLP” operatives could be at work in some of these offerings) and you have systematically exposed and destroyed them. Simply because you choose to shoot down every fallacious and specious incidence of “DLP” spin tossed on the blog, that is not enough justification for any sane person to accuse you of being a BLP yardfowl. Such an accusation would be unwarranted, unjustified, and unfair.

    However, there is an exercise you started recently which currently remains unfinished. I have no doubt that you will eventually get around to completing it, but I thought it would be a nice gesture on my part to offer some assistance. That exercise relates to the compilation of a list of yardfowls. So far you have identified the “DLP” yardfowls on the blog.
    I now take this opportunity to remind you, that when you are compiling the list of “BLP” yardfowls on this blog, you should start with names like Are-we-there-yet, Enuff, Gabriel, and Prodigal Son. Regardless of how “bad” Miller begs, do not add him.

    Finally, the world of politics is filled with much uncertainty and volatility. Just having the ability to make accurate forecasts, outcomes, and projections based on the actions of politicians over a relatively long period of time is an unmistakable sign of genius.
    For ages now, Frustrated Businessman has been repeatedly drumming into readers’ ears that “there will be no economic recovery under Fumble’s Fools.”
    Admittedly, I do not know who Fumble’s Fools are, but I and all Barbadians certainly know that there has been no economic recovery.
