Your message to the BLOGMASTER was sent

corruptionAustria’s highest court annulled their recent presidential election. In delivering the decision the head of the court said:

“The decision I am announcing today has no winner and no loser, it has only one aim: to strengthen trust in the rule of law and democracy”.

That quotation set me thinking about this country’s elections that are constitutionally due in less than two years.

Over time there have been many calls by well-intentioned persons to change the electoral laws to ensure that elections are free and fair. My view is that their focus is too narrow. There are more than adequate laws to ensure that the system of electing the government is fair and transparent.

The obstacle to achieving fairness and transparency, in this regard, lies in what I describe as a system that is designed to be corrupt. The fact that no one has been prosecuted for corruption so far is testimony to the ingrained honesty of Barbadians or that the system has worked well to cover corruption.

It might have been unintentional, but the first steps in the process to where we find ourselves came with the passage of the 1974 constitutional amendments. Those amendments gave the Prime Minister the right to recommend the appointment of judges, after consultation with the Leader of the Opposition; and the right to be consulted on the appointments of permanent secretaries and their deputies, and heads of department and their deputies. But, from inception, the right to be consulted has been misinterpreted to mean that the Prime Minister recommends the appointments. In essence, the Public Service Commission has abdicated its role. Persons who have experienced the Public Service prior to 1974 lament the dramatic decline in today’s standards and output and trace the genesis to those amendments.

It is now widely accepted in the Public Service that an officer does not reach those grades unless he/she has some connection to the party in power or some other relationship to a political operative. A person who obtained an appointment this manner might find his/her impartiality compromised, and be less inclined to be apolitical as the Public Service Act requires.

While in power both political parties have complained that persons who were appointed by the “other side” have given less than their best when called upon to do so. This might be the reason why persons who were acting in senior posts, when the government changed in 2008, continue to act to this day.

To my mind, the Government might be using acting appointments to ensure the loyalty and compliance of those officers. A situation like this would lead to an officer giving his Minister the advice he wants rather than the best possible advice. Failing to give the Minister the advice he requires would result in the acting officer being reverted and replaced with someone more amenable to the Minister’s will.

The corruption in the system ensures that the politician always gets his way on important matters, whether awarding contracts or the appointing staff.

The political contamination in the electoral system is as bad or worse than the infelicities in the general Public Service. Under our laws, a politician can imprisoned, lose his seat, or disqualified from seeking future political office, if he/she is found to have overspent, bought vote, or filed a false return. The problem with the system is not that there is an absence of laws to regulate the process: it is that there is little or no enforcement.

Again, this lack of enforcement comes from the fact that politicians are required to select the persons who are required to regulate the same politicians who selected them in the first place. If that is not a recipe for corruption nothing is.

To strengthen trust in the rule of law and democracy, those well-intentioned persons would be better employed, campaigning against the entrenched corruption that is the Barbadian way.

    I always tell people, with every hundred bad things I can tell you about the US and I am not shy…I can tell you a hundred phenomenal things about their procedures and intent, the same applies to Europe….the problems lie in the Caribbean leaders who tend to only copy the negatives from those systems…to practice on their own people….for monetary gain.

    Sorry to burst your bubble, but TI is not going to make an iota of difference to anything in Barbados. Nor, by the way, is Integrity legislation.

    The ONLY thing that can possibly have made any difference was for a Bajan MAN (or preferably a group of them); with a SERIOUS pair of balls; a proven, long term commitment to truth, justice and RULES; and an unassailable power base that allowed that person (or persons) unlimited access to public media and to the justice system.

    Caswell is unique.
    Wunna THINK wunna know him…. but most don’t…
    He is a fanatical, driven, stickler for rules …with a strong disdain for rule-breakers. He is the very antithesis of the Bajan.
    Caswell will be your best friend – until he finds out that you broke rule 18654-B /A – related to the allocation of office stationary …or some such shiite…

    It would take someone like that, sitting is a position similar to a chairman of the Supervisory Committee of a Cooperative – for at least five years….to bring order to Barbados.
    In short, a BIG-ASS Whacker.

    As Piece correctly states, all the other options essentially depend on some flawed individual making judgements about other flawed individuals ….while hoping that THEIR flaws remain covered (and hence susceptible to blackmail etc)
    Even in something like TI, Caswell will have NO POWER to change anything …just talk shiite (as he does now anyway)
    EVERYTHING that Caswell said in this article …he has said before …at LEAST twice… and WHAT?
    No prosecutions
    No changes
    No outrage
    …NOTHING!
    There are simply TOO MANY brass bowls out there…

    Unless a “Caswell” can …
    …Have unlimited access to ANY and ALL matters of national business
    …ORDER the suspension of ANY national official -pending an open enquiry
    …Audit ANY area of public business at any time
    …Vet the fairness of recruitments and appointments

    …we will just be spinning top in mud.

    It was EITHER BUP ….or BUM!!!

  5. I have to agree with Bushie that Caswell wrote the obvious.

    In Barbados if you want results as soon as possible, all you have to do is pay a small fee.

    A friend of mine asked me for my opinion on a matter. He said a policeman reported him one night because his vehicleโ€™s rear lights were not working. He discussed the matter with a Sergeant friend who said he would โ€œinvestigateโ€ the matter. The Sergeant subsequently told him that he spoke with the Constable, but the matter has already been processed, however, he (the constable) was willing to accept $700 to โ€œforgetโ€ the report. My friend gave the Sergeant $700.

    I told him he should have gone to court, plead guilty and may have incurred a lesser โ€œfine.โ€ I further explained to him that he was duped by the Sergeant. Since a Constable is junior in rank, he would not have made such a negotiation. The Sergeant obviously spoke with his junior rank to have the matter solved and then demanded money from my friend.

    These are issues many of us do not want to discuss, but these types of โ€œnegotiationsโ€ with policemen occur on a daily basis.

  8. If your personal mate is an Immigration Officer you can receive your passport the same day you applied for it. Likewise, if your personal mates work in the BRA, NIS, Customs or Licensing Authority, you can receive your income tax refund, NI benefits, pay no duties and get your driverโ€™s license โ€œthrough the shoot,โ€ respectively.

    This is not unique to the public sector, as accepting money for favours is also done in the private sector.

    In normal circumstances, letting the ‘sunshine in’ does wonders. But clearly these are not normal circumstances.
    BU has been blazing like the midday sun now for 10 years. Naked Departure has also been like a raging cane fire……BUT…
    The only thing that seems to be changing is that more Bajans appear to be adopting the wicked schemes exposed by these ‘lights’ for their own particular circumstances.
    ..No prosecutions
    ..No dismissals
    ..No public outrage

    BU has long passed TI in terms of public transparency.

    Most modern cars have three these days…so what was the hazard if he had at least two working at that moment. But absent that your comments made sense. He was conned.

    And that is the moral in my view, we get into these little problems and then create major issues for ourselves with poor judgement.

    Another friend might have been ballsy enough to have had his phone recorder on. Now that would have been an interesting dynamic for that sergeant.

    But $700 for just a busted tail light….jeeze. Things have really changed, Drastically.

    Your friend paid 10% approximately of what the brother in Minneapolis racked up in fines for over 50+ infractions.

    So is it about $2000 if you get caught running a red light at 2 AM on the way home?

    Oh Lawd, that was either one great con or the Bajan inflation is unreal!!

    But we have to be prepared to try, until the end.

    Your suggestions, around Caswell Franklyn, might seem extreme to some.

    But extreme times require extreme measures.

    Even the Romans used to appoint a Dictator, and that position needs not have negative connotations, when their system became too corrupted.

    Why should we not do the same now.

    You see, the elites use law and customs to rig all the systems in their favour, in Barbados today. The system is incapable of fixing itself, policing itself. Too much inbreeding!

    Rome faced the same existential problems, created from inside!

    Their answer was a ‘Dictator’ and so should ours be. Providing the dictator is the man you described.

    My friend, who has now gone to the โ€œgreat beyond,โ€ had an old Suzuki van which he used to sell fish.

    I also know of a case where the files related to a womanโ€™s son who was on a gun charge, โ€œdisappearingโ€ after a payment of $10,000.

    Con men access and work on their โ€œmarkโ€™sโ€ weaknesses and fears, no matter how educated (or not) they may be. Some people have developed a fear of the police and the justice system, as well as the fear of going into court and facing the possibility of jail time. And in many instances, this is based on stories such as police brutality and being advised not to โ€œdrop the soapโ€ as an inmate in prison.

    The police use these fears to their advantage.

    Well, it was Bushie who has long suggested Mr. Caswell Franklyn for a leadership role, to genuinely help the country.

    We do not know him as well as Bushie does. But we trust Bushie’s political judgement better than anybody else’s here, on BU, even in Barbados.

    We have merely given a historical perspective to what others have done, in similar circumstances, as just one option. And we remain open to other options.

    Your option is to have more of the same. Or having you, as a mere technician, to come in and tinker a little bit here and tinker a little bit there. Those days are dead! That you can’t see this tells about the, still, 11-plus boy you are, even today.

    What is wrong with fleshing out a way out of the dead end your political masters have led us to, absents a useless political duopoly. And all ideas should contend!

    The Romans were the people who made democracy their central organizing principle. And all modern ‘democratic’ systems are based on what the Romans and before them the Greeks did. Have you taken on the Romans for formalizing dictatorship as well? Or were you even aware of the dictatorship on which modern democracy stands?

    A suggestions was made we merely added historical content to that idea.

    And yes, if Caswell Franklyn is the man Bushie seems to think he is, we have no difficulty in recommending his ‘Dictatorship’ as one way out of the problems you and your ilk have created.

    That idea seems infinitely better than the warn over 1900s economic trite you came back ’bout hey talking ’bout.

    Not that a formal dictatorship would be much different than the elected dictatorship in which you are striving to serve. Every prime minister of Barbados has been an elected dictator. So dictatorship is therefore nothing new to Barbados!

    You obviously have no deeper understanding about what you are trying to be a part of.

    Walter Blackman, we are surprised, again, that a man who seeks to impose himself on the people of Barbados could be so unaware of the political science literature as you are.

    Our estimation of you has been right. We suggest that there is not a single issue on which you could win an argument with us on. None!

    I would too, seeing that I would get no chickens to raise.
    But your hypothetical farm does not reflect the reality you see right before your eyes.

    Now consider this.

  21. We all know that Caswell stated the obvious. But there are some who were not aware of exactly how the system works. We all know that Caswell can be trusted and is a stickler for rules. That much is obvious. We all know that Caswell is not a coward. He uses his own name whilst calling names. The problem probably is that Caswell knows that Bajans are cowards so he will stand alone (almost) or that he knows that most Bajans only see corruption as wrong when they are not the beneficiaries.

    I can attest to all that Artax says about the daily corruption. It is endemic and can be deadly. You have public service vehicles passing inspection without being inspected. NIS claims may be ignored without a fee depending on the officer. Imagined traffic infractions are ‘forgotten’ for a fee. Drivers licenses are expected to be purchased. The gambling boys on the block have their money seized by policemen in need of lunch money. Bribery and extortion at every turn.

    I have often heard it said that a man would be a fool to be a minister, and come out broke.

    So….. we are between a rock and a hard place. There are very few who have hands and minds clean enough to attempt a clean up. Caswell cannot do it alone. He is doing what he can. He cannot elevate himself.

    What now has to be done is a rewiring of our brains or a renewing of our minds. so that we come to know what is good for us.

    Corruption is now part of the Bajan DNA, and we have no qualms about other people knowing. While passing through Miami, I went into a store to make some purchases, I queried the price and asked for a discount. The manager then told me that it was his best price, I gave him a credit card and my Barbados passport. He promptly said,

    “Oh you are from Barbados, what price you want me to put on the invoice for Customs?”

    I took my credit card and passport and left his store. I want through that similar experience three other times on 20th Street in one day. Our corruption is now internationally known.

    How many times have you gone through Bridgetown and have been approached by persons sitting outside stores asking if you want to make a duty free purchase? People see nothing wrong with it but that is also corruption. By the way, I have never succumbed to the temptation.

    The problem for the corrupt ministers and minorities…they will not be able to control the information…the head office for transparency international is in Berlin, somewhere far and with people they cannot afford to bribe or who do not need bribes and will report the information internationally.

I heard Caswell on brasstacks tearing into a civil servant who dare ask him for identification when he was applying for a barbados passport for an overseas relative He made no bones about the issue as if he was deserving of preferential treatment.
    Perferential treatment also breeds corruption an epedemic in barbados.So now for Caswell to act like he is so squeaky clean and always act within guidlines of the law is preposterous

    That article about that sensational? item for Hilary bashers highlights what small, seemingly ineffectual newspapers/websites, like the Enquirer and other newspapers, can do.

    And Transparency International?

    While we in Barbados may not tend to think too much of the nature and power of an agency like Transparency International, such entities, in the real world, armed with the right ammunition, wield significant influence.

    There is a research paper called “INFLUENCE OF INTEREST GROUPS ON POLICY-MAKING” which sheds light on the impact that a TI manned by the right people, might have on the perception of the practice of good governance in Barbados.

    It certainly is not a BUP but in the absence of people coming to the fore and saying I’ll be your man/woman, where do we go?

    Posters, animations, cartoons, blogs, have a finite life and or impact quotient.

    After a while you hear the stalwarts saying, “We were saying that 10 years ago, we were saying that 15 years ago…” and pretty soon you get tired writing and saying the same things over and over again.

    I do not see TI as the end game but it carries “us” out of the “twilight zone” of this cyberspace warrior cadre into the real world, like the gestation of an embryo, into the light.

    If you look at the link Old Baje sent it shows you the cycle of enlistment.

    It is not automatic, you have to serve for two years, honourably, and then you get the entitlement.

    I like that.

    How big your balls are for two years, are you committed to this? and then you go to the next step, or not? You have to show that you are for real.

    Yes, Barbadians are cowards and would have great difficulty discussing the fact that there are corrupt Police, Immigration and Customs Officers.

    And I hope you NOTICED that, with the EXCEPTION of you and Dribbler, no OTHER CONTRIBUTOR dared to comment on the issue.

    Some policemen believe they can walk into any business establishment, whether it is a restaurant, village shop or clothing store, and expect to be given food, goods, services, etc., FREE of charge.

    Also, recall in May 2013, an Immigration Officer was charged with misconduct in public office, as it relates to case of human trafficking of five Guyanese women in April 2013.

    Clearly you two are operating under the (mistaken) impression that ‘life’ is an exercise in pursuing peace and happiness and hence that ‘success’ is about enjoying peace, prosperity and hopefully ..some good sex ..”happily ever after”.
    Perhaps, for most of us, that is EXACTLY the case.

    This is just like some notable West Indies (whatever the hell THAT is) cricketers for whom cricket was all about making some big money, getting some girls …and free travel.
    Meanwhile, for the ICC, WICB and cricket purists like GP, it was a game of ‘glorious uncertainties’ which represents the complexities of life and presents opportunities to build national pride, international respect and to inspire youth.

    As a rule, I don’t normally respond to anything “ac” writes, but I must point out that it is an absolute liar. I recall saying that the rules require the issuing officer to satisfy himself of the identity of the applicant before he issues a passport. My concern was that I went to apply for a passport and the issuing officer asked me for identification when he should have been satisfied that I am Caswell Franklyn since he was my shift supervisor when I was an immigration officer.

    That call had nothing to do with preferential treatment, I was merely commenting on a situation where people adopt procedures and elevate them into rules of law when no such law exists.

    it clear to the listening audience that the rules were dumb
    i also gather from your response that as long as the officer knew you it should have been enough to satisfy the rules whereas you were not at all concerned about the livelihood of the officer and if by giving preferential treatment or favoritism he could have lost his job
    Never once did such a concern cross your mind for if it did you would not have got on brasstacks and issued a complaint against the officer
    Now calling me a liar when you have not denied the story and furthermore by your response has all but verified what i said is true

I purchase two of the same items, but knowing how corrupt and Covetous the Customs Officers can be/are, when seeing 2 of the same items in a package, I ask my supplier to split and send shipment 2 week apart, the first package came and on C. Invoice I paid BD$168.10, when the second arrived on June 14, 2016 with C.invoice same total as the first I was told that Customs officer need to see a copy of Bank or Western Union receipt, I took the receipt and explain, this total is what I paid for two, but Customs officer discard the C. invoice and charge me on the face value of Western Union receipt, (for the two items) this time BD$276.02.The strange thing is, this package paid for and collected on June 14 , 2016,The Courier Result Summary of the Way bill #…. On the tracking site Is showing on the 28 June 2016, that the package is at Cincinnati Hub USA and also at Hong Kong, Destination Barbados,the many time I collected, the Result Summary always ended with collected by Tom dick, that Customs Officer was determining to make me pay by losing an item or cash

    I’m sorry to “go off topic,” but the following matter has bothered me immensely.

    A friend of mine was forced to retire from work medically unfit after being employed 40 years as a maid. Her former employer told her that she (employer) does not have to pay severance payment and referred her to the NIS Department.

    The NIS told her that she is not entitled to severance, but a DISABILITY BENEFIT until she reaches retirement age.

    The sad thing about this situation is that after being home since June 2015, she has only received 2 sickness benefit cheques, the last one during the first week in February 2016. She has bills to pay and maintain herself.
    Additionally, it seems as though she has wasted 40 years of her life.

    Calling the NI Department to query payments is often futile exercise because, more often than not, you have to listen to โ€œcaller directionsโ€ from a recording and when you get the rare opportunity to talk to a human being, he/she either tells you the claim is being processed or transfers your call to a phone that no one seems to ever WANT to ANSWER.

    Caswell, as a trade unionist and a man versed in labour law and employee rights, do you think it is fair for someone to slave for 40 years, only to find out they have to forfeit 40 years of severance payment, as a result of sickness, which is no fault of their own?

    IT SEEMS AS THOUGH SHE HAS WASTED 40 YEARS OF HER LIFE.

    Should the government, through the NI Office and the Labour Department, investigate these matters in the hopes of drafting and enacting the necessary/appropriate laws to ensure these types of anomalies do not occur in the future?

    Do trade unions represent maids, gardeners, general workers, chauffeurs and nannies who work in the homes of rich people, only to be exploited/taken advantage of, because they may have only obtained a certain level of education?

    I eagerly await your response to or advice on this issue.

    Mine is a belief that if you do not want to be honest through a natural proclivity then you will be kept honest by other means.

    Some years ago when Mia was the Minister of Education it was reported by a former high ranking official that she purportedly would curse, belittle and carry on her team in a most uncustomary way.

    While such cannot be confirmed since that is reported speech I am sure that it takes no leap of understanding to realise what these micropens will do with the customary decorum of a meeting conducted by Lil Caesar Lashes or Pornville or the Minister of Edykashun.

    We will know that the new engagement styling has kicked in when people who are being summoned to meetings with these parties indicate that they are being asked to leave their pens outside the meetings and one is given a tag to collect your items AFTER the meeting or that rooms and bodies are being scanned as a practice.

    Of course there is a model for ladies which is built into your bra so that while they can take your pen, they would be very stupid to ask to take your bra.

    I dont see any equivalent model for the men but there is one i guess for the in-betweeners.

    The same Customs Officer station at the courier did the first and second package, the first package was open for inspection, the second was ransacked for contents to be stolen.I paid, collected the customs overly tape package, pick out my item and leave the package on the counter, the Courier website has the package waybill #… on 28 June 2016 as in USA and HK, not collected
