Your message to the BLOGMASTER was sent

BU highlighted the plight of an 80 year old Canadian man on October 18, 2008 who alleged that he had been swindled by an offshore company based in Barbados. The Barbados based offshore company Bridge Management (Barbados) Incorporated reportedly received several million dollars from many Canadians who now seem to be fighting a losing battle to redeem investments. Some frustrated investors in Bridge Management Barbados Inc have since used the BU blog to exchange information and extend moral support during this time of great anguish.

In keeping with our promise to be transparent in how we operate, BU has taken the decision to apprise the BU family of an unfolding situation. Yesterday (4 January 2010) we received an email threatening legal action if we did not withdraw certain information from the blog referred to above. We have sought a legal position and BU’s position is our blog did not defame the person purporting to be Frank Mastrocola.  However, out of an abundance of caution we have taken certain actions which are outlined in the document attached.

We ask the BU family to continue to be responsible when posting comments and continue to use BU as a vehicle for freedom of expression.

    HOWEVER, they can put a lot of pressure on BU through WordPress IF they can persuade WordPress that they have been maliciously defamed. Look at the lesson of BFP.

    On a CURSORY (stressed) search of the Internet, I have come up with two Frank Mastrocolos. One lives in the States and the other in Laval, Quebec ( not far from Montreal). The gentleman in the States is an athlete and the one in Laval is an “insurance agent and financial adviser”, which I hasten to say does not mean anything derogatory or that there is not another (or others) in Quebec with the same name AND PROFESSION. There may be more for all I know, I said the search was cursory and I impute no wrongdoing against anyone.

    Adding to the comments of ru4real, IF this gentleman can find out who BU is, he can sue in Canada. BUT, he then has to enforce the judgment in Barbados – and Barbados will refuse, if the law on which it is based is contrary to Barbados law and legal intent – just like in Canada, so, Canadians, don’t complain – rather, be flattered, as imitation is the sincerest form of flattery.

    Also, as BU is, as far as I know, a Barbados-resident entity, this Canadian will have to pay security for his costs into court in Barbados before anything is heard in Barbados – and the precedent for this is…..build up of music pending announcement…….CANADA.

    He will incur massive publicity and be subjected to several full investigations, NEITHER OF WHICH SHOULD HE FEAR – if innocent and transparent.

    Now, he can bring an action against WordPress to force it to reveal the names of the proprietors of BU, but this is not like the clear, unjustifiable and MALICIOUS scandal perpetrated against ROK and BANGO by BFP.

    The BU blog was written to help an 80 year old with severely depleted resources. It was CLEARLY humanitarian in intent, NOT malicous.

    It is also in the public interest.

    The 80 year old is a Canadian, not Bajan. However, out of simple good will and empathy, BU did what it could to help. This is laudable and responsible conduct.

    In doing so, BU exercised its right to comment fairly on PUBLISHED documents and news reports – for the members of the Barbados (so-called) Fourth Estates, TRUST ME, this IS called “FAIR COMMENT”. It is NOT called “sub judice”. Bunch of blasted idiotic poseurs calling themselves journalists – they wouldn’t know a journalist if it bit them on the butt – they can’t even write, most of them. End of rant – for now!!!

    Good faith (bona fides) + fair comment = NO DEFAMATION!!!! Got it, Nation and Advocate and all the rest of that motley crew of idiots???!!! Sorry, they get muh vexed!!!! Stop patronizing them and buying their blasted pap!!!

    THE OTHER SIDE OF THE COIN. If it just so happens that Mr Frank Mastrocolo (writer of the e-mail to BU) is NOT the one referred to in the documents and news reports relied on by BU, BU has an easy fix and one with which I am confident Google and WordPress and La Presse and the Globe & Mail would be happy to assist in making sure that no innocent party whose only problem is a similar name is tarred by the controversy of which they have no part.

    But I did note in going back to the old posting about the 80 year old, that our old friend ‘Anonymous’ has been trying to drum up a revival of interest in this matter since November last year (2009 for those, like me, having difficulty catching up). Is this, perchance, the same Anonymous who beats the BFP/Allard/Knox/Bourne gong over on BU? Respondez-moi, s’il te plait. Ou meme s’il ne te plait pas. Fascinant!!!

  10. @Pat. But not Frank Mastrocolo? Might be Frederic or some other name starting with F.

    The matter the way I see it is simple. The writer of the e-mail to BU has objected to being associated with a person he calls Sam Mecca. However, the connection BU has quoted from La Presse is between SEBASTIAN Mecca and Frank Mastrocolo. Therefore BU is not in a position to withdraw something that it has never said. I see no “Sam Mecca” mentioned by BU.

    One could speculate that Sebastian Mecca may well be known among his friends, colleagues and acquainances as “Sam” Mecca and it would be interesting to know if this is the case and, if the case, how did the writer of the e-mail know this?

    Penultimately, what is all the song and dance about? All this person sending the e-mail had to do was to write saying that he has the same name as the person in the La Presse article and has been adversely affected by the reputation and actions involving the other and could BU please point that out and state the difference. End of problem. I am sure David would jump to clarify the matter – any reasonable human being would.

    Finally, I find it interesting that this story is long dead, is well over a year old – and it is only NOW that this person complains. So what are we missing here? I am going to go onto Google and enter the name of this Frank Mastrocolo and see what comes up. Be right back.

  14. @Pat. Simpler still. Read the article and then write a note to David saying please can he clarify.

    What confuses me is why do it a year and more after the BU posting appeared? If you enter the man’s name on a Google search, it doesn’t even bring up the BU article. In fact, you need to go to about page 3 of the search and then it brings up the La Presse report, not the BU post.

    In any case, the ONLY mention in the previous BU posting of this man arises from the La Presse article. So why is he not threatening La Presse? Why pick on BU?

    Don’t understand. Well, I think I understand, but will hold fire until this unfolds more.

    At no time did Mr Mastrocolo attempt to separate himself from Mr Mecca. I also fail to see any suggestions of fraud by BU. Also, the 80 year old man was un-named and remains un-named.

If the Police were going to investigate anything, it would be BFP that CONSTANTLY runs them and Commissioner Dottin down, thus trying to give the idea that Barbados has no rule of law and no enforcement of same.

    I suggest that you take your threats and try them out on people far less educated than the people of Barbados.

    Also, what is wrong with having pride in your ethnicity and its advances and pushing for greater advances? You think that at ethnicity that has been suppressed for generations and is in the process of climbing out from under and taking its rightful place in national and international matters has no right to celebrate – or are you the Guyanese person or one of his gang in disguise?

  22. Over the last 24 hours BU has had to deal with another legal matter. It appears we have some forces trying very hard to shut BU down. We will not say too much at this time only that this last threat emanates from the Nelson Barbados/Kingsland Estate Affair.

    BU will continue to do the best we can; if our best is not enough, we remain happy in the knowledge we would have done our best to facilitate freedom of expression.

    If you post a factual article and we comment negatively or slander persons involved in the article, can you be sued for comments you didn’t write?

    If that is so, we bloggers will have to be careful what we write.

  26. I have just written a comment on Jeff Cumberbatch’s remarks – with which, while I agree, they do not go far enough by a long shot.

    As for shutting BU down, the Nelson/Kingsland matter instigated by an entity of which Donald Best is sole shareholder (he says) and sole officer (we say) has cost Barbados and its people MILLIONS of dollars, it is a matter of NATIONAL IMPORTANCE TO BARBADOS.

    Nelson Barbados has sued the Country of Barbados, its past and present PMs and its Chief Justice, along with many other Bajans in court in Canada.

    Canada’s courts have denied jurisdiction and competence to try the case, stating that it is a matter for the Barbados courts. It has also made some extremely unflattering comments about the conduct of the Plaintiff (Mr Best’s company) and its counsel.

    In the United States, the case would never have been allowed to have been filed in the first place. But poor old Canada is a little backward in these things – hopefully this case will highlight the need for change.

    Nelson Barbados has not demonstrated even the standing to bring their action – they have no interest of any kind in the matter and there is an action for fraud before the Barbados courts that will, if successful (and no legal person can see how not) conclusively prove this point.

    This whole meritless action has been brought by Nelson Barbados Group Limited, a shell company whose sole officer is one Donald Best.

    Best has failed to turn up for court-ordered cross examinations on two occasions now and a motion for contempt is pending against him, returnable next Friday 15th instant. Which, of course, is why the complaint is timed for right now – to deflect, they hope, the attention of the Court.

    Heretofore, the matter has been civil. If Best does not purge his contempt, the court may decide to issue criminal charges against him.

    The whole exercise has cost Barbados and the Bajan people millions of dollars. AS SUCH, THE REPORTS OF BU ARE A MATTER OF NATIONAL, PUBLIC INTEREST!!!!

    The Inter-American Declaration of Principles on Freedom of Expression http://www.cidh.oas.org/declaration.htm states at Principal 8, the following:

    “8. Every social communicator has the right to keep his/her source of information, notes, personal and professional archives confidential. ”

    This accord is one which binds the USA and Canada as well as Barbados. It also binds their courts.

    The international position is to be found at http://en.wikipedia.org/wiki/Protection_of_sources – and it is much the same.

    So, we have a party who has brought a meritless case with no demontsration of standing to bring it at all, against the Nation of Barbados – and it has effectively been LOST!!!!

    This party cannot be found so that his personal assets can be evaluated in order to satisfy costs orders by the Honourable the Ontario Superior Court of Justice. Legal attempts to find him have resulted in nothing but a series of drop boxes. He is in contempt of court.

    Now, having hounded Barbados and its people, he seeks to hide behind the spurious claim that he is afraid and his privacy has been violated.

    So, he complains, we learn from David, in the hopes that someone or some entity will deflect the interest of the Court and thereby expose itself in law to the high probability of an action brought against that entity for the breach of the the right to freedom of expression as emodied (in the Americas) in the Inter-American Declaration of Principles on Freedom of Expression – which they can be sure as hell will be supported by the US and Canadian Governments, in as much as it impinges directly on the National Interest of an OAS Member State.

    And do they seriously think that the Government of Barbados is going to fail to take agressive action if its treaties and accords are ignored by any entity? Dream on!!!!!

    So, all you international lawyers out there, how much do you assess the damages will be to anyone breaching the Inter-American Declaration of Principles on Freedom of Expression. I merely ask, because I think it will be likely sonmewhere close to US$1 billion, but I am not experienced in that field.

    And this is typical of the bully-boy tactics that have earmarked this entire case….intimidation, deceit, false and incomplete reporting….you name it. All so that Barbados and its National Interest and government and institutions should bow low to some damned foreigner with more money that sense.

    Well, we will see about THAT!!!! And I am NOT amused.

    If all that you say above is a sound assessment, why is it that Barbados did not object to the Canadian jurisdiction in the Canadian Court and filed a no contest or some counter motion? Is that why Peter Simmons got so angry?


  28. Here we go again. I find it very suspicious that all of a sudden, and at the beginning of the year, and one right after the other. Why are these people deciding now to come out of the woodwork to threaten BU? What could have prompted this?

    The first threat seem to have come from a post back in 2008, and so is this latest one. Why silence for so long if the postings which seem to now be ruffling feathers had been initially written a while back.

    This is speculation on my part; (not gud Eyespy, not good) there is no doubt in my mind that BU is being watched through a microscope from all angles. And, even one word out of place associated with anything, anyone will generate a threat to BU.


  29. @ROK. With respect to Peter, I will listen to his opinions on anthropology, but I really cannot be expected to take them seriously when it comes to law. Now David is another matter.

    No contest would not have been a good idea. It would have sent the wrong signal and given BFP and Keltruth and their Canadian paymaster a clear field to decimate Barbados’ international reputation.

    Instead, the vast majority of the over 60 defendants filed a motion objecting to Ontario’s jurisdiction. It took over 2 years (highly unusual by Canadian standards) for this motion to be heard, due to the alleged non-cooperation and delays of the Plaintiff and its counsel.

    Having won it, however, these same defendants have decided to do something almost unheard of in Canadian law – to go after the Plaintiff, its officers and shareholders and to try to get the Court to pierce the corporate veil. They have also asked the court to award costs against Plaintiff’s counsel personally and his firm.

    The Court ordered that the Plaintiff’s sole named officer and shareholder, Mr Donald Best, submit himself for cross-examination, along with the records of the Plaintiff company. On the first occasion set by the Court, Mr Best failed to appear and was therefore in contempt of court.

    A second occasion was set up to permit Mr Best to purge his contempt – and once again, he failed to appear, giving as his excuse what I will mention later.

    He is therefore ordered by the judge to appear before him (and we will not mention the location) next Friday January 15th to answer the charge of contempt. He is further ordered to bring all corporate records and other things with him. Now we will wait to see if he turns up.

    In the meantime, because his counsel and the law firm are also now sued, that counsel, under conflict of interest rules – which are the same in Canada as they are under the Model Rules of the American Bar Association, has had to come off the record as counsel for the Plaintiff and Mr. Best.

    I will jog memories by saying that the Plaintiff and Mr Best had previously given the address of their counsel as being their address. However, when counsel came off the record, Mr Best had to find another address and the one he gave was a UPS drop box in Kingston, Ontario – no telephone number, no fax, no e-mail.

    This was highly unsatisfactory and an investigation was called for which turned up a history of drop boxes. It was this fully documented list that BU published in the National interest in the hopes that someone would be able to point everyone to the whereabouts of Mr Best so that he could be personally served as is required in Canadian law, with the documents and motion materials on the costs issue of his failed action before the Ontario courts.

    ALL of this is provable and in the public domain.

    Mr Best has now disingenuously claimed that he is in fear for his life from the defendants. Which is arrant rubbish. What Mr Best is in fear for is his assets that are now being gone after. he is in fear for his corporate documents that he is ordered by the Court to produce – and one has to wonder why if Mr Best is what he has claimed to be in writing to the Court, he should fear the disclosure of his corporate documents.

    So, what do you do if you are Donald Best? BU has a right to publish under the terms and conditions of the Inter-American Declaration of Principles on Freedom of Expression. So, Mr Best has complained that BU has breached his privacy – this man in who stands in contempt of court now claims that his privacy has been breached, simply in order to avoid facing the music that he and his paymaster have composed all on their own. Music that has cost Barbados MILLIONS of dollars.

    So ROK, I think that answers your questions and EVERY WORD OF IT is document-backed!!!!

    Amused? Hell no. I am as angry as HELL!!!!

    Now, it may be coincidence, but it seems to me that the other side of the Kingsland Estates/Nelson Barbados was first brought to us by an old lady (that is what she said she was and I am not prepared to contradict that) called BWWR.

    Is it not facsinating, but may well be and probably is purely coincidental (let us not descend to paranoia) that JUST at this time in another matter also of National interest to Barbados – that of an off shore company – fair comment documents provided to BU by BWWR are also objected to and that objection is what we are all commenting on. It is also of interest that BWWR is heavily mentioned in the Reasons of the Ontario Court in denying jursidiciton and the assertions of counsel for Nelson dismissed by the judge as irrelevant to the matter before him.

    As Pat has said, “Oh what a tangled web…..” and we, the taxpayers of Barbados are out of pocket to the tune of several million dollars defending this meritless action brought in the wrong jursidiction by Mr Donald Best’s company. Of which he claims to be the SOLE directing mind.

    By the way, Marjorie Knox and two of her three children who are the central players on the Best side of the court, continues to reside in Barbados, free from all threats of violence. So does Peter Allard, whose name crops up in the case with alarming regularity – and he is a Canadian National. So, if those lot can continue their threat-free existence in Barbados, desipte all the BU has had to say, why does this egomaniacal jerk Donald Best feel that he is so damned special? Without Madge Knox’s shares in Kingsland Estates (or the apperance of having an interest in those shares) Best is NADA!!!!

    Methinks that Donald Best is a legend in his own mind. Now I am amused again.
