Your message to the BLOGMASTER was sent

bango-logo-2007-bdocsI noticed that the BANGO thread was truncated before I got a chance to say thanks to all those who contributed: General Lee, JC, Adrian Hinds and Anonymous who expressed gratitude and thanks to BANGO for participating in the hearing on behalf of consumers. Thanks to BWWR too for being the first to lend support to BANGO although BWWR dropped out nearing the end.

I think you know by now that if we have it to do again we will do it. We are gaining valuable experience here as Intervenors as our library is increasing in size and information.

The most important thing about our exercise on BU is that it provided an opportunity and a captive audience for sharing the information. Indeed we did get at least two important leads from BU family that made a difference in our presentations.

1. First it was “Questions for BL&P” who commented: “Before his untimely death, Wendell Mc Clean described the last PUB decision on BL&P rates as a huge mistake which would result in the company OVER RECOVERING from the rates set.” This comment was made at a time when we were still trying to figure out the reason for a separate Depreciation Hearing. This led us to Wendell’s contribution in the transcripts of the ’83 hearing. He had a lot to say about depreciation and explained the link between depreciation, tax losses, deferred taxes and corporation taxes, and why the company would not need to go back to the regulator any time soon. I don’t think Wendell foresaw the rapid advance in technology that would have caused them to return pre-maturely. So they did not have to hide-up profits as QfBL&P thought, it was legitimate.

2. Straight Talk declared: “Not according to their published accounts, they are set up as to make a loss and paid no tax for each of the last 10 years.” Actually it was much longer than that and according to Olson’s calculations it is $135M and the reason is that whenever they buy equipment they get a tax incentive. Has nothing to do with whether they made profit or not.

As simple as they were, these two points did a lot to clear the clouds and as a result we were a lot more vigilant. As a matter of fact, there is some information which we did not get but which we requested, albeit late, because of our late understanding or linking of the issues. We started to see by the minute, even down to closing remarks, as issues came up which were not in there and I had to ad-lib some and some I simply left out. The time was too short and I went over by about three minutes.

On the other hand, there is no doubt that Sir Henry was well briefed and articulated accounts as well as engineering with great ease. He had a whole contingent of about a dozen resources people from the BL&P that could explain things to him in a flash and he was right on it.

    I only hope now that those who are responsible for looking after us the people,ie FTC will do the right thing by us and allowed another monopoly to continue to kill us with high prices even as they make large profits (I am looking at you Lime).


  3. What this hearing has highlighted is that we have granted a public company a monopoly position, with a guaranteed minimum of 12% return on investment, with no actual liability for corporation tax ….. and still they’re looking for more!

    Nice work if you can get it.

    Would like to hear some more on the TeleBarbados factor. As far as we are aware their focus is on commercial. You wrote on your blog we think that the pole plant BL&P is being reserved for them i.e. monopolistic practice.

    We see some ominous implications here.

    This is what we put forward to the FTC. You would note that our closing submission was targeted at the FTC for failing consumers by their manner of proceeding. Intervenors are taken too lightly. One thing, at the FTC they all put forward an accommodating face, but the fact is that the procedures are killing us. Even Sir Henry lamented the fact that there was not more time between the end of the evidence and the closing submissions; less than 24 hrs.

    As it turns out, the guaranteed minimum which is cited for C&W at 12% on capital investment does not apply to BL&P. It was removed after the fuel adjustment clause was introduced to their rate calculation. We realised this when Stephen Worme, after reading BU raised it with me and said he never heard of it. It was Olson Robertson who was able to confirm that it was removed.

    Well, Sunbeach had complained that they had applied for use of the electric poles and were denied. I am not sure who else but probably Blue Communications may have applied.

    We know that only BL&P, C&W and TeleBarbados are using the BL&P network. Mark Clarke, the BL&P engineer testified on the witness stand that these are the only three which are using the network and that he had no knowledge of an application of for use of the grid. He explained that what he got was a query and not a request for use. I think we omitted to ask him what was his response.

    You are correct in saying that if permissions to other service providers are denied that it will cause an imbalance in the competition. We are seeing the BL&P plant as a national resource.

    We cannot say that we are opening our doors to competition and then have the requirements for competition screwed down. That would be against the spirit of competition. In any case, it is the consumers that they are recovering the costs of the poles from, including conduits, etc. and it would not be right to have this resource sitting there and then ask consumers to pay another company to set down the same resources, adding problems to capital works and effectively placing hurdles in the way of competition.

    Furthermore, in order to save the poles from being bored with too may holes, the electric company can employ the use of brackets to hold lines from providers. In these cases holes may not even have to be bored; the brackets can be a strap-on type. Either provide them or let the service providers acquire their own strapping brackets. The latter may be easier and less burden on the BL&P.

    The other problem is the fibre optics, which if Telebarbados is not using now, will certainly be using in the very near future. We cannot have a case where a sister company is using BL&P resources free of cost or for a nominal fee, to make their millions. Indeed the rates which will be fixed for BL&P will have in an amount which consumers have to pay for these assets. It would give TeleBarbados an unfair advantage and disadvantage consumers; only adding to their already heavy burdens.


  6. @ROK et al.

    With regards to the question of users of the poles (and conduits), this is a bit of a complicated issue, with much historical relevance.

    Without meaning to sound like I’m gloating, my questions to Mr. Hutson Best (CFO) and Mark King (COO) were carefully designed to bring forward the facts while still being within the very narrow context of the hearing.

    My intention (which was realized) was to bring into the public domain official knowledge of who was currently on the pole network. I placed on the record that I am personally aware of two previous requests.

    The fundamental issue is that the pole network is a national resource, paid for by the consumers of Barbados, and its use should be maximised for the benefit of said consumers.

    I am working on a document speaking to the issues, history, and recommendations related to this.

    I do recommend that anyone who is interested in this listen to my cross examination of Mr. King on day two, starting at 01:14:20.

Chris we have listened to Day 2 and recognize how you tried to bring this matter to the public’s attention. You may recall we have asked the pole plant question in an earlier blog. We believe that you are on the right track, pole resource allocation has alot of relevance to optimizing the contribution of multiple suppliers to the benefit of the consumer.

    I would not nominally ever answer a question directed to another. However, in this case, I feel I must.

    While BANGO can answer this question, we prefer not to publicly. We prefer to find ourselves with the Company answering such questions.

    However, we *will* say:

    1. From Mr. Best’s answers to Commissioner Brathwaite’s questions, TeleBarbados uses at the very least the “tower” at BL&P Garrison for RF radiation.

    2. Anyone with an understanding of telecommunications and/or electrical distribution systems could infer the answer with a high degree of certainty with only a little empirical investigation.

    (IMHO.)
