Your message to the BLOGMASTER was sent

It was recently announced, by the Government Information Service, that the Protective Service Commission has approved the appointment of Mr. Oral Williams on promotion to the post of Deputy Commissioner of Police in the Royal Barbados Police Force, with effect from May 1, 2020.

I really don’t know if I should congratulate or offer commiserations to Mr. Williams. This has nothing to do with his fitness for the post. I do not know of his work or performance as a senior police officer and cannot speak to his fitness. My concern is that he has been appointed to a non-existent post, since someone is already substantively appointed Deputy Commissioner.

The Police Act, Chapter 167 of the Laws of Barbados, states at section 6:

The Force shall consist of a Commissioner, a Deputy Commissioner and such number of Assistant Commissioners, Superintendents, Inspectors, subordinate police officers and constables respectively as does not exceed the number provided by any order made under section 2 of the Civil Establishments Act: but the members of the Force at 16th October 1961, shall continue to be members of the Force and shall be subject to this Act.

The number of persons appointed to the post of Commissioner and Deputy Commissioner is subject to primary legislation, in this case the Police Act, and can only be changed by an amendment to that Act done in Parliament. On the other hand, the Police Act goes on to give the Minister responsible for Civil Establishments the power, by subsidiary legislation, to determine the number of Assistant Commissioners, Superintendents, Inspectors, subordinate police officers and constables.

For completeness, the Civil Establishments Act was repealed and replaced by the Public Service Act on December 31, 2007. The power to determine the number of posts in the Public Service is now found at section 13.(1) of the Public Service Act.

The power to make appointments to public offices and to remove and to exercise disciplinary control over persons holding or acting in the Public Service is vested in the Governor-General, acting in accordance with the advice of service commissions, in this case the Protective Service Commission. That service commission, like all others in Barbados, can only recommend the appointment of persons to post that are available. There is only one post of Deputy Commissioner available and that is already filled.

Who is responsible for this cock-up? Is this yet another example of this Government not getting anything right the first?

    It is laughable but expected that some persons would wish to characterise the PM’s clarification as “legal gymnastics”. Yes the law can be complex but I don’t think you have to be that nimble and agile to simply point out incontrovertible facts.

    That is absolutely ridiculous and not even slightly related to the facts. Anyone can listen to the Prime Minister say the AG did not walk back the appointment, and she also reinforced the need to tidy the legislation.

    This issue exposes how petty and unnecessarily adversarial (bachannal loving) we can be as a society and reinforces my warning about playing fire with populism. When the Senator first raised this issue, the AG said he was not interested in a tit-4-tat. The media and the bacchanlists jumped all over his comments. I repeat the Nation carried a story a year ago about Williams as a DCOP. You heard anything from Verla or the PdP then? The AG later in a statement said the Police Act will be amended, no different to what the PM said, though admittedly not in as much detail or forceful as the PM in her response. I note that in his Press Statement the AG never said it was unlawful, he said it is true the Police Act only speaks to one post.🤣🤣

    Out steps the Senator and Depeiza calling for the firing, talk of political interference, corruption, the man should not be paid, payback etc. All politicking rather than any sound reason for firing the AG. Up jumps the media again and asked the PM yesterday. Necessary?

    Note how the aspirant Greene sidestepped the demolition of Verla and the General Secretary, even after his tit-4-tat with Artax a mere few days ago. This is not a big issue, we ought to learn how to separate the overtly political mileage-seeking issues from those that are of genuine concern. From all indication the post was created; therefore, whether the implied doctrine was recognised after the AG spoke is irrelevant. There was clearly no intent to hide the establishment of the post or appointment of the gentleman. The actions by the now defunct Police Services Commsion also confirms the man’s suitability for the post. Like I have said before, age should not determine whether an individual is promoted. It is disappointing to hear that implied by a Trades Unionist.

    Where were all these reporters/journalists and Greene when an Executive Chairman was appointed at BWA, when the BWA Act speaks to a General Manager and a Chairman? No post was created, no advertisement and definitely no amendment to the Act.

    I look forward to the debate that Bishop Atherley and his party are keen to participate in, especially in the Senate.

    So why not do the more professional (instead of political) thing and, like the British Met, appoint a person ‘trained’ in “HR and Administrative management” (preferably a female to reflect diversity at the top)?

    Why waste the few years left in that well trained and seasoned asset experienced in areas of the ‘operational’ kind?

    Now what is going to become of that rather successful ‘Crime-stoppers programme’ whose focus was on grassing on petty peddlers of the innocent mary jane and other petty law-breaking activities instead of serious white-collar felonies like the Donvillegate affair to impress the EU black-listing police?

Senator Franklyn claimed the appointment was unlawful and even beyond that motivated by ill intent. Both of those have been proven to be demonstrably false. You all on this thread can either acknowledge that unmistakable reality or dig rabbit holes to spare your own blushes about who said what when. Utterly ridiculous and ironically very infantile. You all make yourselves laughing stocks when you try to avoid the reality hitting you in the face. As I always knew, Mia Mottley and her Administration can never do anything right because a person cannot see through hatred-stained lenses. I am so sorry for all of you.     The appointment was lawful. The reasons for the appointment was aboveboard. The law needs to be tidied. The PM made that abundantly clear, in a more detailed way than the AG.

  21. It just struck me. Senator Franklyn is the one who first “exposed” the government for doing something lawful and helpful for the country (still can’t get over how hilarious that is). He is using DLP talking points manufactured by Hal Gollop et al. One of Sen Franklyn’s most starry-eyed followers is using DLP lawyers as smoking gun substantiation. One of those same lawyers is now the Gen Sec of the DLP, and formerly Chairman of the then PSC who appointed a DCP 23 days before an election. And the Dems want the AG to resign. It has come full circle. I am really surprised though. I didn’t think Ms De Peiza had so many people supporting her to keep the leadership of the DLP. They’re all just working to help her milk a non-existent issue for her gain. It makes sense though. Milk a non-existent issue to sustain a non-existent political career at the helm of a non-existent political organisation. It’s brilliant!

    but …in saying that…if lawyers, i said, not just any DLP riffraff fowl…said that the appointment is STILL ILLEGAL…because of course they would have access to the Police Act which neither YOU NOR I HAVE…and knowing how desperate they are to regain the trust of the electorate…they are hardly in a position to outright LIE…

    notwithstanding the first paragraph, MAM went to law school in the UK. she may not have a legal certificate from a uni in the WI to practice but around that time one could be admitted to practice by the local bar association. that is not the case now.

    as an addendum to what i have said above-

    be that as it may, it seems to me that you are right. that is why they have to amend the police act. if what MAM is saying is correct she would not have to do so.

    this doctrine of implied repeal usually works for like legislation but i am not too sure that a SI, secondary legislation, could repeal primary legislation – the Police Act. i will have to do some more research because the SI seems to be tied to The Public Service Act. but why use a SI to enact law or repeal law?

    it seems to me that they were scrambling for a get out a jail card for PR purposes and Ezra did some good research. well done Ezra.

    nevertheless by saying that they have to go back and do some tidying up to the primary legislation- the Police Act- they are conceding that all is not right.

    again why didnt the AG say all this when he responded to you?

    APPOINTMENT WAS NOT LAWFUL
    I regret having to further embroil the Royal Barbados Police Force in controversy, especially at a time when its members need to focus on keeping our people safe.
    However, I feel constrained to clarify the fog created by statements made by the Prime Minister on the unlawful appointment of a person to a post that does not exist in that organisation.
    The Prime Minister pointed to an interview in 2012 or 2013 after which unsuccessful candidates for the post of Deputy Commissioner were ranked in priority in the event that the post became vacant.
    The single post of Deputy Commissioner has not become vacant since the appointment of the successful candidate.
    Before the then Commission could appoint the successful candidate, legal action was taken to prevent the Commission from making promotions until the court could determine the outcome of the matter before it which challenged the promotion of certain persons.
    Barbados is fully aware that the Royal Barbados Police Force was embroiled in legal matters which prevented any promotions from taking place. An important factor forgotten by the Prime Minister in her declarations about persons acting for inordinate periods in the Force.
    During the tenure of the 2012/2013 Police Services Commission, there was never any contemplation of two posts of Deputy Commissioner.
    The appointment of a person to such a post in 2020, which is nonexistent, can in no way relate to what a now defunct Commission did in 2012 or 2013.
    It should also be borne in mind that the entity which conducted those interviews no longer exists. Therefore, the usual practice of continuity from one Commission to a differently constituted one, does not obtain, for there is now no Police Service Commission.
    Further, a priority list of unsuccessful candidates does not have a life of seven years. Such a list loses its life after two years. This further makes curious the justification used by the Prime Minister for this unfortunate development.
    From what I have heard in her delivery the Prime Minister at no point addressed the critical factor which is the legality of the appointment of a person to a post that does not exist.
    As a result, through no fault of his own, a long serving officer is being used to deflect the unfortunate action of which he is the subject.
    Political tampering has caused problems in the Force before. It seems set to do it again.

  40. Credibility is important in communication. Guyson Mayers has as much moral authority to comment on anything RBPF related as Jack the Ripper has to condemn murder. Even if he had a shred of credibility after he did his utmost to bulldoze morale in the Force, he said nothing substantial.
    1. Why was the RBPF embroiled in lawsuits relating to promotions? Was it because of grossly unfair and politicising appointments by a PSC empanelled by a DLP AG?
    2. The Prime Minister never suggested that the former PSC contemplated a second DCP position, so he is misleading the public again when he says that.
    3. Mayers sought to suggest that Mottley did not address the legality of the appointment, which she plainly and incontrovertibly proved to be lawful. That is however beside the point. There is no explanation here as to why he believes the appointment to be unlawful. Bold assertions from a controversial PSC Chairman are not convincing.

    I make the point again that if these flimsy, washed-out, half-baked excuses for arguments are unable to convince a child of no more than 16 years old, completely unaware of the world, how do you all expect to fool the intelligent, adult population of Barbados.

    I don’t get into legalistic arguments. Cuh dear, we know that the law is an ass, appealing mostly to lawyers and legislators. Lawyers and legislators, all of them dabble in law. That is what they do. AND WE PAY THEM MORE THAN THEY DESERVE TO DO SO. A whole lot of them would not know what to do with themselves otherwise, because they know nothing but law. Very likely most of them cannot even change a tap washer, raise a child, or change an old man’s diapers.

    We know when the law pretended that children born outside of a state/church approved marriage was filii nullius/child of no one, because the LAW/the legislators said so. In reality every single child ever born is the child of a mother and a father.

    So the truth is I don’t have much respect for lawyers/legislators. I pay my taxes so that they can get paid. But this does not say that i have to respect them.

    So I int getting this nonsensical argument, as I told my chief this morning.

  46. Let’s for argument sake accept that the PM had the power to create another post of deputy commissioner, she would have to lay the order in the House of Assembly and the Senate. So says the Section 13.(1)(b)of the Public Service Act. However, section 13.(3) says that an order made under section 13.(1) is subject to affirmative resolution.

    Section 41.(6) of the Interpretation Act states:

    “The expression “subject to affirmative resolution” when used in relation to any statutory instrument or statutory document shall mean that such instrument or document shall not come into operation unless and until affirmed by a resolution of each House.”

    I did not make this up. It seems that the PM was unaware of this provision and thinks that she can just make an order whenever she chooses to create jobs for her friends.

    I am always happy to assist those who are unwilling to answer questions, in the hope that it might foster an appreciation of the virtue of answering simple questions.

    You ask a simple question, but in pursuing this course, I caution you to remember that I was born 16 years ago and not yesterday, so I’m not totally unaware of your intended course of argument. Suffice it to say that it is inadequate to prove whatever point you are trying to make.

    To be courteous, s.91 was amended to reflect the establishment of a new PSC in subsection 1.

    This is as far down this rabbit hole that I am going.

    However, I find it surprising to say the least that you would wish to characterise an appointment of a person to a post within the RBPF as “finding jobs for friends”. The events which preceded the disputed creation of the post are clear and continuing to impute ill intent to the post, whether you think it lawful or not, is not only not supported by the facts but it is also tasteless and offensive not so much to the Prime Minister but to all hardworking members of the Force.
