So, even in the face of wise counsel from such eminent and well respected Barbadian patriots as Senator Sir Roy Trotman, Senator Sir Henry Fraser, Senator Lady Carol Haynes, Senator John Watson, and Senator Sir Trevor Carmichael, to the effect that the Bill to amend the Police Act has such critical implications for the Constitutionally guaranteed rights of the Barbadian people that it should be subjected to a process of national consultation, the twelve Government Senators have simply ignored all pleas for a process of popular consultation, and have enacted the Bill into Law !

How ironic it is that a mere 24 hours after Ministers of the Freundel Stuart Administration made public pronouncements about a Commissioner of Police abusing his powers to carry out wiretapping of telephone conversations, the said Administration is proposing to place even more extreme power into the hands of the Commissioner of Police to — in tandem with the Attorney General– impose Curfews and Cordons on the people and communities of Barbados !

Under the newly amended Police Act, the Commissioner of Police and the  Attorney General will have the power not only to determine which areas of Barbados will be placed under Curfew, but also to determine the Curfew hours.

These two office-holders will therefore have the power to imprison thousands of Barbadians in their homes for up to 48 hours, or to prohibit thousands of Barbadians from returning to and accessing their homes over a 48 hour period.

In addition, the Police will have the power to cordon off areas of Barbados for eight (8) hours at a time, and to oblige any person who happens to be within the cordoned area to answer questions put to them by the Police. And so, the Citizen’s right to choose to remain silent is thrown out of the window !

The new law also gives the Police the right to search persons, motor-vehicles and homes within the Curfew area once a Police officer claims to have reasonable suspicion that the commission of any offence known to the law– no matter how minor or trivial that alleged offence might be — is intended to be committed. In effect, the Police will to all intents and purposes have full liberty to search persons, vehicles and homes as they please.

It is highly unlikely that this new piece of legislation will pass the test of Constitutionality once it is challenged in the Supreme Court of Barbados.

But that does not seem to bother either the DLP members of the House of Assembly nor the DLP members of the Senate ! These–after all — are the same legislators who, less than two years ago, enacted the The IMMIGRATION (BIOMETRICS) REGULATIONS 2015 are NULL, VOID and Un-Constitutional that stipulated that every Barbadian traveling from or returning to his or her own country had to be fingerprinted, and that Barbadians could actually be prevented from re-entering their own country if they refused to be fingerprinted.

These Regulations — it should be recalled — were found to be unconstitutional and were struck down by the Supreme Court of Barbados.

How tragic it is that the callous and stiff-necked Freundel Stuart Administration has seemingly learnt nothing from that most shameful episode in the history of the Parliament of Barbados.

    Having given the prerequisite for any curfew or cordon, should any matter exist in any GATED COMMUNITY, will these “additional powers” supersede the powers vested in the gated communities’ security?

    On another note,

    THE QUESTION IS…
    If the controversial amendment/approval to the Police Act exhibits to be menacing in character, intended to cause annoyance, inconvenience and distress, to be reckless as to whether it has caused annoyance, inconvenience or anxiety to a person(s)/ community/parish/island via ITS EXERCISE or via any telecommunication (electronic message. print or otherwise) to which it (the (intended) curfew or cordon) will be/has/had been executed to wit caused fear for their lives, sustain body harm or injury or any such distress/ property…… CAN THIS LEGISLATION OR ITS AUTHORS BE LITIGATED, and upon conviction be liable to the said $10 000 or 3 years or both or other greater award on each count?

    If so, the numbers in a curfew or cordon area do have an equal leverage of power to redress any recklessness, annoyance, inconvenience and distress as long as it is done collectively and there is a fair and just balance within the Judicature.

    THE QUESTION IS
    Can a “false flag” initiate such an exercise?

    “Philippines drugs war: ICC announces initial inquiry into killings

    The International Criminal Court (ICC) is to open a preliminary inquiry into alleged crimes committed during the Philippines government’s war on drugs, its chief prosecutor says.

    Fatou Bensouda said it would look at reports of extrajudicial killings.

    President Rodridgo Duterte’s policy of endorsing such killings in the drugs war has drawn widespread condemnation.

    Ms Bensouda said an initial examination would also be opened into the use of excessive force in Venezuela.

    The government of President Nicolas Maduro has faced accusations of human rights violations following protests last year in which more than 120 people were killed.

    Ms Bensouda said she had “closely followed” the situations in the Philippines and Venezuela and after “a careful, independent and impartial review… I have decided to open a preliminary examination into each situation”.

    She stressed that the examinations by the ICC – based in The Hague – were “not an investigation” but a process of examining information “in order to reach a fully informed determination on whether there is a reasonable basis to proceed with an investigation”.

    With regard to the Philippines, she said her office would analyse alleged crimes committed in the context of the government’s “war on drugs”.

    “Specifically it has been alleged that since July 2016 thousands of persons have been killed for reasons related to their alleged involvement in illegal drug use or dealing,” she said.

    “While some of such killings have reportedly occurred in the context of clashes between and within gangs it is alleged that many of the reported incidents involved extrajudicial killings in the course of police anti-drug operations.”

    President Duterte’s spokesman, Harry Roque, dismissed the ICC’s examination as a “waste of time and resources”.

    He said Mr Duterte had employed “lawful use of force” against threats to the country.

    Amnesty International welcomed the ICC’s announcement on the Philippines, saying it marked “a crucial moment for justice and accountability”.

    “This announcement is a warning to leaders around the world that those who order or incite crimes against humanity including murder will not be able to get away with it, and will be subject to investigation under international law,” said James Gomez, Amnesty’s south-east Asia director.

    Ms Bensouda said that, for Venezuela, her team would focus on alleged crimes committed during anti-government demonstrations since April 2017.”

    As long as the population know they have international human rights, that they have recourse against government abuse of power and that no one can stop them from reporting any such abuse to international bodies who have the power to investigate and prosecute those governments found to have committed such abuses under international laws…it’s all good.

    Why are people concerned about the passage of this law?

    Let us look at it closely.

    It’s purpose is to assist in the protraction of the General Elections and to strategically disrupt the upcoming political meetings and election related activities leading up to the GE.

    Additionally it shall be used to seize and assist in the search and arrest those persons seen to be supporters of the incoming Barbados Labour Party administration

    But why are people concerned though?

    By The very act of making this law so hurriedly the Democratic Labour Party has sealed its fate and the fact that it will not secure “One Effing Seat”

    The thing that has to occur now though is that the ballot boxes have to be secured and marked and validated because this is where the trickery IS GOING TO OCCUR.

    They have already started the contamination of the eligible voter registers.

    The issue is how will objections to eligibility on the General Elections Day be handled?

    So David Bulldog, he who draw a gun on Marshall in Parliament, used the Water Works surveys to collect and collate voter information.

    And the fellows now have a much better idea of who is where and who will vote for who

    so it should now be evident that this law is purposed to strat3gically disrupt the free movement of persons during the upcoming election gatherings.

    IT HAS NO OTHER PURPOSE

    That being the case it underscores the ole man’s suggestions that the counter has to be equally disruptive and psychologically more impactful.

    The most amusing part of the entire wire-tapping drama is that the DLP gov’t has had nine years to facilitate the arrest and prosecution of the perpetrators but have done absolutely nothing about it (as is their custom).

She had, only they had not registered it properly under the correct name. When the bailiff arrived at her home, she was out and her son answered the door. He walked in without a by-your-leave and proceeded to make an inventory of her possessions before departing.

    As can be imagined, she was horrified by this violation of her family’s privacy. The local council, on checking its records, acknowledged its mistake and apologised. And that was that. Since a complete stranger had entered her home for no good reason, does that not constitute an affront, even if the door was opened by someone in the house? After all, an Englishman’s home is his castle, isn’t it? Apparently not. The powers of bailiffs to enter homes and seize property are wider today than they have ever been and are about to be strengthened further.

    We will be hearing a lot more of the bailiff in coming months. About 75,000 homes will be repossessed this year and hundreds of thousands of people will face action for unpaid debts. Local authorities are also using bailiffs to pursue council tax defaulters, with more than a million visits last year. If you want a job, here is one that will last while all around are losing theirs.

    Inevitably, it preys upon the misery of others; but someone has to do it. The issue, really, is how they do it and in what circumstances. Anyone who watched Little Doritt on television recently will know of Dickens’s obsession with bailiffs that derived from the indebtedness of his father. But even the most rapacious bailiff in one of his novels did not have the power of his modern counterpart. Neckett in Bleak House had to be invited in to serve his warrant for debt on Skimpole. This is because, for centuries, bailiffs were unable forcibly to enter a home under a common law right of citizens established in around 1300 and reaffirmed on many occasions by the courts, as in the Semayne’s judgment in 1604 from which the “Englishman’s castle” concept derives, and by successive governments throughout history.

    In 1760, William Pitt (the Elder) made a famous declaration of this right. “The poorest man may in his cottage bid defiance to all the force of the Crown. It may be frail, its roof may shake, the wind may blow through it. The rain may enter. The storms may enter. But the king of England may not enter. All his forces dare not cross the threshold of the ruined tenement.”

    This right to refuse forced entry held for centuries until the Labour government, with its cavalier disregard for personal privacy, came along. In 2004, it introduced the Domestic Violence, Crime and Victims Bill, which contained a power to force entry in connection with unpaid fines imposed for criminal offences. This was a significant departure from the common law that merited a wide debate; yet it was included in a measure that, on the face of it, had nothing to do with bailiffs. The Government maintains that it was fully considered by Parliament; but it depends what you mean by fully. The Bill was in its final day in committee when ministers tabled “urgent” new proposals to show they were “getting tough” with fine dodgers.

    The minister, Chris Leslie, explained: “These amendments give enforcement officers the power to enter premises to execute a warrant of arrest, commitment, detention or distress where the officer has a reasonable suspicion that the offender who is a subject of warrant is present.” The MPs on the committee seemed to have little idea that they were being asked to set aside an ancient liberty, and Mr Leslie certainly did not spell it out.

    Dominic Grieve, the Tory spokesman and now shadow home secretary, smelled a rat but did not want to sound soft on fine dodgers. “We are about to give considerable powers to non-uniformed individuals… We are allowing them to enter private premises, which will not necessarily be the premises of the person whom they are seeking, to carry out searches… I am a little surprised that we are apparently introducing such potentially draconian legislation without paying real regard to the consequences on the ground on a day-to-day basis.”

    Despite these doubts the Bill went through. Her Majesty’s Courts Service issued guidance to bailiffs about how their powers should be used. “If a person locks himself in their home, it might be reasonable to break open the door, but probably not to smash a hole in the wall,” it advises.

    In 2007, the Government extended these powers in the Tribunals, Courts and Enforcement Act 2007 to allow bailiffs to use physical force against householders to restrain or pin down them down. The Government says the new powers when they are triggered will be overseen by a “robust industry watchdog” still to be established and could only be used as a last resort when all other suitable methods of enforcement have been exhausted.

    But that is beside the point. The fact remains that the liberties of “the poor man in his cottage” have been simply tossed aside, with the barest of parliamentary scrutiny.

    There is no Statute bar to pursuing a criminal matter in Barbados 🇧🇧

    The matter can be pursued 9 years , 20 years or 2 years etc once there is justifiable cause and evidence to do so.

    That’s why the Deputy Commissioner of the RBPF says … ” bring the evidence the RBPF ready to INVESTIGATE !!

His teefin is the main reason investors and business people have disengaged from the Bajan economy; his piss-poor economic management is a secondary consideration.

    That is exactly how innocent people get killed re wrong address, wrong person detained, innocent person wrongly and maliciously prosecuted, malicious persons calling in false tips…..happens all the time.

    Just recently two idiots were playing an extreme computer game, one lost and out of anger randomly picked an address, called the police and lied to them claiming the person inside was holding his own family hostage and already shot one or two, the police converged , the guy emerged from his house not knowing what the hell was going on and a sharpshooter from clear across the street put a bullet in him and killed him instantly…

    We all know how people can be malicious, especially when you have disputes with them, sometimes you do not even need a dispute, they just dont like you and will call police and tell a lie, wuth that lie anyone can end up dead or in prison because of abuse of power and violation of their rights, so I have no clue what Adriel Nitwit and the commissioner are talking about..

    In the meantime, the malicious government never legislated, though they have had 10 years:

    Integrity legislation.
    .
    Anti corruption legislation

    Freedom of Information FOIA

    Anti bullying legislation

    Sex offenders Registry for their well connected rapists and pedophiles

    Powers of arrest for white collar minority and other business criminals in their midst who routinely commit crimes as a rule on the island because the government refuses to rein them in.

    And the government actually expect the electorate to reelect them, what a nerve.


  29. Few months ago Fractured was gonna lock up Mia for practising law without an LEC too. To date, nothing; and Adriel Brathwaite has not unpicked his teets about the investigation requested via a resolution at a political party conference🤣🤣🤣. The mere fact that a political party allowed this to even make it to the agenda of their annual conference says a lot about the DLP. Now Mia will be jailed for wiretapping. Typical of DLP style–confusion. It is also clear that there is a concerted effort by many in parliament to prevent a BLP victory/PM Mottley. It is clear that if the BLP wins, many gine go into hiding.

    Shouldn’t that be ‘CELLS’ (plural)?

    Or do you want to take the country back to the good old Glendairy days of 5 men to a cell no bigger than a pit toilet with slop buckets of human waste to dump near a zone 1 catchment area aka the Belle to make the man-made problem on the South coast look like a walk in the park?

    You will need to lock up all those, ‘allegedly’, involved in the illegal activity (just like you will have to be on the AG’s list of 40). From the ‘mea culpa’ man who took full responsibility that everything that occurred under his watch to those who directly participated in the actual illegal activity.

    What about those (from the son of ‘Guy’ Fawkes guy to the very top of governance) who were made aware of the illegal acts but chose to cover it up like cat shit just to achieve partisan political aka DLP goals?

    So what will it be, Fractured? A full police investigation into itself to bring criminal charges against all of those involved from the bottom to the very top of the pyramid of illegal acts and cover-up or are you going to wait on a full-blown CoI to saddle the taxpayers with clearly unaffordable millions of tax dollars like the St. Joseph Hospital Inquiry or that of the Alexandra School circus event?

    Even to the point where ACTUAL shiite has been pouring into our main streets now for two years UNABATED…… and we continue as ‘normal’…. and get upset that others complain about us.

    So are you saying that a bogus letter was sent to the GG by the PSC asking that a person, in this case, the Commissioner of Police, should be sent on retirement without cause ?
    Are you saying that all the police who corroborated that wire tapping was done are liars ?
    Are you saying that the news story that appeared in Barbados today is fake news ?

    So this is now a laughing matter…..really. Wire tapping citizens’ phones should cause just as much concern as the controversial Police Act .

    Let’s have some balance.

    Skinner, why has the wire-tapping matter received no attention from the DLP for 10 years?

    If it was so important to them and the rest of us, it should have been prosecuted within 12 months of the PSC letter.

    The delay is a further demonstration of DLP incompetence and ineffectiveness.

    So why dont the current commissioner have the former commissioner arrested, since it is PSC….I take it is also part of the policing body….claims to have evidence, get that out of the way and move on.

    I dont see where any politics should be involved, any bugging by the former commissioner was an internal, matter unless he can say he was ordered to by whichever DPP was in office betwwen 2000 and 2010.

    This is not rocket science, start putting checks and balances in place for all these taxpayer funded government controlled offices and departments.

    Frustrated….we are thinking along the same lines.

    My take on this…the government is arrogantly and stupidly confident that the people will reelect them, despite evidence to the contrary….or they would legislate.:

    Integrity legislation.
    .
    Anti corruption legislation

    Freedom of Information FOIA

    Anti bullying legislation

    Sex offenders Registry for their well connected rapists and pedophiles

    Powers of arrest for white collar minority and other business criminals in their midst who routinely commit crimes as a rule on the island because the government refuses to rein them in.

    And dont involve themselves in that wiretapping issue which is clearly between Dottin, PSC and the current commisioner of police to prosecute….none of the ministers can be involved…because the GG was already prompted to relieve Dottin of duties.

    The government is stalling in hope that these pieces of legislation that will introduce checks and balances to governments going forward, cannot be used on them when the next government uncovers their crimes….so they will never legislate them, that is why they should never be reelected.

    And if Mia or whomever forms the next government do not use present legislation to investigate what these current ministers have been up to for the last 10 years and prosecute them based on crimes committed, she or they will be leaving the same legacy.

    Weren’t they aiding and abetting in an illegal activity with their full knowledge of its illegality?

    Isn’t this equivalent to a person receiving stolen goods with the knowledge that the goods were stolen whether the thief was the person’s supervisor or boss?

    So not only, my friend, must the top cop be ‘fingered’ for breaches of the law and abuse of authority but also those who participated in the dastardly of illegal espionage, even if politically orchestrated.

    Yes we agree with you 100% that the wire tapping is a serious matter. So what is the DLP doing about it? Just talking shite in Parliament? 10 years and they haven’t done squat. Come to think of it what have they done in the last 10 years?

    And it is precisely because unauthorised “Wiretapping” is clearly not a “laughing matter” that it ought to be taken seriously by the legally authorised agents of the State like the AG, DPP and CoP and turned it into a ‘Judicial’ matter instead of leaving it in the arena of partisan political gamesmanship to score electoral points.

    So why don’t you call for the light of Justice to be shone on this illegal matter?


  49. Interesting that all of a sudden before an election we are having this Police Act. Seems as if this is a major FEAR TACTIC and Political move on behalf of a FAILED DLP government! It looks like this government is willing to do anything legal or illegal to win an election.
