Ministers Donville Inniss and Chris Sinckler

Perhaps Minister of Finance Chris Sincklerย  and Minister of Industry Donville Inniss could explain to us Barbadians how the process of having Mr Mark Maloney construct aย  hotel at Bay Street, St Michael would boost Barbados’ reserves of foreign exchange.

It would seem to me that Mr Maloney would be likely to use up and further deplete Barbados’ reserves of foreign exchange during the process of constructing his hotel, since most of the construction material that he would be using would be imported into Barbados and would therefore have to be purchased with our scarce foreign exchange.

Any possible foreign exchange earnings from such a project would clearly be several years down the road, if and when the hotel gets up and going and is able to attract additional foreign tourists to our Island.

Furthermore, it is factually incorrect to suggest that I, David Comissiong, have had Maloney’s project put on hold by way of a High Court injunction. Rather, what I have done is to ask a Judge of the Supreme Court of Barbados to subject the grant of permission to Maloney’s company to a process of JUDICIALย  REVIEW.

The facts are as follows:-

In July 2016 Mr. Mark Maloney made a public statementย  asserting that he would be commencing the construction of a 15 storey Hyatt hotel in September 2016 .

I then responded to Maloney’s statement by writingย  to BOTH the Chief Town Planner and the Minister Responsible for Town and Country Planning (Mr Freundel Stuart) expressing consternation at Maloney’s statement, and asserting that the Law of the land demanded that Maloney’s application be subjected to a physical and social “Environmental Impact Assessment” (EIA).

Needless to say, I received no response from either the Chief Town Planner or the Minister — not even a letter of acknowledgement of receipt of my letter !

Furthermore, Prime Minister Freundel Stuart — the Minister Responsible for Town and Country Planning — ultimately went ahead and simply granted Maloney’s company permission to construct their 15 storey hotel without having the benefit of the findings of an Environmental Impact Assessment to guide and inform him in the making of his decision.

It is against this background that I decided that it had become necessary to have a Judge of the Supreme Court of Barbados examine the manner in which Mr Stuart had dealt with the application of Maloney’s company, and determine whether Stuart’s decision was lawfully made. This legal procedure is known as JUDICIALย  REVIEW and it is provided for by the Administrative Justice Act, Chapter 109 B of the Laws of Barbados.

It needs to be noted that under the Laws of Barbados there is a category of construction projects that require the carrying out of an Environmental Impact Assessment “BEFORE” any permission can be granted for them to go ahead. And this is so because these projects possess the potential to do serious damage to the precious physical and social environment of our country.

It is therefore in the best interest of our country to have a Judge of the Supreme Court examine Mr Maloney’s project and its implications for the physical , social, cultural and heritage environment of Barbados, and determine whether the manner in which the Application for the project was processed by the Minister was in compliance with the standards and procedures required by the Laws of Barbados.ย  This is what the Application for Judicial Review that I filed in the Court on the 22nd March 2017 is all about.

I also subsequently filed an Interlocutory Application requesting that the Court grant an INTERIMย  ORDER suspending the Grant of Permission to Maloney’s companyย  until the Court can hear and make a decision on the JUDICIALย  REVIEW application. This request for an INTERIMย  ORDER is in keeping with Section 72 of the Town and Country Planning Act of Barbados. However, this Interlocutory Application has not yet been dealt with by the Supreme Court of Barbados.

Furthermore, Mr Stuart, the Minister Responsible for Town and Country Planning, has indicated that he is opposing the request for an INTERIMย  ORDER suspending the grant of permission to Maloney’s company while the Court carries out the process of JUDICIALย  REVIEW.

Thus, as of today’s date, the grant of permission to Maloney’s company still remains in effect, and, to the best of my knowledge, Maloney is continuing to do work on the Bay Street site.

Ultimately, a Supreme Court judge will review this entire matter and will determine whether the permission that was granted to Maloney’s company was lawfully or unlawfully granted. If it is determined that the permission was not lawfully granted, one would then expect the Court to quash the decision and the permission.

  1. At least DC is much more above board than the Government and the Cabinet under the PM. In 2017 it cannot be acceptable the vain and veiled manner in which the decision-makers proceeded. I support Hyatt but not at any cost and certainly not without the requisite lawful permissions. Ultimately the Supreme Court shall rule.

  3. From the time that Freundel Stuart did the site visit and had his security and police run the Nation journalists from Bay Street, I knew that something was fishy and underhand with this project.

    It is very sad that we have a government whose interest is not the people but for a select five white men who are bleeding this country.

    Dont the black contractors have no ideas or are not worthy of being awarded contracts?

    I am waiting to see if this 100 million comes into Barbados………..are we going to hear that the government is guaranteeing a loan with some bank.

    By the way has the government paid Tom Grant for Sam Lords?

    When will this government answer Ronald Toppin’s question on the status of the land on which this Hyatt is to be built. The land belongs to the taxpayers and was vested to the BTI.

    How much did Maloney pay for our land or was it given away to him for free?


  4. Here is a reminder what Group Economist of RBC for the Caribbean stated in her review of the Barbados economic landscape.

    The authorities have indicated that USD inflows are expected from the Development Banks, and for various

    tourism-related projects, as well as divestment of the Oil Terminal. I want to caution however: (1) that these are largely one-off or exceptional flows, and are not the way in which Barbados would typically earn foreign currency flows,

    (2) that USD inflows raised from debt (from the development banks or otherwise) have to be repaid with even more USD over time, and the Barbados Government is already running a primary fiscal deficit. This means they are borrowing to pay interest on existing debt – and further debt will drive total debt servicing costs even higher (already 26% of total revenues),

    (3) that in light of chronically weaker USD inflows, borrowing more USD now, could make things worse in the

    medium-long term,

    (4) and finally, USD inflows for projects are largely temporary โ€“ they flow back out as materials and equipment are imported for the execution of the project.

    The governmeht breaks the laws of the land to accomodate Maloney, Cow, Bizzy, Bjerkham, who are also law breakers, in dipping their hands in the treasury and NIS pension fund.

    Fruendel the Fraud and his ministers are law breakers, the sooner the island is rid of them, the better. You cannit break the island’s laws for certain prople, then call yoursekf a government.

    Dumbville Inniss is useless as a minister…. the definition of JUDICIAL REVIEW was explained in it’s most simple form, he could also have googled the definition…yet this retard still wants to mislead the population…he should have stuck to porn..

    It’s rather encouraging to see that David C. is at last going for the financial jugular of this make-believe Tower of Baloney instead of shadow boxing with the moving legal target.

    You have now opened wide the window of enlightenment to see what this project is really about.

    From your new helicopter position you should keep your legal weapon firmly focused on the forest of confusion where foreign money is not growing on imported trees and NIS could be the reverse Robin Hood masquerading as the banker of last resort.

    David C, you have shown your full house of betting cards of litigation. Now let us see if your opponent(s) can beat you with a financial straight of diamonds worth $200 million in forex and bury you with a spade of hearts in the eyes of the public.

    BTW….

    I understand parts pf St. Thomas were without electricity for about 7 hours yesterday, from afternoon into the night….. does EMERA not apologize for inconvenience to their customers and give ETA updates to their customers, seeing as they not only pay very high electricity bills, but EMERA Canada got the nerve to also want bajans to pay for their hedging/gambling bets and debts as well, does EMERA believe they have some type of entitlement on the island.

    That is not how electric companies operate in Canada, stop being uncouth in Barbados.

    The sale of the oil terminal will also not see one cent of foreign exchange earned.

    In her response to the budget of June 2015 leader of the Opposition Mia Mottley gave impetus to the Cahill Energy debate when she shocked the country with the revelation that four ministers (Darcy Boyce, Denis Kellman, Chris Sinckler and Denis Lowe) had signed a Power Purchase Agreement with Cahill Energy dated 15 March 2014.

    The government defended (not very well) the agreement with the Claire Cowan Cahill Energy company, however, subsequent events have proved the Fruendel Stuart led government withheld vital information from Barbadians.

    Barbadians were NOT told that on the 13 September 2013 Prime Minister Fruendel Stuart signed a Heads of Terms Agreement related to Cahill Energy that committed the government to specific deliverables which have cost and legal implication for Barbados. For example, clause 5 of the agreement reads as follows:

    Why did the Prime Minister remain silent on the matter of his involvement during the June 2015 budget debate? Why did he not defend Minister Denis Lowe โ€“ who had lead responsibility โ€“ and the other ministers who were heavily criticized for their involvement with Cahill Energy?

    What adds to the Cahill intrigue is the letter (parts 1,2) signed by Prime Minister Fruendel Stuart dated 3 March 2014 addressed to Clare Cowan advising that Cabinet approval was obtained and the agreement with Cahill had been submitted to the Solicitor Generalโ€™s Office as part of the required due diligence process.

    In 2013 Prime Minister Stuart in his head to head with Owen Arthur won the debate on the matter of who was perceived to have greater integrity by the public. The Cahill Energy transaction has given justification to those who now question the honesty of our prime minister. The public announcement last week by Minister Denis Lowe โ€“ forced by the No Confidence Motion โ€“ is not the final chapter in the book titled โ€˜Governanceโ€˜.

    Obviously you live in Urbania? Go a few hours north and discover how often they shut down the power without notice. I keep 3 ice cubes in a glass in the freezer, just to check, things haven’t thawed and refrozen.The clocks etc tell me the power has been off, I just don’t know for how long if I am away.

  28. The statement quoted by Donville Inniss on the morning news smacks of trying to intimidate David Comissiong. It is a citizen’s right to invoke the option to apply to the courts to seek a judicial review. What Inniss needs to address is the outcome of the illegal importation of chicken wings by a member of his constituency and the relabeling of items that was highlighted last year.

    Northern…if you check their website or call their hotline in Canada, ya will get information..even if it’s an estimate, I have done it many time even in minus 47 degree weather where all the power lines are ripped down.

    Calls were made to EMERA yesterday and all they got was the standard…. they dont know…that is not good customer service.

Now how is it that when ministers speak on the issue he rans to media to defend his claims . Does he not have enough trust in the judicial process in which he has placed his claims.     Ok Northern…I am yet to experience power outages outside of extreme weather conditions or flooding, only get the occasional outage. Your area must be overloaded..ya tend to get that in heavily populated cities, or there could be other reasons.

    That is what Comissiong proceeded to do when he unilaterally delayed barbados progress and put many lives in economic limbo until the court decides the fate of the Hyatt.
    The court decision if negative can have devastating results home and aboard for future investment in barbados
    For those who wants to see a decision against govt better beware that when all is said and done the economic future of barbados would be the one to suffer

The hignorance of the DLP sycophants never cease to astound.An objection is placed before the High Court seeking Judicial Review of an act of the Barbados Government through its PM and others.Its nothing to do with weighing the pros or cons of the “economic interest” whatever that is supposed to mean.This item which DC has had to place before the court should never have been allowed by the minister.Its a tragedy of insane proportions to see how the slave mentality is alive and well with the member out of Marchfield,St Philip.Bussa’s blood was spilled for these stupid people and they still have not learned to stop saying and doing the albino’s bidding.Its a bloody shame.

    Many weeks ago in a press release made public- and posted on BU and traditional media- the government was warned that if it proceeded without meeting with the people of the area to effectively explain the project DC would seek intervention from the Court.

    The fact they have proceeded means two things 1) they hignorant or 2)the project is a front to distribute project fees.

Seen the courts gave Comissiong permissioins that were not in the best int erst of barbados namely the case of Raul Garcia the convicted criminal whose homeland of Cuba refuse to take him back initially ,the courts bend over backwards allowing taxpayers money to house this criminal but then this is barbados a country where love of self int erst supersedes love of country.
