Dear Sirs / Madams

Re: Privatization of functions of the Sanitation Service Authority

I act in my capacity as a Citizen and taxpayer of Barbados, and write to each of you in your capacity as a member of the Sanitation Service Authority Board, and in accordance with your appointment to the said Board on the 16th of June 2016 by Dr. Denis Lowe, the Minister of Environment and Drainage, acting under powers conferred on him by the Sanitation Service Authority Act, Chapter 382 of the Laws of Barbados.

As you are no doubt aware, the Sanitation Service Authority Board of which you are a Member is a “board” or “other authority of the Government of Barbados” and exercises powers and is bound by duties conferred and imposed by the Sanitation Service Authority Act.

You would also be aware that under Section 9 of the said Sanitation Service Authority Act, it is provided that “the expenses of the Authority……….. shall be defrayed out of moneys voted for the purpose by Parliament”. (In other words, out of moneys provided by the Citizens and taxpayers of Barbados!)

Furthermore, as a result of the public / governmental / statutory status of the Board that you are a Member of, the said Board is legally obligated to make decisions and to act in a manner that is NOT “unreasonable” and /or that does NOT constitute an “irregular or improper exercise of discretion”. Additionally, the Board is NOTpermitted to make decisions or to act in a manner that constitutes a breach of or omission to perform a duty.

And you would also be aware that under Sections 3 and 4 of the Administrative Justice Act, Chapter 109B of the Laws of Barbados, the decisions and acts of a Board or other authority of the Government of Barbados (such as the SSA Board) are subject to Judicial Review before the Supreme Court of Barbados in the event  that such decisions or acts constitute :–

      “ (e) unreasonable or irregular or improper exercise of discretion”

      “ (l) breach of or omission to perform a duty”

It is against this background, therefore, that I would now like to draw to your attention the financial implications of the decision that was recently made by your SSA Board to “privatize” some of the functions and services of the SSA by hiring eight compactor trucks owned by such private sector companies as Williams Liquid & Solid Waste Management Inc., Forde’s Freighting &Rental Services Inc., Garbage Master Ltd, and Project Recycling Ltd, at a rental fee of $411 per hour per truck, over a six month period.

The information that has been made available to me and other members of the Barbadian public through the news media establishes that the SSA will be paying the private business-men $411 per hour per truck, and that each truck will be in operation for 8 hours per day and for 5 days a week.

Thus, EACH TRUCK will cost the SSA (and by extension the taxpayers of Barbados) the sum of $16,440 per week or $427,440 over the six month period, and ultimately $854,880 over a one year period –in the likely event that the arrangement is extended .

This half-yearly cost to the SSA of $427,440 per truck or yearly cost of $854,880 PER TRUCK needs to be juxtaposed against the one-off cost that the SSA would incur if it actually purchased such a compactor truck for itself —- approximately $250,000 !

The question that arises therefore is as follows:-  Why should the Sanitation Service Authority Board be saddling the SSA (and by extension the taxpayers of Barbados) with payments to private businessmen of $427,440 per truck per half-year (or $854,880 per truck per year), when the Board could have purchased the said truck for a one-time cost of some $250,000 , and end up being the OWNER of the truck rather than a mere RENTER with no ownership rights ?

In addition :– Why would the SSA Board enter into such an arrangement with these private companies, when it means that several truck drivers who are members of the staff of the SSA will have no trucks to drive (and therefore no duties to perform) but will still be entitled to receive payment of their full salary from the SSA ?

On the face of it, the decision that the Board has made to put this privatization scheme in place is so financially outrageous and so detrimental to the financial interests of both the SSA and the Citizens and taxpayers of Barbados that it appears to constitute an “unreasonable or irregular or improper exercise of discretion” and/or “a breach of or omission to perform a duty”.

The purpose of this letter therefore is to draw the ugly and outrageous implications of this decision to your attention, and to hereby request that you provide me (and by extension all of the other Citizens and taxpayers of Barbados) with a written explanation and justification of this decision, so that we — the Citizens and taxpayers — can make our own assessment of your rationalization and determine whether further action (including legal action) is required.

I now hereby call upon each of you to do his or her duty as public officials accountable to the people of Barbados, and to provide the said requested written explanation/justification within 14 days of your receipt of this letter.

I would also like to inform you that in light of the fact that this matter affects not only me, but all of the other Citizens and taxpayers of Barbados, I intend to share the contents of this letter with the national community through the news media. I also propose to similarly share your response with my fellow Citizens.

    Forget agenda Vincent, even if there is one this matter is egregious beyond comprehension and his efforts need not only be commended but taken, as he has quietly noted, to the courts.

    In the corporate world company directors are normally immune from criminal prosecution for acts carried out by their entity the company but they can yet be held liable when matters are egregious.

    This smacks of this and if the legal construct of a statutory corp is in any way legally similar then these directors should be held accountable. The financial details as noted here simply do not make any practical sense. This is bold faced robbery ‘prima facie’.

    Fearplay…….apparently the other attorneys, too many of them, are busy victimizing people on the island, they do not seem to have the time to stand up for what’s right when they can make 6 million dollars a year doing all the wrong things to the people… until one of their business partners stab them in the back, then they become too busy looking to recoup that lost money to bother with doing what is right…… then they are too old to care about what is right.

    To attempt to answer your questions lawyers like many other professionals in Barbados go to work and go home. To do extra duty for fellow man is selfishly forgotten. How many Barbadians do philanthropic work in their off time? Hell 40% do no vote!

    Why are we expecting lawyers to be different?

    @ Fear Play.
    Be reasonable. You should know by now that many attorneys in Barbados do not like to rock the boat, against Government or big businesses, for fear than one day down the road, neither of these entities may throw a few pickings their way. Take for example the last lady who headed the FTC. Do you think that she would now be in the employ of one of the utility companies, if she had looked after the interest of the public/taxpayer who was paying her salary,instead of that particular utility company, which came under the control of the FTC?

    It is quite possible that she did her job so well for the public and was so well versed in her area of expertise that getting her on board working for the utility company would have been a coup of the highest order for that company. I understand that the foreigner lady who led that company got a million dollar bonus for about a year’s work! Go figure.

    But your first sentence about attorneys is spot on and also captures the attitudes of many other professionals. Yuh know how many Engineers and Accountants and Doctors and Actuaries operate in the same mould?

    It is a bajan thing that is enshrined in our DNA.

    These people probably could not do the computation that Come-and-sing outlined above – even if Stinkliar offered his personal assistance.
    These ‘Board members’ simply await instructions from the relevant minister, via the chairman, and vote as instructed…. theirs is not to reason why… else they just get reshuffled…

    This is a simple political perk, after all, …given for putting up DLP posters last election.
    Wait….Is that the same ‘Simmons’ who is the muguffy in sport?
    That may explain everything.

    The decision makes no sense whatsoever, but that will not phase AC… 🙂

    This can only be explained as the government seeking to do anything necessary to get pass the independence celebrations and into next year…
    Without actual money to buy trucks, they had enlisted the usual suspects to help them out (while helping themselves to more millions) but between BU and other Bajans who are now aware of these schemes, this ploy was exposed at the port…

    So, in order to avoid embarrassment during the Prince’s visit, this handy little scheme was concocted – which will likely end up with Stinkler promising to pay the contractors with proceeds from a new shiite tax….

    Bajans can either continue to waste time reasoning with the donkeys who have the keys to our treasury… or we can put a whip to their tails ..and point them in the direction we want to go in…. with blinkers if needed….

    By the time the next set of thieves come into office, we will be so broke that Mia may have to dip into her Four Seasons account to pay national expenses like these garbage contractors….

    We know at least one member and he has never distinguished himself as a thinker.

    We highly doubt that this man knows how to do a time value calculation, as if that were necessary.

    While we agree entirely with David Comissiong, if we had to address all these acts of malfeasance there will be nothing else we could get done.

    We would wager that there will be no response. Then the only thing that could be done is an appeal to a useless judicial system which will hear this matter in 40 years time.

    As a former Board Chair yourself, that is a revealing ‘breast laid bare to the thrust of the rapier’ acknowledgement is ever there was one. Obvious though this all be your honest appraisal puts all these affairs into eyes wide-open WTF reality.

    David the blogmaster was apparently bemused when I asked why condemn the constituency voters who support the big monied outsiders over his desired tried and trusted community stalwart so I am hopeful the picture is much clearer now: a desired seat on a Board starts with ‘poster duty’ and starts right there in the school hall in a St. Michael South Central riding and even in a St. James South. The piper plays the tune and pays the musicians.

    But don’t lets get carried away. There is no difference here vrs what happens in US or Canada. The political machinations are the same. Gov Cuomo (NY) created an integrity commission to investigate malfeasance among legislators generally. He then abruptly disbanded it when a few commissioners actually took aim with some serious allegations against HIS administration.

    Go into Michigan and see the political misdirection from ‘trusted’ chairmen of state agencies that led to the debacle of citizens’ deaths and wide spread mayhem that became the Flint water crisis

    And all here surely are aware of how the Gov of NJ used his political power to bring into disrepute the integrity the Board of the NY/NJ Port Authority with a bogus traffic study constructed by one of his appointees.

    Conflate all that with a CLICO Board of ‘trusted’ acolytes or the Board at Enron or even more recently the one at Wells Fargo and there really is no difference, Mr Chairman Bush Tea.

    Chairmen normally are the fellows who help design, source and direct the poster campaign. Not so! So you have been there and now you are rightfully fighting the good fight to enforce more change.

    All good, as not every poster campaign is bad…viz @Pieces and Sunshine’s is quite invigorating. So let’s presume you were always part of a well meaning brigade; as you are now!

    Having said that, this is what informs on de ole man’s perspective per my dim understanding of the Holy Bible or any Tome which one uses to direct one’s life

    I recall, and leep frontal, the words of one Alberto’s Pieters who wrote ” none of these schools of interpretation can claim any monopoly on scholarship and faith”

    “Each group numbers many fine scholars and devout Christian believers. Therefore complete certainty in regard to the interpretation of the Apocalypse [and the ole man adds “and passage in the Bible”] is not to be had.”

    “It is our duty to do the best that we can, to study the various systems and accept the view that seems to us right, BUT ALWAYS WITH A CERTAIN AMOUNT OF RESERVATION (my caps) and of respect for the opinions of others” The Lamb, The Woman and The Dragon.

    Imagine dat!!

    De irony and hypocrisy of it all!!

    Here de ole man speaketh of “respect for the opinion of others” yet he doth treat Dompey with such scant accord!!

    Dear Dr. GP,

    I am NOT, I AM NOT one of those people who have not read the Bible through.

    I would however say that

    (a) having read it through I am one of those to whom it was asked “understandeth thou what thou readeth”

    The point about the 4 is not to say one is right or one is wrong but moreso to underscore the fact that there are as many interpretations as they are badword parts.

    What my point of nexus was moreso to say that one MUST, especially with the Holy Bible, while we do not agree with the opinions of others, employ the same practice as he who wrote the Epistles and those that sought to encourage the brethren and sisters at the 7 Churches over 2,000 years ago.

    Nothing has changed my goodly Doctor, there are still those who are firmly grounded NOT ONLY IN THE READING OF THE WORD, but in its UNDERSTANDING and moreso to the point, IN LIVING IT.

    All that prose that you espouse per all of Timothy’s commands amount to nought and is truly nullified when you consider this passage spoken by Jesus the Christ and not one of his subordinates

    “And other sheep I have, which are not of this fold: them also I must bring, and they shall hear my voice; and there shall be one fold, and one shepherd…”

    How then can you propose that reading the Bible is a prequisite for “knowing” GOD if, as per the Master’s own words, such sheep of another fold, MAY NOT EVER HAVE READ THE GOOD BOOK??

    In some jurisdictions other than Caribbean islands ran by ‘god’, political ‘re-retribution’ can be a ‘itch, even for powerful legal officers:

    “A judge has sentenced former Pennsylvania Attorney General Kathleen Kane to 10 to 23 months in prison for committing multiple felonies stemming from a politically motivated act of retribution. Kane, who was convicted in August of perjury and obstruction, also will be on probation for eight years following her jail time…”

    Unlike Hillary she got nailed for bold faced lying!

    The recent exposures in the Killary/Chump contest to our north has made us very aware of the fact that one’s past and secrets WILL COME BACK TO HAUNT US.

    One thing that is noted is that there was no “intimation” of Trump’s video suggesting that one grab at the pokkerts, it was released.

    Personally, I find that while I am mindful that all of us got skeletons in our closets to be wary of, you style of prosecution, half way statements and innuendos tend to leave me with a few thoughts.

    1.That you are both knowledgeable of these people’s sins BUT MORESO you are complicit in them FOR HOW ELSE COULD IT BE that you can hint at Come-Sing-A-Song’s, his wife and Ernest Jackman’s less than honourable character, yet as with your usual prose, jes lef um dere?

    2.I myself love Dr. GP.

    He is a very serious Blogger here.

    He tells you like it is.

    Even if your are the Honourable Blogmaster.

    And when shyt##e going down that man does come out guns blazing!! PPKs pun semi !!

    And if you are a man like Carl Moore or Carson C Cadogan (whom I am reliably informed is Michael Lashley) one only has to wait and watch dem scatter for the hills

    3.You are a lawyer so I will explain the issue of defamation and Barbados Underground for you from an IP address point of view.

    Facebook logins presume that the party blogging is the party defaming UNLESS proven otherwise e.g. your password has been stolen like as what occurred with its owner Zukenberg

    Barbados Underground is a blog WHICH DOES NOT AUTHENTICATE/VERIFY the Email of record.

    So if you create a false email and then log in on Barbados Underground, without that intermediary step of email verification you can say that you are me and vice versa.


    This is why this government, or the last government or the one before or the one coming CANNOT SUE A MAN JACK FOR DEFAMATION OF CHARACTER because there is nothing, at least not yet, to tie the post to the postee for want of a better word.

    You need a VPN something free that anonymizes your IP at source and, AS LONG AS YOU CAN PERIODICALLY LOG OFF, AND MAKE A CHANGE TO YOUR USER NAME, nom de plume etc, the Computer Misuse Act of 2005 is a waste foop law

    So tell be ole man why you feel dat Come Sing A Song is a fraud?

    A public health issue. It’s unlikely that a challenge by way of judicial review would be successful even though well intended.

    The measure is temporary.

    Was the SSA in a position to service the entire island?
    Did the use of these private contractors improve the garbage collection process and by extension the “public health ” position?
    Is the “profit” of a ridiculous amount to have the effect of the “fatted calf” syndrome thus being used as an enabler for “kickbacks”?

    Answer these and a few more… Then decide whether a court case makes sense other than political sense!!

    Mr. Comissiong I am among the few Bajans who can see the wisdom in what you are accustomed writing and the things you do stand for Re. this Barbados, and I vow to stand beside you as such to correct the wrong meted out to us.

    Most of your learned attorney friends seem to be among the worst fibsters and will not side with you because they have friends in high places and not enough iron balls to look into their friends faces.

    We can safely ignore the Nation News when it comes to publishing many things that has real bearing on news or articles of importance about this Island. Seems they are afraid of their shadows and would prefer rainy days. No shadows.

    There is the possibility you just might have to deal with the water coming from Suriname on barges coming to Barbados for consumption by us Bajans.

    Keep hammering awaY at the injustices that we have to endure daily..

    Why is it okay for a Presidential candidate to not publish (file) his Income Taxx return, and also not pay income tax for many many years.
    To be specific, with respect to your question, I do not say it is okay for the annual financial statements not to be filed. It is preferable, but I cannot pass judgement on the NIS because I do not know what the causes are. I refuse to attribute nefarious intent to this failure. My point is that I refuse to allow that to prevent me from doing what I can to help my country. Purchasing bonds will help and as a consequence I will continue to buy them.

    Did the SSA take the opportunity to weigh refuse delivered by private haulers during this exercise, in order to calculate the effective cost per ton for having this emergency service provided, and if so, how did the various contractors’ cost compare with the in house figure? Such exercise might form a basis of future contracts being negotiated to have green waste and recycling picked up separately, easing the strain and improving refuse collection.
    Is SBRC still receiving payment for 1000 tons per day even though receiving substantially less waste due to the tipping fee being instituted? What can be done to break this neck-hold?
    When will the public see fit to support efforts at improving transparency, accountability and true democratic governance?
