Philip_NichllsIt would be disingenuous of BU not to have read Philip Nicholls’s book More Binding Than Marriage and to provide unvarnished feedback. Nicholl’s has revealed enough about the Barbados Court System, Director of Public Prosecutions Charles Leacock, former partners Allan Watson and Joyce Griffith, Disciplinary Committee, lawyers in the system and much more to be sued if true. It is a damning indictment of the system by a former insider. Also his animosity towards Vernon Smith QC, Barry Gale QC and Charles Leacock merits special mention.

The quiet from traditional media is not surprising.

BU respects the intellectual property of Nicholls, however we posted six pages to give members of the BU family who have not yet purchased some insight to three issues among several raised by Nicholls.

Pages 82 and 83 – Nicholls shares his view as a former President of the about the Disciplinary Committee. He brands it a toothless tiger.

Pages 114 and 115 – Nicholls describes Barbados Court as a ‘total mess’.

Pages 129 and 130 – He decides to leave DPP Charles Leacock to God

  1. Former Prime minister the Hon. Errol W. Barrow pleaded with black people to keep out of the Law Courts. My father in law was a “lodge man” and told me do not look for justice there.
    Enough said.

Is it not a disgrace that in a society, that professes to be christian and intelligent, one can be sued for telling the truth, while the criminals in the justice system and their friends and business partners commit all manner of crimes against the people and roam freely and continue to run around trying to sue everyone for telling the truth.

What the hell is wrong with that picture and why is this present government not getting rid of DPP Charles Leacock. I did not know DPP was a taxpayer funded post for life for one person.

The supreme court system should have been exposed decades ago to start the necessary changes, instead it was left alone in corruption and disarray to generate thousands of helpless victims, no one wanted to change anything, they were all too greedy and self-serving, slimy politics was the order of the day and no one wanted to rock the boat to get rid of the demons occupying the justice system…….so here they are…….hope they are proud of themselves now that everyone from coast to coast knows and are being warned about all of them on the island.

  5. This book has cast light in the darkness that occupies the legal and judicial systems, archaic and crying out to be brought into the 21st century. One of its hindrances is the fact that lawyers now abound in Barbados and abound in the parliament among whom are the biggest crooks, thieves, liars and scumbags,so,don’t expect change in our laws too soon.An ineffective system that can allow an uncertified madman to so flout its precepts and principles of what was intended to be proper Justice, and for the head of that system to say to an aggrieved counsellor…..go to your tormentor’s court to be heard…..is nothing short of betrayal and a classic example of passing the buck.Chuk the judicial officers who masquerade the profession. They are worthless, more st home on Mt Stinkeroo, where they truly belong.

  6. One of the dangers of opening the floodgates of access to higher education is that among the bright and needy deprived, are the low life scumbags who have no sense of decency in their interaction with John public. So one encounters the likes of Leacock whom attorney Cheltenham once described in court as a cane cutter from Guyana. It is also known that Leacock appeared in court as DPP Barbados but holding a brief for the US government in a case involving extradition of 3 persons and was called out by attorney Hal Gollop for this treachery and was forced to withdraw.

  7. What BU found to be disappointing is the inability (refusal? ) of Sir Henry to mediate this matter.

  8. We all know that the judiciary is dysfunctional and why.

Staff is selected by qualification, only the very brightest work there – and earth is flat 😉

Oh me oh my@David…I have not bought the book (yet?) so your postings are very useful.

I was transformed back to his days as Secretary of the BCA and those annual meetings where my impressions of Mr Vernon Smith as a supercilious, arrogant son of mother were formed. Interesting now to see that Mr Nicholls was not necessarily over awed by him then…or was he!!!

Also quite interesting to me is Mr Nicholls’ telling comment of being the first person of colour elected President at Pickwick. I do not know the man personally but I wonder if this is just a wonderful turn of phrase in keeping with his excellent command of the spoken/written word or if its a strongly held precept of the life and times in Barbados.

As a member of Barbados 1% and being so for most of his youth and adulthood I wonder at the depth of the statement. So very interesting comment from him on race and Barbados!

But to top it all off was his comment re Charles Leacock to wit ‘you often reap what you sow’.
No truer words have been said.

Nicholls came through the system, he saw and used it to his benefit. He conquered it. He now reaps what he sowed.

He can yet be a hero for his country. Use all his contacts international & local, persuasive power of his father and others, his own power and knowledge to be a ‘whistle blower’ who gets the changes needed to right our listing legal ship.

That should be the legacy left by the man who embraces his position as the first person of colour to Preside at the Pickwick Club. Greatness can be thrust on us in strange ways….

But is he up for that very hard, long fight or is this book really about improving finances and settling scores?

    Oh me oh my….

  10. The people get the lawyer/politicians they vote for. Why can’t we reform the legal system by allowing the chambers to compete through advertising; by creating new disciplines of conveyancers, welfare advocates, allow non-lawyers to appear in tribunals, etc.
We allow unqualified police to appear in the magistrates courts, why not other civilians? Bring in consultants o sort out the back in the civil and criminal courts; remove road traffic cases from the courts, unless some one has been injured or reported for speeding. Leave the crooked insurance companies to sort out routine accidents.
Put an age limit on allowing lawyers to practise. Five year beyond the state retirement age is a good point.
And, finally, years ago pubic servants who allow membership of other organisations to interfere with their duties became an offence in Britain. Why not Barbados.

  11. I was not the least surprised that Sir did what Nicholls said.I have good information on some data in which the individual now deceased was taken for a ride and will perhaps receive her pennies in the ‘sweet by and by’.Hearing it from the horses mouth was not only incredulous but the irony was her other half was a big up in the RBPF.

  12. Anther takeaway from the book is the influence Nicholls believe was exerted in the police investigators. Frightening!

  13. It is known that the Governor General was a Public Prosecutor and was notorious for intervening in criminal cases over which he presided. It is abroad that he had more overturned verdicts at Appeal than most other judges and was the object of derision by counsel at the bar for interfering with the process. There was a notorious criminal from the same district of Boscobelle who delighted in insulting this high court judge, who in the vernacular used to give the judge a lot ‘o sauce and for which he was appropriately dealt with.It was the opinion of onlookers that the judge was aiding prosecutor Leacock to ask pertinent questions as Leacock was seen as his protege.

  14. Read between the lines to determine why Nicholls had his US visa revoked without his knowledge.Read between the lines to guess who among our judicial officers of note are regulars at embassy functions and who with one phone call can wreak havoc on a man’s ability to live.As Nicholls said …what you respect you sow…Karma

  15. Why the money laundering charge? Where is the logic.

  16. ……what you sow,you reap

  17. Nicholls suggests that Leacock’s interpretation is if you are criminally accused of stealing large sums of money,it follows that disposal of those funds would be tantamount to laundering. The big question is who stole the money and why did the accuser who had the real thief working out of his own chambers not bring the real thief to justice. Why scapegoat Nicholls.

  18. Well Well & Consequences Avatar

Gabriel…the beauty of the US Embassy, they also reserve the right to revoke the US visas of their snitches……all these title holders are now seen for what they really are, people who believed they arrived and can step on and kick down the same taxpayers who paid for their education and subsequently pay their salaries.

Again I ask……why is Charles Leacock still DPP on the island, I had reason to stand close to this dude a decade ago and he crawled my skin, same reaction I got from standing too close to David Simmons, former Chief Justice……now I know my instincts were right….these types of white collar criminals have ruined the island’s reputation…..get rid of Leacock.

PM Stuart with a straight face is spouting about human trafficking on the island, they all know the culprits’ identities, get rid of Leacock or there will never be any justice on the island for victims of human trafficking….he will never lock up his golfing partners.

Nicholls should be given a medal, despite him being ruined which prompted these revelations.

The players in his book are very dangerous to the welfare and wellbeing of the public.

  19. If you follow Nicholls and accept what he is saying, Leacock would have been aware of the issue of over drawings by the partners and all that flowed from it.

This matter of collusion and depravity within the judicial system WILL NOT GO AWAY and, as revealing as Philip Nicholl’s revelations are, speak to what is a toothless defendant for a horde of ravaging jackals.

As I get older and these grains of glass expire in the inverted triangle of my fast emptying hour glass, as if by some sort of epiphany, I come to see solutions much easier.

We need an improvement on the “lawyers in the News Section of this Website.

An Online Ombudsman for John Public to police the legal fraternity in a way that will remove the impotence of all the agencies that he Nicholls speaks about in his book.

    That solution will

    (a) permit the upload of the name, address, and pertinent details of every single lawyer in Bulbados.

    (b) Allow Bajans who are the clients of these lawyers input experiences with said lawyers just like the Craig’s List.

    (c) allow users to conduct a search of the Lawyers in Barbados Registry to review remarks and make decisions regarding whether to use the lawyers services

    (d) The Reality of said system is that it has two possible outcomes. It can become the Naked Departure nightmare for these lawyers OR effect a better business bureau for those who will stick by rules and be ethical. The system is its own self policing mechanism, IF YOU TREAT CLIENTS GOOD.

IT WILL GIVE YOU A GOOD STUDENT REPORT CARD, but if you are a tif, you will get bad marks.

    (e) like Naked Departure AND Barbados Underground, host it in a foreign jurisdiction so that local authorities CANNOT bring lawsuits against the platform in a willy nilly fashion.

My grandson at the *** Bank, tells me that it is still a grey area to determine WHERE THE CRIME OF SAY DEFAMATION IS COMMITTED when the poster is behind a VPN that is in Romania.

Any UWI student can use Microsoft access database and a Search box that allows users to search for a lawyer’s rating by name, area of expertise, efficiency with his/her cases, litigation pending agains said “ potential tif” etc. He says that ASP script is best used to develop this project.

WE THE PEOPLE HAVE TO STOP PLAYING THIS BY THEIR RULES WE HAVE TO USE THE TECHNOLOGY TO BE THEIR SCOURGE AS THEY CONTINUE TO RELENTLESS BE OURS.

The motto of that online tool’s website could be “Keeping Teives Honest when the Judicial Systems, The Director of Public Prosecutions, The Royal Barbados Police Force CANNOT (as in dont want to)

I am thinking of a tune for the site that will be sung to the tune of “Bringing in the Sheaves” aptly retitled “Reeling in the Thieves”.

I wonder if Philip Nicholls might be disposed to help refine that platform.

Certainly if he were truly devoted to what he is suggesting his book is supposed to be, a reality, he might be disposed to funding this platform.

Tell him send you $25,000 from the proceeds of his $69 exposee and I am positive that me grandson would make that tool available as a bolton to the Lawyers in the News segment in about 6 weeks.

Of course what i have also noticed is that Bajans love to talk big about dem doggie size but as soon as they are tasked with doing it, they baulk at action.

Massah trained us dogs well don’t you agree?

@David, a brief lunch time munch…the tales told by Nicholls casts grave concerns on the behaviour of our legal fraternity and as you noted above it’s frightening to imagine how criminal (and too civil ) cases were compromised by judicial or attorney ‘unethical’ behaviour.

There was a recent case in the US which highlights such ethics. Interestingly, in my mind it has loud echoes of a former AG who as I recall said ‘ I gine get one’ re a hanging conviction and who later went to the judiciary. So I caution all those with the regular refrain…well that can’t happen here and dis US stuff is not relevant!

The basic details (all can Google for more: YOU GET DAT AC!!!!) are: The Supreme Court is asked to adjudicate whether a judge (Ron Castille) violated the Constitution when he ruled in a death penalty case in which he was involved with as a prosecutor and thus by refusing to recuse himself, denied the defendant a fair hearing.

On first blush one says…WT Frig but of course he can’t do that.

But alas, there is an almost 30 year time lapse here.

As the district attorney (our DPP basically) he personally authorized seeking the death penalty in the case, and would later tout his firm stance as a death penalty advocate as he sought higher office. So many years later when the man whom he had sought to execute (he was 18 years and this was his second killing) had a stay and an appeal of his case, this DA was by then the Chief Judge and he REFUSED to recuse himself.

Surprise, surprise his six-justice court reinstated the death penalty by a unanimous vote.

So it can be argued his influence was minimal as all his colleagues were in agreement….Practical people would say just the opposite…as Chief Judge his influence was overwhelming.

In BIM conflict/interference, grossly unethical and even illegal issues like this and those beyond this abound no doubt. I suspect the peer influence is just as significant.

Unfortunately, it takes a wounded and aggrieved lawyer to write tell all books before these matters can be told far less even actually properly interrogated.

As was said….What they sow so shall we (and they) all reap!

    Awesome video.

We got a long way to, bit this video is a good start

  24. I remembered some time in the late ’70s Errol Barrow speaking at a political meeting, he said that as an attorney, one of the tricks the police in Barbados used in getting supposedly confessions from the accused to stand up in court, was that the cops who beat the shit out of the accuse wasn’t the one to take the oral “confession’.” Thus, when asked by the judge if the cop now giving evidence coerced him, obviously no was the answer. As prime minister did he try to change the way things were done, obviously not. I’m sure he saw many things that were wrong with the judiciary here in Barbados… then we had the degenerate Tom Adams and others from both parties.
Its no wonder Barrow admonished us to stay away from Coleridge street

I certainly have always viewed skin colour in much the same way as you say.

However, while many of us appreciate this approach there are far more who want to banish anyone too light. This starts from the TOP in Bim these days with MPs and I assure you from my contacts in inner circles that get Whitey is high on the Agenda. It may be valid in certain specific cases of virulent white racists, BUT as PVN says clearly they were Whiteys that helped and mentored him.

It is ironic that those darker racists that pop up on this site fail to appreciate that situations like this case occur where Darker people are attempting to destroy other Dark people or where so called leaders are pocketing the peoples money in large quantities.

The money laundering charge is as “logical” as it is “illogical” since it is meant to be “sticky” and to achieve an objective which is to so tarnish the reputation of the person who is to be destroyed in all realms of endeavour and that is the objective.

Vivianne Gittens was enjoined in the Sankey Price matter not because she had uttered the lascivious pictures that Sankey slipped into the Nation Newspaper on the night that Morris left that idiot, (Sankey not Vivianne) with the keys, but to do maximum damage and to be disruptive and to have a constant sword of Damacles over the shoulder of the news agency of the Barbados Labour Party.

Again I cite the Polonium that was administered to the Russian spy to underscore my point that, we do not just kill our enemy, we use the machinery of radioactive poising and the mechanisms of our court to so discredit you in the eyes of the parties that you interact with, that it becomes tantamount to killing you by “long suffering” instead of “sudden death”

What would be the purpose to have a court case in 1 month like Noel Lynch accomplished in his successful litigation against the Nation when you can stretch it out for 3 or four years and destroy the man who would seek to point out the travesties of the legal profession?

The VietCong were good at this psychological terror with captured American soldiers when they would tie you and slit your stomach, and pull you long intestines out and put it high above the victims and let them cry out in the pain of deaths so that their buddies would also suffer as they heard their comrades die.

Since Mr. Nicholls problems began with money, specifically business partners stealing from the partnership, I was left to wonder how without annual audits the partners and the firm could file income tax returns? Nor was he the first to experience this at CC, he references a former partner, whom I believe can be found frequently today on the golf courses of S.Florida, after serving as CJ.
The ‘firm’ had terrible accounting practices, with the Kingsland chapter highlighting them. He also writes (p428) “The $30 a share purchase price has been hotly debated since then as it to whether it was fair market value, and I cannot remember much of what was discussed then and how it was discussed to arrive at the recommendation.” How many years was Mr.N a director and worked on this file? It seems he can remember a lot else?
However, again, this is a “business matter”, which seems to be Mr.N’s weakness.
His entire arrest, and subsequent failure by the prosecution to present a case “smells”. I was left baffled, beyond his father’s explanation in the Forward, to understand where the money laundering charges stemmed from.
The ‘remedies’ available concerned me. His partners are found guilty, yet the partnership is not reimbursed, nor assets they held liquidated? [they were hidden in companies?] This is when mafia style tactics garner my full respect.
A tough read. I suspect the author is disorganized, for the flow wasn’t always clear to me. I was left with the feeling that system checks and balances are missing across a wide swath of Barbadian life.

POW-ER-FULLLL, Mr Vincent. Great video dat! A wonderful collection of ‘cars’. Great message.

As said above and brought home again today with a ‘lil’ incident up there there in Seattle wid a famous NFL player…we can have a heart of gold, but when judged by our outer appearance we are often seen as nothing no more than a load of lead!

re the topic of money laundering…I have NOT read the book but I really don’t see why if a prosecutor is out to get his man and the charge is theft of a large sum of money why it’s not absolutely plausible to bring a case of money laundering. Particularly when that opens the door to more and serious sanctions than the basic underlying theft charge.

“Money laundering is the generic term used to describe the process by which criminals disguise the original ownership and control of the proceeds … by making such proceeds appear to have derived from a legitimate source.”

So if monetary theft is alleged this basic definition would fit nicely as an indictable crime, I suspect.

David, you must educate me here. According to practice and logic where does reading his book supplant the public charge that was brought against the man and which as I recall you have displayed on your lawyer’s page.

I made a very simpl link between money laundering and that charge. It seems logical to me.

I am not debating whether its ethical, reasonable or whether the charge of theft was inappropriately and unjustly lodged.

I am making an assessment based on the international construct re money laundering charges.

Surely he wasn’t charged with stealing $50 or $500. On the basis of his charge money laundering is a perfect further indictment…like it or lump it, shrewd prosecutors – honest or not – do go after their targets with ‘innovative’ methods.

Remember what you said earlier today: ” In fact those of us who critique activities in our space of life do so out of a love for country. ”

You also said: “These 30 people in the House of Assembly are not blessed with any unique ability that we should resign to all their decisions.”

So let me paraphrase: learned and well-connected attorneys like Mr Nicholls are not absolved from their own missteps because they write tell-all books!!!

A spade is still a spade until otherwise shown to be a King of Hearts! Ok, bro!

……if memory serves the hierarchical order in Bim was absentee landlords,Planter/owner on site,manager,bookkeeper/cane weigher,overseers/engineers,chemists/wheelwright these are roughly the free english ones who would come and go,not many of these still here.

….then you would have field superintendent/mill supervisors and general workers these would be indentured and could overlap sometimes at the bottom with the previous set, loads of these still here catching their royal.

……from the general workers would come villages such Zoares,Glenburnie,Chalky Mount to name a few, some of these to this day maintain a tribal purity with interbreeding being the norm and have never risen above the poverty level.

You also correctly identified the bajan trait of ascribing whiteness to individuals who would readily admit that their Grandmother was a black women.

What makes Nicholls’ book so believeable apart from many of us knowing about all the thefts by too many titled individuals in the supreme court, which started way back in 1964, is that the dude was at one time president of the bar association, you do not get more inside than that in an organization. You do not get more upclose and personal than that……anywhere. I am sure thete is more he can tell, mif he wanted.

What is even more frightening is that though I heard for many decades about the thefts re land perpetrated by these titled people, nothing could prepare you for the matters with claim numbers attached, still rolling throw the supreme court from 1964, many of these titled crooks are dead, left destruction in their wake and started the collusion and stealing while still studying law in England, before even graduating, the6 attached their names to fraudulent transactions before they passed the bar……disgusting as it sounds, these lowlifes’ sole intent upon finishing law school in 1964, was to return to the island with their new knowledge of law, enrich themselves by any means present atvthe time and destroy their own people by any means possible, how nasty and horrific.

Some of these well known beasts are still alive and have mentored other lawyers, passing on the same evil practices.

Or it is that the book is saying that these actions were so pervasive across our entire judicial legal process that there is no ability for one person to seek to redress or fix.
