Is DPP Charles Leacock on the Golf Course While An Innocent Man Awaits JUSTICE?

BU continues to follow the story – Rapists, Commissioner Darwin Dottin and the Integrity of the Evidence – of a poor Black man accused of raping two English visitors to Barbados. That the story has taken an interesting twist must be termed an understatement. Last week in an unusual occurrence for Court systems around the world, the two women raped appeared in open Court to argue that the man Commissioner Darwin Dottin says there is incontrovertible evidence they believe to be innocent.

To update this matter from the Barbados Court: the case has been adjourned until December 13, 2012 to await direction from the Director of Public Prosecutions (DPP) Charles Leacock. BU sincerely expects that given the extraordinary harm this story is having and will continue to have on the reputation of Barbados and its people, that decision makers are giving this matter their urgent attention. BU would be very disappointed to learn that DPP Charles Leacock has continued his weekend routine of being on the golf course at Sandy Lane or Westmorland when his urgent feedback is required to resolve this matter. Why the hell did the Magistrate feel compel to adjourn this matter until the 13 December 2012?

To those who believe it is not an urgent matter, a scan of the widely circulated UK press The Telegraph shows its lead story in the World Section as – How two British women raped in Barbados declared their ‘attacker’ innocent. The story is currently listed in the newspaper’s Top Ten most read stories.

BU has been relentless in exposing the inefficiency of the judicial system which continues to negatively impact our international business sector. Here is another example where commonsense should have dictated that the DPP, the Attorney General and perhaps the Prime Minister should have acted with alacrity to resolve this matter. Instead they have allowed this matter to gain traction in the international media.  It was widely publicised BEFORE the women arrived from England to attend Court what they were going to testify therefore ALL (DPP et al) should have ANTICIPATED how dispense swift justice given the national importance of doing so..

  1. When will you get it into your head that most of our magistrates are a pack of little sissies with no balls, backbone or intelligence?
    This is the job you take if you are unable to make money in private practice like Amused.
    When they balls up the magistrates court (and if they play their cards right…especially is there are supporting assets,) they get promoted to balls up the high court or the registry.

    Everyone is waiting for someone else to do something because no one wants to risk their behind. It is call CYA.


  2. @Bushie. High time all attorneys in Barbados applied for jobs as magistrates. BECAUSE, times are really hard for them financially. WHY? because they cannot get their cases heard before the courts because no one has the balls to fire the Registrar and the CJ is too damned busy just talking.

    But, you are right. For Barbados alone, I adapt the old adage to, “Those who can, do. Those who can’t, teach – OR BECOME MEMBERS OF THE JUDICIARY!”

    I mean, this was not a difficult matter to deal with. Respect and dignity for the victims would have been a great start. And don’t tell me that Dotty and Fumble and Adriel didn’t have the time to meet with these ladies and express their concern and distress at what had happened to them and even place at their disposal any assistance they were able to and Leacock might have offered to at least take them golfing. They are visitors – without readily available family support. What would it have cost to offer them the support of the country in which they were assaulted?


  3. Why has the case has been adjourned until Dec 13? There is either a case to answer or there is not. Where is the attorney general? It does not take a remand of about three weeks to realise the weakness of the prosecution case.
    The attorney general has the authority to take over the case and withdraw the charges.
    On the other hand, the defendant’s attorney can put a no case to answer petition to the magistrate and she can either agree, or order a trial.
    At present the defendant has an apparent case of wrongful arrest, false charges, infringement of human rights and, depending, reputational damage.
    It is but further evidence that the nonsense that our legal and legislative systems are based on the Westminster/Whitehall, common law systems are rather thin.

      St. Lucia police say they have arrested a man who killed a P.E.I. senior who was visiting the island last week.

      Colin Peter, 75, was walking along the beach with his wife Gwen last Thursday afternoon when he was attacked, St. Lucia police spokeswoman Aniel Innocent said Wednesday.

      The Guernsey Cove was taken to hospital where he later died. His wife was not injured.

      Clinton Reynolds of St Lucia’s news channel DBS TV told CBC that Peter’s attacker did not resist arrest, confessed to the crime and that he is expected to be formally charged with the murder early this week.
      DBS TV had reported Peter and Gwen were on the island tracing his family roots and staying at a private residence.

      The Peter’s three children flew to St. Lucia Saturday to join their mother and attend a private funeral.

  4. The legal and justice system in Barbados has now become the laughing stock of the Western democratic World. Imagine a country that foolishly boasts ad nauseam of having the best educational system in the world can come to such a sorry laughable state.
    But as they say free things are normally of poor quality and soon become valueless.

    There is now nowhere that Barbados can have set aside the charges laid in the Shanique Myrie case and at the same time giving stronger credence to the myriad of allegations of human rights abuse at the hands of the Bajan authorities. Neither can Barbados salvage its recent acquired reputation as a jingoistic anti-foreigner place to shun and avoid doing business with.

    As things stand right now this country is on a collision course with a social and economic destroying asteroid with the name Barbados written all over it. Only a drastic change in the administration of the country’s affair can nudge us away from imminent impact.

    BUT – someone please tell me:

    1. How did Mr C manage to have his photo taken topless with the two women?

    2. How did he manage to have an interview with them?

    3. Who is paying for his defence lawyer? One report says the two women, another a third woman – a past rape victim…and when rape is a legally aided offence.

    4. And what has Mr C’s attorney been doing for the past 18 months or so?

    5. What led the police to pick up Mr C in the first place? Someone has written that he says he was out of the island when the rapes occurred. Well if he was, that’s the end of it – and it should be a simple matter to determine whether he was..

Part of the really big problem in the judiciary is the all inclusive favors its members have been doing for each other for decades, the spillover comes wen it affects accuse who have no direct family connections. Leacock is very energetic wen locking up local blacks, have never seen him plead a case for an innocent one. We shall see the outcome on this one, the blackeye to the island can only get bigger.

  25. Let me start by saying that I am not referring to the incumbent: I am dealing with the appearance.

    For a civil servant in the legal profession in Barbados, the height of his career is to become a judge and better yet Chief Justice. In order to reach those pinnacles, that legal officer must meet the approval of the Prime Minister. A director of public prosecutions is not at the pinnacle of his career path and in order to do so, he must be careful not to incur the wrath of the PM. Even though the Constitution provides that the DPP is independent, that independence is somewhat diminished if he has to keep his eye on the PM’s favour if he is to advance.
    In order that the DPP is truly independent, he should be placed at a level where his salary and other conditions of service are equivalent to that of the Chief Justice. The political directorate would therefore not have anything to hold over a DPP so he could be truly independent and not be looking over his shoulder at the PM. Also the job of recommending appointment to the post of CJ, Judge and DPP should be taken out of the hands of the PM and given to an independent commission.

    The DPP’s job is to lead public prosecutions.
    While part of the job is to review cases to see that there is sufficient evidence to get a conviction, I am not sure there are many opportunities for him to plead a case for an innocent person.
    If that means he is seen as “energetic w(h)en locking up local blacks” I would say he is doing his job well.

    As usual you miss the point and react without thought.

    The DPP has an awesome responsibility with far more power attached to it than the Chief Justice. If you were to commit a crime and the matter were going through the courts, the DPP could discontinue the matter without reference to anyone. If there is an impediment that could prevent him from being independent: it should be removed. One of those impediments is that he can still seek promotion, salary wise, and the only person that could prevent him from attaining that salary is the PM. The DPP has more responsibility than a judge but is paid less: if he is looking to receive more salary, he could be tempted to look the other way if the PM requires it. All I am saying is make him truly independent.

    Dear David: Even thoug I am sorry to hear that this guy in in jail if he did not rape anybody. I don’t think that a 3 week adjournment to study the case is unreasonable.

    And David please give middle aged people in highly stressful jobs a break.

    Look in today’s paper and tell me how many DEAD people between the age of 45 and 65 you see in there.

    A DPP who takes no recreation and no weekends off and who drops down dead from a heart attack or a stroke is of no use to anybody.

    I had a little beach time today, no doubt some people had a littl golf time, or football time or rumshop lime time. Does that make us a bad employees?

You know, what we need here is for the PM to convene a COI under Frederick Waterman, so the Waterman can write a report saying that the rape victims were hallucinating during the rape and did not recognise their rapist. Then, in a reversal of his unpopular position on pitching marbles, Waterman can state that T shirt shopping was completely in order and he can absolve the “woman” officer of insensitivity and claim that she is NOT a complete moron, as we all think, but akin to Einstein. Then, after his report is published, he can stand back in amazement as the people most affected by it stage a series of protests and lampoon him variously as “Waterman the Wa*ker” or “Freddie the Fa*t”. And it will be a mere snip for the taxpayer at $600,000, especially when the taxpayer has to cough up several tens of millions to cover the resulting shortfall in tourism. And Dotty can carry on smartly with his fit of pique because the rape victims had the nerve and gall to expose him to the same ridicule he enjoys locally, internationally.

  50. I am bemused that a highbrow would respond to the “yapping of little dogs” and ignore the big dog that dispatched Mia with undue haste as leader of the den. The “big dog” that remarked that he gave her everything in politics including the opportunity to succeed him as leader but found her not to be up to the task.
    I made a point that the then Gov’t led by the “big dog” protected her from any fallout from Glendairy by ensuring that she wouldn’t have to testify at the Commission of Inquiry and we are informed that “only morons could possibly think that Mia is not the most respected stateswoman and politician in the country”

  54. Barbados will soon be in need of a new commissioner of police. There is a widespread belief that the commissioner has to be a gazetted officer. Nonsense. A commissioner is basically a chief executive and any good manager who, in the wisdom of the appointments commission, suits the bill, can be appointed coimissioner.
    I suggest that the Attorney General and the search party look far and wide for a replacement, rather than the small and limited pool of senior officers.
    How about someone trained in criminology and management, a lawyer, someone from business? Look overseas and offer a two or three year contract to a suitable candidate.
    He should not limit himself.
