An apparent misanthrope, of a twisted mind and hell-bent on taking as many people as possible with him as he shuffles off this mortal coil, fortified by a bizarre official interpretation of a Constitutional amendment that ostensibly relates to a collective entitlement but that has been construed as permitting any lunatic with enough wherewithal to arm himself to the teeth with high powered weaponry, sends his girlfriend home to the land of her birth, rents a luxury hotel suite overlooking a concert venue in Las Vegas and proceeds to murder no fewer than 58 innocent souls assembled to enjoy the music, thereby giving the lie to the popular slogan that “what happens in Vegas stays in Vegas!”

The media will record that this abyssal conduct on his part was a new record for the most people ever murdered in a mass shooting in the US. The resultant “human cry”, as it is put in the Barbadian mondegreen, sounds like so much crocodile tears in a country that can place men on the Moon but that seemingly has not grasped the notion that permitting a near unlimited civic right to bear arms and thus to use them however might lead inexorably to these sorts of tragedies.

I have explored before in this space my own interpretation of the notorious Second Amendment that is utilized as the vehicle for this dubious and enabling right. According to the text of the provision;

A well regulated Militia, being necessary to the security of a free State, the right of the people to keep and bear Arms, shall not be infringed.”

 

Given that a militia does not comprise one individual solely, and given the primacy accorded that body in the structure of the text, one might very well be tempted to read the amendment as empowering the people to keep and bear arms purely for the purposes of forming the necessary well-regulated militia for protecting the security and freedom of the state. This, however, has not been the construction that has found favour with the Supreme Court charged with the overarching interpretation of the Constitution.

In its 2008 decision in District of Columbia v Heller, the Court, by a five to four majority, iterated that the Amendment protected an individual right to possess a firearm unconnected with service in a militia and to use that arm for traditionally lawful purposes such as self-defence. Further, they held that the prefatory clause in the Amendment that I rely on in my argument to control its spirit does not in fact limit or expand the second part whose text and history connotes an individual right to keep and bear arms.

The justices also made reference to the amendment’s legislative history, noting that it was the product of a response to the fears of the anti-federalists that Federal Government would disarm the militia in favour of a standing army or a select Federal militia. The Second Amendment was thus enacted to deny Congress the power to abridge the “ancient“ right of the people to keep and bear arms so that the ideal of a citizens’ militia would be preserved.

Moreover, although it did not form part of the ratio of the decision, the Court noted that at least three (3) states’ proposals had referred unequivocally to the individual and not merely collective right. The law seems to be settled given that the Supreme Court is at the apex of the system, unless a future Court ids minded to overrule this precedent.

As distasteful as it may be, the media have made much of the record number of those killed, a record that is likely to be inevitably broken so long as the status quo continues. An instructive WhatsApp post in one group last week, explored the illogic behind the individual right to bear arms whereby a youngster, thirteen years of age, is appropriately unable to purchase alcohol, cigarettes or adult magazines, but is nonetheless able to secure the supply from a dealer of a high-powered firearm intended for the sole purpose of ending a life, even if not necessarily that of a human being.

Veteran Congressman Steve Israel, in an op-ed piece in the New York Times last Monday, also addresses the issue of the likelihood of a reprise of the Las Vegas massacres. He puts it bluntly, “ In the wake of one of the deadliest mass shootings in our nation’s history, perhaps the most asked question by Americans is, and “Will anything change?” The simple answer is no. The more vital question is, “Why not?”

Israel recounts his failed attempt as a freshman to introduce legislation to require safety locks on certain guns when he failed to gain the support of a fellow freshman Democrat who begged off on the ground that “In my district we close the schools on the first day of hunting season”.

He relates too his disappointment after the murder of 26 children and adults at the Sandy Hook Elementary School in 2012 and the image of President Obama with tears running down his cheeks. His thoughts that finally something would be done were dashed when the debate morphed into one over the rights of gun owners rather than the right to life of young schoolchildren. Some congressional colleagues, he writes, confided that any vote for gun safety would lower their NRA scores and increase the probability of their demise in the next election.

The identical scenario was to obtain after the mass shootings in the Orlando, Florida nightclub in June 2016 and the failure of a proposed amendment to prevent people on the terrorist watch list from purchasing firearms, opposed by the Republican chairman of the House Appropriations Committee on the basis that “in America, everyone is innocent until proven guilty.”

This principle is not peculiar to the US, but according to an October 2 article in the online newsmagazine Vox, there are 29.7 homicides by firearm per 1 million in the US people as compared to 1.4 in Australia and 1.6 in New Zealand, two jurisdictions that embrace the identical presumption.

Congressman Israel offers finally three reasons why nothing will change. First, he notes, the gun lobbies are now in a race to the bottom to see who can become more brazen and more extreme since more moderation means less market share. Second, the political right now adheres to the view that anything less than total subservience to the gun lobby is perceived as supporting gun confiscation, anathema to that sector. Third, there is the public inoculation to gun violence –“You’ll read this essay and others like it, and turn the page or click another link”, he writes presciently. You’ll watch or listen to the news and shake your head, then flip to another channel or another app. This horrific event will recede into our collective memory….”

Exactly what the gun lobby is counting on.

    The Obamacare birth control mandate now lies in tatters after President Trump announced new exemptions so broad that it is now basically unenforceable.

    Why he didn’t do this on his first day in office I don’t know. It should not have taken the new president nine months to deep-six this blatant violation of the First Amendment. But better late than never, I suppose.

    Not that this fight is over. As sure as the sun will rise tomorrow, the next Democratic president will reinstate the mandate. It will surely rear its ugly head again if we don’t put a stake through the heart of this un-American diktat. The logical solution seems to be a full repeal of Obamacare but apparently Republicans—who represent a majority in both houses of Congress!—can’t close that deal. Pathetic.

    Predictably, anti-theist groups are up in arms over the decision. This isn’t about birth control for them, you see, it’s about bringing religious people to heel. The goal is to sweep believers to the margins of society by forcing them to either bend a knee to the almighty state or give up their livelihoods. Their endgame is to render the Constitution’s free exercise clause a dead letter.

    As usual, the anti-theist groups have spun freedom on its head in order to portray liberation as oppression and vice versa. “Preserving religious freedom does not mean expanding the right to impose beliefs on others,” said Larry T. Decker of the Secular Coalition. “It means ensuring that all Americans have the right to make medical decisions without interference from anyone else’s religious or moral beliefs.”

    It takes a certain chutzpah to demand that your employer cover a raft of birth control methods while simultaneously insisting that he doesn’t have a say in your “medical decisions.” If Larry Decker and the organization he speaks for don’t want their bosses in their bedrooms I would suggest that they pay for their own damned birth control. That’s kind of the way it used to work before 2012, which wasn’t exactly the dark ages.

    Until Trump’s most recent executive order the cost of birth control was borne entirely by the employer. The whole point of the mandate was to ensure that women received birth control “with no out-of-pocket costs.” The insurance company certainly wasn’t picking up the tab so that means that the employer paid for the whole thing.

    This was not a case of politicians playing Santa Claus and giving away money from the public treasury, as they so often do. This was much worse. This was politicians demanding that someone else pay out of their own pocket for other people’s freebies. Doesn’t the person having his wallet lifted have the right to raise his voice in protest? Well, no. According to the Left, that would be imposing his morality on others.

    The only person being imposed upon by the Obamacare contraceptive mandate was the employer. Before it came into existence, all parties—the employee, the employer, and the insurance carrier—were frech to do as they wished. Many employers did cover birth control but it was their prerogative. Insurance companies were free to offer or not offer birth control. Employees were free to find another job or pay out of pocket. Rumor has it that a month’s worth of birth control pills costs nine whole dollars at Target! That’s pretty steep, I know.

    Whenever crybaby liberals can’t impose upon other people they claim that someone else is imposing upon them. For their benefit, I will provide a handy how-to guide for identifying who is imposing upon whom.

    It’s pretty simple. Every time a law is passed, consider what is being prohibited or mandated. Then look at whom the law is incumbent upon. That’s the person who can rightly claim an imposition. That does not mean that that imposition is always unwarranted but it does indicate whose liberty is being abridged. It’s sometimes necessary to think this through because liberals so often portray the one imposing as the one being imposed upon.

    The Obamacare birth control mandate is an excellent example. Mandates, by definition, force people to act against their will. Some religious employers oppose all forms of birth control, some oppose only those that dislodge a fertilized egg, and some have no problem at all providing birth control for married couples but don’t feel comfortable subsidizing the sex lives of their unmarried employees. The birth control mandate forced all of these employers to shut up and financially support what they considered immoral. All of the coercive force here was exerted on the employers.

    With the stroke of his pen, President Trump made that coercive force disappear. Now no one is imposing on anyone! Pretty cool, huh?

    Liberals intuitively understand this, I believe, even if they pretend they don’t. It’s in our American DNA to put a libertarian frame around our arguments: “I don’t care what you do as long as it doesn’t impose on me!” That formulation loses all meaning when the word “impose” is twisted to mean its exact opposite. What liberals really mean is “I don’t care what you do as long as I can continue to impose upon you!”

    If this construct were somehow turned against them they would surely understand that this isn’t a “live-and-let-live” attitude. For example, if someone were forcing them to pay for their employees’ guns they would say “Not on my dime!”—and they would be right.

    The contraceptive mandate’s poster girl, Sandra Fluke, offers a real life illustration. In 2012, Fluke testified before Congress about the difficulties of going through Georgetown law school without access to free (to her) birth control which was not covered by the university’s health care plan. Did she not know before matriculating that Georgetown is at least nominally Catholic? Apparently, she did know. According to a Washington Post article—which is not, as far as I can tell, an editorial though it reads like one—Fluke researched the school’s health plan before attending. “I decided I was absolutely not willing to compromise the quality of my education in exchange for my health care,” said Fluke.

    By “health care,” she didn’t mean real health care. She wasn’t asking for anything that would prevent or treat illness or injury. What she meant was that she was unwilling to compromise the quality of her education in exchange for her sex life.

    But Fluke was still completely free to get her freak on. That was not the issue. She could have a) bought her own birth control pills (which, again, cost about nine dollars for a month supply at Target) or b) chosen a different university. But that would have required her to make choices. She wanted it all and she wanted someone else to pay for it—in this case, the Catholic Church and its members. That makes her a very entitled brat.

    Let’s stop and ask ourselves who is imposing upon whom here. This woman could have gotten her pills elsewhere—and presumably did. Even so, she expected the government to shove its way into Georgetown, overrule Catholic doctrine, and force them to fund her sexcapades. For five years, that is exactly what the government did. The imposition here was entirely one-sided.

    Naturally, government coercion is occasionally necessary. All laws impose on someone and I’m not completely opposed to that; only an anarchist would be. Freedom should be abundant but it shouldn’t be unlimited. Even so, we shouldn’t allow ourselves to be bamboozled about who is being imposed upon in a given scenario. If the government is telling me that I have to shell out my money to buy someone else’s birth control—or guns, private school tuition, whatever—the government is imposing upon me. If the government stops forcing me to shell out my money, that does not mean that I am now imposing upon the person who is accustomed to getting free stuff at my expense. It means that the imposition has ended.

    The end of the birth control mandate—if this really is the end—is a national blessing. It does not mean that anyone is cramming his morality down anyone else’s throat. Quite the opposite. We are freer and better country without it.

    Appendicitis causes pain, fever, and vomiting. Taking medicines to ease the symptoms might provide temporary relief, but without addressing the cause, serious complications or even death will occur. To cure the disease, you must first know what it is that you are treating.

    The American health care system has some very serious symptoms. Costs are rising much faster than personal incomes, quickly becoming unaffordable to most. Serious diseases, like cancer, diabetes, heart disease, osteoporosis, and a raft of others, have been growing plagues for decades and getting worse. The average health of the people is not improving in proportion to the increase in cost, in fact it is not improving at all. The number of physicians per 10,000 people has grown about seventy percent since the 1970s, and administration to a much greater extent, so it is not a matter of care becoming more scarce.

    Over the last several decades, politicians at the federal and state levels have decided that health care is just too juicy an issue not to get their mitts into. Over that time, there has been law after law, regulation after regulation, and program after program to show that they are doing something. They are, however, looking at symptoms and not causes, because, in many cases, they are the cause. Many of the negative results we experience with the system are predictable results of their direct and indirect manipulation of health care markets and embedded incentives.

    The rules have not been written for the benefit of individuals whose health is at stake, but rather for the benefit of pharmaceutical companies, medical equipment manufacturers, insurance companies, and processed food makers. The Food and Drug Administration and the United States Department of Agriculture are among the agencies, federal and state, that have revolving door policies with the personnel of companies that they supposedly regulate, with foxes guarding the hen-house.

    There is little difference between the Republican version of Obamacare and the original. Nowhere does it address the cancer in the system. Corruption abounds, be it hard or soft. Lobbyists for corporations with vested interests heavily influence what goes into the laws. Nutrition recommendations from the government are heavily influenced by the processed food and drug industries, and those are accepted as gospel truth by the entire health network.

    Those same vested interests provide a significant portion of the revenue for most major health organizations. Thus, we have diabetes, heart disease and cancer organizations that endorse diets that promote diabetes, heart disease, and cancer, while also recommending every new, expensive treatment available. Your health is not their concern.

    It is understandable how the health and nutrition communities might have been more open to the new USDA diet recommendations in the 1970s, though the change certainly should have been treated with much more skepticism and actual science than it was. After several decades of watching health problems multiply with the new diet recommendations, however, and with the growing body of evidence demonstrating that it was wrong-headed dogma from the beginning, there is no excuse for Americans to accept it or to blindly accept advice from organizations corrupted by financial interests and expensive lobbying.

    America’s health care crisis is not a matter of too little health care. It is, in fact, a matter of much to much health care at the expense of actual health. The purpose of the health care system has become selling drugs, equipment, and services, not a healthy population.

    The disease of the health care system today is corruption, aided and abetted by public policy, which tends to limit true competition and market forces and enables abuse. Health care definitely needs an overhaul, but without treating the causes, the symptoms will persist and grow.

Hotel and food cost me about $500.

    Politicians / Govt here are spendthrift lefties and are trying to injure the DRs by cutting their incomes and raising the Taxes they pay. The DR I had “retired” from his practice at age 45 approx!!!! Many people in this province dont have a DR and must go to Emrg and line up for hours. Immigrant DRs are not permitted to practice!!!!! They drive Taxis! Most qualified/ educated cabbies on Earth! Took 2 yrs for my wife’s Rotator Cuff surgery as she correctly wanted orthoscopy.

    The US needs sensible solutions as leading cause of Bankruptcy at 60+ was medical bills. They should really research what works and what needs to be improved in any system design. The problem will be Politics as they will not want to stop wastage as like when people go for med help for a bumped toe.

    An average wait, even in a hospital like the former St. Claire’s now St. Vincent’s is 4 hours, so imagine hispitals in the war zones like King’s County.

    I always wonder, with hundreds of millions less people in Canada, why is the waiting period so long for medical care of any kind.

    I wont even bother read half of GPs nonsense, trump did not even know he was president of US terrorities and embarassed himself at a press conference this morning..
