Given the fact that the Bar Association (BA) has now debunked Barry Gale as its president, the actions by the Chief Justice (CJ) in interfering in matters in which he has no authority must now raise the suspicion that the CJ’s conduct was designed to shore up Barry Gale’s position as president of the BA, given the fact that the BA is contemplating taking legal action against the CJ. Whether this was the CJ’s intent or not, is now a moot point as Barry Gale has been voted out of office and Tariq Khan into office.

BU family member Pachamama raised some interesting points recently concerning what happens to lawyers who appropriate money from clients’ funds. BU did a little research on one such case, that of attorney Therold Fields, which provides the template of how things are done in Barbados – See $700,000 theft charge.

The Disciplinary Committee of the BA referred the matter of Mr Fields to the Court of Appeal. And, predictably, in the last week or so, the Court of Appeal adjourned its hearing. Meanwhile, so far as BY can discover, no criminal proceedings for theft have been commenced by the DPP against Mr Fields. And Mr Fields continues to have the right to practice law.

Why has Mr Fields not been criminally indicted? Why has Mr Fields not been suspended from the practice of law? Why is the CJ usurping an authority that he does not have to go after attorneys who are lawfully practicing law and NOT making free with their clients’ money, but merely insisting on their right under the Constitution not to join an association?

It has also been suggested that we should do away with the UK systems. How the UK system treats with clients’ funds is interesting. We can clearly see that Barbados is very far what is practiced in the UK system.

  • In the UK, there are solicitors and barristers. Solicitors have to be members of the Law Society and barristers have to be members of the inns of court.

  • Clients do not instruct and pay barristers, this is done by their solicitors and payment from clients’ funds is only made to the barrister once costs are taxed and it is made by the solicitor, not the client.

  • Each year, solicitors have to submit their accounts to the Law Society for auditing and it is only after the Law Society has satisfied itself that these accounts are in order that the solicitor is issued a practice certificate.

This is not to say that there are no “irregularities” in the UK with solicitors and clients’ funds, merely that if there are, these are likely to be discovered annually by the Law Society and, until the solicitor has satisfied the Law Society, they cannot practice law.

Another BU family member Jeff Cumberbatch posted a comment on another blog which referred to Belize, which has the same conditions as those in our Constitution and Legal Professions Act, in which there is the complaint that the BA of Belize does nothing. And the same can be said of the Barbados Bar Association – BECAUSE the BA is allowed by law to call on any attorney to have their accounts audited, but has always failed to do this, until the cat is out of the bag.

Let us not forget about the Compensation Fund. Every year upon paying their fees for their practice certificates, every attorney is required to pay a fixed sum in addition that is remitted to the BA, the purpose being to compensate clients for “irregularities” perpetrated by attorneys. As BU has previously pointed out, this account runs into the millions of dollars and the only removals that have been from it have been to pay for the advertising of the estates of deceased attorneys – see Tales from the Courts.

Is it any wonder, therefore, that a growing number of attorneys have exercised their constitutional right not to enter into association with the BA? Indeed, given the eminence and the respect in which these dissenting attorneys are held, it may be safer to select an attorney on the basis of their NOT being a member of the BA where membership seems to assure an apparent immunity from criminal prosecution and suspension pending an investigation taking years.

Meanwhile, Mr Fields continues to have a legal right to practice law in Barbados, while the CJ is illegitimately seeking to deny audience and reclaim the practice certificates of attorneys who choose to exercise their constitutional rights.

    I do not understand my people. They sit in bars, under trees, in their homes and in corners of their work places and talk but would not stand up for their rights. They are exploited, lied too and taken for granted and yet they tolerate without a whimper of protest or show of objection. Do they not understand that change cannot always be by diplomacy or negotiation. Do they not understand that the system of governance in Barbados presents a democratic front but a totalitarian practice. Do they not understand that the government is not interested in state agreements but governmental inducement. Barbados is in trouble. Here in Europe the economic forecast for Barbados and the way in which state holders speak about the island’s governance is really shameful.

    Yes they are concerned but they are equally concerned about disrupting the status quo and all that it possible brings. A majority do not identify with protest via demonstrations in the way Mac Fingall described in his Sunday column. Something will have to happen to trigger a reaction, maybe the muni tax does it. We will have to wait to see.

  6. The Bar Association can help resolve the disciplinary problems by adding enough strong non-lawyers to the Disciplinary Committee. Enough strong non-lawyers to constitute the committee so matters do not become stalled. The “everybody knows everybody else problem” will still have to be managed so that the socially well connected are treated like every other person. This seems to be the core problem and having “regular” lay people sitting on the Disciplinary Committee may be enough to level the “playing field”.

The way I see it is that there is a provision, dishonoured in the breach (John, based of Shakespeare) that allows that the client accounts of all holders of practice certificates can be required yearly. Now, all it takes is a minor change in the law that makes a yearly audit mandatory until which and unless the results of which are satisfactory, no practice certificate will be issued by the Government. It is a breathtakingly simple solution. AND all unsatisfactory audits will be reported to the DPP for investigation and, where indicated, criminal indictment. What pray is wrong with that? Surely the government would welcome the chance to serve and PROTECT the electorate in this way. Even though your recently dubbed “Defender of the Status Quo” will surely exercise his constitutional right to object (along with a torrent of ad hominem abuse) to having provisions for the protection of the people put in place.

    John has raised an issue of lawyers in their 80s going to court and expecting easy access. One would think that being in their 80s some of them suffer from physical, as opposed to mental, disabilities. Are we therefore a society that has prejudice against persons with physical disabilities? Are we so lost to the rights of the disabled? As lawyers are officers of the Court, does John think that other officers of the Court should not attempt to alleviate the physical disabilities of their colleagues? It seems to me that John has an agenda against lawyers in their 80s. I am not myself in my 80s, but I know a quite few lawyers who are, like Henry, Vernon, Clyde, Edmund, Maurice, Elliot and the rest. Which one, or group, I wonder, has got up John’s nose?

    Seems to me that the thrust of this article, among others, is to investigate here on BU a system by which it is rendered far more difficult and productive of serious criminal penalties for lawyers to teef clients’ funds. In my view, the resolution (albeit not completely fool-proof – nothing is) is to amend and strengthen the Act. It doesn’t require massive brain power, merely goodwill by the executive towards the well-being and protection of the people who voted for them. In other words, a dose of simple care, good-will and humanity.

  13. @David. Indeed. Where have they gone? I suggest that frustration with the “brass bowls” has set in and they just are not prepared to put up with the nonsense – they have lost heart, as I sometimes (often) do.

    @Pachamama. Some bad apples cannot spoil the whole barrel. Remember Sodom and Gomorrah. The city would be saved if one righteous man could be found in it. In the legal profession in Barbados, there are quite a few righteous men and women of all ages and seniority. But they have almost to a man/woman lost heart. So, yes, I certainly do defend them. I have given a specific means of resolution. In other words, a specific and easily implemented way forward. You are urging revolution without any framework or suggestions to put in place once the revolution has won. What you are proposing would lead to even worse and more extreme abuse than now exists – it would create a new and even more dangerous crop of “brass bowls”.

    The older officers of the court are perhaps the source of the problems we see!!

    It is on their watch that things have gone to pot.

    If judges have an age limit, why not lawyers.

    Perhaps we concentrate too much on the judiciary without realizing that judges pass through the system and are out by age 70.

    Must be a reason!!

    Great idea.

    However I would prefer that the lawyers retain only their estimated fees and the rest of the clients money be put in a Commercial bank.

    A payment system/schedule should be put in place to ensure lawyers are paid for their work in a timely manner.

    There is no reason why a client’s money should be put at an unacceptable risk.

    Too add to what you said.I think the burden of proof to expose these people might be viewed in the eyes of many Barbadians as an act in futility. So many just accept it for what it is and do not nothing. The crooks in the business have made it this way for eons to the point that many Barbadians are afraid of the system. Also how many people in Barbados who are fed up but have the financial resources to bring these people down that could start a movement. I am convince that the majority of wealth holders in Barbados are all part of the big compromise? Even if they have the resources, I am not talking about fighting these corrupt brutes from within. I am talking about paying good reputable lawyer or investigative firm to come to Barbados to carryout the job.. It is my opinion, and I will keep on saying it that the system of lawyers, the justice and judiciary, and the law enforcers have key persons in the system who are highly contaminated and who are into the business of contaminating others for continuity of the corrupt cycle..

Thirdly, it would be a revolution In Barbados to dis-empower lawyers in relation to handling people’s monies. There is nothing that should suggest that this needs continue.

    SSS……that is why when they start up with their slave minded bullshit i brutally expose their vicious psyche….trying to return to Barbados and change the damaged psyche of the blacks on the island or trying to reverse the cycle of corruption would not be an easy task.

    Case in point, recently some people who opted to return and retire in Barbados brought in vehicles because they are entitled to have duty free cars upon return……most of them are realizing that the same blacks are trying to protect the business people on the island who sell cars and are giving the retirees pure hell to clear their cars, why? because they are protecting the status quo, they would feel better about themselves if their brethren/sister bought a vehicle for $90,000 from Simpson Motors than to bring in the same vehicle that might cost them 6,000 in the US and to which they are entitled……that is only one example, there are many.

    Most of the problems that black people are experiencing, they gleefully and giddily bring upon themselves when they refuse to acknowledge, recognize and understand what is being done to them, they prefer to remain in the comfort zone of denial, hate and blame you when you point out the obvious and just do the same things all over again.

    Dompey…….i would not label you a racist for stating the truth, what you said is true and most Bajan whites practice that idiocy against blacks who work for them, blacks witness it and say nothing, pretending it did not and does not happen……comfort zone of denial. I know quite well what racism is and can recognize it just by body language……unfortunately, Bajans have a very long way to go.

  29. @David. I have to agree that John has entered the silly arena. I defend neither the CJ nor a totally unsatisfactory justice system. I have suggested, nay URGED what to do about the CJ….. get rid of him. I have also constantly critiqued the Bar and the practices of some, not all, lawyers. The problem, as I see it, is that the checks, balances and PENALTIES within the justice system are either lacking or not enforced. Time was that a lawyer’s client’s account was sacrosanct and no lawyer would misuse it. In fact, if you needed a mortgage, instead of going to the bank, you went to your lawyer and that lawyer would contact clients with money in the clients account and ask if you would loan it, because with a mortgage, there was a secured loan that yielded a higher rate of return than the banks would give you. There are cases where it still works that way.

    There is a lot of talk about escrow. I suspect that people who glibly refer to escrow have no idea how difficult that is and how expensive. Don’t take my word for it, call your bank and ask what it takes to set up an escrow account.

    I still suspect that poor old John must have found himself on the receiving end of a few octogenarian lawyers and has an agenda. Forget about my list, John, give your own list of the ones who have beaten you up. Was it Henry or was it Elliot or Edmund or Vernon or Clyde or Richard…… who?

    We don’t need a public fight, let’s work it out.

    That, essentially, was Chief Justice Sir Marston Gibson’s message to the Bar Association of Barbados yesterday in response to their pending move to take him to court for failing to hold meetings of the Judicial Council, which plays a pivotal role in the local administration of justice.

    In a telephone interview from Trinidad, Sir Marston said not only did the courts have a backlog, but the attorneys’ body was challenged with dealing with the issue of dishonesty, and the most effective way to tackle these issues was through cooperation.

    “This is not a spirit of war. I am deeply invested in ADR (alternate dispute resolution) and we can work it out,” he said.

    Chief Justice Sir Marston Gibson is concerned about what he sees as “growing instances of attorney dishonesty”.

    And in a statement today issued by the Registrar of the Supreme Court, Sir Marston, who is currently in Trinidad, said that while the disciplinary rules required that complainants complete an affidavit, “we may need to consider the possibility of permitting ‘whistleblower’ complaints by lawyers against lawyers on a confidential basis”.

    His comments come ahead of a special general meeting of the Bar Association scheduled for Thursday, July 17, at 2 p.m. at which a resolution is to be tabled for the president of the Barbados Bar Association, Tariq Khan, to “commence proceedings for Judicial Review, in accordance with the Administration of Justice Act, Chapter 109B, of the Laws Of Barbados, of the actions of the Chief Justice of Barbados as chairman of the Judicial Council for failing to call and constitute a meeting of the Judicial Council in contravention of Section 93 of the Supreme Court of Judicature Act, Chapter 117A, of the Laws                   Of Barbados”.

    When contacted today, the Bar president said he had no comment to make on the matter.

    However, in his statement, the Chief Justice said he was worried about reports of lawyers who owed large sums to clients, and tried to settle the matter by bypassing the Disciplinary Committee.

    “Even I have heard of lawyers who owe hundreds of thousands of dollars and who are being permitted to repay the money piecemeal, without any formal complaint being filed with the committee.

    “This is intolerable and cannot be permitted to continue,” the island’s top judicial officer warned.

    He said the legal fraternity was being adversely impacted by what he called a crisis of trust that exists in the country.

    “The suggestion which I plan to make, on an interim basis, is for volunteer lawyers to assist the committee with its work, but a long-term solution is desperately needed, if the Bar is not to lose out in the crisis of trust which presently exists,” he added.

    “I want to find out what is the Bar’s plan to tackle the growing instances of attorney dishonesty. The twitter in Barbados is that there are several attorneys who are in the same position as the attorney whose case is presently pending before the Court of Appeal,” he said.

    However, the Chief Justice said the Disciplinary Committee had been unable to “get its head above the staggering backlog under which it labours”.

    He pointed out though, that while the committee had a “huge backlog” of complaints against lawyers, several of them would be found without merit, but several others required investigation.

    “This is an issue which the Bar has not dealt with, at least not publicly, and the Disciplinary Committee needs help. Too many Barbadians view attorneys as belonging to some sort of secret organization which protects itself even when its members commit defalcation against clients’ accounts. Nothing could be further from the truth,” Sir Marston insisted.

    He said the committee met in the Supreme Court every Tuesday and worked until late in the evening.

    The top judicial officer also addressed the issue where he said that certain attorneys had refused to pay their annual Bar fees, despite the “clear language” of the                         Legal Profession Act.

    “I have recently sent a letter out to the judges and magistrates directing that such lawyers have no right of audience in the courts. To their credit, the two presidents of the Bar, with whom I have worked, have raised this as a major issue, but until recently with the suggestion of Mr Barry Gale, QC, there has been no discussion of the appropriate remedy.”

    All these are matters the Chief Justice said he would be discussing with the current president Tariq Khan, when they meet on July 23.

    Prominent attorney at law Philip Vernon Nicholls has been released on $200,000 bail, after appearing in the District “A” Magistrates’ Court today to answer charges of theft and the laundering of more than $500,000.

    Police public relations officer Inspector David Welch said the 53-year-old former secretary of the Barbados Cricket Association, who was granted bail with two sureties, is to return to court on February 25.

    Nicholls, who resides at Dover Mews, Dover, Christ Church, was arrested by members of the Fraud Squad and charged with the two offences earlier this week. (RG)

You are respected! But please be warned: the SSS have a serious problem with those who are on the take. And a more serious problem with those who are beneficiaries of those who take and feel their loyalties too their puppet masters must still be given in the face of obvious wrong. I got a very very serious problem with that and so no respect is given. I do not care if you are a Prime Minister or Jesus. Wrong can’t be right and right can’t be wrong. So again I ask you Robert Ross are you corrupt or are you honest. Are you led politically and live lavishly on your loyalties to a political party? Or have you work hard for your keep. I wrote concerning your reply to David because you seem to be oppose to David’s post which I think reflects the happenings of the secret crime world our politicians conveniently call the business of “scratch my back and I scratch yours.” I tend to call it – PILFERING.
