"Warner choosing green as his party’s colour was typical of his ability to read his electorate"
“Warner choosing green as his party’s colour was typical of his ability to read his electorate” – Mark Jones

For those prepared to look as well as see, Trinidad & Tobago is a fascinating country. One steeped in history, rich in cultural variety; a land of contrasts that deserves far greater attention than it receives. For a nation with a stable economy, rich in oil and gas, with an undervalued currency it is currently experiencing events in its body politic that can truly be said to be shifting its tectonic plates. The architect of this seismic activity is none other than Jack Warner, yes Jack ‘Teflon’ Warner of FIFA fame (or some might prefer infamy). Rarely in the history of the islands can one individual have caused so much excitement and anxiety. All the more remarkable as not so long ago Warner faced investigation and a degree of censure following on from a report compiled by the Integrity Committee of the Confederation of North, Central America and Caribbean Association Football (CONCACAF). In many ways this CONCACAF report could be said to be the genesis of the political ructions being experienced throughout Trinidad & Tobago at the present time.

Whilst Warner is no longer a big shot at FIFA, he certainly wields enormous influence in the Caribbean and effectively bankrolled the United National Congress (the largest partner in the People’s Partnership coalition) in Trinidad & Tobago’s two most recent general elections. Ever the workaholic, the wealth of evidence he is believed to have amassed on colleagues whilst heading up the Ministry of Works and Infrastructure (ministerial portfolio with possibly the largest budget and the greatest scope for corruption), and latterly as Minister of National Security in the Coalition Government will no doubt prove a handy ‘insurance policy’ in these turbulent times. The CONCACAF report has certainly proved controversial, especially in regard to the issue of the ownership of João Havalange Centre of Excellence (a 16-acre sprawl containing a conference centre, football stadium, hotel and swimming pool) on Trinidad. Whilst Warner had remained defiant, the damning criticism contained within the report along with the news that his sons in the US had been placed under house arrest for a time and of his being investigated by the Federal Bureau for Investigation (FBI) for possible fraud and tax evasion caused Warner to consider his position. Realising the potential gravity of the situation on 21st April 2013 he went to see the Prime Minister the Hon. Kamla Persad-Bissessar to tender his resignation as a Minister, MP and Chair of the UNC.

Ever the conviction politician, Warner believed that he should go back to electorate and allow them to pass judgement through the ballot box as they saw fit. With his being so pivotal to the UNC Persad-Bissessar told him not to resign, a decision he went along with and duly left only to see Surujrattan Rambachan, Dr Roodal Moonilal and Chandresh Sharma waiting to see the Prime Minister on his departure. Warner’s instinct told him that something was afoot, especially as there had been bad blood between Rambachan and himself (Warner having been instrumental in orchestrating a coup with the Opposition Party – the Peoples’ National Movement (PNM) that unseated Rambachan as Mayor of Chaguanas and replaced him with Natasha Navas). These three figures, whom amongst others he has subsequently dubbed the Cabal (A cabal is a group of people united in some close design together, often by intrigue). A few hours later that Sunday evening Warner received a communication from Persad-Bissessar informing him that she had decided to accept his resignation. That very night Warner cleared his desk and his resignation was duly made public the next morning. Matters were made all the more remarkable by the fact that breaking from the apolitical tradition of his post, the Police Commissioner Stephen Williams said after Warner’s resignation that he had been an “exceptional minister”. It is understood that the Prime Minister told Warner that in standing for re-election he was bound to win, yet whilst all the 31 UNC party groups in the Chaguanas West constituency chose Warner for their candidate, oddly the Executive of the UNC preferred not to have Warner as the Party’s candidate. A classic case of biting the hand that feeds you.

Going it alone as an independent can be a daunting prospect. Yet for a man who had always prided himself on being an accessible constituency MP, Warner appeared to relish his new found freedom. He resolved to found his own party, the Independent Liberal Party (ILP) and set about his campaign with gusto. Only too aware of his strengths, leading figures in the UNC preferred not to stand against him. For an Afro-Trinidadian standing for election in a predominantly Indo-Trinidadian populated constituency he demonstrated considerable insight and understanding of signs and symbols. Choosing green as his party’s colour was typical of his ability to read his electorate, green evoking the verdant landscape so precious to those of Indian heritage, a colour that resonates readily with Hindu and Muslim alike. It is worth noting that green is also the colour of the maxis, the minibuses that serve as the transportation of choice or necessity for many local people in Chaguanas. With oil and sugar cane featuring on the Party badge, here was further evidence of his appreciation of elements central to identity and prosperity in the past and present.

When it came to the campaign itself rather than denigrating the PM he opted not to criticise her, but rather to claim that she had been badly advised by the Cabal. His opponents naturally sought useful ammunition in the findings of the CONCACAF inquiry and report. The inquiry having been led by Sir David Simmons, a former chief justice of Barbados had found that on the balance of probabilities, that Warner had committed fraud and misappropriated funds. Preferring not to refute accusations in person Warner skilfully made use of lawyers who armed with a wealth of correspondence and documentation going back over several decades were able to pick holes in the report and suggest that he had in affect been ‘gifted’ the João Havalange Centre of Excellence by Mr Havalange for services rendered. As more and more evidence was wheeled out, Warner’s team were able to sow seeds of doubt that worked in his favour, they even managed to elicit considerable degree of sympathy for Warner.

Friend and foe alike are aware that Warner has a capacity for work comparable to the late Margaret Thatcher (a politician who in her prime famously survived on only four hours sleep a night). Only a few weeks prior to his resignation Persad-Bissessar had singled her Minister of National Security for particular praise – footage Warner and his team were happy to replay at every available opportunity. With the UNC’s campaign failing to make inroads, the Prime Minister took to describing Warner as a lagahoo – a creature from local folklore famed for staying up all night making mischief and dragging chains. Far from being offended Warner laughed off the supposed insult, believing that his nocturnal industry was in marked contrast to the poor work ethic of her closest advisors. His campaign was proving to be slick and engaging. His adept use of social media enabled Warner supporters to sign up for a free party card online (a first for Trinidad and Tobago). Particular emphasis was also placed on connecting with young voters with a ‘Youth for Warner’ campaign and a large green painted Hummer driving around the constituency featuring a picture of genial Uncle Jack and the chance to enter competitions to win prizes such as a ride in the said Hummer.

The Jack Warner juggernaut and his stunning victory in the bi-election on 29th July 2013 have resulted in a state of near panic for all the other political parties. Khadijah Ameen (UNC), his nearest rival for the Chaguanas West seat polled less than half the number of votes that Warner secured. In the course of campaign the UNC candidate’s medical records mysteriously made it into the public domain, a fact that seemed to confirm just how high the stakes were. For the UNC the psychological trauma of Warner’s triumph in a constituency in what was once viewed as its key heartland cannot be underestimated, it is already having far reaching ramifications. For the Congress of the People (COP), the junior party in the PP coalition there is a sense that they have become tainted by their association with the UNC. Some COP MPs and party members are increasingly critical of their party leader, Prakash Ramadhar. The main opposition, the PNM is equally filled with doom and gloom. Warner and the ILP have demonstrated an uncanny ability to cross racial boundaries. The PNM has traditionally relied on its core voters hailing from constituencies largely made up of people with an African heritage, often from poorer districts such as Laventille. Neglected “eat ah food” areas (places where anyone prepared to give will gain support) have relied on meagre support from the PNM, but with the party’s funds limited Warner’s largess or his ability to get things done looks set to change allegiances. This formidably shrewd political operator appreciates the fact that Trinidadians are generally impatient, especially of politicians and he has been quick to exploit this fact to his advantage. Friends and foes alike all agree that he is a man that makes things happen. All the political parties have finally begun to appreciate the gravity of what has taken place and emergency meetings have suddenly become the order of the day.

Even on the evening the result was announced three ministers in the PP Government chose to publically congratulate Warner something deemed an act of near treachery. Those three ministers: Winston Edward ‘Gypsy’ Peters (Minister of Culture), Fuad Khan (Minister of Health) and Anil Roberts (Minister of Sports) already look likely to jump ship. Recognising Warner’s potential to wreak havoc the Prime Minister is believed to have offered Warner a place in the Coalition, something he rejected out of hand. In such a small country it has not taken long for people to realise the enormity of what has taken place. Herbert Volney, MP for St Joseph has already resigned from the UNC and whilst an Independent at present looks set to join the ILP once the party has a constitution. Various UNC and COP councillors have already rallied to the ILP flag, and the Vice-President of the Senate (Lyndira Oudit) has resigned and been appointed Deputy Leader of the ILP. PNM MPs and councillors are equally nervous and whilst the PNM is endeavouring to stay calm they are aware that the shock waves of what is taking place are just as likely to envelope them as the Coalition. Donna Cox, the PNM MP for Laventille-Morvant is one of a number of PNM figures believed to be seriously considering joining the ILP. Even the relatively sleepy tourist idyll that is Tobago has not been immune to the reverberations. Insensitive remarks from some in Trinidad, especially referring to the Calcutta ship coming to Tobago has caused particular offense. The racial overtones of this remark have managed to touch a nerve with Tobagonians who are largely of African heritage. For all the general harmony across the country, the issue of ethnicity and race remains a problematic one, especially as there is a perception that the Government in Port of Spain has presided over the Indianisation of many ministries and public offices.

The current bacchanal is being enjoyed by the media, with much coverage appearing largely sympathetic to Warner. There has been degree of schadenfreude about the Coalition’s discomfort, something that has been made all the sweeter as in the past the Government has used the power of the purse in regard to advertising to thwart those whose journalistic endeavours were not to its liking. Whilst the economy appears unaffected at present, there is growing anxiety, especially in regard to job security both the public and private sector. In recent years people have been hired on short contracts and the Ruling Party/Parties have appointed their own people. The private sector is jittery about contracts with the Government, especially if there is the risk of a change of administration. So sensitive have things become politically that the Prime Minister is fearful about calling the local elections. In the current febrile atmosphere the word on the street is that the Coalition Budget on 9th September 2013 is likely to offer sweeteners in order try and win back support. As for the Great Machiavellian himself, Jack Warner is probably busy working every hour God sends on his game plan to ensure that one day he becomes Prime Minister of Trinidad & Tobago. His artful machinations might just become a textbook example of how to achieve and maintain power. Love him or loathe him, one thing is for certain and that is Warner’s ingenuity and zeal must never be underestimated.

  1. Amazing for a man embroiled in so much fraud.. wow!

  2. @Mark T. Jones. This is an excellent and insightful report. Deepest respect, sir. It is excellent to have the whole matter laid out for us, especially given the pending lawsuit of Warner against former Barbados Chief Justice Sir David Simmons.

I am often accused of “Simmons-bashing” gratuitously. In my defense, I have to say that if someone presents themselves constantly to be bashed through their actions that assist in or directly encompass the denial of due process, then the accusation against me for simply pointing out these egrigious acts by them, is out of order.

Let is examine the Simmons-led inquiry into Warner that has led to a law suit being filed against Simmons by Warner.

Fraud is an accusation not to be undertaken lightly, as it is both an indictable criminal offense and a tort. Therefore, the burden of proof in a civil action for fraud is, of vital necessity, extremely high. Far higher than the “balance of probabilities” that will suffice in a civil action which is not also criminal in nature. Indeed, if unproven applying such a high burden of proof, the defendant may well succeed in an action for defamation against the plaintiff.

It is also settled that for any such finding as Simmons made, the person against whom it is made MUST be allowed to confront their accusers and proffer a defense. We saw it in the Commission of Enquiry into Jeff Broomes when, having been accused of certain fraudulent acts, Mr Broomes had to be informed by the Commission, the witnesses who alleged these acts recalled to face cross examination and Mr Broomes allowed to defend himself. Not only did Mr Broomes present a credible and undeniable defense, he also proved – beyond a reasonable doubt – that the witnesses had committed perjury – a fact that would not have come to the attention of the public, had it not been for the unremitting investigative reporting of Barbados Underground. A criminal act not reported in the Commissions findings and as yet unprosecuted by the DPP.

Warner was given no such right to confront, cross-examine or defend by the Simmons Commission. And as such, Simmons’ finding of fraud are an egrigous denial of Warner’s rights. Shameful in a commission headed by a man who has held the offices of Attorney general and CHIEF JUSTICE of Barbados.

SO, am I the Simmons-basher. OR is Simmons constantly doing it to himself?

Jack warner guilty as sin hey FBI extradite him to New York to be with Dudus

FIFA: New evidence will show Jack’s involvement
    By

Story Created: Jul 7, 2011 at 12:54 AM ECT
A FIFA corruption investigation has concluded there is fresh evidence to support claims that former FIFA vice-president Jack Warner and Mohamed bin Hammam colluded to offer bribes of up to US$1 million (£625,000) to Caribbean football officials, according to the London Telegraph newspaper.

The investigation, conducted by former Federal Bureau of Investigations (FBI) director Louis Freeh, is understood to have uncovered new evidence supporting the findings of the initial enquiry by lawyers acting for FIFA executive committee member Chuck Blazer.

Up to nine out of the 25 Caribbean Football Union (CFU) national associations have told Freeh that they were offered or witnessed bribes of up to US$40,000 per-nation (amounting to US$1 million) being offered in brown envelopes to delegates at a special meeting of the CFU in Trinidad in May.

The witnesses have also alleged that they heard Warner explicitly explain that the money was from

The re-election of Mr Warner appears to be a serious indictment on the people of Trinidad and Tobago.

He should be behind bars, bloody crook.

He reminds me of the Barbados Labour Party.

My understanding is that JW is alleged to have suggested that T&T’s FIFA vote could be obtained by a gift of GBP2.5 million for a school to be established in Trinidad and he is alleged to have suggested that the funds ought to be sent through him personally. Is this what 40 acres is describing as spreading the spoils around?

Warner was given no such right to confront, cross-examine or defend by the Simmons Commission.

Warner refused to cooperate with the Commission he was given opportunity to present his side of the case unlike Jeff Broomes he arrogantly declined. Sixty million Frenchmen cant be wrong from the Australian government to the British to the starving Haitians have accused Warner of thieving and fraud and we’ve not mentioned FIFA and CONCACAF, or CFU. Simmons just has to summon whistleblower Chuck Blazer the long time co accused thief in football with Jack and his (Warner’s) suit is dead on arrival. The FBI and the Americans are building a case against slippery Jack. Never in history has so much evidence been collected to show the corruption of one man. In spite of all this Warner remains popular among Trinidadians. That is a matter Trinidadians themselves have to confront. Were Warner a politician in Barbados in fact in most countries, he would have been kicked out of Parliament without a hope of returning. It would not surprise if Warner becomes Prime Minister of Trinidad in the final analysis. Look at eccentric Mugabe a former war hero who ruined beautiful Zimbabwe yet continues to “win” elections and is leader long past his sell by date. These anomalies happen and are hard to explain. David Simmons should not lose a night’s sleep over Jack Warner the entire world except Warner’s countrymen know Warner is a criminal and can prove it.

  7. @ Mark T Jones
“…..he certainly wields enormous influence in the Caribbean”
Really? Maybe in Trinidad but the Caribbean? Maybe it’s time you left London and came to the Caribbean.

“Friend and foe alike are aware that Warner has a capacity for work comparable to the late Margaret Thatcher (a politician who in her prime famously survived on only four hours sleep a night). ” The only difference is that Jack Warner is working for his own benefit but Margaret Thatcher, whatever you may think of her policies, was working in the interest of what she thought was best for her country. Soon you will be comparing him to Winston Churchill!

  8. @Notradamus

Do think JW does not have the low down on individuals (politicians) across the Caribbean?

  9. @Amused
Had Broomes refused to cooperate what would have been the options of the Commission?

  10. @All who state that Warner refused to cooperate, that was his right. The commission was not a court of law and had no right to make a finding of fraud. A finding of fraud can only be decided by a court of law and a jury of one’s peers. NOT by a commission that has clearly exceeded its remit. If Broomes had refused to cooperate and a finding a fraud had been made by the Waterman Commission, I daresay that Waterman would have found himself in the same position as Simmons – BEING SUED!

Understand me clearly, I hold no brief for Warner whatever. However, absent solid proof and a conviction in court and by a jury of his peers, my PRIVATE views on him have no standing and I will not be guilty of defaming him by unproved (in court) accusations.

  11. @ Amused
Your main (very human) weakness is that you tend to allow personal bias to influence your professional logic.
(Perhaps that is a major strength for a lawyer since you never know which side will hire you 🙂 )
Some easy examples of this weakness are Caswell, Homosexuality, and Simmons.
Someone is not ALWAYS wrong just because you don’t like them….

Jack Warner is a blatant and arrogant crook. Full stop. His response to the hearing justified the rulings given.

His “success” was only possible in a ‘spiritually damaged’ country like Trinidad, a country that was foolish enough to allow two coups to be treated like mock sport; where court witnesses routinely die before trials….
A country where persons openly steal BILLIONS of dollars in an airport project and one that was the genesis of regional the CLICO debacle.
A country where money is worshipped and justice and righteousness is on life support……..Were it not for oil……

Barbados is now well on the way to such spiritually damaged – status under the expert guidance of our new Trickydadian owners and managers….aided and abetted by our clueless politicians and intellectuals…

  12. This particular political electoral phenomenon taking place in the republic of Trinidad and Tobago – though not defined as yet – is unprecedented in the politics of the English-speaking region.

It is clear that this phenomenon in Trinidad and Tobago needs to be studied by political analysts in Trinidad and Tobago and beyond for its nature, scope, interconnections, and effects, especially when the person at the center of it has had so many political and other negatives stacked against his name.

Whilst some Barbadians have been loosely calling for it to happen here in Barbados, it is clear that it is impossible to replicate here as that there are fundamental factors that are not present here but that are present in that country that drive the phenomenon itself. For instance, there is the fact of the synthesization of the multi-racial/ethnic politics of that republic, the bachannalian political culture of the said Trinidad and Tobago, and the Jack Warner factor itself.

Where the Jack Warner factor is concerned though it clear that he has been a leading figure, and a controversial and publicity seeking one at that, in international regional football; that he has been a strong donor of political largess to many political camps in that republic, and that he has had strong community roots in Trinidad and Tobago.

These aspects lend properly to the centrality of the Jack Warner factor in Trinidad and Tobagonian politics.

While it is true that some people in Barbados will readily look at those features as being fundamental parts of this evolving phenomenon in Trinidad and Tobago, the PDC in a preliminary sketch of this phenomenon is of the view that the motor force of this phenomenon has more to do with Warner’s independent political leadership and philosophy in relationship things political in Trinidad and Tobago than to do with those above mentioned fundamentals, and as such are a primary reason why has been feared by many other political functionaries in the UNC and the PP, and yet still politically supported by many others in that country that cries out for serious leadership against crime, on law and order and justice – something that Warner seems so willing able to provide.

It is no small wonder that with those features present in the Jack Warner factor, Warner himself and others would have seen the logic in forming a party, and coming up with an appropriate name for the party – Independent Liberal Party – that just not happens to be named so – but that is the embodiment of who they essentially politically there are as political change agents in the political electoral dynamics of their country.

This extraordinary movement in the politics of Trinidad and Tobago aside, what is outrageously damning though in Barbados is that there are persons, like Dr. David Estwick, Mr. Denis Kellman, Mr. Clyde Mascoll, Mr Kerrie Symmonds, etc who have the abilities attitudes – a few things apart – to provide leadership for the country, partly on the basis of the independent political leaderships and cosmologies of theirs but who apparently for whatever reasons prefer to remain subjugated to lesser intellectual political lights in their moribund political camps.

So, where Dr. Estwick is concerned he has subjugated himself to fools and jokers like Sealy, Sinckler, Stuart in this old intellectually politically bankrupt ramshackled faction called the DLP, when what a great number of people in Barbados are calling for is a new brand and style of political leadership at the highest levels in Barbados, and serious seismic realignments and for the better in the political electoral system of this country.

    PDC

  13. What is interesting about the JW phenomenon is that he has the overwhelming support of the people.

  14. Bush tea you were going well until your last paragraph but you are correct on Amused. His posit is Caswellian bush lawyer in nature. A Commission is set up with terms of reference and to follow the money wherever it leads. On conclusion of its enquiries the Commission announces what it has found. It found Jack Warner to be a CROOK. How else can you state that without being untruthful. Where does Warner’s unlimited wealth come from? Ii is said he started life as a primary school teacher who know one could understand because he stutters. Nothing wrong with stuttering but the man became unimaginably rich within twenty years and if you follow the money he cant account for his unlimited wealth. The Commission basically declared that to the world. Warner will pay those lawyers millions to obfuscate a case they are bound to lose but we know for Warner money is not a problem. Case closed

  15. Why wunnah don’t leave Jack alone? Ever hear of Vox dei vox populi? Jack has even turned “you can’t fool all the people all the time” on its ear.

To “Amused’s” point about judicial niceties, even eminent legal practitioners fall prey to the court of public opinion which goes “If it looks like a duck, quacks like a duck and walks like a duck, it’s a duck” or a pig with feathers.

The writer of the essay was full of comments about the colour green and its symbolism, however he failed to mention the “beanstalk”, ah wonder what will be at the end of Jack’s beanstalk.

  16. @Bushie. Still smarting for the gay debate, I see. Never mind. There there.

You say, “Jack Warner is a blatant and arrogant crook. Full stop. His response to the hearing justified the rulings given.” I will agree only in so far as Jack Warner is, in my view, blatant and arrogant – but those are traits that he shares with many, including yourself, your protege Casewell and, dare I say it, myself. So far as I can see, apart from David, the only BU family member who scrupulously avoids arrogance is my friend Baffy – but then again, a supreme agent provocateur like Baffy doesn’t need arrogance and he can leave that to lesser mortals – like you, Casewell, me, the Mighty Miller, the not-at-all-stupid-at-all ac – and others. Whether Jack Warner is a crook or not would be a matter of private speculation on my part that I will not share it and it is subject to a finding of fact in a court of law, not by a commission of enquiry. The very basis of our (and the T&T) justice system is that such a charge be made by the DPP and bought before a court of justice and tried by a jury of his peers. I note with great interest that, despite the “verdict” of the Simmons Commission, the T&T DPP has not filed any charges against Jack Warner. I do not know the reason why and unless you can provide evidence that shows that the T&T DPP is not doing his job, neither do you! Therefore, we are left with no alternative but to assume that in the opinion of the T&T DPP, there is insufficient evidence to convict Jack Warner in a court of law.

As David has been at pains to ask, can you therefore explain the tremendous popularity of Jack Warner in T&T? I would, sincerely, be most interested in your answers to that particular question. And please don’t let me down with a lot of garbage about the good people of T&T also being a bunch of crooks.

  17. Excellent article.

“Love him or loathe him, one thing is for certain and that is Warner’s ingenuity and zeal must never be underestimated.”

Aspiring leaders should take note (without the controversy and bachanalia though, lol)

  18. @Sarge. You seem intent on becoming an agent provocateur too. Nice one.

  19. @ Bushie
We can agree sometimes. Yuh on point ref JW.

  20. @ Amused
“…..can you therefore explain the tremendous popularity of Jack Warner in T&T?”
    ********
…for the same reason they liked and trusted Duprey and indeed anyone else liberal with money, …be it theirs, the government’s or other people’s (as with CLICO).
The people worship money and fetes…..and as long as Jack manages to get away with it, he will be a local hero…

    You refer to T&T’s AG?
LOL Ha Ha ….oh Shirt…. No wonder you think ac is smart…

You remember the recent incident in T&T Where the GOVERNMENT actually CHANGED THE LAW to allow their crook friends to escape the penalties of the law?
What was the DPP’s role as chief legal advisor?
Are you aware that most Trini’s actually thought that the whole thing was funny….?

You REALLY know Trickydad though Amused…?

  21. @ David
“Do think JW does not have the low down on individuals (politicians) across the Caribbean?”

I don’t know but maybe if they were involved in football associations he might:)

  22. This is the time for serious action to be taken against the DLP/BLP and all the other oppressors of the broad masses and middle classes of people of this country.

This is a call to all of the very progressive people of this country to rally against these oppressors at this critical time in the historical development of this country.

This is a serious call to action as this country faces its worst material and financial times in its post-independence history.

    PDC

  23. @David. Thank you so very much for posting this letter. I am not going to be guilty of pre-judging this case, but have to reflect on a few matters that may be of interest to those who law must prevail over their own prejudices, no matter how justified (or not) those prejudices may be.

    1. WWW. In pointing out that the Commission posted its report on the WWW, counsel for Mr Warner has given themselves the option of instructing counsel in each and every country in which Mr Warner has allegedly been defamed to bring actions for libel (except Barbados which, thanks to the defendant Simmons, does not recognise the difference between libel and slander, so as to create a reduction of damages to the benefit of the Nation Newspaper) BUT Simmons can be sued in Barbados for Defamation. This effectively means that Mr Warner is enabled to sue the Commission and Simmons in each and every country that is a signatory to FIFA, or is which Mr Warner can prove he has been damaged. Now we know that Mr Warner has the wherewithal to prosecute such actions worldwide. The question is if Sir David has the wherewithal to defend them – after all, Sir David has to look to his own purse on this one, not as he is used to doing, the public purse. I cannot help feeling that there is a measure of poetic justice here for the many litigants in Barbados who have been financially devastated by the breakdown of the Barbados justice system under Sir David. As is now clearly seen, what goes around comes around. Marston Gibson and Barbados judges, BEWARE!

    2. It is further noted that counsel for Mr Warner has correctly stated that accusations of criminality require to be proved “BEYOND A REASONABLE DOUBT”, and NOT by a balance of probabilities. And we must all stand astounded and dismayed that a former Chief Justice of Barbados did not recognise this basic principal of law.

    3. It is also noted that the conditions of curing the alleged defamation are not unreasonable. A retraction is requested commensurate with the publicity given the alleged defamations, Mr Warner’s legal costs (which is usual and reasonable) and, instead of a payment to Mr Warner for any damages he might have incurred, a payment to charities (presumably registered charities) of Mr Warner’s choice. Thus, Mr Warner does not seek to profit from his action, merely to be cured of the alleged libel and have his costs paid.

Given the Commission/Simmons report and the glaring errors in legal judgement in it and the fact that this action can be brought in any country in which Mr Warner has sustained and can prove he has sustained, damage, the pre-action protocol letter appears to me to be most reasonable. I personally would advise its acceptance. But, of course, the time for acceptance has passed, but I am sure could be extended upon request of the Simmons counsel, which is something I would recommend. It appears to me that Jack Warner has David Simmons by the nuts and he can squeeze those nuts, not only in T&T, but in over 100 other justice systems around the World.

And, like or loath Warner (and I take no public position on that) the poetic justice of this lawsuit has me much amused, in that, after hiding behind a public purse to flout the Constitution of Barbados and encourage said flouting in the justice system of which he was head, Simmons is now in the same financial boat as the distressed litigants of Barbados. On that basis, I say “BRAVO JACK!!!!!”

  24. Amused, I do not know what Mr Simmons has done you but your rantings and ravings against Mr Simmons suggest that he did you irreparable harm which you have allowed to cloud your judgment

  25. Quote
“In the article Warner is compared to Jamaica’s,‘drug kingpin’ Christopher “Dudus” Coke. “Residents were accused of protecting Coke as police tried to execute an arrest warrant from U.S. officials, who sought him on drug and gun trafficking charges.”

  26. @Nostradamus

BU comes back to why JW is so popular with the masses. The answer to this question addresses the problem many societies including Barbados are now confronted. A crisis of governance. When the people are willing to compromised on morality and obvious wrong over right, we have a problem.

We can debate the legal merits of JW and Sir S but the real issue remains.

  27. Good to see such a thorough and objective analysis from Mark T Jones. He has an uncanny ability of getting to the heart of the matter. Two years ago he wrote a superb piece that blew the lid on some of the antics going on at the highest level in Trinidad & Tobago:

If you really knew what was going on in Trinidad you would not be surprised at Warner’s action. Criminals run things in T&T. When honest people come forward they are bombarded with all kinds of action from fire bombing, to severe beatings to murder….to the extent that honest people are forced to use their common sense and see no evil, hear no evil and speak NOT against evil.

So if you complain about a criminal you can EXPECT to have your house burnt, burgled or even to disappear before the court date…

Same shiite happened in Jamaica….honest people were ridiculed and harrassed for standing up for what is right.
OBVIOUSLY the criminals took over …even took over the police – and they ended up with Dudus ….who owned the politicians.

Are you surprised that Warner is taking this approach?
Seems quite consistent with the tactics of the criminal element.

Bushie holds no brief for Simmons, but….
Why the hell does Warner not bring evidence that his dealings have been legal and above board? Would that approach not effectively cancel the commission’s findings and humiliate Sir David?

Wunna lawyers are the main reason that these damn crooks are able to get away with this lotta shiite….

…..see why Bushie can’t run nothing bout here now…? The bushman would have shown both Warner and his lawyers which God they are serving the very day that they came with this criminal and vindictive tactic…..

  29. The stinging victory by Jack Warner was one that showed up those that sat in judgement on Warner wherby the electorate simply said .that those sitting in judgement of the corrupt must have an above and aborad stanadard one which is impeachable requiring a modium of decency and moral authority. such elements however were missing from those who sat in judgement.on Warner.the electorate vocally said this is HYPOCRISY can.t fault them.

  30. @ac

    What are you saying?

Warner is a man who has been able to hone his political skill by years of operating within the bowels of FIFA, one of the most politically entities in the world today. Outmaneuvering the players in T&T therefore is child’s play. Even as we discuss politician current and former are mapping an exit strategy by looking to hitch their wagons to JW’s political party.

    Riots in de land!!!

    @Bush Tea

That is the key to the whole thing Jack will have to prove how the commission “Damaged” him. De man showing he undergarments, all he looking tuh do now is get nuff money outta dese commission fellas.

And it will be entirely their fault if they lose to a knave like jack. They who are “Supposed to know” the law will have made a greivous boo-boo.

But I see this action brought by jack as a double edged sword and jack may very well fall on it.

The electorate in the Caribbean is not ready and is quite silly. For years we’ve been voting in clowns, prostitutes and criminals. They are supposed to work for the citizens and yet it seems when voted in they see themselves as our lords and bosses. They are guaranteed a salary and job for five years with a hefty pension to boot along with allowances. The electorate of us can’t get a job, can’t afford or get chicken backs (latest news from jamaica), are seeing our wages and working conditions deteriorate. Worst minister of labor for though she passes employment rights laws many injustices in the workplace still occur. Now Dey gone and elect “gift taking” jack, it really is an indictement on Trinidadians, the man is not a sound investment.

As many know they (politicians) cannot go to a citizen with their head on to ask for votes, no. They go to the weak and ask “What do you want” or “what can I give you”. They go to the strong saying “please sir, beg ya sir can you donate some money please, I ayn got nun” Latest fad now is buying votes, right here in buhbaydas. The PM saw this and did nothing but mention it on national television, which I’m sure he regrets doing. They fill the public service with friends, family and their mistresses male or female, that’s why they won’t send home anybody. Once you keep the bloated public sector in barbados happy you are assured government.

They have failed us. They should be fired on grounds of gross mismanagement. Citizens should not let them off so easily. Citizens should become more responsible and be more vigilant. If people so willing to sell their vote universal suffrage should be revised to somehow exclude those who would be susceptable to do such. There should be a well audited election campaign fund which should not exceed $40,000 each for all political parties .Third parties, fourth and fifth parties should be supported. Constituency councils are tools of corruption and must go. If there is provision for impeachment or recall then these should be used.

    Riots in de land!!

  32. @Amused
This is somewhat difficult for me to admit but I agree with “Balance” that you seem to have a ‘hard on’ (metaphorically speaking) for Sir David.

Now my only claim to any legal knowledge is what I picked up at the stand pipe but didn’t CONCACAF establish the Committee of Inquiry to look into this whole affair? Wouldn’t CONCACAF be presented with a copy of the Committee’s findings before it is released to the public? Wouldn’t CONCACAF have its legal counsel vet the report to ensure that all that its legal rear end was covered? And lastly if CONCACAF established the Committee and Sir David as its leader isn’t he acting as an agent for CONCACAF? Wouldn’t CONCACAF be the principal defendant in this “lawsuit” rather than Sir David?

Personally I think the possibility of any lawsuit is as remote as a three legged unicorn but stranger things have happened when egos are involved.

  33. @ Sargeant
I can’t wait to hear Amused’s response. It should be quite amusing.

All of this talk by Warner about legal action is just pure BS. Not that it does not serve his purpose, which is in part to make it look like he is an innocent victim for the benefit of the people who voted for him in his constituentcy.

  34. @Amused
You live up to your moniker. You are Amusing to read.Such legal gobbledegook!
Sparrow sang many years ago;”Trinidad?Dis place too damn democratic”By all the laws of probability,Abu Bakr would have been shot dead when he walked out of Red House with his hands high in the air,Duprey would have been serving a life sentence and all his assets everywhere would have been confiscated by the State,Warner would have been serving a heavy sentence and all his and his family’s assets confiscated by the State.Trinidad is a sick country led by an inebriated and now wounded set of coolies straight out of the Caroni canefields where BOBOLL is the currency of exchange.Amused,t is clear that Simmons has wounded you immensely.Politicians in Trinidad and now in Barbados are living one day at a time, they are aware BUT they know not what the morrow brings:
THEIR IDOLS ARE SILVER AND GOLD;EVEN THE WORKS OF MEN’S HANDS.
THEY HAVE MOUTHS AND SPEAK NOT;EYES HAVE THEY AND SEE NOT.
THEY HAVE EARS AND HEAR NOT;NOSES HAVE THEY AND SMELL NOT.
THEY HAVE HANDS AND HANDLE NOT;FEET HAVE THEY AND WALK NOT,
NEITHER SPEAK THEY THROUGH THEIR THROAT.THEY THAT MAKE THEM ARE LIKE THEM,AND SO ARE ALL THAT TRUST THEM.

  35. @ David
“BU comes back to why JW is so popular with the masses”

The only “masses” he needs to be popular with are the ones in his constituency and he made sure that he shared the spoils and “looked after the people” . If Pablo Escobar had run for office in Colombia for the equivalent of a T & T “constituency” he would have won hands down.

If Mark Jones thinks Warner “ wields enormous influence in the Caribbean” then he is really out of touch. Jones also says “……Ever the conviction politician, Warner believed….” . What Convictions? What Fundamental values or ideas does Warner espouse?

  36. David good Point. however he was politically in tune with the people. as a matter iof fact he can be dubbed ” a people man” one of the very reasons he was able to outmanuverured those who sought to bring him down. He knew that the people would see the hypocrisy that even though he is not cean that the albratross which was put aroun his neck should have been also equally applied to those who sat in judgement an the people responded. as for the lawsuit he has a very good chance of winning.

  38. Look i did not folow thuisdebacle with great interest but fom the tuidbits i got the impression hat JW was being hounded and harrassed without unfounded allegatiins.ther was something about this investigation that did not seem as kosher as it all was put out to be and the possibilty is that the voters felt the same.

  39. @ ac
Why not do yourself a BIG favor nuh……
    …and HUSH.

  41. Let me tell you Mara Thompson something.Get to hell back to Sen Lucia whey ya come from whey all ya accustom to eatin’ and drinkin’ in a calabash. You tellin buhbaydus ’bout a failing party name the DLP that a man name David say if they win the election the party faithful will be eating the fatted calf and you and your coterie of ill informed and incompetent jokers took literally and spending taxpayers money pun foolishness like constituency councils and a football tournament, free bus rides for people who can pay and free holiday camps for people who did not ask for them,an unnecessary StJohn polyclinic and at the same time depriving the only health care institution of funding,(a repeat of the same foolishness done by one Brandford Taitt in the 90’s)take away a tax credit that helped poor people, take away state paid tertiary education that helped the poor. When this country reacts to these measures you
can run back to Sen Lucia. Many of us must of necessity remain here and
    battle the odds

  42. Bush TEA wuh shite man u tell ac to HUSH! wait i ain’t the one walking around BU with a magnifying glas sping up the rear end of every man jack….u got to beside ur self with humour. LOL!

  43. Man wunna BLP yardfowls get over it… POOR people what who u trying to FOOL. Electorate can stand HYPOCRITES the BLP best bet is to let go of that issue cause CHRIS and the PM showed u guys up for the political antagonist that you are hard to win elections based on propaganda even old scoundrel jack warner proved that to be so

  44. @Georgie Porgie
That was well sung and accompanied by one of the world’s best proponents of the Anglican Chant King’s College Cambridge.Thank you so much.I regret that present day Barbados is now into the music of the ghettos of Jamaica and the USA and those who have a sense of decency are greatly outnumbered and like everything else adult suffrage has thrust upon us some of the worst creatures ever to ascend the steps of Parliament and who now have Barbados going down the road leading to the strictures of the IMF.The Barbados dollar is now in jeopardy.Free University education,Sacred Cow no 1, is the first to go.Look for Sacred Cow no 2,parity of the dollar, to go on the auction block within a year.Reminds me of the chorus ‘All we like sheep,we have turned ev’ry one to his own way’ from Handel’s Messiah.O pray for the peace of Barbados, they shall prosper that love thee.

  45. I see my old friend has done it again. As a composer he is unsurpassed. The ‘Simmons’ Symphony’ will, I’m sure, be performed again soon.

  46. Riots in de land!!

You made many interesting points in your August 17, 2013, 10:15 am post.

Keep making them on here and elsewhere.

For, this is the time for serious political action to be taken by the broad masses and middle classes against the DLP BLP and the money grubbing oppressors in this country.

    PDC

  47. JW in the news again allegedly for soliciting donations from contractors who were qualified to bid on government tenders all at a time when JW was minister of works.

  48. @David. It is alleged that Jack Warner has now filed his defamation suit against David Simmons et al, the time period of the pre-action protocol having now expired. Are you able to obtain a copy of this Statement of Claim? I have asked, but it is T&T, so not so easy, but you appear to have the contacts to do it.

I have also asked in how many other countries Jack Warner has filed, because effectively he can file in every country that is a member of FIFA. Because of the Commission’s publication on the Internet. It would be interesting to know if there have been filings in any other country and if so, how many other countries.
