CLICO Policyholders suing, finally! Photo credit: Nation
CLICO Policyholders suing, finally!

There seems to be some direct correlation between snow fall and slumber. As I sat last night at the old desktop intent on taking in the happenings in my Barbados via the world wide web, mother nature delivered her calling card in the form of powder white, and equally light snow. For me light snow makes for heavy eye lids so quite soon I was fast asleep…and now I understand why they say peaceful sleep.

I am reading BU where it has been reported that PM Stuart has shared with us a secret that has been kept better than the code to the vault of the US treasury. I am preparing to cuss Prodigal Son for his claim that my PM didn’t even know what “de damn date was till de inner circle tell he. “I just had to get the jump on AC, CCC and ! for surely my three compadres would not permit Prodigal to get away with such disrespect for a man, my man who has just created major history in Barbados. Just as my finger is about to press the submit button so as to upstage AC and them, David writes that PM Stuart…my man of the century has just announced that a major player in the CLICO master con would be arrested and his assets frozen, all this to take place on or before nomination day.

Immediately someone writing under the moniker of Leroy writes “None of you people has no nollege about who I am. There is many more over night millionaires about here than me “. Onions and Miller are now in the do, telling the BU family that the handing over of these beautiful homes to poor people is by design an election gimmick. What madness are these two telling us? This is government for the people…Government buy the people, and the people luv the government, for all of these things are nothing new.

As I grapple with the thought of cussing out Miller and Onions for poo pooing my party’s housing solutions, I am listening to Brasstacks and cussing my man Dennis J, cause Rawle relentlessly pun Mitt Mascoll’s case and DJ keeps interrupting and then refuse to let me help David Ellis  as he choked on his own saliva while trying to answer the simple question of what happened to Kaymar?

The shrill of the alarm clock gives me that wake up jolt at three am on a snowy Saturday morning, an off day nonetheless, so now I am mad as hell. I shall now spend the rest of the day trying to divvy up my anger between the fact that through the fault of none other than myself I am wide awake at three in the morning, and the fact that the jolt brought me back to reality where some Bajans wait for their pay for work already done, while all wait for a date already known, since last year. All that’s left for me to say is that peaceful slumber breeds wishful thinking.

This law suit against the Directors and Auditors is long in coming but warm the cockles of the miller’s heart who recommended this course of action 18 months or so ago.

June Fowler and her BIPA band of exploited brave hearts have prevailed against all the many stumbling blocks placed in their way by this DLP administration in its unashamedly naked quest to protect Leroy Parris from the arms of Justice and retribution.

But although procrastination can be the thief of time it can also be a blessing in disguise.

The false claim of FS to be a chief priest in the holy temple of integrity has again be laid bare by this suit designed by a tailor called truth with the scissors and needle forged in the CLICO forensic report and the utterances of a holy pretentious innocent Lawrence Duprey laying all failings of the Barbados-based operations squarely on the shoulders of the local executives and directors.

June Fowler and her band of suckers would have been totally stupid to rely on the comforting words of the Master Liar the Fumbler who wrestles with the beasts of Ephesus after slaying the lion of called King David.
June Fowler did you really expect the Fumbler to keep his promise of giving back the principal portion of their investments to the CLICO policyholders when the Barrack settlement can’t even be concluded and remains a millstone of junk around this country’s downgraded fiscal neck?

Remember this is a man who got up in the highest Court of the land and showered Leroy Parris with such adorable praises in managing a uniquely successful business called CLICO that your justification and bases for suing the same man along with named directors “SHOULD BE PUNISHED WITH LAUGHTER”.

This is a man of misplaced values of integrity that still protects the biggest con man and crook in Bim who is still able to cavort within the bosom of the DLP and offered succour and consultancy contracts by this DLP administration.

But before you, June Fowler, start thumping your chest for initiating some legal redress in the right quarters please explain to the BU readers how come such a man like Terrence Thornhill is still employed by the same CLICO Holdings where most of the assets still reside and where most of the financial shenanigans and infelicities took place and possibly still taking place?
Why are you allowing this man you are suing to be paid a salary for doing diddly-squat out of the premiums of the same policy holders you claim to be representing?

  6. The lead story in Today’s Sunday Nation is what I was hinting at earlier. The story is reproduced below.

    BY DAWNE PARRIS | SUN, JANUARY 27, 2013 – 12:10 AM
THIRTEEN DIRECTORS of the insolvent CLICO and British American Insurance Company (BAICO), including former CLICO executive chairman Leroy Parris and president of CLICO Holdings Barbados Limited, Terrence Thornhill, are facing $128 million in negligence lawsuits.
The action has been initiated by the Barbados Investors and Policyholders Alliance (BIPA), whose lawyers have served the directors with pre-action protocol letters, giving them two weeks to respond with either “plausible reasons” why the action should not be maintained or a convincing settlement offer.
Failing that, the court action to recover $76 million from the CLICO players and $52 million from those accused of negligence in the BAICO matter will be triggered.
The SUNDAY SUN was told that attorneys at law Alair Shepherd, QC, and Esther Arthur sent off the January 17 correspondence along with a draft statement of claim to CLICO directors Parris, Thornhill, Anthony Ellis, Woodbine Davis, QC, Leslie Haynes, QC, Elridge Thompson, Adrian Lorde, Basil Springer, Edrick Griffith and Vishnu Ramlogan.
The BAICO claim named former CL Financial chairman Lawrence Duprey and directors Brian Branker and Robert Fullerton.
The other defendants named in both claims were accounting firm PriceWaterhouseCoopers, the auditors of BAICO and CLICO; the Supervisor of Insurance; and the Attorney General, as the representative of the Crown.
BIPA has contended that the loss suffered by its members was a direct and/or indirect result of the negligence and breach of duties by the defendants.
President June Fowler said their actions “individually and collectively contributed to the unnecessary demise of the two companies and the consequent massive losses to policyholders”.
“It is with a heavy heart that BIPA has instructed its attorneys at law to proceed with these actions,” she said.
“Having pursued various other more conciliatory avenues over the past two years without success, BIPA has been left with no alternative but to represent the best interests of its members by taking this action,” Fowler added.
She said that many Government promises had gone unfulfilled and neither of the judicial managers had taken the route of legal action to recover the funds.
In the case of BAICO, the alliance said its members had lost out on $52 million, while the higher amount of $76 million was lost by the CLICO investors.
The statements of claim detailed where BIPA believed each defendant fell short.
Among dozens of accusations made against the directors were that they did not properly manage the affairs of the companies; rubber-stamped management decisions; recklessly funded acquisitions of investments regardless of whether they could yield any dividends, thereby exposing the company to insolvency; blindly relied on the reputation of Duprey and the CL Financial group of companies; and failed to recognize that the course of conduct embarked on by the companies could only result in their insolvency.
The Supervisor of Insurance was accused of failing to perform his statutory duties by ensuring that BAICO was only able to carry on as an insurance company if it both maintained the required Statutory Fund and complied with restrictions on the use of assets representing that fund.
As for the auditors, the claim further contended that they failed to carry out their work to uncover the companies’ risk of not maintaining the liquidity needed to meet their obligations; plan and carry out their work to uncover potential deficits in future cash flows of the companies; and to carry out their work so as to show that the returns on investment for high interest rate products were substantially lower than the returns guaranteed to the policyholders.
PricewaterhouseCoopers has already responded to the correspondence from BIPA’s lawyers. In a January 23 letter, territory leader Marcus Hatch said the company was in the process of seeking to appoint attorneys who would respond after an investigation of the matter. It promised a full, written response within a month.
Fowler said that while BIPA campaigned for the rights and restitutions of funds to all 35 000 CLICO and BIPA policyholders in Barbados, only the 424 members of the alliance had been named in the court action.
BIPA’s action comes ahead of the four-year anniversary of the collapse of CL Financial, the parent company of BAICO and CLICO, and amid efforts by judicial managers – Deloitte Consulting represented by Oliver Jordan and Patrick Toppin in the case of CLICO, and KPMG’s Lisa Taylor and Michael Edghill for BAICO – to find a resolution.
Both have indicated that policyholders would not get back all the money they invested.

Note the consummnate timing of the action. They could have done it earlier. It can damage both parties but which one is it likely to damage most. The dead King’s estate is not mentioned but It would be very strange if he is not brought into the mix especially re. the “money laundering” issue and the fact that nothing was apparently done to remove the CLICO principal executives from the list of entities exempt from the normal money laundering declarations and scrutiny that everyone else has to put up with thereby leaving an enormous chasm for the disappearance of vast sums even after the JM was active.

    Very interesting.

Hamilton Hill, I suspect that is what your dream was all about.

Today’s Nation epaper also has some interesting observations from Hartley Henry.

  8. In March last year we touched on the matter of corporate governance or the lack of in the CLICO matter. A Culture Of Diminishing Corporate Governance

The CLICO Mess has brought into focus a bigger issue, the lack of a reliable governance framework. BU maintains we have witnessed a catastrophic regulatory failure which continues to challenge all jurisdictions CLICO operated. This view is contrary to William Layne’s who continues to dumb down the role of the regulator.
The CLICO Mess has exposed corporate governance as only a term of art, to be used by the learned in our midst to demonstrate astuteness.. The mind boggling revelation by ex-CLICO directors on the weekend that many decisions made by Leroy Parris was down unbeknownst to them. Who are some of the directors you ask? Tony Marshall a retired Barclays banker who would have operated in a corporate environment at a senior level – Tony Marshall in your position as Chairman of the NIS Board the public wants to know what is the status of the financial statements. Here is a reminder of your Press Release.  Dr. Basil Springer a local management guru who founded Systems Caribbean Limited before he sold it. Woodbine Davis a former Solicitor General, Leslie Haynes, a member of the legal profession who wears silk and the former president of the Bar. To Dr. Frank Alleyne’s credit he has pleaded no comment.

  9. it would be tied up in the courts for a long time. no govt going to have any say so as to the outcome once in the courts. oSA may try to hoodwinked the clico policy holders that he can find instant relief for them once elected. but the truth is that while in govt he did nothing to prevent this disaster now he of course would want to present himself as a knight in shining armour.afterall when all is said an d done he was the gatekepper who stood around and watch the Clico house burn to the ground.

“it would be tied up in the courts for a long time. no govt going to have any say so as to the outcome once in the courts.”

Why would it be so tied up? Is that the way you see our legal system as just one long drawn out incompetent dose of salts for a justice institution?

And to think it is headed by a man specifically headhunted by our Mr. Lying Integrity from Molasses Hill who promised the same policyholders they will get back at least the principal portion of their investments very very soon like before the end of last year.
Can they really rely on this man of false promises who has the unique gift of unheard silence but when he speaks always puts his lying foot in his gaffe prone mouth.

The man’s word is certainly not his bond. No wonder he was turned down in his marriage proposal when he wanted to look ‘respectable’ in the eyes of the electorate on assuming office in the capacity of Acting Boss Man when he realized his nemesis King David laid in his bed mortally wounded from the arrow of retributive justice.

This CLICO affair will be the financial undoing of this country and the death knell to political integrity especially as long as Leroy Parris remains protected in the bosom of the DLP.

David a topic idea for you begin a thread on a head to head of DLP versus BLP platform speakers for the election campaign.

Who prevails on the platform like so:
-Stuart v Arthur > Stuart wins Arthur terrified of Staurt stayed away from parliament because of fear. Stuart oratory too profound and powerful.
-Sinckler v Mottley> keen tussle ,Sinckler cutting oratory and street humour pips Mottley.
-Estwick v Dale Marshall. No contest Marshall destroyed escorted to Jenkins by campaign platform police.
-Donville Inniss v Payne> No contest again Payne joins his shadow Gail Marshall in Jenkins.
-Jones v Cynthia Forde> Forde loses.
-Sealy V Toppin> Toppin loses curses Arthur for setting him up
-Kellman v Glyne Clark >a draw both unintelligible.
-Michael Lashley v Duguid> Dugiuid cowardly turns tail runs all the way to Montreal never returns.

What do you think let Dees supporters and Bees supporters weigh in.

    Faulty comparison here, Harry!

Duguid, despite his cussing predilection can go and come from and to Bim as he likes; even to the Christian heartland of the USA.

Can we say the same for Michael the black archangel of money laundering who can’t even move to another ministry or even pelican island for fear of being arrested by the FBI for taking gold coins from the jada and preconco fountain to be stashed overseas?

So you guys are cussing the political hand of spin and subterfuge that fed you prior to the fall of the diseased king infected with the virus of lies and cheating that ate away like a raging cancer to his deceitful character of pretense.

Come on, man, give Hartley his King Henry’s crown of divine retribution! After all, he was the chief architect and builder of the 2008 DLP resounding victory of lies over truth. He knows exactly what he is talking about.
BTW do you along with BLPNationNewspaper, Fractured, “!”, CCC, ac and the likes still trust the Nation Newspaper to tell the truth and present fairly the views of people especially those of the ditched HH?

What is reported in that article is all concocted propaganda to sully the image of this DLP administration and its moribund leader called the Lying Fumbler.

Don’t believe one word said in that newspaper. You guys know that too. Just look at the expensive ads placed in that lying rag sheet by DLP purveyors of Truth and Integrity.

  18. @Miller

With or without Henry the DLP would have won the last general election. It was Arthur’s to lose and he did a good job. There was also a third term lethargy at play and a DLP leader who had national appeal.

This time around we have a government managing in a difficult economic ad austere period. Commonsense suggests that there will be the known predilection for some voters to move and stay away. What is happening is that the Bees have energized its base but we have not seen corresponding movement on the DLP side.

On election day it will come down to who the voter has the most confidence to manage at this time.

    By Caswell Franklyn | Sun, January 27, 2013 – 12:01 AM

THE People of this country must be constantly on guard to ensure that this society is not divided in two: one part which must obey our laws, and another section that ignores the law because of the position they hold. In other words, we must not develop this society where there is one law for the Medes and another for the Persians, to use a cliché.

To that I say “expletives deleted.”

I will continue to read The Advocate and BarbadosToday as long as they remain free.

Now with regards to the Clico mess.

I read that the Trinidad government gave Clico a TT $20 billion “bailout”

It is also interesting that you all continue to blame the Leroy Parris and the board of Clico Barbados for the problems but give the Trinidadian owner a free pass.
Do you really think that Lawrence Duprey and his team in Trinidad would allow Parris to independently manage Clico Barbados?

Parris and the Barbados board are guilty of enjoying the sweets of being puppets for a Trickydadian and his band in Port of Spain.

I hate to agree with millertheanunnaki but this lawsuit should have started 2 years ago.

I would also like to know how much profit Duprey took out of Clico Barbados but wunna more interested in beating up on a lilliputian like Parris.

CLICO is a company incorporated in Barbados. Duprey could only have gotten his hands on money, read take out, if the local executive cum directorship approved it.

  23. @ Miller..As long as Leroy Parris remains protected in the bosom of the DLP.Would you go as far as telling the BU household that with a change of government, even if the justice system were allowed to function without the usual impediments,do ya really think that any of the bajan fat cats would get a taste of prison?Say yes and be guilty of the same affliction of which you accuse the PM.

“With or without Henry the DLP would have won the last general election”

We don’t even need hindsight to accept this obvious truth. Even the miller was inclined to give the BLP a vacation and time out to re-energize its expended tank of ideas and projects and shed itself of the politically bedraggled band of parasites.

It’s a pity that the people hired to hold the forte has been a miserable failure and lacking in the appropriate skills sets even though the opportunities arose to learn on the job with the goodwill of the people whose trust they are so arrogantly violating.

It seems that they (the DLP) have not learned their lesson and are employing the same expensively futile tactics utilized in the last elections to retain power this time around. Even though the Families First Account is in escrow the DLP still seem to have a financial cornucopia to support a pending campaign of mudslinging and character assassination instead of focusing on the seriously challenging matters before this economically wounded country.

The people will not fall for the lies and propaganda even if they lack the artistic sophisticated finesse of the spin doctor HH. They want to see evidence that they can buy into any promises made that would improve the fast deteriorating socio-economic conditions both at the individual and national level.
Making unrealistic pie-in-the-sky promises from both sides will not cut it this time around.

What ought to be done is to use the law via the Income Tax Act, the companies Act and the Anti-Money Laundering legislative provisions to recover some of the morally illicit gains and lucre.
The State has the power to do it with drug dealers; why not these highway brigands of financial impropriety.

  26. Agree that the people are tired and turned of from the muckraking politics.

In the article today HH made an interesting observation that a political strategist can be compared to a woman and her gynecologist in response to whether Stuart (DLP) had given him a call to perform in the role as political strategist. He went on to say he does not know who Stuart has reposed his confidence to perform in such a role. Any persons come to mind?

Do you really think that Lawrence Duprey and his team in Trinidad would allow Parris to independently manage Clico Barbados?”

    @Hants:
The problem is, our [then] PM assured the public that Clico [Barbados] WAS an independently-run organisation; no way connected to the ole mas that was taking place in Port-of-Spain.
So it is really difficult now to blame those crooks in T&T! All they have to do is quote our Late PM!!!!
    and therein lies the problem

  32. Duprey has already said he just used to “find new deals and woo clients”. That he left the “management” up to his well-paid managers.

You will be wounded trying to defend DT or FS in regard to the clean bill of health and protective sustenance given to Leroy Parris and CLICO Barbados.

Back off, Jack! Let the people (not the miller) on the ground and in the media tell you what really went down and is still going down in the continuing protection of Leroy and his bandits.

  37. What we could have a quasi philosophical discussion an is the composition of the Clico board. Forget Leroy Parris.

The Board was comprised of Elite Bajan professionals and that is probably why other Elite Bajan professionals bought “Executive Premium”

  38. @Hants

Incorrect, the reason in one word, GREED!

This was a private company and the Board of Directors flew largely under the radar.

  39. @millertheanunnaki I don’t have a sword. Requires too much energy.

    The relationship is deep.

  42. David says it was GREED!

i do not understand why bajans choose to be so gullible, why they chose to remain awake with their eyes wide shut…as usual when elections are in the air the issues that generated great havoc and lost of income are pushed into the public’s line of vision. Wait and see who will actually go before a judge, how many, if any, at all of those policyholders will receive their just reward. if they receive anything, for sure it will be to their lost, .25c to every $1.00.

Remember HARDWOOD HOUSING? With all the that went on, prey tell me, how many of the Directors and management of Hardwood housing were taken to court? how many of those potential home owners have so far received a house for which they paid? or better yet, how many have had their funds returned to them? Where are the ‘big boys’ who was running HARWOOD HOUSING now? are they in jail? have they ever refunded those potential homeowners their monies? At that time Bajans were absolutely sure and adamant that someone was going to jail.

    Clico being sued…yeah right…

  49. CLICO:how does the DLP measure the political fallout? Will they understand when they have to make the X?
