Your message to the BLOGMASTER was sent

Interesting news today.

Celebrated Lord Evil from the North breached bail conditions last weekend AND was soon after released on the same bail conditions. His bail conditions read a 10PM to 6AM curfew on the man known as Andre Omar Jackman, the name on Lord Evil’s birth certificate.

Of interest is that Evil appeared before Justice Randell Worrell in No.2 Supreme Court. His matter was adjourned until September 25, 2019.

The blogmaster is a keen observer of matters occurring in the local judiciary as evidenced in BU’s Tales from the Courts, however, what has unfolded with Lord Evil being granted bail with same conditions after breaching said conditions is a true WTF moment.

The blogmaster is willing to be guided by what occurred yesterday in the No. 2 Supreme Court.

  5. Wuhlaus! I am forced to consider Tron’s assertion that this is real politics. The government knows that as long as there are drug users there will be drug dealers. It has chosen the lesser evil of the Barbadian drug dealer in order that the Jamaican drug dealer does not take over. After all, the Barbadian drug dealer normally kills only those who are involved in the trade. The Jamaican drug dealer takes out the whole family, babies included.

    No Barbadian drug dealer has ever sought out my son or his friends and badgered or tricked them into taking drugs. The most we have to worry about is a stray bullet if two feuding dealers encounter each other and shoot in fear that the other will.do so.

    Maybe the powers that be realize that Lord Evil is indeed differentially evil or the lesser of two evils.

    Ms Mockley changed the constitution to allow judges to be removed if they delay in giving decisions more than 6 months.

    That was April 4!!

    October 4 is 6 months!!

    We will see how the constitution is enforced but don’t expect miracles, the GG has the final say and the GG as a judge was a bad offender!!

    Between her, the CJ and Burgess there were 6 civil decisions outstanding back in April!!

    … not to mention criminal …. Andrew Pilgrim got the CCJ to reverse itself and agree to hear an appeal against an outstanding criminal decision of the Court of Appeal, GG, CJ and Burgess.

    Last I heard the Court of Appeal produced a decision in that matter!!

    In April, Worrell had 19 outstanding!!

    Are you anticipating the Chief Justice will be unable to reassign the case? Also how often should we anticipate a sitting judge would be sacked?
    Finally, do you disagree with decommissioning a judge for non-performance?

    How would you suggest a case which has been already heard and is awaiting a decision be reassigned?
    The case would have to be reheard which means the litigants would have to find a whole second set of legal fees to pay their lawyers!!
    Have you thought about what is involved in decommissioning a judge for non-performance means?
    If you are savvy enough, go through the 2016 list of non performing judges (outstanding decisions) you published here!!

    If you use this list to define non-performance then here is a list of Judges who you would have decommissioned in 2016.
    Worrell
    Reifer
    Cornelius
    Roberts
    Chandler …. recently promoted to the Court of Appeal
    Alleyne
    Richards
    Jackson
    Gibson
    Burgess – promoted to the CCJ
    Mason – promoted to GG
    Goodridge
    What you could do to determine non-performance is publish the current list in 2019 and see how many judges were able, over the past 3 years, correct their non-performance in 2016.
    My bet is you will find none!!
    See how many would be left if you decommissioned the judges on the 2016 list you published, allowing the 3 year period as a period for correcting non performance!!
    The entire unholy racket, lawyers, judges, clerks etc making up the court would. it appears, have to be disbanded.
    The list above does not include the retired judges like Greenidge, Williams and Moore who no longer have the opportunity to correct their non performance!!.
    It would appear from the list above that a promotion often follows non-performance.

    Lets see how the first 3 judges on the 2016 list stack up against each other in terms of how many outstanding decisions they have been able to chalk up.
    Worrell had 12 outstanding
    Reifer had 8 outstanding
    Cornelius had 19 outstanding
    Now, let me see if I can find the 2019 list so we can say how these three judges were able to address their delinquencies over the past 3 years.

    From what I see it looks as if:
    Worrell’s outstanding decisions have increased from 12 in 2016 to 21 in 2019
    Reifer’s outstanding decisions have remained the same, 8 in 2016 and 8 in 2019
    Cornelius has reduced her outstanding decisions from 19 in 2016 to 9 in 2019

    I am surprised at your argument.

    A choice between the devil and the deep blue sea [especially if you can’t swim] is no choice at all,

    It seems to me that we would all be better off [Lord Evil too, as he seems to be an intelligent, strong, healthy young man] if there were more drug reduction education programs, so as to reduce or possibly eliminate new users, Much better treatment programs, And much much better enforcement at the airport and seaport. And a seriously strengthen coast guard [more men and women, more machines]

    You argument reminds me of the argument that a woman/man cannot leave an abusive partner, because she/he knows the devil that she/he has, but does not know which devil she/he may get if he/she leaves.

  14. I said, I am forced to consider Tron’s assertion . That is only because, other than pure corruption, I cannot think of any other reason why the man is still walking bout free. I did not say that I agree with Tron, just that I am forced to consider it.

    ‘Mr Lynch was justified in criticising it. However, I do not believe that it damaged the defence or had the potential to undermine the safety of the conviction.’
    Smith-Williams was sentenced to serve at least 35 years in prison last October, after he was found guilty of the murder by a majority verdict.

    He said Smith-Williams also told him that Rasheed Muhammad had pulled the trigger and that Mr. Ferguson was not the intended target.

    Smith-Williams launched an appeal against his conviction, which was heard in June.

    In the hearing, Mr Lynch criticised Mr Justice Greaves’s handling of the case, particularly his behaviour during Mr Harris’s evidence.

    He argued that the judge had done little to rein in the witness’s use of vulgar language and that the ‘tacit approval’ of the behaviour had lent it credibility.

    In transcripts presented to the Court of Appeal, Mr Harris cursed repeatedly, called Mr Muhammad a f****t and made repeated references to ‘fing py’.

    But the higher court found Mr Justice Greaves’s response to the unsavoury language was not prejudicial.

    Mr Justice Kay wrote: ‘Anybody familiar with serious criminal trials, in this jurisdiction in recent years, knows the judge has a very personal style, whereby he engages with witnesses, defendants, juries and advocates in an informal way, often using casual language and rich metaphors.

    ‘In relation to Harris, it was important that the judge should facilitate his evidence, whatever it turned out to be.

    ‘If he took the view, and I suspect he did, that the best course was to let the witness have his say, subject to the rules of evidence, rather than seek to inhibit him, it seems to me that that was an exercise of judgment which was open to him.’

    The way I figure it is like this.

  40. I play the ball as I see it. I sometimes find him difficult to understand. I was told that we don’t do grammar here and so even I, a former member of the grammar police force have loosened up and no longer pay full attention to good sentence structure, punctuation etc. I no longer correct most of my errors. And since I don’t edit as I used to I sometimes ramble.

    He was released under the same bail conditions as originally set out. “
