BU featured the case of Johan Bjerkham and Felisia Holder a couple days ago – with a subplot Mark Maloney – and asked the question if the law in Barbados is defined by two Barbadoses – see Mother Charged for Death of Son – Reminding the Court that Johan Bjerkham Did Same.

Again we are forced to make the same inquiry about one Mark George Daghorn, 49, of West End, Queen Street, Speightstown, St Peter who was charged with wounding with intent 39-year-old Ricardo Vincent Corbin in November 2016. A google of the name ‘Mark Daghorn’ details a few interesting stories. Go ahead, see for yourself.

BU understands Daghorn operates three restaurants in the North of the island and that the aforementioned charge against him was dropped. If the information received by BU is correct the blogmaster is curious to ask why? Daghorn is free to convey his side of the story which the blogmaster promises to publish (unedited).

    Since no one seems to notice, I will ask again: why hasn’t the man, who took his minor child to Bathsheba to surf during a storm, been charged in relation to the death of that child?

    He had a duty to protect his child, instead, he placed that child in harms way that resulted in his death. That should amount to negligently or recklessly causing the child’s death. I have heard of no criminal prosecution in this case but the authorities are prosecuting the mother who accidentally collided with an illegal protrusion onto the highway at Coverley.

    The New York Daily News pointed out that the 16 year old boy was a minor surfing in a storm in Bathsheba, with adults all around him, the idiot clowns in the minority community tried to make the drowned boy out to be some local hero despite no one even knowing who he was….and the idiot authorities in Barbados followed suit…

    In this case there must be more than one party liable for negligence leading to the ‘accidental’ death of the schoolboy.

    Based on all the evidence which has been put in the public domain one could only conclude that is was nothing but a fatal accident waiting to happen.

    The child’s mother just happened to be the careless one to bring about what the authorities- despite their edicts and protestations but still under the control and manipulation of the local maguffey Maloney- knew would eventually happen with the effluxion of time.

    So far have we had confirmation from the TP department that the Coverley construction is illegal?

    Is this an opportunity for the leader of the Opposition and the former Attorney General Dale Marshall making the claim to put their money where their mouths are and challenge the issue in the Court a la David Comissiong?

    The construction is located in the area normally reserved for traffic to pull off the highway. There is no reason for a vigilante driver to be in the path of the alleged construction. The argument is whether the constitution should be allowed in the reserve. How is it different to the one which is located at the exit from the Belle for example?

  25. We do not know the full details. If a TP officer issued an order it can be appealed and or be overruled by the minister responsible for TP. In this instance the Prime Minster. We need to know the status of the order, if it was issued and how was it responded to. Bear in mind the gas station located inside Coverley was said to be in breach of the regulations and when last the blogmaster cruised through Coverley there were attendants dispensing petrol.

  29. How is it different to the one which is located at the exit from the Belle for example?

    The only difference that I can see is that the Coverly construction is an exit/entrance off/to to a two lane highway (one lane each direction), while the one at the Bell is is next to a 4 lane highway (two lanes each direction). I think the fact that the highway at Coverly is only two lane vs 4 lane at the Bell could make it a bit more confusing for a driver not paying attention, not familiar with the highway (eg a tourist), or perhaps a bit “under the influence” to assume that the exit lane at Coverly is another driving lane and not an exit, especially at night.

    I think the exit at Coverly could really use a big “Exit Lane Only” sign hanging over or posted next to the exit lane well before the actual turn off into Coverly and some fluorescent arrow signs about 3 feet up off the ground pointing to the left (the type that really light up in the headlights) on top of the concrete protusion and plant bed that sticks out into the entrance/exit lane. If that were done, I would have no objection to the protrusion.

    Very likely because the authorities don’t care about the lives of little white children. Little white children also deserve the full protection of the law, but it seems that they may not be getting it.

    And in addition If their white fathers don’t stand up for them maybe their mothers should, but I expect that the mothers have little or no income of their own and can’t or won’t gainsay the more powerful white fathers.

    It does not need all the ”what if” speculation and assumption to determine that Barbados judicial system protects those with a lot of money. We all know that behind closed doors a lot of money can be paid to persons with significant influence to get their cases squash or make it look like the system is serving up justice while subjecting it to the normalcy of plenty delays. Both political parties have shaped and formed a special protective net to keep the status quo in Bim from ever seeing the insides of a jail cell. Therefore, why would they give a rats ass about any case that bears a stark similarity to another case, where one person could leave the island without consequence, and another has to feel the full weight of the law. We all know that Barbados is a place where politicians and the filthy rich can easily live in comfort despite the overwhelming evidence that points to get rich scheming.

    Even the ‘reactive’ Opposition have read your clarion call and are throwing their weighty legal resources behind the dead boy’s accused mother.

    The question still remains as to why the authorities are still allowing that illegal structure to pose a serious risk to other motorists.

    Can you expect to see the other law enforcement agencies applying the law evenhandedly and charge the other parties who by their very ‘illegal’ acts have contributed to the negligence which resulted in the death of the child?

    The same way people buying goods which have been stolen (even without them knowing the goods were ‘illegally’ acquired) can be charged as an accessory to criminal activities why can’t the party which put up the ‘unapproved’ structure on the highway?

    “Opposition Leader Mia Mottley says it’s unfair that the mother of deceased 11-year-old Elijah Holder-Phillips is the only one facing criminal charges following his untimely death nearly three years ago.

    The boy’s mother, 33-year-old Felisha Osula Holder, of Hopefield, Christ Church, was the driver of the vehicle, which struck a sign post before overturning at the entrance of the Villages at Coverley on June 26, 2015, killing her son on the spot.

    As a result, she appeared in court here last Wednesday and was released on $7,500 bail with one surety on a charge of dangerous driving.

    However, addressing a BLP meeting at Briar Hall, Christ Church last night, Mottley was adamant that the young mother was not solely responsible and as such she should not be the only one criminally charged for her son’s death.

    “How she can face the law courts alone and the person who built that obstruction on the highway does not have to face a single [charge] in this country?” Mottley asked in reference to the developer Mark Maloney, who has been a persistent thorn in the BLP’s side over the past six years in particular.

    In fact, their criticisms over his erection of a concrete abutment that extends from the Villages onto the ABC Highway grew louder with the death of Elijah, who was on his way home from his school’s graduation when he met his tragic end.

    “How do you think that ordinary Bajans feel tonight to know that . . . a mother having lost her son on the day in which he left primary school to go to Queen’s College? . . . How this woman can even face tomorrow morning?” Mottley asked.

    Reaching back to the issue that her party has long had with the abutment, she said, “the man who built and the company who built that obstruction on the highway, was told that it had to move”.

    “The Chief Technical Officer [in the Town Planning Department], on the 7th of March, 2012, said the design as it stands not only encroaches on the road shoulder, but also the road reserve as well as the land which is needed for any future expansion of the highway, which, given the rate of increase in traffic volumes, will soon be necessary,” Mottley added.

    Holding high some documents which she said substantiated her contention, the Opposition Leader said that on March 6, 2015, the then Permanent Secretary in the Prime Minister’s Office had written the developers at Coverley complaining that the “access egress located within the acquisition corridor of the ABC Highway has not been altered as requested . . . to allow tanker trucks to use the access egress which will exacerbate an already hazardous traffic situation”.

    Mottley also spoke of the Deputy Chief Planning Officer writing the Permanent Secretary to say that the entrance was not built in compliance with the regulatory requirements.

    “How does that gentleman [Maloney] not face action, and how has the Town Planning Department not gone up there to dig it up?” the BLP leader asked.”
