Submitted DAVID A. COMISSIONG,Citizen of Barbados
During his presentation in the Budget debate, Minister Donville Inniss claimed that the Chief Town Planner had already dealt with and given approval (“with conditions”) to an application to construct a 15 storey Hyatt Hotel at Carlisle Bay. (I,personally, harbour serious doubts about this, and I hope that the Chief Town Planner will soon issue a public statement and clear the air about this matter,)
The Minister also claimed that some of the conditions attached to the Chief Town Planner’s approval were being appealed against, and that the appeal was being addressed “at the highest level”. ( Just imagine that! They are appealing against “conditions” allegedly imposed by the Chief Town Planner! And one assumes that the phrase “at the highest level” refers to the Prime Minister Barbados – Mr Freundel Stuart.)
Mr Inniss also claimed that an “Environmental Impact Assessment”, a heritage impact assessment, a traffic study, a geotechnical survey, a marine survey and a geophysical survey were all carried out, as part of the processing of the said application.
It is against the background of these surprising and expansive claims that I would now like to draw the following matters to the attention of Minister Inniss and the people of Barbados:-
(1) Sections 17 and 18 of the Town and Country Planning Act, Chapter 240 of the Laws of Barbados stipulate that – “The Chief Town Planner shall keep, in such manner as may be prescribed, a register containing such information as may be prescribed, with respect to applications for planning permission made to him, including information as to the manner in which such applications have been dealt with”…… and …….. “Every register kept …..shall be available for inspection by the public at all reasonable hours”.
(2) As recently as Wednesday 3rd August 2016 (some 8 days after Mr Mark Maloney publicly declared that he would be beginning construction of the Hyatt Hotel in two months time) I visited the Town and Country Planning Office , consulted the Public Register, and discovered that Visions Development Inc. (Mark Maloney’s company) had filed the relevant application on 30th March 2015 under reference number 0445 / 03 / 2015B, and that the section of the Public Register which deals with “Consultations” carried out in relation to the application, as well as the section which records the “Decisions” made in respect of the said Application, were both BLANK!
(I would urge members of both the News Media and the Barbadian public to go to the Town and Country Planning Office and scrutinize the Public Register for themselves. BU emphasis)
(3) A legitimate “Environmental Impact Assessment” (EIA) CANNOT be carried out in secret – unknown to the Barbadian public– and without the participation and input of the people of Barbados , particularly the participation and input of the people who reside in the communities closest to and most affected by the proposed hotel! And to the best of my knowledge, information and belief, the people of Barbados were never given public notice of and invited to participate in any Environmental Impact Assessment (EIA) pertaining to the proposed 15 storey Hyatt Hotel! Indeed, not even one single Town Hall meeting has been held about this matter!
(4) The United Nations Environment Programme (UNEP) outlines the critical role of public participation in an Environmental Impact Assessment(EIA) as follows:-
“Public involvement is a cornerstone of the EIA process. A requirement to make information available to the concerned public and seek their views and comments helps ensure that EIA procedures are implemented in an open, transparent and accountable manner. Public scrutiny also encourages the preparation of robust and defensible EIA studies and reports. In addition, information and inputs from the public have proven useful at various steps in the EIA process, including scoping, impact identification, examination of alternatives and planning of mitigation measures. Finally, the inclusion of public views and comments in the decision-making process promotes equitable and informed choice……… At a minimum, the EIA process should provide for public notification, disclosure of information on a proposal, access to EIA documentation and comment by affected and interested parties on scoping and EIA reports. In addition, the procedures for public consultation should allow for all interested and affected parties to express their views. EIA procedures for implementing public involvement in accordance with international good practice will emphasize “active” rather that “passive” engagement of stakeholders, beginning early in the process of continuing throughout.”
The people of Barbados in general, and the people and organizations of the Bridgetown and Bay Street communities in particular, must therefore be fully informed about the proposed project, and must be afforded an opportunity to participate fully in an Assessment of its likely or potential impacts on such issues as Barbadians’ continued access to and enjoyment of the beach; implications for the animal, plant and marine life of the beach; Bridgetown’s designation as a UNESCO world heritage site; issues pertaining to sewage disposal, possible damage to neighbouring buildings, and urban congestion; and its implications for the overall environmental well-being of the City of Bridgetown.
As a result of the foregoing, I now hereby put Mr Donville Inniss and Mr Mark Maloney on notice that any effort to commence construction of a massive 15 storey Hyatt Hotel at Carlisle Bay without subjecting the proposal to a rigorous and comprehensive LEGITIMATE Environmental Impact Assessment (EIA) that provides for suitable notification of and input by the people of Barbados will, in all likelihood, be met with a challenge in the Law Courts of Barbados .

I remember the then DLP opposition, especially Denis Kellman, was highly critical when the old Hilton Hotel was about to be demolished by controlled implosion on October 25, 1999. Ignoring the fact that the original Hilton, which was opened on November 27, 1966, needed refurbishing, the DEMS continued to criticize the project until after the new resort was opened on June 6, 2005.
The DEMS were also CRITICAL of Sugar Hill, Royal Westmoreland, Sandy Lane Golf Club, Water Hall Polo Club, Port St. Charles and when Owen Arthur broke the ground, in February 2006, to commence construction of the $1B Apes Hill Development Project (a joint venture between local and foreign investors), as well as the number of private villas and condominiums constructed on the West and South coasts.

The then BLP administration was heavily criticized by the DLP opposition for facilitating the “planting” of hotels and villas and retirement villages with associated golf courses and facilities, rather than sugar cane. They also expressed concern about “the availability of land in our small country and the development of large-scale projects by foreign capital alone or in tandem with local financing.”
An emotional argument, designed to prey on the sentimentality of Barbadians for the benefit of individuals whose primary interests were political, to wit, “Barbados was being sold out to rich white foreigners, at the expense of ordinary Barbadians,” became the “buzz word” of the day.
Arthur explained those hotel and tourism related projects were geared at earning foreign exchange and generating employment. Ironically, Sealy expressed a similar view to justify the recently announced hotel projects.
Therefore, based on the DLP’s criticisms, one could reasonably conclude the DEMS were of the opinion foreign direct and local investments, earning foreign exchange, economic growth and employment were NOT IMPORTANT in those days.
Early in 2007, Royal Westmoreland produced a promotional video, which also showed black Barbadians serving white guests, and this caused the topic of racism to “raise its ugly head.”
Perhaps Donville and his colleagues did not believe their criticisms of white investors “building properties for the rich and famous to be served by black Barbadians” as “the opposition playing the race card.”
Ironically, the DLP who are DEFENDING the concessions given to Sandals, were HIGHLY CRITICAL of the generous concessions the Owen Arthur administration GRANTED to the Ape Hill project.
There are no fundamental DIFFERENCES between BLP and DLP POLITICIANS and their YARD-FOWLS.

JADA has “imported” a number of artisans from St. Vincent to work on the Sandals project. Management’s claim is that they cannot solicit an adequate number of Barbadian artisans for this project. Their claim may be “technically” correct if one does not take into consideration that JADA is prepared to break Barbados’ labour laws as it relates to of remuneration.
In actuality, the “DEARTH” of local workers is as a result of this construction company being adamant in paying Barbadian artisans BELOW the AVERAGE DAILY RATE.
For example, JADA is prepared to pay a labourer $60 per day, $20 less than the legitimate daily rate of $80. Additionally, they want, for example, a carpenter or a mason to also undertake labourer duties, for the same rate of pay per day.
Add CHEAP LABOUR to Sandal’s list of generous concessions.
But you know when anyone dares mention “Sandals” or “Butch Stewart” in this forum, the resident consortium of yard-fowls “get into a tizzy” and respond with absolute nonsense.

A court challenge is the only way to make sure everything that was supposed to be done prior to construction actually was. It wouldn’t have come to this if the government would have been transparent with it’s citizens. In addition guarantees should be in place in the form of cash in a deposit to the Central Bank to make sure the entire project is completed, and approved which will be returned without interest, and that interest being returned to the general fund. No government personnel, or their family, or their relatives can profit by any connection with any part of construction, and if discovered would have to resign their position, and an election to replace them in government would require a vote by the people of either a B, or D candidate.

The property will be located on Carlisle Bay’s Brownes Beach, adjacent to the capital city of bridgetown.
The property will have a restaurant, pool bar and grill, cafe, full-service spa, fitness center, outdoor pool, kid’s club and 6,135 square feet of meeting space.
The hotel will be built by Vision Developments.

What if these vagabonds effect their own version of a EIA, sans any of the expansive requirements of the UN or other agency definitions and EIA scope?
For example when building a house in recent times it behoves the buyer to have a sounding effected for the foundation of the house to ensure that one is not building on what was previously a filled in swamp or land fill in 1850.
Suppose a man is supposed to drill 6 holes that are 25 feet deep but he drills six 2 foot holes and, like the foundation of the Old NIS building on Fairfield Street, feels that to secure foundation might require too deep a sounding, how can you (a) ascertain that he did do what was required and (b) having supplied that confabulation, hold him to any other standard that what he has set for his EIA?

Many a Document of Intent by International Corporations when they are apprised of the irregularities of an administration, have ground to a long term halt, once they become aware of the fact that the normal enabling steps for them to affirm the utilization of their name does not come into any disrepute, HAVE NOT BEEN EFFECTED.
That has happened in a number of WB projects when the WB catches wind of some sleight of hand.
Hyatt is not an idiotic firm and they cannot be hoodwinked by Baloney and his local goons.
The issue of the EIA and this legal issue is enough for a firm that is not a banana republic agency and that is responsible to shareholders IS ENOUGH TO CAUSE THIS PAUSE until they can be totally assured of specific conditions.

The other Caribbean island’s leaders would know to engage the people, the voters, the taxpayers whom they work for FIRST, before any such deal is done in any back room, they will know that being arrogant, secretive and telling lies to the people will result in another island getting the opportunity..when the shit hits the fan, as it is for yall now.
