Dear Sir or Madame  – we act for Liz Spencer.   It has come to her notice that on your interesting site are copies of documents in connection with  our client’s dealings with Ms Clare Cowan and, we see, a letter other UK lawyers, IFLG,  wrote to Ms Cowan, dated 13 March 2015 .

We have been asked by our client to write to you to please ask you to take down from your site the copies of documents which in any way relate to our client  – which are both confidential and privileged.

Please reply to us by return with your agreement to our client’s request and to confirm you will take such steps immediately.

Please also tell us the source of those papers.

BU responded to rhw on the same day, to date we have not received a response. We have given a reasonable time for a response and in the interest of being transparent  we share the communication with the BU family.

Dear Mr Britten,

We have your e-mail dated 20 October instant.

Your request is very non-specific and we would be obliged if you could assist us in pointing out exactly which letters and/or e-mails specifically assert privilege or those on which solicitor-client privilege might be asserted. If we have indeed published documents on which privilege is asserted or can be asserted on a solicitor-client bases, it would have been in error and we would certainly be prepared to remove these from our site. However, absent such assertion of privilege or evidence of the paper-trail by which such privilege was first asserted, we regret that we cannot comply with your request.

As for your request to name our source, you know better than that and if you do not, you should, given the press practices and rules in the United Kingdom.

In any and all events, we state without equivocation or fear of contradiction that this subject matter is one of national importance and interest to Barbados. Your client, either by herself or through you, is welcomed to post your side here on BU and we invite you to do so, either credited or anonymously. We are an equal-opportunity blog.

I wonder if Mr. Britten would have the audacity of telling any British paper to “please give them the source” of anything which it has published. I very much doubt it! That is why we need a Freedom of Information Act in this country posthaste.

Liz Spencer seems very qualified to be in the ‘loan shark’ business. Alvin Cummins intimated in earlier comments on other blogs BU’s claim of having received a letter from Spencer’s lawyer less than genuine and requested we post it. Truth be told we wanted to give Spencer adequate time to respond, to be fair.

In the mean time traditional media continues to be led by the political narrative of the day. Listen to VoB in Sunday talk show if there is doubt

That is it. Cow-an would have had to convince her that Cahill/Barbados was in the bag to get her to release such a lumpsum…….hmmmm…interesting to see the outcome.

  16. Amused November 13, 2015 at 6:40 PM #

    @David. Well done.

@Casewell. In your first post you say, “I am grateful for the Solicitor’s letter because it has proven beyond any shadow of a doubt that BU is the real deal that can be relied upon for authentic news.” Yes. BUT you fail to make mention of the fact that BU protects both its sources and its family, unlike other blogs. AND I think you have misspoke in your second post. You say, “….we’ll just have to wait to see if Claire is walking funny the next time she’s in this neck of the woods,” I would respectfully suggest that you take the words “the next time” and replace them with the word “because”, although I also venture to most respectfully suggest that her walking funny might have far more to do with activities the results of which are quite other than broken knees.

Quoting the Times of Malta article above (individuals therein actually residing in Guildford, quite like the ones that you quote, interesting that).

”Convicted conman Patrick Spiteri was arrested yesterday afternoon following an investigation by The Sunday Times of Malta that tracked down the disgraced lawyer to a country mansion in an upmarket rural town in the UK.

Surrey and Guildford police moved in at around 3pm after being alerted to his whereabouts by this newspaper.

He was watching his favourite team Chelsea play Liverpool when the police knocked on the door. He was later found hiding under a bed, police sources said.

The 50-year-old former tax law guru has been living permanently in the UK since January in a €4 million country estate set over 15 acres of land, evading the Maltese courts where he is facing eight separate cases linked to fraud and misappropriation charges.

Since October 2013, he has been presenting medical certificates that claimed he had multiple sclerosis and was unfit to travel.

    Police raid country home

Last May, Magistrate Consuelo Scerri Herrera – at the request of the prosecution – decided to postpone indefinitely a case in which he was accused of defrauding an Italian businessman of almost €5 million.

Seven other cases, in which Mr Spiteri is alleged to have swindled in excess of €10 million, were also put off. However, in an apparent change of heart Malta police asked the courts to issue a European arrest warrant after the medical certificates could not be verified.

The request was upheld on October 20, but Mr Spiteri’s whereabouts were unknown until The Sunday Times of Malta tracked him down in the sprawling Barford Court estate belonging to former Tory MP and MEP Tom Spencer and his financier wife, Liz. He has been living there with the Spencers’ daughter, Lorna Maltby, and their two children. Though this newspaper managed to get visual confirmation that he was on the property, Ms Spencer ordered journalists out of the mansion’s inner grounds, which are separated from the main gate by a 70 metre driveway.

Mr Spiteri was visiting a Christmas fair with his family in a nearby town yesterday morning but returned in the early afternoon, only to be taken into custody shortly afterwards.

Two Surrey officers turned up with a police van.

One stayed at the front while the other checked the property from the back when they got no answer after knocking several times.

Eventually, they were allowed inside and moved in to arrest Mr Spiteri after searching the house.

Shortly after that, he was driven out in a panelled police Ford Transit van.

Patrick Spiteri’s profile as Patrick Borgia on dating site and, top, his message to ‘Sarah Montgomery’.

    Conning the conman

The man accused by many of being a con artist ended up giving himself away with a profile on dating website

Notoriously camera shy, Mr Spiteri ditched his inhibitions and posted four pictures to entice prospective “slim and athletic”, “attractive” women whose best features are their “smile and legs”.

He used the alias Patrick Borgia – another independent reference to his claims of a House of Borgia lineage [see box below] – and confirmed his identity when he responded to a message sent from a profile this newspaper set up under the name of Sarah Montgomery.

He asked for photos to be sent to an e-mail address attached to the server of Symphony Global, a consultancy firm where he was a director and in which his current partner and the mother of his two children, Lorna Maltby, and her mother Liz Spencer are still involved.

“Hi there. Yes, I am [Italian],” he answered when asked a question about his nationality.

‘Patrick Spiteri runs like a greyhound’

Not everyone at the estate was distressed by the arrest. Tom Spencer, former Conservative MP for the Surrey county, said he blamed the disgraced lawyer for the breakup of his family.

He said his wife was seeking a divorce, which he was not opposing, but she wanted to sell Barford Court, which was put on the market in March 2014 with an asking price of £3 million, to give her share of the money to Mr Spiteri.

“My children will never see it again,” an emotional Mr Spencer, a broad 6’5” bearded man said, referring to the lush green park at the back of the property.

He claimed Mr Spiteri manipulated his wife and step-daughter into believing the Malta court cases were orchestrated by the former PN government.

The PN was in power when his career fell apart in 2000 and he was engulfed by a stream of fraud allegations by investors.

However, before his fall from grace, Mr Spiteri was widely regarded as a leading legal authority on financial services, having been entrusted by both PN and Labour administrations to draft landmark tax legislation.

Ms Spencer rejected her husband’s claims, saying as she escorted the journalists off her property that Mr Spiteri had never done anything to harm the family. However, she also alluded to political orchestration in connection with his legal trouble in Malta.

    Former Tory MEP Tom Spencer
    Former Tory MEP Tom Spencer

Asked whether he believed that Mr Spiteri was seriously ill, Mr Spencer said that over the past months “Patrick would on some occasions climb down the stairs apparently hardly able to move, having to prop himself up with a walking cane… but then on other days he would forget and be completely normal”.

“The truth is that Patrick runs like a greyhound. He is very nervous and runs up stairs in sets of three.”

Mr Spencer said Mr Spiteri had persuaded his estranged wife to lend him hundreds of thousands of pounds that were lost in what he called unsuccessful investments. Ms Spencer denied this claim.

For years Mr Spiteri ran an investment firm and advised the Fenech Adami administration on the introduction of VAT in 1995. He also acted as a consultant to Labour a year later on the changeover to the Customs and Excise duty.

In the late 1990s he was investigated over multiple cases of fraud and misappropriation that led to at least 11 criminal cases. So far his only conviction is in relation to a property contract. Prosecutors often said he used delaying tactics in court.

    Borgia family turned Mossad agent?

According to Mr Spencer, Mr Spiteri would make outlandish claims about himself and his family history.

Among these alleged stories was a claim to be a descendent of the Borgias – the highly influential Spanish family that dominated Italian public life during the Renaissance after producing two popes and a string of cardinals, aristocrats and politicians.

“Patrick said that the Borgia family had settled in Malta when they were exiled from Italy during the Mussolini era and that he was a descendent of this family.

“He claimed the Italian State had seized a number of properties belonging to the Borgias which the family was now battling to obtain back over a long-drawn legal process typical of the Italian legal system.”

According to Mr Spencer, he even claimed to be a former agent of the Israeli intelligence agency Mossad – a connection that apparently also springs from the Borgias’ rumoured Jewish heritage.

“He said that he was part of an international anti-terrorism agency that incorporated people from the US, UK, Israeli, Russian and Chinese intelligence agencies,” whose task was to uncover the secret financial assets of terrorist organisations.

In recent months, Mr Spencer said that Mr Spiteri claimed to have travelled on secret missions to all sorts of exotic destinations like Angola Djibuti.

“In late Autumn 2013 – a period corresponding with the onset of the alleged medical condition – he claimed that he was poisoned by al-Qaeda.” Unquote

“That is it. Cow-an would have had to convince her that Cahill/Barbados was in the bag to get her to release such a lumpsum”

DD’s gut says that, given that Liz Spencer was Chief Communications Officer of Cahill Energy – Guernsey, from June 2012 to August or September 2013, while the Four Ministers were being set up, Liz was a (big) part of the set-up, and believed in her own good work for Cahill.

And the unsecured “loan” may in fact represent unpaid wages/salaries etc she was owed by Cahill which she decided she should have documented after she left and got cold feet.

“Liz Spencer seems very qualified to be in the ‘loan shark’ business.”

I agree with Caswell that “loan sharks tend to break knee caps”

As MECC said in her September 4 email to Tim Gleason, the “rather ruthless fellows” at Ridgemount FS Ltd more closely fit the loan shark profile.

So what will it take to convince politicians in Barbados that fraudsters from other countries target and prey on small island governments because of their vulnerability and greed. If the Cow-an fiasco don’t teach them something this time., they will never learn.

Seriously though, why do people in Barbados buy newspapers? As much as I love VOB and Q FM if I had to pay to listen I would feel cheated. While we understand that not everything placed on social media is gospel, lil common sense tends to get you to the meat of the matter. That’s why these heifers are so bitterly opposed to BU…..problem is that just like me checking BU is high on the list of Order Of Business for the day for most of them. …..though they don’t admit it. Heard David Ellis sometime ago talking about something he had read and as if he would catch the plague holler amm amm I saw it somewhere. We all knew that source was BARBADOS UNDERGROUND.

Pardon me but I’m a little disjointed from the lack of sleep. I was trying to make the point that the mainstream media cannot be relied upon to provide thorough ventilation of issues. As the song goes Ain’t That A Shame? That some feel more of a need to police the noise that night life makes than offer their all powerful voice to the condemnation of CAHILL is shameful.

    @ Gabriel

I am humbled to be among your venerable listing even though the ole man is often referred to (adoringly by detractors here) as PieceuhMadman and PieceuhSpiritualBackSlider (were it not for the Saving Grace of de Madam) at the ** Church

BBC featured a a noted calligraphist, an educator from Berkeley, a writer and a neurosurgeon and spoke around the issue and mechanism of writing in a recent airing on one of its many engaging talks.

In speaking on that topic, the calligraphist spoke to the science of writing, the educator and writer spoke to the skills of writing and the neurosurgeon spoke to the synapses which the brain scans activated.

DE ole man, while not a calligraphist, nor writer nor neurosurgeon would however state that the diet we received in being raised on books, without going anywhere, but the church, the schoolyard, the stan pipe, the pasture, the Harvest, the church fair, the church in another district, the other peoples churches that were “permitted interfaith venues” and much later, as you were allowed to “lef home” ALONE, the fairs in another district etc., without leaving the shores of this 2 x 2, in the Atlantic Ocean, our world was well defined, albeit by x, y, z, AND the dimension of thought, long before we went to Amurica Kenada and Englant.

We knew of racism well before our encounters in Canada and London and in the United States of America and while the x, y, z and t (time) riveted us more rigidly in “their” timeline, we had been there before in the expansive spectrum of our minds, coloured by later encounters facilitated by steamers and BOAC.

It is therefore not necessary for CNN News to feed us with the drivel of 128 people dead, we understand why “the soft belly of Paris, as opposed to Englant” with its MI5 and 6 and SAS and what is the impact of showing to this host of the Climate Change in a few days/week, why we can bring up our date, with impunity, just months after our Charlie incursion.

We were raised to think for ourselves and to take information, filter the fluff and to extrapolate with some uncanny accuracy and, while we do not relish in the falling of these citizens, what already our minds are clearly understanding is what these 128 AND the man with the grenade in the UK airport WILL MEAN to our tourism product, already lurching.

If the UK and France with its National Gendarmerie Intervention Group (GIGN) could be so seemingly useless then what can we with a Police Force embroiled in a fired Commissioner of Police who was implicated in taping the conversations of a former Prime Minister and and Acting Commissioner of Police without the power to arrest CLICO and BHL criminals, what can we truly expect to be the outcome WHEN the hotel booking are cancelled?

    What are the cuntry’s alternatives?

Oh doan tell de ole man nuffin, I am getting a feeling from those disembodied spirits here assembled, they are telling me…”hitch your wagon to Clare’s wagon…” cause, one more incident, and the coming winter season is through the edoes

Needless to say, the economy of Barbados is well on the way to recovery and our other industries so skillfully crafted, and supported by these DLP Dufusses, will easily weather the coming storm..

The owner of the sprawling beach front property on the east coast, once known as Foster’s Funland, sadly, met his death in a traffic accident recently.
Lets wait and see who will be lining up to grab this piece of prime real estate. In the blue corner are the lawyers, and in the red corner are the BJerkmans, COWS, Malonies.

  36. Frustrated Businessman November 19, 2015 at 7:12 AM #

CB, Mr. Foster has had that property for sale for decades but unfortunately, there is a long history of development permission refusal for Foster’s Funland based on the fact that the Scotland District is a National Park. The exception to this blanket embargo would obviously be the Greenland Landfill. A change of circumstances that would allow its development and, therefore, sale would certainly be an earth-shaking development.

But it seems Gov’t House is earthquake-proof. In fact, by the time you get up on the 3rd floor, not only can’t you feel what is going on in the world outside but all ‘noise’ is negated as well.

Is it a coincidence that Bjerkham ,after 17 years of fighting for land which the Australian farmer was evicted from, suddenly gave up all interest in the same land, shortly after the demise of Mr Foster. Is Bjerkham now has his chops set on developing what was once Foster’s Funland.
