In the news recently Barbadians learned about a Court battle over the sale of The Farm Plantation. In 2005 a Court approved the sale of the plantation to Timothy Walsh of Nature’s Produce for $1.5 million. And in a recent court order the 135 acre property was approved to be sold to building magnate Bjorn Bjerkhamn for $1.35 million.

The treasure which has caused wars to be fought continues. On BU “Plantation Deeds” continues his online war to expose a matter which he believes is not being given enough airplay by the establishment. Here are some more documents which includes The Farm plantation and the Urban Development Commission (UDC).

Yes we know, BU is not a court of law BUT an online medium which allows the ordinary to give vent to concerns.

    I have been following this with interest but am getting increasingly confused.
    Deeds has not strung together any kind of cogent story; the documents don’t seem to prove anything – they are just produced at random.
    I have seen no case made out that shows me (let alone a Court of Law) that there is any substance behind this at all. It is not helped by comments from Deeds like the one about 200 – 300 plantations being owned.
    Sorry – for me, unless something more conclusive comes out, I have to conclude while there may be some basis of land pwnership behind this, the conspiracy theory is a fiction.

Some of the lots at Well Gap were stolen by persons who went to court and perjured themselves by claiming that they were entitled to claim title because they were in undisputed possession of the land for ten or more years. Violet was unaware of the matters before the court and therefore did not object. I still believe that these properties could be recovered because the new owners obtained title to the land by perpetrating a fraud on the court. Unfortunately, some lawyers were active and willing participants in this fraud and we know Barbados, their fellow attorneys and the courts will close ranks to protect them.

    Enuff@ Let us say that the letter from the UDC Lawyer made up 2 names that we did not see at that time ,
    We ask the lawyer to produce the deed in the letter and it can not be found now where at all even the land registry not Archives ,See if you can find that name person , we cant even find it at birth records.The lawyer never reply.

    As you all were told before Sir Ham was to Ascent the Plantation deeds, He did not get the other land and house deeds, So we still have them , We also did not give all what we had to the police and most removed from records??

    The letter proves that they made up a letter to get paid for the lots , that money was paid out to a Big law Firm.No one ever though that , THAT real deed was still around from under Beatrice Henrys BED

    After leaving Barbados in 1970 , Lived in Guyana& Suriname and the US of A and to come back in 2003 , To hear a cry for help , to get on a plane and come to see this Queen ,, Who just BURN my brain.
    Then to sit at her table for more than 3weeks looking at papers , from 9 am to after midnight, Then to walk from King Street to Rockely
    Then to learn Barbados from the Plantation down , not LOT nor Plot,
    Had to study how Barbados looked when Beatrice Jemmott was born 1892 till the time she bought her first plantations in 1926 , Ventnor , Sixmans, Allyendale, and so on , ,Then to buy My first in car Barbados to drive her to see them All ,Using the Plantation Deeds as a road map.. Yes it will burn your head,
    I will say it took a year to sink in , until i had a problem like most of you had , and when i had a dream i woke up and said to my self,

    With each new release of documents, your case, imho, takes on a greater degree of believability although some things are still not clear. On seeing the pictures of Violet Beckles I realized that I recognized her face as someone I’d seen before, possibly at the General Hospital where I worked for a year after leaving HC (Brumley for Legalese). The stories in the Nation therefore partially filled a gap in my recognition of a real person whose inheritance was probably stolen through the collusion of several actors. Your description of driving Beatrice Henry around to see her property all around barbados also struck a chord but It would be nice to get some fuller historical vignettes of her as the rich high flyer of a half century ago but who is practically unknown now. That is possibly one of the greatest unwonted consequences of the numerous bites that possibly claimed all her properties.

    It would be a pity if this matter becomes swept under the carpet and dies a natural death. Following David’s suggestion that the BU Lawyer posters should consider using Caswell’s BU inputs on this matter as a starting point for a more rigorous assessment of the legal viability of your claims on BU , I’m wondering if you ever considered contracting say, Caswell, to put together a “case” for you that might have a fair chance of being considered seriously by some outlier member(s) of the legal fraternity. I think they are a few young ones who who could be trusted and who might see the case as a vehicle for advancing their careers.

    Once again it might be useful if someone in the young group of lawyers that we were told on BU had taken up the case and then abandoned it because of its complexity, could themselves tell the BU family exactly why they abandoned it. I wonder if the Lawyer (Was it Legalese?) who made that disclosure could go one step further and ask one of the group to summarize their reasons for quitting on BU. That should give us some untrammeled insight into the likely legal outcomes of this campaign.

    The young lawyers has no choice to back down not because of any complexity. Complexities can be unraveled. It is my belief that the young lawyers where shown the road to their success and after careful manipulation and intimidation by their superiors to see the trouble that would brew for them on that road they decided to back off.

For my taste, however, there is still far too much information missing. This entails not one, but several, title searches, some going back over a century – each one of those will require a LOT of man hours. And at the end of the day, they may not prove anything. Therefore, if I were Deeds, I would find a good searches clerk – and there are several in Barbados – and pay them to conduct the necessary searches at the Archives and the Land Registry. I would then order certified copies of the relevant documents (which he is going to have to do anyway if this matter is to come before the courts). In the timeframes that Deeds is discussing, let me assure you that there is no possibility of the documents at the Archoves going missing. So, if they are not recorded there, it means that they were never recorded – and if they were never recorded, then they have either been misplaced and there is nothing further to be done – OR they never existed.

    I do not have enough to go on from what has been posted here and in previous blogs, to form any firm opinion. There is the appearance of there being something here, but insufficient hard evidence at this stage.

    It was not the ” complexity ” of the case that turned off the group of young eager lawyers ; it was really the inadequacy of the evidence , documentary and otherwise which showed them no way forward in the ungodly jumble . Complexity is no barrier to the unraveling of legal issues . A very real example of what they encountered is here presented by the ” documents ” produced on this blog ; these documents provide nothing but confusion . Our system of title searching allows a search to be done on any parcel of land in Barbados . We now need to go back no more than twenty years to establish a root of title ; not so long ago the period was SEVENTY years . There is therefore adequate facility for making legal sense of any land matter if AUTHENTIC documentary evidence is produced . My own basic knowledge of conveyancing causes me to treat the documents displayed
    by this Plantation deeds person with the greatest level of incredulity . It is however clear that your own knowledge of conveyancing causes you to have a wholly different opinion . Take comfort ; that is the nature of the law .

    Whoever ” fabricated this mess ” is not the issue . I am more concerned about the outlandish claims being made by the Deeds person that may only confuse this matter more . For example , in answer to a very logical observation by ANON about an EARLIER document bearing reference to a LATER statute and the irregularity of the drawn and prepared stamp at that time , Deeds replies that that happened WHEN THE DEED WAS REDONE. Now that is an explanation that can make no legal sense ; DEEDS ARE NOT REDONE . A deed may be replaced if the original became lost or destroyed . If land changes ownership A NEW DEED IS DRAWN TO REFLECT THE NEW TRANSACTION LEADING TO THE TRANSFER . If you wish this blog to be credible you must allow claims like this to be held up to logical scrutiny ; in the absence of that kind of assessment , the blog would degenerate into a medium for slander and the destruction of our institutions . All I have been trying to do is to raise some issues which go to the heart of this incredible tale in an attempt to rid the discussion of that kind of sentiment , based on someone’s acquaintance of Violet Beckles when she was a patient in hospital etc , which seems to have influenced the thinking of persons like CHECK IT OUT .

    Deeds is not a lawyer and obviously does not have all the answers. It is why he is reaching out via this citizens medium to make his concerns known. Some of us are prepared to work with him to separate fact from fiction. It seems you are willing to shoot down all of his argument on the basis of its ‘incredulity’.

    Earlier question stands, who are the young lawyers who tried to help out on this matter?

    Caswell’s preliminary investigation has caused him to treat most of what the Deeds person alleges with a pinch of salt . Go back to his earliest postings and you will see that he said as much . He said too that his researches lead to the discovery of SEVENTEEN PARCELS of land ; there is nothing unusual in finding persons of modest means with that kind of legacy . A search in the many villages would support that view . Start with the wider Black Rock area and you will see what I am talking about . The larger level of disbelief surrounds the claim about 200 to 300 plantations etc .

    NO YOUNG LAWYER IN BARBADOS CAN MARK FAT WITH THIS CASE….they are just a bunch of trainee donkey lickers.

    What we have here is a case of massive whole scale FRAUD at the highest levels of our society.(Where is Bushie’s National Supervisory Committee with Caswell when we need it….?)

    Amusing’s prescription is truly amusing. Taking this matter to court in Barbados will be synonymous with praying to the Devil for deliverance from Hell. As Deeds correctly surmises, the thieving lawyers who defrauded Violet Beckles are now QCs, Senior Counsel, Sirs, AND JUDGES……and even higher….

    In the SAME vein in which the BU lawyers raise minor technical doubts to attempt to dismiss the case, you CAN BET that any Bajan Court will likewise – after many years and MANY HUNDREDS OF THOUSANDS OF DEED’S DOLLARS ARE WASTED, ‘decide’ that in its opinion “some evidence is unconvincing”…..and dismiss Deeds’ claims.
    That is their idea of JUSTICE.

    Deeds has the right approach.
    – PUBLISH THE FACTS THROUGHOUT BARBADOS AND THE WORLD

    – CALL NAMES. If David refuses to publish them, then start your OWN BLOG too. (What became of FOI David?)

    – PICK ONE OBVIOUS CLAIMED PROPERTY with full documentation and pursue THAT ONE legally initially.

    Sue one of the thieving lawyers for malpractice just to keep the case in public view. (Such a suit could only succeed in a just society)

    ….whatever you do, DO NOT LET ANY MORE OF YOUR DOCUMENTS OUT OF YOUR CONTROL….

    If you go back to your earlier postings you will see that mention was made of a group of lawyers lead by Dr Blackman that gained coverage in the Nation newspaper . I am not shooting down anything . I take issue with the fact that a greater level of debate is taking place on what is obviously FICTION rather than any concerted effort being made to use the FACT as a means of assisting this Deeds person . Because of this he has been allowed to become more and more preposterous in his claims .


  22. A Court Application should be filed in to ensure that Evidence is reviewed and not ignored. The Court will decide if it has any merit. If you reserve the right to submit further evidence it can be collected and submitted while the case is in progress. Lawyers would charge large to produce Bundles for Court, which David is doing free, so Lawyers will not be needed for their extortionate cut.

  25. Thanks Kiki, what the lawyers who have contributed so far have ignored is that there is activity which feeds the discovery process. It is here that Deeds needs help instead we have our legal eagles attacking the guy as if he were on the damn witness stand.

    The point which you have conveniently tried to go pedantic on is that the issue here for BU is whether Violet Beckles was taken to the cleaners by the ‘system’. The quantum is secondary at this point.

    One man’s “lot” is another man’s “plantation”. Who says that a plantation must be 500 acres? Or 500 square miles as in Brazil? Or maybe 5000 square feet as in Violet Beckles’ mind…..?

    Deeds made the earlier point that records have gone missing and he produced the references to show (is this not so Deeds?).

    If there are references it means there were documents. Let us have a look!

    What do you mean by ” records gone missing ” ? If you are speaking of the official Government Archives , that statement does not make sense . The Archive Department makes it possible to trace documents and they are recorded as historical records ; it is not like going into a library and not being able to find a text because it has gone missing for whatever reason . Archival science is too complex an area to be understood by the person that Deeds presents himself to be . That is why i keep making the point that emotionalism , slander and ignorance must not be allowed the currency that it is receiving in this matter .

    The claim is that a set of documents were presented to a well known lawyer whose services were sought in handling the affairs of an ordinary but land rich citizen.
    -The lawyer later reported the papers “missing” and some of the land subsequently ended in in strange hands.
    -Strange people received money for the sale of said lands
    -The official documents have been “adjusted” or are missing
    -The named lawyer has had his name “out there” now for YEARS…
    Has he clarified his position? Cleared his name? Offered an explanation?
    -Other Legal persons have been named…..have they clarified/explained?
    -Known lawyers’ names are on documents …has anyone explained?
    -Caswell attests that something is amiss…..does ANYONE doubt Caswell’s ability to confirm such?

    But anonymous “legal lights” are calling this a “non issue”!!!??
    WHAT THE HELL! Not ALL Bajans are jackasses!

    I do not know how to contact Deeds, however, I think that he should start small by trying to recover the piece of land that the Chief Marshal sold in error or in incompetence.

    Violet was not a patient: she worked as a maid at the QEH for many years.

    I am not trying to be mean, but Violet could not fabricate a shopping list: there is no way on this earth that she could fabricate a deed.

    I am not saying that there were only 17 parcels. I had other work to do and I thought that I had enough information to satisfy the Attorney General that Violet had a credible case, and the AG would then institute an investigation: she never did.

    NOW think why? If you go back 70 years if there you will find Beatrice Henry. or a big gap between the land registry and the Archives.
    so they made it 20 years for the have been taking from the Estate for over 24 years, What year did the 20 rule came in to effect?
    So behind 20 years you will find NOTHING and make your new deed and make your fees.This a called Fraud and good title , what you need to get is CLEAR TITLE.
    The problem is that most lawyers are lazy and look for the easy way out and to make a US DOLLAR.

  43. I hope BU notes that the UDC letter (a) was addressed to M. M. Talma and explicitly states that “subsidies were paid to Messrs Carrington & Sealy attorneys-at-law, who acted on the behalf of the purchasers….”, which confirms what I have been saying all along that UDC does not sell land. With this information should Plantation Deeds not be able to have a title search done at the Registry to find out who was the Vendor?

    Did you check to see who now lives on the identified lots? It is not like the land is mobile. Again if research was done, BU and Deeds would know that the names of tenants are ascertained and confirmed by conducting a survey of the tenantry so I find it hard to believe that the attorney could have sent fabricated names to UDC when they would have supplied him with the names in the first place.

    David@ YES We went all places and even face to face with Mr. Williams the Chief Archivist at the Archives in Black Rock. After we arrived there with a suit case of 50 pounds of papers(DEEDS) .

    Mr Williams as i was told by him to be there at that time for 25 years and counting,So who better to ask about the Plantation Deeds,Instead Mr. Williams ran out the door and said he know he got his deed.
    The same papers that the Fraud Squad saw and copied ,All the places the AG told us to go to check we had done before going to the AG.in 2009 and 2010.
    Remember also went to the AG MIA so that is 3 AGs and NOTHING was done?
    What is the Duty of the AG in Barbados ?, Is it to get an extra check? and to block the laws in favor of lawyers like the BAR Disciplinary Committee.With Keith Simmons and David Simmons on TOP.
    Why you think PM David move him, he knew and saw Violets Papers when he was Also the AG for Barbados ,, TOTAL NUMBER OF AGs = 4.

    Kiki @ last count of lawyers who was on this case is at 63. many came back with Plantation deeds and the amounts of the land at time was reduced from 80 acres to 20 acres but the land surveyor said the papers he have show it was really 90 acres.
    We had many stack of deeds from the different lawyers looking to take off what they needed for their private use over the years.
    Land registry books were re written and now many things on different pages and the name of Beatrice Henry Missing,
    Print outs in 1980 is a lot different in 2011 and the dead persons did not sell anything when already dead.
    To change His-story from Our-Story to make gains.

    Remember the lawyer for the NHC and now at the land registry is Samantha Cummings of both the NHC and the land registry ,
    NHC was taking Violet Land behind her back just by signing papers.To transfer land to the Crown and then to Iona Marshall et al of New Jersey. USA, then back to the Crown and paying Iona Marshall et al, and not paying Violet Beckles of King Street in the City of Bridgetown Barbados.

    Do try and read what Deeds has said to me .Do you think a person with his mindset is open to receiving legal advice ? You see what i mean by the name calling ? Note his reference to ” Mr Blackman . I am curious to know when he visited him as Chief Archivist . Do you really find it credibel that a Chief Archivist would reply to a person making a search in his department in the manner reported by Deeds ? This deed person is becoming more and more unbelievable .

    Miss Cummings CANNOT be lawyer for NHC and the Land Registry at the same time . the NHC is a statutory institution ; the Land registry is a branch of the regular Civil Service .

    You claim that you have been keeping this deeds person in check . How then can you allow him to make this kind of statement about Miss Cummings without verification . Or is it that you expect the lady to come on to the blog and refute the statement?
