Former Chief Justice, Sir David Simmons

It is no secret BU has developed a good relationship with some members of the legal fraternity. Today’s Sunday Sun reports that former CJ Sir David Simmons plans to reveal ‘shocking’ details about the refusal of the government to extend his tenure has prompted a ‘BU Op-ed’ from one of our legal sources.

Former Chief Justice of Barbados  Sir David Simmons has broken his silence and in an interview reported in today’s Sunday Sun, “is promising to reveal “SHOCKING” details of the Government’s refusal to extend his tenure as the Island’s top judicial officer two years ago “.

In addition, Sir David has promised he would “soon tell all to the nation regarding the decision to turn down his request “. He is further quoted as threatening:  “When I reveal all the facts in due course after the inquiry, I promise that it will be clear that it was a political decision. I have a lot more to say and documents to produce that will shock the people of this country .”

This new stand about to be taken by Simmons is both surprising and shocking for the following reasons:

  1. After a period of relative silence, he has now resurrected the issue of his appointment which was opposed by ALL REASONABLE INDEPENDENT PERSONS as an appointment that should never have taken place given his political involvement.
  2. It is utterly amazing that a former Chief Justice would seek to jettison the HALLOWED LEGAL PRINCIPLE that you do not attack ANYBODY WHEN HE DOES NOT HAVE AN OPPORTUNITY TO DEFEND HIMSELF. It would seem that Sir David has waited until Mr Thompson was a SAFE DISTANCE AWAY AND UNABLE TO SPEAK IN REBUTTAL TO LAUNCH AN ASSAULT.
  3. I clearly remember that in an interview with the same NATION NEWSPAPER, Sir David Simmons towards the end of his tenure, when asked about his judicial future said , among other things , he was tired and needed a rest; he wanted to be in a position to give assistance to his daughter who was in the practice of law; he wanted to do some writing. When asked by the interviewer if he had sought an extension, HE REFUSED TO SAY. I recall too that the said edition of the NATION was held up by Prime Minister Stuart in the Parliament and made a document of the House. Is Sir David now prepared to have the whole of Barbados consider him as being DISINGENUOUS?
  4. Can you imagine that a former Chief Justice would threaten to PRODUCE DOCUMENTS to support a PERSONAL agenda he is pursuing? One wonders if there are OFFICIAL STATE DOCUMENTS AMONG THEM . The mind boggles. One thing has come to light from this threatened expose’; DAVID SIMMONS IS A BITTER MAN. HE HAS SUFFERED A HUGE DENT TO HIS PRIDE. But he has made a FUNDAMENTAL MISTAKE; HE HAS RETURNED TO THE BATTLEFIELD FROM WHENCE HE CAME, THE POLITICAL BATTLEFIELD.

That being the case, he must know that he can expect no mercy from the man at the head of the other army nor his troops. DAVID SIMMONS HAS EXPOSED HIS HAND . HE HAS PROBABLY TAKEN THE MOST INJUDICIOUS STEP HE HAS EVER TAKEN IN HIS PROFESSIONAL LIFE. HISTORY WILL BE LEFT TO JUDGE HIM.

I believe that it is this reptilian fascination and unyielding reliance on Chiefs that has lead to the under development and quick downfall of the many indigenous peoples around the world.

    To show how disorganised the P.M is, why stop the EAGER 30 from goingf to work today to have a meeting with them at 4.00 p.m? My guess is, he don’t know what to tell them, the MOE is not happy with the way the matter is being handled, so the P.M chose a new PSC to help him, but the advice given is that Mr Broomes CANNOT be separated without JUST CAUSE. However, FS, to save face, is behaving like a spoilt child or a ruthless dictator, just to please that RED woMAN.

A Prime Minister will not decide for me what strategy I should adopt in order to make life better for my staff and myself. He is NOT my boss. What goes on in the world of politics boils down to showmanship, being carried out by people who surely take instructions from others.

Another $500,000 like the poverty report? Myrie right in assuming that SHE WILL GET NO JUSTICE in the Barbados courts. I hope the CCJ considers her request favorably. It will embarrass the entire judicial system in Barbados and indeed the Commonwealth …!

    However it is not enough for you and Pacha to spend, buy and sell whatever we do in micro

    There is a wider world we have to operate in where treaties are negotiated, agreements are made so that deficits and surpluses can be managed to the benefit of micro. We label this macro

    In order for macro to facilitate micro and vice versa decisions have to be made. Because we are not clones in how we think how do you propose macro harnesses and maximize resources?

    The scenario is specific to the economy.

    ammm, ac… does it take 3 hours and counting for a man of such wide and vast vocabulary to “explain” stage 2, 3, 4 or more to the “satisfaction” of the “absent from work without explanation” 30?????

    If it does, that alone says alot… current issue notwithstanding.

    Mary is politically naive and clearly untrained in public relations and crisis management. Regardless of outcome for a sitting PM to be willingly, voluntarily and proactively wrapped up in this in the manner that it has been, is almost depressing. I’ll still give him the benefit of the doubt and assume that he get set up.

    Decisions at the Macro level have to be made, hopefully by a collective and with the input of many many other affected parties. Many countries empower a Politburo. These men/women must act on advice and must have the wherewithal (experience) to separate good from shite. I still think the concept of leadership at that level is far far different from what is witnessed in these parts.

    I am very much on Earth. The more we marginalize the perception of a need for a single macro leader, the better off we will be. The simpletons among us associate Politburos with communist and Islamic states. Maybe we should just call it a different name like a “Cabinet” or a “Senate” that is of course differently configured.

    But surely David Thompson left papers, personal papers, party papers, parliamentary papers, cabinet papers. Surely even though David is dead, surely he made a will and his executor can make his papers available to the public. Or can give them to the university, then scholars and others can examine them and then write David Thompson’s legacy. If his widow is his executor we can call upon her to make his papers public. So that he can speak to us from beyond the grave.

However, I think this matter could be even more influential re concretizing the country’s assessment of FS’s leadership ability and style than any of the other situations which are now calling out for action such as CLICO, etc.

    It is very clear that she is missing something important….

    The woman is arguing( with a straight face) that this whole thing is about these teachers right to be ‘happy at work’….

  39. Suppose the resolution of this matter is to force the Union to withdraw its demands of separation of Mr. Broomes.

    This seems very counterintuitive given the previous stances of the PM and Ms. Redman. But can the union now realistically call a strike this term and not expect serious repercussions? Could it be that we will hear that the Broomes separation is being actively worked on and is expected to bear fruit in another five months or so and that the BSTU has graciously considered the PM’s position and recognizing that the students will suffer seriously if they went on strike now, will hold off striking until the beginning of next term (SEptember) if Mr. Broomes is not separated at that time.
    The BSTU looks as if they are really looking after the children’s interests. The PM also as well as he comes off as being very wily and tricky, despite the roundabout way the settlement would have been achieved. Mr. Broomes gets a reprieve temporarily, and the Children win also. Mr. Stuart can also call the election during the vacation period and if he wins, put off the separation a little longer, and if he loses, leave the matter in the hands of the BLP for an ultimate resolution.

    Could this be why this meeting with the PM is taking so long ? Informing the BSTU and the teachers that separation is imminent (as they obviously expected) should not take so long.

    Now on to the clarification of the Lime matter and delaying any further information coming out of CLICO, etc. etc.

    The figure is quite accurate, but if I reveal one of my sources, the others would dry up and I can’t have that.

    Let me tell you a little story. Last year, I got hold of some documents that some people at NUPW wanted to hide. I posted them on BU. The President accused someone of leaking the documents to me in an open forum. He refused to apologies and is now referred to in court as the Respondent. I think that the case started on Tuesday.

    My source even if I could remember who it was has nothing to fear: my evidence is already in by affidavit.

  44. Caswell; To get back on topic and, fwiw, to support your assessment of David Simmons. I remember him as a human being, unlike most of his colleagues. He gave the impression of being a genuinely upright and sharp individual who truly appreciated the immense thankless effort that many public servants put into their work. The David Simmons that most on this blog seem to like to curse and the David Simmons I met occasionally were as chalk is to cheese.

    The issue for many is the distasteful period between Simmons the politician and Simmons the CJ.

    Whether he is a good man or not is not in dispute by many.

    Are you aware that distasteful period, as you called it, was mandated and sanctioned David Thompson. That aside, you have something to judge him by, his record as CJ. Can you or anyone point to any of his judicial decisions or judgments that reflected any partisan political leaning? His tenure as CJ has advance jurisprudence in Barbados to the point where judges from throughout the Caribbean would seek his assistance on a regular basis. Locally, some lawyers, including Observer, would pick his brain rather than research some point of law on their own.
